Family donates Arlen Ness bike to raise funds for kids with special needs– Craig Betz of California was a longtime motorcyclist and a new member of the international motorcycle group Hamsters, USA. Last fall, shortly after being inducted into the group at the 2008 Sturgis Rally, Betz lost his battle with cancer. His most beloved possession was arguably his custom Arlen Ness Speed Liner motorcycle, built by world-famous bike builder Arlen Ness.

As part of Craig?s legacy, his sister Cecily Betz donated his motorcycle as a fundraiser for the non-profit organization Children?s Care Hospital & School, which serves children with special healthcare and educational needs. Rapid City is located in the foothills of the Black Hills, just 30 miles from Sturgis.

Raffle tickets are available now for $25 at www.biketickets.com The drawing will be held at the Hamsters, USA annual banquet during the Sturgis Rally on August 3, 2009. The winner will be notified by phone, and the bike will be signed for the winner by Arlen Ness and his sons, Cory and Zack, also builders.

The 2006 Arlen Ness Speed Liner has a 124? S&S motor and Baker 6- speed transmission. Hamsters, USA spokesman Grady Pfeiffer says the group is known for their big hearts when it comes to children. ?We are really pleased that Craig and Cecily chose to remember special kids through the Hamsters, USA organization and Children?s Care. This is a really nice testament to who Craig was.?

Children?s Care of Rapid City, served over 1200 children last year. It is affiliated with Children?s Care Hospital & School, based in Sioux Falls, SD . Children?s Care is a private, independent, non-profit organization with a mission to help children with special needs reach their best-possible potential. Funds raised through the raffle will provide physical, occupational, and speech therapies, plus special educational and psychological services. The organization as a whole served over 2600 children last year.

The time has come upon us all to unite even tighter than ever and to be as innovative and resourceful as possible. This is a time for us to reach deep into our creative being and experiment, become like children and tap into the wonder of not having all the answers, so that we can be led to discover our inner strength and power in the face of adversity. We all have it in ourselves to rise up, to be true and spirited, to be there for one another, and to make lemon out of lemonade, open a stand and create a profit from our talents.

Wicked Biggest Loser Contest Announced–Motorcycle Industry Personnel Rally Around Healthier Living.

During Daytona Bike Week, Chris Callen of Cycle Source Magazine and Roadside Marty Of Willies Tropical Tattoo Show were on the topic of the need to lose the winter pounds. Well, as normally happens, one thing lead to another and they started a contest to see who could be in better shape by the end of this year’s riding season. Well, as long as these two are going to the mat in the name of good health, they decided to take it into the motorcycle media and see who else they could get involved with this contest. Here’s the outline of what’s going on:

Official starting weight, photo, age and current health conditions will be established in the first issue. From there they will give monthly updates as to their personal health, fitness level and diet as well as updated weight and picture. Through a monthly release in whatever print media and all blogs and motorcycle news Web sites will carry it, the progress of the Wicked Big Losers group will be tracked as they work their way towards better health. There will also be small bits of information from health and nutrition experts, fitness trainers and long time motorcycle personalities who practice good health like a religion.

But we need more big losers!

If you are or know anyone that could stand about six months of getting in shape, please contact us ASAP as we are in the process of launching this campaign.

Since the magazine has gone to the national newsstands I have had very little time to take care of myself, hence the very large spare tire that has amassed around my midsection. (No I am not smuggling free Dunlops across state lines). Anyway, after many lectures from friends and family, and one time when Cyril Huze told me I’m not built for love, I am ready to get back in shape, for my health and appearance. Riding hard and partying like a nut is only okay if you prepare your body for the abuse of life on the road. I have not and it’s staring to take its toll. I look to lose about 80 pounds during this challenge, that was the weight I was at about five years ago when the magazine went to the regional newsstands and I started working 18 hour days. PS- Roadside, it’s on like Donkey Kong…. Beyatch!

Daytona bike week was tease, maybe. Something is in the air. I had a birthday this week, so what did I do to treat myself. I shut off the computer and used the entire day to work in the shop and catch up on the 5-Ball Factory Racer project. I made major progress. Hell, it’s almost t-shirt weather on the coast.

So, you’ll see a 5-Ball Racer report the first of next week, but that’s not all. Ken Conte just sent me his third Sucker Punch Sally rebuild episode. Plus Greg Friend, now the marketing manager of Saddleman sent me his second or third Big Twin Sportster project report. It’s all happening on Bikernet next week, in addition to a Girl of Bikernet brought to you by the folks at Saxon motorcycles. The Arizona babe posed in the desert sand on the latest Saxon inexpensive model.

BIKERNET MEDICAL CENTER FAST FOOD FINDING BY DR. WEIL–4 Fast-Food No-Nos.Last week we discussed the best choices to make if you find that you have no alternative to eating fast food. This week, we cover four nutritional pitfalls to avoid when eating at a fast-food restaurant.

Opt out of cheese and condiments such as mayonnaise and tartar sauce which can add unnecessary (and unhealthy) calories and fat. Use mustard or vinegar to add flavor as desired.

Avoid anything deep-fried. From chicken to potatoes to onions, deep-fried foods contain altered fats that are pro-inflammatory and detrimental to the body.

Skip the soda – it has no nutritional value and adds unnecessary calories to an already nutritionally-challenged meal. Order plain water instead.

We’ve just returned from Daytona Bike Week and are delighted to report that Bikers simply are not paying attention to all the political negativity in the “news”. NEW STURGIS PARKING ORDINANCE–The City of Sturgis/Sturgis City Council has just passed a new parking/storage ordinance that may effect you or someone you know during the Sturgis Rally. Ordinance 16.05.11 “prohibits parking or storage of any trailer, recreational vehicle, implement, vehicle or other personal property on any public right-of-way.” It includes:

A) leaving any car, pick up, motorcycle, camper or RV in any public right of way for more than five (5) consecutive days;
B) Leaving any farm tractor, implement, trailer, truck or truck tractor in any public right of way for more than twenty-four (24) hours; or
C) During the period of July 20-August 15, leaving any RV or camper in any public right of way for more than twenty-four (24) hours.

Florida Seeks To Make Sex With Animals Illegal–A Florida Legislator Senator Nan Rich is putting forward a bill (SB 448) that would make it a third ?degree felony to have sex with an animal.

This has gained attention after a series of Goat Rapes in the Panhandle town of Mossy Head Florida.

Hey if you don?t believe me look it up. I just hope the legislature is careful in the wording and do not include the female human, who sometimes is called an animal when having sex. LOL

Look what happened last year with a bill being passed that has a fine of $1,000.00 for a vertical license plate.

BIKERNET SUMMER RUN RECOMMENDATIONS–Natural Bug Repellent Better Than DEET–A natural, safe compound found in the Tauroniro tree (Humiria balsamifera) of South America has been found to effectively deter mosquitoes and ticks.

The substance, known by the rather daunting name isolongifolenone, has been used in derivative form widely and safely as a component of fragrances in cosmetics, perfumes, deodorants, and paper products. The results of research into the compound are presented in the February, 2009 issue of Journal of Medical Entomology.

