THE FIGHT TO SAVE HARLEY

This was taken from an article by Rick Barrett, Milwaukee Journal Sentinel

The fight for control of Harley-Davidson Inc. was decided May 14 when shareholders approved the election of the entire board of directors, including Jochen Zeitz who is also the company’s chief executive officer.

However, a source told the Journal Sentinel that dissident shareholder H Partners Management was successful in that two board members it sought to remove in a withhold-the-vote campaign — Tom Linebarger and Sara Levinson — are expected to voluntarily step down in 2026 after many years as directors.

Also, Zeitz’s successor as CEO will come from outside the company, something H Partners had also sought. Earlier, Zeitz announced his retirement for some time this year.

This appears to be the best news from this article, but it’s not over. The challengers lost by 1percent of the vote, but that’s not all. We will report more as we move forward to save the Harley-Davidson brand.

Oppose So-Called “Right To Repair” Legislation (H.R. 1566/S. 1379)

Legislation Raises Serious Vehicle Privacy, Security and Safety Issues for Consumers 

Published April 25, 2025

Members of Congress are Urged to Oppose H.R. 1566/S. 1379

ISSUE

Advocates for “right to repair” legislation claim that independent automotive repair shops do not have access to the parts or data necessary to repair vehicles. However, this concern was rectified by a 2014 Memorandum of Understanding, signed by “right to repair” proponents and auto manufacturers, and reaffirmed by a 2023 industry commitment that includes telematics. Today, the information independent shops need to repair vehicles is readily available from every auto and truck manufacturer. H.R. 1566/S. 1379 has little to do with repairing a vehicle; instead, the bill would allow vehicle owners to give all technical and compatibility information, software, and technology to any third party they designate “without restriction or limitation.” This bill regulates only vehicles and does not apply to other products, such as farm equipment or mobile phones. Members of Congress should oppose H.R. 1566/S. 1379, which is redundant in nature and creates an unlevel playing field for small business dealers.

BACKGROUND

Instead of increasing competition in the service market, H.R. 1566/S. 1379 would reduce competition and consumer choice. Dealerships currently service multiple brands, including those outside their franchise. However, this legislation may exclude franchised dealers from receiving so-called “necessary” vehicle-generated data that would be needed for repairs. For example, a franchised GM dealer may be barred from receiving the repair information necessary from any other automaker to repair vehicles outside of their brand. This could put dealers at a competitive disadvantage and limit where customers can take their vehicle for repairs leading to fewer service options.

Congress should also consider whether this bill is necessary to ensure “right to repair” as automakers and independent repairers already have a longstanding formal mechanism through the National Automotive Service Task Force to ensure service information, tool information and training data is made available from every truck and auto manufacturer.

Despite this effective dispute resolution mechanism, S. 1379 would unnecessarily expand the powers of federal agencies. The legislation would empower the Federal Trade Commission (FTC) to expand the definitions included in the bill at their own discretion. Additionally, the bill requires the FTC to “promulgate regulations” requiring additional paperwork for customers at the point of purchase when dealers are trying to streamline and shorten the purchasing process. Failure to comply with this new requirement could result in up to a $51,744 fine per violation. This regulation would not apply to independent dealers or direct sellers, further creating an unlevel playing field.

KEY POINTS

The legislation provides an unfair competitive market since dealers annually invest significant amounts of capital into their service and repair capabilities, first rate technician training and state of the art diagnostic and repair tools to provide safe repairs. Under their franchise sales and service agreements, dealers invest on average $334,000 annually on machinery and shop equipment and $82,000 annually on technician training to keep up with the latest technology to repair vehicles safely and securely.

Dealers must meet significant regulatory requirements under the FTC Safeguards Rule and FTC Act to be able to safely and securely handle customer’s vehicle data. Technological requirements under the FTC Safeguards Rule alone are significant, with an average small dealership having an initial $220,000 cost and a $218,000 annual cost to comply. While in both House and Senate REPAIR bills repair information must be subject to the “same technological protections” it remains unclear what in practicality that means and if ‘any third party’ will have to meet the same data privacy and security regulatory safeguards that dealers do to handle their customers’ vehicle data.

A Government Accountability Office (GAO) report confirms the information and tools necessary to repair vehicles are already available to independent repair shops. The report found that of the eight automakers GAO interviewed, all confirmed that “they provide to independent repair shops, on fair and reasonable conditions, equal access to the information, data, and tools needed for repairs, and will continue to do so.” Independent repair shops currently perform more than 70% of all non-warranty repairs, and according to the Auto Care Association, which supports this legislation, their total revenue grew 43% from 2014-2022.

STATUS

Rep. Neal Dunn (R-Fla.) reintroduced H.R. 1566, the REPAIR Act in February and Sens. Ben Lujan (D-N.M.) and Josh Hawley (R-Mo.) introduced S. 1379 in April. Last Congress, NADA and industry stakeholders submitted a coalition letter opposing this flawed legislation. Members of Congress are urged not to cosponsor H.R. 1566/S. 1379.

