Montana Passes Motorcycle Lane-Filtering Legislation

Montana has become the third state to recognize lane filtering, with the Gov. Greg Gianforte’s signature on a bill legalizing filtering of motorcycles under certain conditions. “We applaud the efforts of Montana’s motorcycling community and the state’s legislators, and thank Gov. Gianforte for signing this legislation into law,” said Russ Ehnes, chair of the AMA Board of Directors. S.B. 9 allows the operator of a two-wheeled motorcycle to overtake stopped or slow-moving vehicles at a speed not in excess of 20 mph, to filter between lanes of stopped traffic traveling in the same direction as conditions permit, and specifies reasonable and prudent motorcycle operation while lane filtering. “With the signing of S.B. 9, Montanans have recognized the benefits of lane splitting, which allows motorcyclists the choice to filter in traffic when it is safe to do so,” said Tiffany Cipoletti, on-highway government relations manager for the American Motorcyclist Association. The bill, sponsored by state Sen. Russ Tempel (R-SD14) and state Rep. Barry Usher (R-HD40), was signed by Gov. Gianforte on March 2 at a public signing ceremony in Helena. Ehnes was in attendance. The bill takes effect October 1, 2021. California (A.B. 51, 2016) and Utah (H.B. 149, 2018) were the first two states to codify and sign lane-splitting or lane-filtering legislation. Efforts to legalize and formally recognize lane filtering/splitting is under consideration in three other states during the 2021 legislative session. Automated Driving Systems and SMRO Visits

RIDING FREE FROM DC: Your Weekly Biker Bulletin from Inside the Beltway ­Automated Driving Systems (AKA Autonomous Vehicles) Late last year, the National Highway Traffic Safety Administration (NHTSA) announced a rulemaking process for developing a “Framework for Automated Driving System (ADS) Safety.” As part of the process public comments were solicited by NHTSA. This week the Motorcycle Riders Foundation (MRF) submitted a 6-page formal letter outlining our thoughts on the development, testing and deployment of ADS. Building on past submissions to both Congress and the U.S. Department of Transportation, the MRF laid out important priorities that NHTSA should consider. Some of the main topics the MRF highlights include the need to account for the unique attributes and characteristics of motorcycles, cyber security concerns, liability provisions, the role of individual states, the need for public transparency, threats to the protected communication spectrum and the challenges of regulations keeping pace with this technology. While ADS has promising potential, the devil will be in the details. How this technology is developed, tested and deployed will impact all Americans. This year many of those meetings have been rescheduled, held virtually or have unfortunately been cancelled all together. We’re giving away motorcycle show tickets

by Al Beeber from https://lethbridgeherald.com/ For enthusiasts across southern Alberta, the Calgary Motorcycle Show in January is a yearly pilgrimage to see the latest two-wheeled, three-wheeled and four-wheeled machines manufacturers are rolling into showrooms. For my crew, hitting the show has been a ritual for a good decade or so — I’ve lost count of the morning breakfast stops at Roy’s Place in Claresholm where we fill our own tanks in preparation for a long day of sitting on and walking among the numerous bikes, scooters and all-terrain vehicles on display. As usual, the 2020 show will be staged at the BMO Centre on the Calgary Stampede grounds and for the second year, The Lethbridge Herald has a reader giveaway. Thanks to show publicist Jackie Jackson and western regional show manager Laurie Paetz, I have five pairs of tickets to give away to motorcycle fans. Last year, the tickets offered by the show organizers were snapped up quickly so this year I’m going to be holding a draw. Meeting of the Minds Last week the 35th Annual Meeting of the Minds was held in Bloomington, Minnesota. The gathering of so many dedicated and selfless motorcycle advocates in one place was powerful. We in D.C. are continually talking with lawmakers about our membership and the riding community but being in the same room with the people we represent further fueled our passion for advocating on your behalf. Two full days of meetings and panels covered a wide range of issues including collaboration between SMRO’s and clubs, lobbying tips and tricks, our health, being a better brother and sister, the MRF PAC and the establishment of the 2020 MRF legislative priorities. On Saturday night, we heard from two guest speakers. First Rep. Peter Stauber from the 8th Congressional district of Minnesota spent 20 minutes discussing many of the issues we face at the federal level in D.C. Congressman Stauber is a member of the Transportation and Infrastructure Committee and pledged to work with the MRF to fight for our priorities in the upcoming transportation bill. Additionally, as a former law enforcement officer, he understood our concerns regarding motorcyclist profiling and was proud to be a cosponsor of H.Res. 255 since June. He offered to meet with the D.C. team in the coming weeks to follow up on our priorities. Second, State Senator John Hoffman from the Minnesota State Senate addressed the group. He spoke about working with local motorcycle rights groups and the battles and victories that have been fought at the State Capitol in St. Paul.   Having both a federal and a state elected officials speak to us demonstrates that motorcycle rights are a battle fought on different fronts.  State legislators and federal lawmakers each play a different but useful role in the fight for motorcycle rights. The Environmental Protection Agency in August 2018 proposed revoking a waiver granted to California in 2013 under the Clean Air Act as part of the Trump administration’s plan to roll back Obama-era fuel economy standards through 2025. The EPA and the National Highway Traffic Safety Administration (NHTSA) are expected to seek approval to finalize the first portion of the rule dealing with California and other states before completing action on setting yearly fuel efficiency requirements. The plan would not revoke California’s ability to set low-emission vehicle standards that has been in place since 1990, the sources said. The move comes as President Donald Trump has expressed anger with automakers over the issue. In July, four major automakers, including Ford Motor Co and Volkswagen AG, said they had reached a voluntary agreement with California on fuel efficiency rules. California and other states had vowed to enforce stricter Obama-era emissions standards, after Trump proposed rolling back the federal rules. The IIHS: When a New Study is Not New and Not a Study