The chief author, Aijun Zhang, a chemist for the U.S. Agricultural Service, found that isolongifolenone deters the biting of the mosquitoes Aedes aegypti (L.) and Anopheles stephensi Liston more effectively than the widely used synthetic chemical repellent N,N-diethyl-3-methyl benzamide, usually known as DEET. And it repelled blacklegged ticks and lone star ticks as effectively as DEET.

Since “isolongifolenone is easily synthesized from inexpensive turpentine oil feedstock,” Zhang and his coauthors wrote, “we are therefore confident that the compound has significant potential as an inexpensive and safe repellent for protection of large human populations against blood-feeding arthropods.”

In addition, a new, patented method developed by Zhang and his colleagues to efficiently produce isolongifolenone would make it even more cost effective.

Insect repellents containing DEET are nasty and toxic, but mosquito and tick bites are more than just annoying, in many parts of the world they can lead to serious illnesses including malaria and Lyme disease. A nontoxic, inexpensive repellent that outperforms DEET is certainly good news, and I hope further testing confirms these results. In the meantime, I recommend using repellents that contain geraniol; some research suggests that this natural, plant-derived substance is safe and effective.

CALIFORNIA: Two Anti-Gun Bills Proposed in Sacramento!– As previously reported, two anti-gun bills taking aim at our Second Amendment freedoms are pending in the California Legislature.

Assembly Bill 962, sponsored by Assembly Member Kevin De Leon (D-45), would make it a crime to privately transfer more than 50 rounds of ammunition per month, even between family and friends, unless you are registered as a “handgun ammunition vendor” in the Department of Justice’s database. Ammunition retailers would have to be licensed and store ammunition in such a manner that it would be inaccessible to purchasers.

The bill would also require purchasers submit to fingerprinting, which would be submitted to the Department of Justice. Mail order ammunition sales would also be prohibited. Senate Bill 585, authored by State Senator Mark Leno (D-3), would prohibit the sale of firearms and ammunition at the Cow Palace.

In short, this bill is a stepping-stone to banning all gun shows in the Golden State. These bills have yet to be assigned to committees. Please continue checking your email and www.NRAILA.org for updates.

CONGRESSIONAL COMMITTEE APPROVES BILL TO PROTECT HEALTH INSURANCE FOR RIDERSOn March 4, by voice vote, the House Energy and Commerce Committee passed bipartisan legislation to strengthen health insurance coverage for injuries incurred while participating in legal recreational and transportation activities, such as motorcycling, riding ATVs, snowmobiling and horseback riding.

“This bill requires health insurance companies to be up front and honest with their policy holders when limitations or restrictions are placed on benefits,” said Rep. Bart Stupak (D-MI) who introduced the measure with Rep. Michael Burgess (R-TX).. “Many Americans are unaware that their health insurance may not cover injuries resulting from certain recreational activities because their policy is unclear or overly broad.”

H.R. 1253, the ?Health Insurance Restrictions and Limitations Clarification Act of 2009?, would establish new disclosure rules requiring health insurance plans to provide a description of limitations and exclusions in their policies. Specifically, the bill requires that coverage exclusions must be ?explicit and clear? and that they must be disclosed to plan sponsors in advance of the point of sale. The bill further requires that plan sponsors and insurers must disclose such coverage exclusions to enrollees ?in a form that is easily understandable? both before enrollment and upon their enrollment at the earliest opportunity that other materials are provided.

In January 2001, a rule was issued that created an inadvertent loophole in the Health Insurance Portability and Accountability Act (HIPAA). Because of the way the rule was written, it has allowed insurers to deny health benefits for a covered injury resulting from participation in recreational activities such as skiing, horseback riding, ATV riding, snowmobiling and motorcycling.

In many situations the exclusions are unclear or overly broad, creating confusion for individuals who may ride motorcycles, horses, snowmobiles, ATVs or participate in other legal activities that could result in an injury.

“Passing this straight forward legislation would protect those across the country who ride motorcycles, horses, snowmobiles, ATVs or participate in other recreational activities from being caught by surprise,” Stupak said.

Stupak is a senior member of the House Energy and Commerce Committee, which has jurisdiction over health policy. H.R. 1253 awaits consideration by the full House of Representatives, which previously approved the legislation in September 2008, but the bill was not considered by the Senate in the 110th Congress.

KIDDIE BIKE BAN COULD COST BILLIONSThe new lead-content rules that have banned the sales of many youth motorcycles and all-terrain vehicles could cost the industry over $1 billion in lost economic value this year, predicts the Motorcycle Industry Council. Last year, more than 100,000 of the youth-oriented vehicles were sold. Today, more than 13,000 dealers nationwide are stuck holding onto millions of dollars in inventory as the off-road industry now finds itself crippled and rather confused in the destructive wake of the CPSIA in an already harsh economy.

Motorcycle dealers across the country are fuming, saying the ban couldn?t have come at a worse time, making sluggish sales in a tough economy even tougher. Powersports manufacturers are advising their dealers to pull the banned models off the sales floor or risk heavy fines under the Consumer Product Safety Improvement Act of 2008, which went into force February 10th.

Intentionally or otherwise, the CPSIA has effectively banned the production, importing and sale of kids’ motorcycles and ATVs because certain parts of the vehicles unavoidably contain more lead than is deemed allowable on children’s products – for instance, on the battery terminals, brake components and valve stems – and the CPSC has interpreted this to mean that OHVs (off-highway vehicles) present a lead-poisoning threat to children 12 and under. Not only can they not sell the new vehicles, but they’re not even allowed to sell parts for them!

Dealers from every corner of the country and other concerned individuals have flooded the CPSC and Congress with calls, e-mails and more than 100,000 letters complaining about the new law and urging support for exclusions from the act for powersports vehicles, parts and accessories.

They claim in part that the lead present in their products pose no health risk to children because the only interaction would be by hand, not mouth, and that a toxicologist study reveals that exposure is substantially less than the intake of lead from food and water.

UTAH MAY REWARD HELMET WEARERSIn a unique and interesting twist to mandatory helmet laws, the state of Utah is considering a bill that would reward riders who break the law while wearing a helmet.

The House Transportation Committee unanimously approved a proposal from Rep. Ronda Rudd Menlove (R-Garland) that would knock $10 off of the fine for motorcyclists cited for traffic violations if they are wearing a helmet at the time.

“Instead of just punishment, why not give an incentive for people to use a helmet?,” Menlove told the Standard-Examiner newspaper.

The committee also unanimously tabled a bill that would mandate helmet use for all riders in Utah’s largest cities.&nb sp; Additionally, the measure would have increased the age limit at which motorcycle riders in Utah are required to wear helmets from 18 to 21; require anyone riding with a passenger under 21 to wear a helmet; and require riders of any age operating on a learning permit to wear a helmet.

A contingent of bikers came to the committee meeting to voice their opposition to the bill. Eric Stine, education coordinator for ABATE Utah, said the focus of motorcycle safety should be on educating the public about watching for motorcyclists while driving. “We believe in accident prevention, not safer crashes. Many sports and activities are more dangerous than motorcycle riding. We will never be able to legislate the risk out of living.?

