Motorcycle Riders Foundation: Coalitions Rejuvenated

The Motorcycle Riders Foundation (MRF) 2023 legislative agenda includes a diverse set of issues that strike at the core of who we are as bikers.

Historically, the MRF has fought many battles to defend individuals and the aftermarket motorcycle businesses’ rights to customize and repair motorcycles. Our successful defense against the EPA’s “Color and Chrome” only initiative and the regulations/enforcement related to it helped define the MRF and what we stand for to this day.

The MRF has long supported the Recognizing the Protection of Motorsports Act (RPM Act), which would ensure that modifying motor vehicles into racing vehicles used for competition would not violate the Clean Air Act. We anticipate an updated version of the RPM Act will be introduced this Spring. The MRF and our partners will work diligently for passage of this commonsense piece of legislation. Importantly, some of these parts and technology we are looking to protect are used in the EPA allowances for one-per-lifetime custom bikes and Tier 1 eligible motorcycles we fought for two decades ago.

The MRF agenda also strongly supports the desire to protect a consumer’s right to repair, and ownership of data related to their vehicles. A recently introduced bill, H.R. 906 The Repair Act, helps protect consumers’ ability to utilize independent repair shops and aftermarket parts to work on vehicles, including motorcycles.

These issues are becoming increasingly important and drawing the attention of the aftermarket industry and bike customizers. The EPA has restarted a campaign of increased enforcement and it is threatening shops and individuals with legal action.

MRF President Kirk “Hardtail” Willard recently appeared on Cycle Source Magazines “Shop Talk” radio show to discuss these issues and this week traveled to Daytona Bike Week to join independent motorcycle shop owners and others in the aftermarket industry to discuss the many issues facing this industry. The meeting was hosted by Chris Callen of Cycle Source Magazine and moderated by industry icon Bob Kay. Hardtail had this to say about the meeting, “It was encouraging to see both the level of concern and willingness in this group to engage in our efforts and educate other players in the aftermarket industry.”

The MRF won’t tackle these challenges alone, we are aggressively looking to put back together our coalition that was so effective in past battles. In the past the coalition included, the aftermarket industry, media and print publications, other custom vehicle organizations, and other motorcyclists’ rights groups. Lastly, our Master Mechanic and technical expert Dave “Dad” Dwyer is looking to schedule a meeting with the EPA in Detroit to discuss our growing concerns.

These are challenging issues, but with your continued support and the help of other like-minded advocates we will fight to defend the rights and freedoms we cherish.

Florida Insurance Laws: VOTE Bikers Over Billionaires

BIKERS OVER BILLIONAIRES!!!

Our rights are under attack! I must call your attention to a new bill (HB 837) that was filed recently in the Florida Legislature.

This bill, by the multi-billion-dollar insurance industry and corporate elites would strip away the rights of Floridians … taking away our constitutional right to hold others accountable and responsible when they harm you, your family, or your business.

If the multi-billion dollar insurance industry were to put together a wish list of ways in which they would harm policy holders, while at the same time attacking our access to courts, it would read exactly like HB 837. This bill seeks to take away our rights by reducing insurance company accountability to Insureds and claimants, expand insurance company profits, take away our rights to go to the doctors we choose and ultimately increase costs that will fall back on workers, taxpayers, and healthcare providers. All this, while trying to claim that the bill “may indirectly lower the cost of insurance.” How many of you have ever seen your auto, motorcycle, home, health, or life insurance rates ever go down?

Please join me on Thursday as we RIDE FOR OUR RIGHTS to Tallahassee to attend the House Civil Justice Subcommittee meeting, this Friday, February 24, at 8:00 a.m., where this bill will be considered. I will be there, along with countless others, making sure that the voices of actual bikers and Floridians are heard.

“Florida is under attack. The rights of every Floridian are under assault by insurance companies and corporate elites who think they can dictate which rights should be preserved and which can be tossed aside.”