S&S CYCLE ANNOUNCES RETURN OF JUSTIN BRAMSTEDT–

S&S Cycle is excited to announce the return of Justin Bramstedt as Senior Manager of Warranty and Benchmarking. Bramstedt previously worked at S&S from 1999 to 2016.

During his prior time at S&S Cycle, Bramstedt held several titles, including Development Engineer, Product Line Manager, R&D Manager, NHRA/S&S Race Manager, and Warranty and Remanufacturing Manager. All of that experience led him to run his own repair and performance shop after his time at S&S Cycle.

PFAS REGULATIONS–

The EPA Extends Data Reporting Period Required for Manufacturers

The U.S. Environmental Protection Agency is delaying reporting dates for data it wants from companies making PFAS chemicals and also from some importers.

“This interim final rule delays the start of the submission period by nine months, from July 11, 2025, to April 13, 2026,” the EPA stated in a blast email to various stakeholders. “Submissions will now be due by October 13, 2026, for most manufacturers, and by April 13, 2027, for small manufacturers reporting exclusively as article importers. This extension will allow EPA to further develop and test the software being used to collect the data from manufacturers, thereby providing critical feedback to EPA, including what additional guidance would be useful for the reporting community.”

On Monday, the EPA began accepting public comments (for 30 days) on the reporting period change.

“Additionally, the agency is considering a separate action to reopen other aspects of this rule for public comment,” the email stated. “EPA plans to address any comments submitted on this interim final rule and on the future proposed rule concurrently. Comments can be submitted on the interim final rule on www.regulations.gov in docket EPA-HQ-OPPT-2020-0549. The interim final rule is now available.”

“This can be welcome news for some powersports manufacturers and distributors,” said Scott Schloegel, MIC Senior Vice President of Government Relations. “We have argued for years on Capitol Hill and in state legislatures nationwide that businesses need more time to prepare for and adapt to PFAS chemical regulations.”

National Coalition of Motorcyclists, 40th Anniversary

Over this past weekend, the National Coalition of Motorcyclists (NCOM) held their 40th Annual Meeting in Biloxi, MS. The event was attended by members of the Motorcycle Riders Foundation (MRF), PRO Convention (PROC), National Council of Informed Riders (COIR), State Motorcycle Rights Organizations (SMROs), Coalitions of Clubs (COCs), Clubs and motorcyclists from across North America.

This year included panel discussions on passing anti-profiling legislation and leadership, plus presentation of legislative updates and more. MRF President Kirk “Hardtail” Willard, MRF Club Rep. Russell Radke, MRF SSMRO Rep. Brick Lindsey and State Rep. Jacque Lindsey were among this year’s presenters. The MRF congratulates NCOM on a successful event and their 40th Anniversary.

HISTORY LESSON FROM COMPETITION DISTRIBUTING–

Meguro Motorcycles: better known at that time as the “senior make and the king of four strokes.”

Meguro entered the motorcycle industry in 1937. Having a good relationship with the government, the people at Meguro took advantage of army orders. Their first motorcycle was the Z97, a 500cc rocker-valve motorcycle influenced by the Swiss Motosacoche. It’s worth mentioning that this model was a success for the factory, and the Z97 was in production until the fifties.

Through the years, Meguro produced some very nice 250cc and 350cc rocker-valve, single-cylinder models as well as high-performance twins. All of them with a very strong British influence. Then and thanks to the commercial success they were living, they also launched a rocker-valve 125 cc for their low-end range and a twin-cylinder 650cc to accompany the already existing 500cc.  But it was in 1958, when Meguro tried to get rid of their British influence, that things started to go wrong…

Based on a winning prototype of Mount Asama (one of the biggest races that time), Meguro Motorcycles produced three nice and elegant machines with overhead camshaft: the 125cc E3, the 250cc F and the 350cc Y A. Unfortunately these bikes turned out to be too heavy and didn’t get the buyers’ attention.  Meguro will soon return to rocker valve models.

Meguro Motorcycles remained as one of the top 10 manufacturers till 1960, but due to some bad decisions, as the ones mentioned above, the company started to decline and was soon bought by Kawasaki.  In 1960 Meguro signed an initial agreement with Kawasaki Motorcycles, and in 1962 they had completely disappeared.

A LESSON FROM THE CO2 COALITION–Dr. Happer on CO2 & Warming

Here at the CO2 Coalition, we get regular requests for a commonsense explanation of the relationship between increasing COand its possible warming effect on the atmosphere. 

In response to a recent question on the subject, our Chairman, Dr. William Happer, gave a somewhat abbreviated explanation that you can file away for future reference. Caution, for climate geeks and fans thereof!! 

“Calculating Earth’s radiation to space for cloud-free skies has very little uncertainty to it, since it depends only on the altitude dependence of the temperature, from Earth’s surface to the top of the radiative atmosphere, say 100 kilometers, and on the frequency dependent infrared opacity, which also depends strongly on altitude. Both have been measured very precisely for many atmospheric conditions.” 