SHOW-ME FREEDOMMissouri is the latest state looking to give adult motorcycle riders the choice of wearing a helmet while riding. The Missouri Senate has endorsed legislation that, if signed into law, would repeal their decades-old helmet law and allow motorcyclists 21 and older the option to ride without a helmet.

Many feel the bill stands a good chance of passing because Senators this year tacked the helmet provisions onto a larger bill regarding motorcycle insurance. The bill, sponsored by State Senator Luann Ridgeway of District 17, was approved with little debate and is expected to pass easily in the House, whic h generally has been more receptive to efforts to repeal helmet requirements for adults. According to Freedom of Road Riders (FORR-MO), a non-profit motorcyclists? advocacy group, the change in legislation would be a welcome one.

In the meantime, several other states are reviewing motorcycle helmet laws, including Arkansas where a proposal to require motorcyclists to wear a helmet or carry thousands of dollars in health insurance failed to make it out of committee.

Senate Bill 29 by Sen. Kim Hendren (R-Gravette) would have compelled motorcyclists to provide proof of at least $10,000 in health insu rance coverage if they opted to not wear a helmet, but the proposal failed to get a motion recommending its passage and died in the Senate Transportation, Technology and Legislative Affairs Committee. Legislators were overwhelmed by calls to committee members from motorcycle enthusiasts, lead by ABATE of Arkansas, who argued that the measure would unfairly target them, negatively impact tourism, and would drive business away from the state?s motorcycle dealers.

In Nevada, Assemblyman Don Gustavson (R-Sparks) has introduced AB300 to repeal state law which has mandated helmet usage since 1971. In seeking to modify current law to allow choice for motorcyclists 21 years or older with at least one year experience, Gustavson is citing studies which prove that mandated helmet laws injure the economy while doing little to increase safety. Using California as an example, Gustavson said the death rate was 2% higher after passage of mandated helmet usage, while revenues continually declined due to loss of registration fees and sales taxes from weakened motorcycle sales. ?Our neighbor suffered a 26% drop in new motorcycle sales in 1992-93 after passage of their mandatory helmet law resulting in job loss and costing the state nearly $17 million in lost tax & fee revenue.?

Gustavson said that tourism will increase in Nevada after the law is modified. Using Pennsylvania as an example, Gustavson pointed out that ?Thunder in the Valley? saw attendance jump from 70,000 to over 100,000 the very first year after their law was modified.

Gustavson also emphasized that repeal of current law will add jobs and multiply revenues to Nevada through additional sales and payroll taxes without increasing any new fees or taxes. After Florida reformed their helmet law, motorcycle sales jumped 143% in Florida in five years generating $166 million in sales tax revenue.

RIDE SMART – MOTORCYCLES IMPROVE BRAIN FUNCTIONRiding motorcycles helps keep drivers young by invigorating their brains, the scientist behind popular “Brain Training” computer software said recently, citing a new scientific study. “The driver’s brain gets activated by riding motorbikes” in part because it requires heightened alertness, Japanese neuroscientist Ryuta Kawashima said after his research team and Yamaha Motor conducted a string of experiments involving middle-aged men.

“In a convenient and easy environment, the human mind and body get used to setting the hurdle low,” he warned. “Our final conclusion is that riding motorcycles can lead to smart ageing.”

Kawashima is the designer of “Brain Training” software, which incorporates quizzes and other games and is available on the Nintendo DS game console under the name “Brain Age”.

A self-professed motorcycle fan, 49-year-old Kawashima cited a new study conducted jointly by Yamaha and Tohoku University, for which he works.

One experiment involved 22 men in their 40s and 50s who held motorcycle licenses but had not operated a cycle for at least a decade. They were randomly split into two groups, with one asked to resume riding motorcycles in everyday life for two months, and another that kept using bicycles or cars. Kawashima says research showed the motorcycle-riding team demonstrated improvements in memory, space recognition and other functions of the prefrontal area. The area covers memory, information processing and concentration functions.

“The group that rode motorbikes posted higher marks in cognitive function tests,” Kawashima said.

In a test requiring the men to remember a set of numbers in reverse order, the riders’ scores jumped by more than 50 percent in two months, while the non-riders’ marks deteriorated slightly, he said.

The riders also said they made fewer mistakes at work and felt happier.

“Mental care is a very big issue in modern society,” said Kawashima. “I think we made an interesting stir here as data showed you can improve your mental condition simply by using motorbikes to commute.”

In 2003, Kawashima authored ?Train Your Brain: 60 Days to a Better Brain?. More recently, he teamed with Toyota to help develop intelligent cars designed to help seniors drive safely.

SMOG CHECKS MAY INCLUDE MOTORCYCLESSB 435, introduced by California State Senator Fran Pavely (D-Beverly Hills), would include motorcycles in the state?s Smog Check Program. In a review of the Smog Check Program, the California Inspection and Maintenance Review Committee?s recommendations included “implement a non-loaded mode biennial Smog Check inspection on motorcycles.”

In a brief explanation of their strategy, the report states:?Inspection of Motorcycles: Include motorcycle inspections as part of Smog Check. Studies indicate that motorcycles are subject to high rates of exhaust system tampering which subsequently increases the vehicle emissions.?

Existing law exempts motorcycles from inspection ?until the department implements test procedures applicable to motorcycles,? which the legislation seeks to accomplish. If passed the new emissions law would require motorcycle owners in California to get Smog checks for their motorcycles once every two years. The law would take effect January 1, 2012 and cover all on-highway motorcycles model year 2000 or newer.

Opponents say the bill is simply a thinly veiled attempt to levy yet another fee to offset the states record budget deficit and point to a recent raid of the OHV trust fund of $90 million dollars for non-OHV related expenditures. The bikes potentially affected are in fact the cleanest in the nation, having already been required to meet the stricter California CARB emissions standards years prior to similar requirements being adopted nationally by the federal EPA.

For a long time the Golden State has been granted special waivers from the Environmental Protection Agency to enact stiffer emissions regulations for autos and motorcycles. During the Bush administration, a dozen other states requested EPA waivers to increase their own regulations to match California?s, but were denied. It is expected that the new Obama administration will reverse this decision, which may lead to variable emissions rules from state to state for automobiles, and potentially for motorcycles.

Jail Time For Injuring Motorcyclists?–A person who causes an accident that results in the injury or death of amotorcyclist would face tougher penalties under a proposal in the stateLegislature.

The proposal is one of a series of measures that would increase finesand penalties for certain traffic offenses.

The bill would make it a second-degree misdemeanor for a movingviolation that results in the injury of a person on a motorcycle. Itwould be punishable by a fine of at least $500, incarceration for 30days, attendance at a driver improvement course, and license suspensionfor 30 days.

A driver who causes an accident that results in the death of amotorcyclist would face a first-degree misdemeanor. That punishmentwould include a fine of at least $1,000, incarceration for at least 90days, attendance at a driver improvement course, and a licensesuspension for at least one year.

Some lawmakers disagree with the stiffer penalties saying they are tooharsh.