It was bullshit audacity to think anyone can break up our free country without a fight. This year we fight for reasonable borders, clean, crime-free cities, free speech and scientific transparency. Hell, oil didn’t come from fossils, it’s natural and we need all the CO2 we can get. It ain’t a pollutant!

Your Help Needed to Protect the Second Amendment

Election Day is Tuesday, November 8, and the outcome of this election is crucial to the future of the Second Amendment and the ability of all Americans to keep and bear arms. NRA-ILA asks you to take action by urging your members and patrons to get to the polls and vote for pro-gun candidates in this election.*

The stakes could not be higher. If gun control candidates win this election, we will see more attempts to ban ”assault weapons,” criminalize private firearm transfers, implement ”red flag” confiscation laws, and bankrupt the firearms industry, just to name a few.

MRF Update: Paving the Way & Rolling Toward Washington, D.C.

BIKERS INSIDE THE BELTWAY ! THE VOICE OF BIKERS IN WASHINGTON !

The groundwork to pave the metaphorical roads to Washington D.C. and Capitol Hill took time and commitments from freedom loving motorcyclists from throughout the country. Individual attendance to Bikers Inside the Beltway, less than a month away, makes a difference in accomplishing our legislative goals.

Yes, the Motorcycle Riders Foundation is rolling toward Washington. Yes, since 2009 the MRF has hosted Bikers Inside the Beltway, a grassroots tradition orchestrated by SMROs that began with just as much determination but without a name in 1989.

The MRF has brought over a thousand motorcyclists to Washington to meet with their members of Congress with the sole mission of promoting a legislative agenda that continues to successfully become law on behalf of all street riding motorcyclists.

Those visits are effective. Members of Congress know that it is not easy for constituents to make the trip to Washington, D.C. And when constituents from a well-known organization such as the Motorcycle Riders Foundation venture to Washington to meet with their congressional delegation, members of Congress tend to listen.

Your personal visit to Congress does make a difference. Co-sponsors on legislation the MRF supported rose over 20 percent during Bikers Inside the Beltway in 2021. Numbers make a difference. Currently, there almost ninety co-sponsors on H. Res 366 – an anti-profiling resolution. By joining other freedom loving motorcyclists, you can help increase those co-sponsors so that those numbers make an even greater difference.

The MRF’s legislative agenda – beyond the three items listed below — recommended and approved by SMRO leaders at the 2021 Meeting of the Minds, is not all-inclusive.

News items during the past two weeks have repeatedly demonstrated why the following items are at the top of the MRF’s legislative agenda as we move toward Bikers Inside the Beltway:

  • Profiling: Sustain lobbying efforts for the passage of resolutions or legislation that promotes awareness and prohibition of motorcyclists profiling.
  • Renewable Fuels: Advocate for targeted changes to the Renewable Fuel Standard (RFS). Support the universal availability of approved fuel blends, containing no more than 10 percent ethanol by volume. Ensure that consumers are educated on proper fuel usage.
  • Autonomous Vehicles: Advocate and monitor any legislation or regulations related to motorcycles concerning connected and autonomous vehicles (AV) including endorsing rulemaking to set new standards specific to seeing, detecting, and properly reacting to motorcycles. Ensure motorcycles are part of all testing and development procedure.

The pandemic, and the events of January 6, 2021, did not deter the MRF. More than one-hundred motorcyclists attended the first in-person meeting in 2021 with members of Congress last May. The above items are the missing pieces of the 2021 infrastructure legislation, and they are driving the MRF’s need to return to Washington when Bikers Inside the Beltway meets on May 17.

  • Familiarize yourself with the briefing points
  • Confirm your appointment locally or in Washington
  • Virtual or in person, make notes on your meeting
  • Share your meeting notes with the MRF

Numbers do make a difference toward accomplishing the legislative goals of the MRF. All 435 members of the House of Representatives are up for reelection. Thirty-four members of the Senate are up for election. Numbers do make a difference. Like it or not, legislators tend to listen better during election years.