By Gary Biller, NMA President Every two or three years, the Insurance Institute for Highway Safety (IIHS) splashes the media with a recycled report of how many deaths have occurred due to raised speed limits. And reporters dutifully echo it as gospel because sensational headlines like, “Speed limit increases are tied to 37,000 deaths over 25 years,” grab attention and generate views. That is the current press release title from IIHS for a just-issued report that is a rehash of a similar effort from 2016. The claim from the insurance industry advocacy group made back then, with uncanny precision for a methodology based almost entirely on assumption and extrapolation, was that 32,894 people died from higher speed limits since the 55 mph National Maximum Speed Limit (NMSL) was repealed. This skeptical review of that IIHS claim three years ago could serve just as well in critiquing the 2019 IIHS repeat of the “speed kills” mantra. Perhaps my favorite quote in the current reporting of the IIHS release is this from Axiom’s “Slow the hell down:” “ ’Every time you raise speed limits, you see more deaths,’ said IIHS vice president for research and statistical services Charles Farmer.” It isn’t necessary to stretch our advocacy muscles even a tiny bit to show this as provably false. The National Highway Traffic Safety Administration’s Fatality Analysis Reporting System Encyclopedia publishes annual highway fatalities rates. Speed limits have climbed steadily since the full repeal of the NMSL in 1995, commonly reaching 75, 80 and even 85 mph, and yet fatalities per 100 million vehicle miles traveled have plummeted: 1995                1.73 2000                1.53 2005                1.46 2010                1.11 2015                1.15 The 2017 fatality rate of 1.16 marks a 33 percent reduction over the past 22 years. Letter sent to NHTSA Seeking Clarification on the Definition of a Motorcycle

The Motorcycle Riders Foundation would like to thank Congressman Michael Burgess (TX) and Congressman Tim Walberg (MI) for a letter they sent this week to the National Highway Traffic Safety Administration (NHTSA) seeking clarification regarding the definition of a motorcycle. In addition to Congressman Burgess and Congressman Wahlberg, the following U.S. Representatives joined their colleagues in signing the letter: Congressman Troy Balderson (OH), Congressman Doug Lamborn (CO), Congressman Collin Peterson (MN), Congressman Steve Stivers (OH) and Congressman Glenn “GT” Thompson (PA). The current definition is decades old and so broad that new vehicles on our roadways, with numerous carlike features, are defined as motorcycles. “As you know, NHTSA has long defined a motorcycle as a ‘motor vehicle with motive power having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground.’ While this was a clear characterization for many years, the recent emergence of a new class of vehicle that has attributes of both automobiles and motorcycles has created confusion,” the members wrote. “We respectfully request a response that describes whether NHTSA believes the current federal definition of a motorcycle is appropriate and if not, what NHTSA is doing to address this issue.” The ambiguity of the classification of these new vehicles as either motorcycles or autocycles has created a patchwork of rules and regulations at the state level for licensing, registration and insurance. The MRF believes that a review of this definition is needed and would help provide clarity to states when making decisions on how to appropriately regulate them. Capitol Hill Update Republicans Pressing Democrats With Democrats now the majority party in the House of Representatives, they control the committee chairmanships and thus control the agenda for each committee. The House Energy and Commerce Committee, who has jurisdiction over autonomous vehicle technology, is now chaired by Frank Pallone of New Jersey. This puts Republicans in a role they not been in since 2010, seeking the help of Democrats to tackle legislative priorities. Republican Greg Walden of Oregon, the previous chairman and now ranking member as well as Congresswoman McMorris Rodgers of Washington and Bob Latta of Ohio sent Chairman Pallone a letter regarding the need for Congress to act on autonomous vehicles legislation. “We write to urge the Energy and Commerce Committee to take up bipartisan self-driving vehicle legislation. Last Congress this Committee worked across party lines to draft H.R. 3388, the Safely Ensuring Lives Future Deployment and Research in Vehicle Evolution Act (SELF DRIVE Act). The SELF DRIVE Act was an example of this Committee at its very best: working together, across the aisle, to develop legislation that will advance lifesaving technology. As a result of our deliberative, transparent, and bipartisan process, the Committee voted unanimously, 54 yeas and 0 nays, to report the SELF-DRIVE Act to the House floor where it again passed unanimously. Read how Susan and Nerolie got into triking and why they are living the dream with Trikes. https://www.touroztrikes.com.au https://www.rewaco.com Susan – “Wild and crazy and it felt a little bit rebellious” A surprise and spontaneous ride to high school on the back of a friends new Trike while living in a small country town in New Zealand, was the very moment I knew I wanted one. It was love at first ride, I was hooked. At the time I was not old enough to have a car licence, but I will never forget how it felt to be on the back of the Trike. It was cool and it was different, lots of people had two-wheeler bikes, but this chopped up, backyard, custom made Trike was the real deal, it was wild and crazy and felt a little bit rebellious. I moved back to Australia a few years later, and I never really saw many trikes. Every so often I would look around to buy one, but they were hard to find and never quite what I was looking for. Most trikes were motorbike conversions but I wanted a long-raked style trike with a low centre of gravity but also one that would not spend more time in the garage being pulled apart and repaired. I’m not a mechanic, I just wanted to ride. Life got in the way of my dream – kids, family, work all took priority for many years, and a trike was not something I could afford and it was not practical. How would I fit a baby seat to a trike?