But the sponsor of the bill says the current fines aren’t harsh enough.Rep. Greg Evers says a stronger message needs to be sent to makemotorists more cautious when it comes to motorcycles on the state’shighways.

The bill was approved today (Wednesday) by the House Roads, Bridges &Ports Policy Committee. It passed on a vote of 17-2.

BIKERNET WROTE THE ASSEMBLYMAN IN SUPPORT– I’m very impressed with your effort to repeal the helmet laws. We’ve become a society that ignores freedom for anything that will supposedly save money or the environment.

Here’s a couple of statistics supporting freedom to choose:

Helmets in some cases cause a false sense of security and safety, and can cause accidents. I’ve experienced near collisions due to a restricted peripheral vision. Some riders aren’t so lucky.

Riding without a helmet affords riders the pure ability to see, hear and adjust to traffic demands.

About 5,000 riders die a year on motorcycles, about 20 percent due to head injuries. Some 44,000 die in car accidents each year, about 90 percent due to head injuries.

I have often thought that if we set up a road block and forced car drivers to wear helmets while driving through town, that we would never hear of helmet laws again.

May freedom shine in this effort. We need to remember this country was based on freedom, not safety and security. There’s no safety clause in the Constitution.

They would have the right to come and inspect that you are storing your gun safely away from accessibility to children and fine is punishable for up to 5 yrs. in prison.

Joe’s Vault: The Cyclist–Today’s Vault offering is for you motorcycle enthusiasts. In June of 1971, KOMO Special Projects presented a film by photographer Bill Jensen called “The Cyclist.” He covered the spectrum of the motorcycle – dirt bikes, racing, stunts, fund-raising, even Evel Knievel.

It’s very well done, especially when one knows how a show was put together back then compared to now. It was quite labor-intensive to edit. None of the computer drag-and-drop moves as we have now. Film was cut, workprints were made, final prints made for air. Mr. Jensen did a great job.

Time doesn’t permit me to present the whole show, so I’ve showed highlights that touch on just about all of the program. Wonderful stuff. Enjoy The Cyclist!

BIKER CLASSICS COME TO TCM, ON APRIL 6–You should know about TCM or Turner Classic Movies on cable. It’s a station devoted to old classic films, and it’s all commercial free. Here’s a news bit:

Leather, denim and the rumble of V-twin motor–the image of the biker is one indebted to Hollywood portrayals. From Marlon Brando challenging authority in “The Wild One (1953) to Dennis Hopper and Peter Fonda confronting prejudice in Easy Rider (1969), the biker’s journey though cinema is the theme of our programming for April 6th. Included is the TCM premier of Roger Corman’s tour de force, “The Wild Angels” (1966). Following a successful run at the box office, Corman’s movie paved the way for a biker film renaissance in the late ’60s, including notable projects like Tom Laughlin’s “The Born Losers” (1967). Our exhaust-filled night concludes with George Miller’s desolate look into the future as Mel Gibson battles an outlaw band of bikers in “Mad Max” (1979). Hold tight, it’s going to be a wild ride on TCM.

An enormous thanks goes to both of these organizations for their generous support of our efforts. This funding will be well used this spring to fund a motorcycle awareness campaign throughout BC. California Reintroduces Bill to Require ANNUAL Emissions Tests for Vehicles 15-Years Old and Older Here we go again! Legislation (A.B. 859) has been reintroduced in the California Assembly by Assemblyman Dave Jones (Assemblymember.jones@assembly.ca.gov) to require annual Smog check inspections for vehicles 15-years old and older. The bill would also require that funds generated through the additional inspection fees be deposited into an account which can be used to scrap older cars.

You may recall that in 2004 a new law was enacted in California to require the lifetime testing of all 1976 and newer model-year vehicles. Pre-1976 motor vehicles would remain exempt under A.B. 859. The bill has been referred to the Assembly Transportation Committee. We Urge You to Contact Assemblyman Jones and Members of the Assembly Transportation Committee (List Below) Immediately to Oppose A.B. 859

?A.B. 859 ignores the minimal impact vintage cars have on air quality.
???A.B. 859 could entice vintage car owners into allowing these vehicles to be scrapped.
???A.B. 859 ignores the fact that vehicles 15-years old and older still constitute a small portion of the overall vehicle population and are a poor source from which to look for emissions reduction.
???A.B. 859 ignores the fact that classic vehicles are overwhelmingly well-maintained and infrequently driven.

(Iraq: What would happen if the U..S. won a war but the media didn’t tell the American public? Apparently, we have to rely on a British newspaper for the news that we’ve defeated the last remnants of al-Qaida in Iraq.

London’s Sunday Times called it ‘the culmination of one of the most spectacular victories of the war on terror.’ A terrorist force that once numbered more than 12,000, with strongholds in the west and central regions of Iraq, has in over two years been reduced to a mere 1,200 fighters, backed against the wall in the northern city of Mosul. The destruction of al-Qaida in Iraq (AQI) is one of the most unlikely and unforeseen events in the long history of American warfare.

We can thank President Bush’s surge Strategy, in which he bucked both Republican and Democratic leaders in Washington by increasing our forces there instead of surrendering. We can also thank the leadership of the new general he placed in charge there, David Petraeus, who may be the foremost expert in the world on counter-insurgency warfare. And we can thank those serving in our military in Iraq who engaged local Iraqi tribal leaders and convinced them America was their friend and AQI their enemy.

Al-Qaida’s loss of the hearts and minds of ordinary Iraqis began in Anbar Province, which had been written off as a basket case, and spread out from there. Now, in Operation Lion’s Roar the Iraqi army and the U.S. .. 3rd Armored Cavalry Regiment is destroying the fraction of terrorists who are left. More than 1,000 AQI operatives have already been apprehended.. Sunday Times (London) reporter Marie Colvin, traveling with Iraqi forces in Mosul, found little AQI presence even in bullet-ridden residential areas that were once insurgency strongholds, and reported that the terrorists have lost control of its Mosul urban base, with what is left of the organization having fled south into the countryside.

Meanwhile, the State Department reports that Iraqi Prime Minister Nouri al-Maliki’s government has achieved ‘satisfactory’ progress on 15 of the 18 political benchmarks ‘a big change for the better from a year ago.’ Things are going so well that Maliki has even for the first time floated the idea of a timetable for withdrawal of American forces. He did so while visiting the United Arab Emirates , which over the weekend announced that it was forgiving almost $7 billion of debt owed byBaghdad, an impressive vote of confidence from a fellow Arab st ate in thefuture of a free Iraq .

But where are the headlines and the front-page stories about all this good news? As the MediaResearch Center pointed out last week, ‘the CBS Evening News, NBC Nightly News and CNN’sAnderson Cooper 360 were silent Tuesday night about the benchmarks ‘that signaled political progress.’ The war in Iraq has been turned around 180 degrees both militarily and politically because President Bush stuck to his guns. Yet apart from IBD, Fox News Channel and parts of the foreign press, the media don’t seem to consider this historic event a big story.

This girl is one of them.