Paving the way for the long haul is what the MRF does to ensure that the future of motorcycling survives. It is not too late to use that “paved way” to help the numbers make a difference.

Political Agendas Surrounding Automobiles Charge Up Strong Emotions

The impending arrival of electric cars and trucks has caused quite a stir. Sure, everyone shares the well-intentioned notion of a healthier environment. But constant announcements about the potential phasing out of new gas-powered vehicles have enthusiasts worried about the future of the hobby. Thanks in part to a 24-hour news-cycle, the automotive-minded are forced to ponder this great unknown with greater frequency. With the topic weighing heavier on many minds, the question arises: what’s to become of the tailpipe—and when? Clearly there are crossed wires needing to be untangled.

Acronym Soup

First, we must understand the common lingo used in automotive discussions. The gasoline-sipping internal combustion engine (ICE) has long been the motivator of choice. However, the low- and zero-emissions vehicles (ZEVs) categories have emerged and made significant improvements in recent years. There are several different models of these cars and trucks such as electric vehicles (EVs), plug-in hybrids, and those running on hydrogen fuel-cells. With such competition, it may seem like traditional rides could have a tougher existence in a yet-uncertain future of alternative powerplants.

Government Directives

The latest update in the automotive world came from the nation’s top office: the Biden Administration. President Joe Biden signed the “Executive Order on Strengthening American Leadership in Clean Cars and Trucks” in August. In short, the measure calls for 50% of all sales of new cars and light trucks in the US be ZEV by the year 2030. “It is the policy of my Administration to advance these objectives in order to improve our economy and public health, boost energy security, secure consumer savings, advance environmental justice, and address the climate crisis,” said President Biden.

Biden’s action was preceded by California Governor Gavin Newsom’s controversial notice last year. That order instructed the California Air Resources Board (CARB) to draft regulations requiring that all new cars and passenger trucks sold in the state be zero-emissions by 2035. Once drafted, CARB’s proposed regulations will be subject to a lengthy regulatory process, including legal, economic, and environmental analyses, public comment, and hearings. The Governor’s order is also expected to face numerous legal challenges from opponents.

Cause for Concern?

The concern surrounding EVs is understandable, but premature. Many of the proposed rules and legal mandates are far more symbolic in nature. For example, President Biden’s actions were merely issued as an Executive Order, meaning it is not a federal law and has no binding authority. In fact, the following disclaimer is included at the end of the Order:

(c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

Directives like President Biden’s also tend to be highly aspirational with ambitious time frames for implementation. For example, many of the President’s proposed benchmarks extend beyond his time in office, giving him little say on the final product.

Realities: Supply vs. Demand

Perhaps the most direct impact to personal transportation will come from the automakers themselves. The evolving market is already experiencing highs and lows. While seeking to boost ZEV sales, major brands have been subject to factors beyond their control. Supply chain shortages and logistical issues have impeded production schedules, causing delays, and price surges. Additionally, massive investment of resources will be required for materials and retooling throughout the entire manufacturing process.

Many fundamental issues need to be resolved before any major shift to “clean” vehicles is feasible. Most importantly, more than 281 million rides share US roads—a small fraction of which are EVs. Such a massive fleet won’t be replaced anytime soon. Of course, the lion’s share are newer vehicles, which often have a life spanning a decade or longer. Also, the urge to trade-in for an electric model decreases without widespread options for “refueling.” Charging woes include long recharging time, charger availability, and standardization of hardware between brand offerings. Additionally, the U.S. electrical grid can hardly handle its current strain—let alone an entire nation needing to recharge at home or on-the-go. At this point, clear solutions appear far from sight.

Informed & Involved

Although the future of EV adoption remains to be seen, the SEMA Action Network (SAN) believes a balance can be achieved and has made this fight a top priority. Our community’s rich history of innovation should be celebrated as it continues evolving with emerging technologies. As always, the SAN opposes proposed efforts to ban the ICE and other such mandates impacting vehicles of all kinds—vintage collectibles and their fuel supply included.