And in conclusion

“So a feedback-free estimate of the warming from doubling CO2 is 0.75 C. The few competent scientists who support IPCC (Intergovernmental Panel on Climate Change) alarmism know perfectly well that this puny warming estimate is correct. To get around it they assume there are huge positive feedbacks, usually from water vapor or clouds. The hypothetical feedbacks multiply the feedback-free warming by factors of four or more. As you probably know most feedbacks in natural systems are negative, not positive, so the real warming will probably be less than 0.75 C for doubling CO2.”

Told Greg I’ll be there in spirit, usually he rides one of his older bikes, but this year he’s taking the FLT.  We could be twins as I usually am behind him, maybe next year if he takes it again.

Berry Wardlaw might be out of the play for the salt this year, but we’re still trying with the Bonne Belle. The engine is reaching the final stages at Departure Bike Work is Richmond, Virginia.

Should have balancing finished today,” said Brian at Departure. “I was waiting on Mallory metal for adding weight to the flywheel. They came in Monday. Got two pieces welded in yesterday and at the end of the day I needed just a little more weight.”

The Mallory metal is carbide. It’s heavier than the cast flywheel metal. “We have to add one piece at a time and re-true the flywheels with the bob weight installed then check the balance, again,” said Brian,”Very close yesterday. I’m finishing up now.”

“Wheels stop in four places on the bearing knife means the wheels are balanced. Now, I’ll assemble the wheels with rods and true and install into the left case half.”

Absolutely correct that there needs to be a board member that represents the dealers and that you need a Davidson on the board. I suspect that those 2 items by themselves would have prevented the current disaster. The new CEO needs to understand the paradigm Harley-Davidson operates in. To attract new riders, he needs to be able to connect that paradigm to the developing new paradigm.

Jochen Zeitz and the Board of Directors should be dragged thru the streets of Milwaukee from the back of Big Twin Harleys, then dumped into Lake Michigan. I mean that in a good Christian way. Also get rid of the plastic intake manifold, it’s bad enough to break down on the road with a flat tire but crack your cheap plastic intake manifold, you may be stuck for days.

BIKERNET GUN NUT REPORT

The United States House Committee on Ways & Means released the text for the House Reconciliation Bill. Included in this legislation, is a provision which would reduce the National Firearms Act (NFA) tax imposed on suppressors from $200 to $0. However, this legislation would continue to subject suppressors to the other unconstitutional provisions of the NFA.

“The NRA fully supports removal of suppressors from the NFA and will work to achieve that goal as the Reconciliation Process continues,” said John Commerford, Executive Director of NRA-ILA.

This Reconciliation Bill only requires a simple majority vote in both the U.S. House and U.S. Senate. There may be time to include language in the Reconciliation Bill which would not only remove the tax, but would remove suppressors from the United States tax code and NFA completely.

The Reconciliation process will go very quickly, and your member of Congress needs to hear from you! In order to improve this legislation and have suppressors completely removed from the NFA, please call your U.S. Representative today and ask them to include Section 2 of the Hearing Protection Act in the Reconciliation Bill!

Today, I choose to withdraw my attention from confusion, fear, and judgment. I consciously release anything and anyone that no longer serves my Highest Good—including doom scrolling, negative news, draining conversations, and past burdens. Too often, we are pulled into the noise of gloom and forget to honor the beauty and blessings already present in our lives.

Even when the world around me seems uncertain or dark, I remember this truth: Life is real, meaningful, and always unfolding for the greater good. No sincere effort toward truth, love, or unity is ever lost. I turn inward, into the deep well of Peace that lives at the core of my being. In that stillness, I feel strength. I feel power. I feel divine order.

I know there is a Presence within me—my Higher Power, by any name—that is the source of every good I could ever need. It provides for me physically, mentally, and spiritually. I open my heart with confidence and welcome these gifts, trusting they are already on their way.

I come to this divine Fountain of Supply within me and embody all I need. I am filled with joyful fulfillment and eager expectation. As Ralph Waldo Emerson so beautifully wrote, “I get my bloated nothingness out of the way of the Divine Circuit.”

A brother in SoCal is running to the end of his shop lease and selling equipment. “It’s pricey stuff and the best machinery every made (Monarch 10ee, Deckel, Logan, etc.),” said Rick Krost.

He’s doing an incredible job with his new shop on Melrose in Hollywood.

I finished shipping out another 80 Sturgis Museum packages. Each package contains 20 tickets. That’s almost 7,600 tickets over the last month. They are selling and we were forced to order another 5,000 tickets. It’s all for a very good cause. We need to keep this museum running and growing until it’s world class and open all year long in the epicenter of the Worldwide Motorcycle Industry. Just five weeks after my hip surgery, I’m driving, working out and getting out and about. Leaving my PT class I stopped to see John bleeding his brakes. We adjusted, tuned, took the bike off the rack and started to kick. I kicked with my left foot unsuccessfully, but it did fire. We were close.

I suggest we try to find a roller starting system. As it turned out the guy he bought the Pan basket from has one collecting dust. Are we lucky or what.

Every week I set up a to-do list and go after the shit. Today has been incredible and more stuff jumps onto the list daily.

That’s it, busy day and jammed tomorrow. Need to relax.