Trayci is a local rider who went down a couple yrs ago during a local charity ride. She wasn?t spooked and got right back in the saddle. Nothing seems to knock her down in her journey,one very strong girl. She also has an incredible talent of photography. Since I?m a regular to Bikernet and the Cantina, I thought I?d send her link to you. Maybe some readers would like see some of her work.

Young motorcyclists and ATV riders join state lawmakers to seek lead-law exemption–Young riders, parents, state lawmakers and others concerned about the current federal ban on selling youth dirtbikes and all-terrain vehicles (ATVs) rallied on the steps of the Missouri State Capitol in Jefferson City, Wednesday, March 4, to support an exemption to the Consumer Product Safety Improvement Act (CPSIA) of 2008, the American Motorcyclist Association (AMA) reports.

The press conference that followed was organized by State Rep. Tom Self (R-Cole Camp), who also sponsored a successful Missouri House resolution urging the Consumer Product Safety Commission (CPSC) to “provide a waiver or exclusion for youth ATVs and motorcycles from the lead limit requirements of the Consumer Product Safety Improvement Act.”

Under the CPSIA, which took effect Feb. 10, manufacturers, importers, distributors and retailers are barred from making, importing, distributing or selling any product intended for children 12 and under that contains more than 600 parts per million of lead in any accessible part. According to the CPSC, that includes youth-sized motorcycles and ATVs, which include lead in such things as batteries, brakes and engines. The ban also shelves many parts needed for repair.

The CPSIA greatly concerns the AMA, the industry and the off-highway vehicle (OHV) community because it encourages parents to put their youngsters on adult-sized OHVs. There is also great concern for the survival of powersports dealers and their employees, which are already struggling given the current recession. According to the Motorcycle Industry Council, the CPSIA could lead to $1 billion in lost economic value annually for the industry.”Washington, D.C. tells us that this ban is a result of unintended consequences, effectively passing the buck,” said Ed Moreland, AMA vice president for government relations, who spoke at the rally. “That’s not good enough. These changes need to be made now before kids are injured, and thousands of small family-owned businesses are needlessly put out of business.”

Moreland added that it is ironic that the agency with which the AMA and the industry have spent years developing youth-sized OHV standards is now charged with enforcing the CPSIA, effectively rendering the standards useless.

Moreland asked all concerned parents and riders nationwide to contact their own state lawmakers to urge them to pass resolutions like Missouri’s, supporting an exemption to the law banning youth-sized motorcycles and ATVs. They also need to contact the members of their federal congressional delegations and the CPSC to demand that the law be changed to include an exemption, he said.

The easiest way to do this is to go to the Rights section of the AMA website at www.AmericanMotorcyclist.com, and then click Issues and Legislation. There, riders and their parents can contact lawmakers and the CPSC to voice their concerns.

This bill eliminates the requirement of wearing headgear for a passenger of a motorcycle who is 21 of age or older.

STURGIS GLENCOE CAMPGROUND AND ROLLING THUNDER VENUE SOLD–Gary Lippold, who owned and managed the Glencoe Camp Resort and the Rock?n The Rally concert venue in Sturgis, S.D., has sold the property. The property, which sees most of its visitors during the massive Sturgis Motorcycle Rally each year, was sold for $8,595,000 to Devorah Lopez of Hacienda Heights, Calif., according to the Black Hills Pioneer. 



The paper cited a three-page document filed at the Meade County Courthouse. Sean Clark is expected to continue running the campground and outdoor stage. The Web site for the campground promises a full bar, two stages and all kinds of biker amenities like pool tables and barmaids.

The Rock?n The Rally stage was the site of some controversy at last year?s event. Larry the Cable Guy pulled out of his Aug. 5 support slot because the promoter did not have the funds to cover the performance, manager J.P. Williams told sources.

JUDGE DENIES REQUEST TO STOP MYRTLE BEACH MOTORCYCLE RALLY–A federal judge has declined another request to stop Myrtle Beach from enforcing some of its ordinances to curb the spring biker rallies.

U.S. District Court Judge Terry Wooten has denied a request for an injunction filed last week by Greenville attorney Suzanne Coe on behalf of Doghouse and Steel Horse Saloon owner Don Emery, The Master’s Club, www.myrtle beachbikeweek.com and other business owners.

That injunction request, filed on Wednesday, sought to prevent Myrtle Beach from enforcing amendments and ordinances dealing with special events, noise and motorcycle helmets.

Wooten stated in his decision Wednesday that the “balance of hardships” weighs against the plaintiffs and tips in favor of the city, which asserted that the injunction would restrict the city “in its obligation and attempts to protect its residents,” motorists, pedestrians and tourists.

Wooten stated that additional work is necessary before any more decisions can be made. In December, Wooten also denied a request for an injunction filed by event promoter Mike Shank and Harley-Davidson of Myrtle Beach.

That group; two Myrtle Beach residents and motorcycle enthusiasts, Carol and William O’Day; and the group including Doghouse and Steel Horse Saloon owner Don Emery still have pending lawsuits against the city.

Lawsuits by Shank and the Doghouse group allege that the city’s new ordinances are overbroad and unconstitutional.

The Doghouse’s lawsuit also alleges the new rules restrict interstate commerce, because many of the businesses that set up shop during the rallies are from out of state.

Both lawsuits were filed in federal court in Florence.

Bell Announces Compliance With Lead Law–Bell Powersports has announced that its SC-X Jr. youth motocross helmet is compliant with the new lead law. The company said it?s sending dealers a letter of assurance along with a copy of the certificate of conformity proving the helmet meets new Consumer Product Safety Improvement Act (CPSIA) guidelines.

Bell national sales manager Randy George said he?s fielded a handful of calls from dealers asking about the helmet. ?I hear some of the stories, and it?s evident that there?s a lot of confusion out there,? he said. ?The one thing I can say with certainty, however, is that dealers can continue to sell ? and consumers can continue to use ? the Bell SC-X Jr. with full confidence. All Bell powersport helmets are in compliance with the CPSIA.?

Several dealers have told Dealernews that they wish the aftermarket would send them a list of compliant youth products. To that end, we welcome any such lists and will post them here on our Web site.

The CPSIA contains sweeping guidelines made in response to high lead levels found in children?s toys. The law requires surface coatings and substrates to have lead content of less than 600 parts per million on any product intended for children age 12 and under.

HARLEY U.S. RETAIL SALES DOWN 9.4% THROUGH FEBRUARY–In an unusual interim sales report, Harley-Davidson announced that during January and February, its U.S. dealers sold 9.4 percent fewer motorcycles than they did during the same period last year. Not the end of the world, by a long shot.

Taking the entire world into account, retail sales during the two-month period were down 13 percent, pulled down by a 21.5 percent decline in international sales. U.S. retail sales represented nearly 73 percent of total worldwide sales.

Harley continues to expect to ship between 264,000 and 273,000 new motorcycles in 2009.

HARLEY-DAVIDSON ROCKER TESTING LAB REVEALED– Incidentally, as you probably know, Harley-Davidson had a helluva time with breaking fenders on the Rocker early on.Attached is a pic I took at the H-D museum of the machine that the factory engineers built to cycle the Rocker rear fender through tens of thousands of virtual road miles.

They still had problems early on, though admittedly they?re using a double-skinned alloy piece.Still, it makes you wonder about Kevin?s heavy steel units ? many more G-forces there I?d guess.

HOW CAN I START A MOTORCYCLE CLUB?– It seems to be a question I?m asked more and more now a days. The biggest problem is that most callers are a lot like me. Work, family and everything else seem to come before riding. For them their bike is the last to emerge in spring, the first to disappear in fall.

When times get tough their motorbike is the first to be sold. But they have seen the romantic version of Motorcycle Clubs offered by Hollywood in shows like Hell Ride or the Sons of Anarchy and think that could be them. They assume that all is required is a cool name and an attitude.

They want the instant recognition and respect the patch garnishes but don?t want to do the work. The truth is Motorcycle Clubs have fought and clawed their way to earn the respect of their three-piece patches. Members of Motorcycle Clubs are true outlaw bikers, 1% bikers. The club comes first, before family, before friends, before themselves.

For many the criminal exploits of their members far out weigh a speeding ticket and inhaling the occasional joint on the weekend. Most people calling me wanting to start a Motorcycle Club are far removed from that lifestyle, that way of life. They don?t realize that there is a huge difference between riding groups and Motorcycle Clubs.

Only 1% of riders are tough enough, strong enough, mean enough to be a member of a Motorcycle Club. Most riders are much better suited to being a member of a riding group. A group of friends coming together to support a charity or cause. No more harmful then your local chapter of the HOG or service clubs like the Lions or the Royal Order of Water Buffalo. So next time you get the urge to start a Motorcycle Club ask yourself if you are that true 1%er or are you like the other 99% of us.

The invitation was to meet up outside of Lexington at the Barnyard Flea Market and ride together to Murrell?s Inlet. The weather forecast the day before was rather bleak, prompting a few phone calls to verify what was billed as the ?Myrtle Beach Helmet Freedom Ride? was taking place (despite having a published rain date). It was ON!

Getting up so very early in the a.m. was difficult enough, actually getting to Sam?s seemed like a daunting task in the gray sludgy morning. Arriving at the Barnyard I spotted the riders under the shelter, and realized I knew all of them. We exchanged our hellos and did a quick review of the plan?on to Jimmy?s in Sumter and later to the Bo Jangles in Manning, both stops to join with any waiting fellow adventurers.

On to Jimmy?s it was. Their was hot coffee and cheerful encouragement here. We exchanged pleasantries and anticipated the actual ride. After waiting about 20 minutes past the appointed time, we departed for Manning…

As I followed these motorcyclists I wondered at the effort and energy they put forth on a weekend?a day off?Saturday?Cold, nasty weather?Wouldn?t they rather be inside warm and snug? (probably?.)

They rode on in the wet and the cold. Along the way they came to a railroad track and as they crossed, the water shot into the air looking like a gray clammy sheet springing up out of the road and wrapping around each of them in turn. They were road warriors coping with nature?s elements on the way to do battle with ?elements? of man. Whether you agree with them or not, one must admire folks with convictions of principle this strong.

At times these skilled riders disappeared into the fog, only one visible as the silvery fabric across the shoulders of his jacket shimmered faintly, and then they would all mysteriously return back into sight. Around a curve in perfect formation, they seemed to blend into one lone tall shadowy motorcycle. On the long straight stretches they blended into only two vehicles. In and out they appeared to weave in the mist.

Arriving in Manning, a fuel stop and joining of another adventurer. The band of ?like minded?s? continued on to the Beaver Bar to join in raising a voice of protest. The group grew in small numbers as a rider or a pair would come in. All got a chuckle when an adventurer came in pulling a helmet behind him on a rope.

Round about discussions hit upon many topics: Where was the multitude? Did you bring a helmet? Are you riding with or without your lid? Are our citizens going to endorse the discriminatory targeting of motorcyclist by the city of Myrtle Beach? Why haven?t more people realized that a municipality has enacted ordinances that seem to be in direct conflict with existing State laws? How can this be? Where are the vast numbers that should be here to help raise the alarm?

The parking lot was comfortably full (not overflowing) and noon had arrived. Adventurers from all over SC had arrived as well as from NC, FL, VA and MI to name only a few other states. A call to attention went out along with an invitation to any one wishing to depart shortly might want to be aware of some things. The advisors re-iterated the ordinances and the penalties as they currently stand. Riders were encouraged to show their protest as they were comfortable ? with our without a lid. This ride was about a show of support against the discriminatory practices of one city! Participants were advised to make sure to follow instructions from any police officer and to not interfere with the officers performing their jobs. A brief thank you to those present and it was time to mount up and ride.

It has been reported that 100 rode into the city down Ocean Blvd., where they were met with a barrage of blue lights. In a peaceful act of civil disobedience, those targeted pulled over and accepted their citations. Riders continued down Ocean Blvd. turned onto 29th and then down Kings Hwy.

Four dozen tickets had been claimed as prizes by these seekers of Liberty.

Such was the day?s adventure done. Everyone re-convened at the Beaver Bar where hotdogs & hamburgers were served up. Riders warmed themselves by the fire and in the glow of the shared adventure of defending the rights of the citizens of SC.

If you have still not realized?the Myrtle Beach Helmet Freedom Ride (also known as the ?Not a Dime in 2009 Ride?) wasn?t at all about helmets or even actually about the MB Rally. It was and continues to be about protecting the citizens of SC from municipalities enacting ordinances, rules or regulations that supersede state laws for whatever reason. The SC State Law requires those under 21 to wear a helmet, thus allowing ?those who ride, to decide?. So what will be next? Will you stand idly by while one city in SC discriminates and targets one group? If so, will you be in the next group that is targeted? DECIDE and take a stand! Isn?t that what ABATE (A Brotherhood Against Totalitarian Enactments) is all about?

We recently discovered an old magazine editor in the corner of the Kendon Trailer and Lift manufacturing shop. He was sweeping up lathe shavings and filtering old cutting oil to be reused. Buck’s been around the business since Ed Roth published his miniature chopper book in the ‘60s.

” I’ve been riding American motorcycles since 1968 when I purchased a 1947 Indian Chief with sidecar from a CMC prison guard who lived in Shell Beach, California.”

He started rambling on about his old motorcycles before I could explain why I was sneaking through the Kendon Manufacturing facility. Actually I was there to see about some side panels for my light portable Kendon tubular lift I purchased recently. One of the employees told me I might know the old fart in the back sweeping up.

”The Chief had a Harley-Davidson style mousetrap and hand clutch assembly installed with the Indian rocker foot-clutch pedal attached to the shift tower. This was supposed to give me a foot shift mechanism on a motorcycle that was originally sold with foot clutch hand shift.”

I recognized the long frizzy hair and massive beard immediately, but I couldn’t tell if he recognized me. He seemed to glance up, but then stared back at the metal-shaving laden concrete deck and continued to sweep, carefully. I remembered his photography from his years at HOT BIKE. He was good and knew a classic scooter when he spotted one. He went on about his first motorcycle as if I was interviewing him for a Bikernet profile article. I wanted parts for my Kendon lift.

“I rode the motorcycle home to Santa Maria, California running on one cylinder and in second gear. It was 19 slow miles of spitting and popping. When I arrived in Santa Maria, I took the bike to a gas station where a friend of mine was working as a mechanic, he cleaned the points and spark plugs and the motor started running on both cylinders.

” Some Indian riders from Ventura hunted me down, three weeks later, having heard about my Indian purchase. They took the mousetrap off the bike and scolded me, ‘Don’t ever put Harley-Davidson parts on an Indian.’ They attached the rocker clutch pedal correctly and reattached the hand shift lever to the shift tower, and I was in business. I was now a biker. I extended the front fork 14 inches. The front end was so long the kickstand wouldn’t hold the bike up. I had to lengthen the kickstand.”

“Here me out Bandit,” Buck said and his eyes slammed into mine. “I got invited to a biker wedding in Lompoc, California sometime in 1974. There was a big biker party in the local riverbed after the wedding.

And after all was said and done I was charged with 15 counts of assault with a deadly weapon and one of attempted murder. What a fucking party huh?

”What’s the fuckin’ point, Buck,” I said beginning to pace the well-swept deck?

“I need a favor,” Buck said, “so listen up. I rode Indian motorcycles for many years before switching totally to Harley-Davidson. My first H-D was a 1949 EL with 74 inch flywheels, and an M-74 Linkert carburetor. I bought it from a biker type dude in 1976 in Petaluma, California after seeing an ad in the local paper. When I went to see the bike the transmission was gone. The owner had taken the trans to the local Harley-Davidson shop for repairs and didn’t have the money to retrieve it. I went the Harley shop and paid the bill, got the transmission and took it back to the owner. He installed it, the inner primary cover, primary chain, and outer primary cover. I paid $1500 for a rigid frame, 1949 EL (stroked to 74), with jockey shift (jockey top on the trans, no ratchet top) no front brake (21-inch wheel out front), 15-over wide glide with about a half-inch rake. The foot clutch pedal was in reality a foot shift lever. Even though I had lots of experience riding foot clutch, I damn near hit both sides of the owner’s gate when leaving his yard.”

“I rode this machine from Petaluma to San Jose, and ran out of gas only once. The Linkert had no air cleaner, and it kept sucking my bell bottom pant leg into the venturi causing the motor to quit. After three or four stops and kick starts, I caught on. It had a 2.5 gallon Sportster tank mounted on the top rail, Frisco style. The reserve was broken on the petcock. The Linkert carb provided about 45-50 miles to the gallon, but riding was such a blast that occasionally I forgot to get gas.”

”That’s cool, Buck, but what’s the deal,” I stammered trying to get to the point? “We’re burnin’ daylight.”

Tough looking Shovelhead, “The Real Deal” according to Buck. Shovels represent tough times for me. I grew up with the bastards. They were tough on the factory.

“I started taking pictures of motorcycles and motorcycle events long before motorcycling was considered acceptable by most citizens of this fine country. I became a freelance photojournalist and made prints of parties I attended and other events. Iron Horse Magazine published my first motorcycle magazine article in 1979. It was a multi-photo feature-bike layout of Stan Dishong’s 1941 Crocker motorcycle.”

I recently published a police motorcycle photographic history book titled American Police Motorcycles. I have always been an Antique and Classic motorcycle fan, and police motorcycles have traditionally been the least preserved of all American motorcycle categories. I decided about 25 years ago to start collecting photos to be used as a historical perspective of the way the motorcycle was used in traffic law enforcement and as an emergency response tool. The book displays the bulk of those collected photos.”

”What’s that got to do with me,” I said? I respect cops, but I’m not a fan. You want to sell me a book? I came here for lift parts.”

”Hold on goddamnit,” Buck snapped. “I’m getting close. I only recently started selecting images to display and sell. I haven’t yet dug into my black & white photo archives. Motorcycles have always been works of art to me, art that is both functional, as well as something to enjoy looking at, either in motion or on display. While building custom motorcycle with originality is becoming increasingly difficult these days, I’m never tired of looking at all the different machines produced by today’s creative builders.”

“My only caveat, when photographing a motorcycle, is that the machine must be a rider, or was a rider in the past. If it can’t be ridden, it ain’t a motorcycle. I’ve always said, If it has a radio, a radiator, a windshield, and cruise control, it ain’t a motorcycle–it’s a car. “

I started scratching my head in wonderment. He had some goddamn angle up his sleave.

”Come on,” Buck said. “Take a look at my motorcycle photos; I had a lot of fun taking the photos during the last 30 years. Maybe sell some of my prints on Bikernet. I still commute 80-90 miles round trip to work and back on a motorcycle, and will continue to do so as long as I can.

Riding a motorcycle is the last American freedom.

Riding a Harley-Davidson motorcycle is still the most fun one can have with our clothes on!

BIKERNET 5-BALL RACING TEAM OFFICIAL ART REWORKED BY THE MASTER– Like planned, I finished reworking the Racing Team art last week.Now it’s closer to my original vision and the digital color study.It looks even better than the photo. Hope to get a better image with a scan.

Here’s what I did.1. 5 Ball: Reworked the highlight, added secondary reflections and shading

2. Helmet: Shaded near edge and under women, Blue pinstriped the scallops, and highlighted.

3. Background: Reworked the blue outlines (they faded), and darkened outer edges with airbrush.

4. Sprayed entire art with satin clear coat to protect.

All that’s left is to scan it for a better image for my files, put it back in frame,and write the Step-by-Step process from start to finish.

I’ll likely also post the step by step on my blog, and hopefully you will post the process on Bikernet.

AUSTRALIAN SHOW WINNER CHECKS IN– Thanks for the interest in my latest bike, here’s a bit of info about it.I just picked up the title of National Australian Custom Bike Championand picked up a beauty of a prize and a S&S 93cu knucklehead engine supplied by Australia’s East coast custom, which I am sure will come in handy for my next project.

I go by the name RHC “Robb Handcrafted Cycles.” The current bike is a ’69 XLCH Sportster fitted with big valves, heavy porting, P cams, an S&S super E, and a Joe Hunt magneto. I radically modified the cam cover, rocker boxes and kick shaft support, and fitted an alternator conversion. This is all sitting in a 1-inch off a 4130 chromemoly custom chassis built by a great mate, Luke from Gworks Custom Cycles.

Front end comes via a Ducati 916, a set of blackstone tech carbon fiber wheels keep it off the ground, and everything was handmade, including all the carbon fiber work which consist of tanks, seat, primary cover, rear guard, chain guard, exhaust shield, which reminds me a lot of work went into the exhaust which exits under the bike through an aluminum muffler. The heat shields keep the heat away from the rear set controls, which I fabed up too. All the brake rotors are one-off, which make this puppy stop on a dime. I am extremely happy with the bike’s handling in the go, turn, stop department. The bike only weighs 357pounds.

I think there were not too many parts on the bike that didn’t escaped heavy modification in one way or another. The bike has been so well accepted down here since it’s very rideable, practical bike. Also it wasn’t a big dollar bike built in a fully equipped workshop, just one guy, in his shed out in the backyard! Now my plans are set on the AMD 2010 with the knucklehead!!

JUDGE LETS MYRTLE BEACH BIKER LAWS RIDE– Disappointed with a judge’s ruling Tuesday to allow Myrtle Beach’s new bike rules to take effect as planned, two city residents suing the city because of its efforts to curb the May bike rallies have vowed to fight on.

“This isn’t about the rallies. This is about the freedoms we have,” said resident, motorcyclist and motel owner William O’Day. “As soon as you stop fighting for your freedoms, you lose them.”

Horry County Circuit Court Judge Michael Baxley declined to side with O’Day and his wife, Carol O’Day, on Tuesday and stop the city from enforcing its new helmet law and an amendment to its noise ordinance specifying required labeling on mufflers.

?Meanwhile, the Myrtle Beach City Council on Tuesday afternoon passed the first draft of an ordinance repealing the amendment to the noise law that requires Environmental Protection Agency labels on mufflers, saying it was redundant now that it has set a decibel limit for nonemergency motor vehicles. The ordinance requires a second approval, but if it passes, it could negate the second count of the O’Days’ lawsuit. The revision also included repealing the portion of the law that said all vehicles must have continuously functioning mufflers, because the state already has such a law.

The O’Days’ attorney, Virginia-based Tom McGrath, asked Baxley to rule immediately because some of the new laws, including the helmet law, go into effect Saturday.

Baxley declined to prohibit the city from holding administrative hearings to deal with the civil infractions that will result from some of the 15 laws and amendments it passed last fall.

McGrath called the system a “motorcycle court” that has not been overseen by the state, and said the S.C. law has no provision allowing the city to create an administrative court process for civil infractions.

After listening to both sides and asking several questions of each, Baxley took about 15 minutes to make his decision, saying the lawsuit will still go forward, but that because the helmet law is not in effect yet and no hearings have been held in the administrative court, it’s too soon to say they should be stopped.

Cindy Graham Howe, representing the city, contended the civil infraction tickets that will be handed out for motorcyclists and scooter riders not wearing helmets will not be any different than parking tickets.

Co-attorney Michael Battle addressed McGrath’s argument by saying that impounding motorcycles for muffler violations is no different than what is done for other vehicle defects such as a broken tail light or headlamp.

The city said it passed the helmet law to help prevent serious head injuries and deaths.

“The state law says helmets are required for people under 21, period. We would like the state to pass a helmet law for everyone, but it hasn’t, so we did,” city spokesman Mark Kruea said.

But the O’Days’ supporters are skeptical.

“If the city is so concerned about our safety, why did they wait until now to make a helmet law?” Michele Taylor asked. “Where were they 25 years ago?”

She said she went to Tuesday’s hearing to support her friends, and even though the O’Days are the only plaintiffs in the lawsuit, “they speak for all of us.”

ROW (RIGHT-OF-WAY) BILL FILED IN NEW MEXICO–A Failure to Yield the Right of Way bill has been introduced in New Mexico by State Representative Rick Miera, a longtime motorcyclists? rights advocate and member of the National Coalition of Motorcyclists Legislative Task Force (NCOM-LTF).

The bill will increase the penalties imposed for Failing to Yield the Right of Way. The current penalties for Failure to Yield is a fine of $25.00 to $50.00 no matter the severity of the accident. Careless driving which also falls under the Failure to Yield Statutes is only a $125.00 fine! HB 290 would increase the penalties to $200.00 or 30 day suspension of driver?s license causing NO great bodily harm or death. Great Bodily harm would hold a penalty of $500.00 or 30 day suspension of driver?s license. Failing to Yield causing Death would hold a penalty of $1000.00 or 6 months suspension of driver?s license.

HB 290 is now headed to the Transportation and Public Works Committee, and concerned riders are being asked by the New Mexico Motorcyclists Rights Organization, ABATE and the Confederation of Clubs to contact their legislators seeking support for the proposed ROW legislation. MILWAUKEE (February 26, 2009) ? For thousands of female motorcyclists, hope springs eternal at Daytona Beach Bike Week this year. As a new day dawns on the motorcycle riding season, female riders hope for two wheels and hundreds of miles of open blacktop, clear skies, wind in their face, breathtaking sunsets and unique experiences with their fellow riders. They also share hope to find a cure for neuromuscular disease.

During this year?s 68th Annual Daytona Beach Bike Week, thousands of female riders and Harley-Davidson Motor Company are banding together to help the Muscular Dystrophy Association (MDA) make their hope of finding a cure for neuromuscular disease a reality. The Motor Company has planned two special initiatives for female riders to help raise funds for the MDA:

?Wall For Hope: Harley-Davidson will feature a ?signature wall? in the Women?s Interactive Experience area at the Daytona Beach Ocean Center from Saturday, February 28 through Saturday, March 7, 2009. Riders and non-riders alike can showcase their support for the MDA and their efforts to find a cure for neuromuscular disease by signing the special Wall For Hope. The Motor Company will make a $1.00 donation for every signature on the wall to the MDA.
?2nd Annual Harley-Davidson Women?s Day Ride: The ride will take place on Tuesday, March 3, 2009, and feature hundreds of women riders who will ride triumphantly through the streets of Daytona celebrating their freedom and passion for riding and the MDA. All of the riders participating in the ride were encouraged to secure pledges and donations from their friends and families to support MDA Summer Camp programs across the country. The top three fundraisers will receive a Harley-Davidson jacket and anyone who raises more than $600 will receive an exclusive MDA charm. Last year?s ride raised almost $67,000 for MDA Summer Camps.

IT’S A WILD WRAP–I’m trying to pull myself back on track and it’s working, sorta. Cash, one of our black labs looks up at me with a hollow stare, like, “What the fuck is he saying now?” We’re working with Andy at Big Bear Choppers on their 2009 ride to the mountain. We?re scrambling on our 10th anniversary Smoke Out run and maybe a ride to Burt Munroe’s race in New Zealand, but I’m getting way ahead of myself.

I need to bring you another report on the 5-Ball Factory Racer and the Mudflab girl bike. We need an update on Greg Friend’s big twin Sportster, and the Bonne Belle is still alive at Paughco and Departure Bike Works. We will bring you a new 45 Flathead with a 4-speed transmission Paughco frame build in the next couple of weeks. This frame breathes new life into any old 45 flathead lying around. It’s incredible and Paughco is making a stretched job for our Bonne Belle effort for Bonneville 2010.

Here’s the point cover for the mudflap girl bike, and I now have a Klockworks fender so we can begin designing the rear end. Plus, I’m going to make one final run at my next fiction book, during March and Chris Kallas is thinking about the cover art. This will be the first and toughest fiction effort I’ve stumbled through, but it will be damn worth it. Then I can complete the movie treatment. So while a chunk of the biker nation parties in Daytona, we will focus on delivering you fine content in the form of techs, features and girls. And I’ll wrap up another book. But that ain’t all by a long shot; this year is packed, so let’s ride.
