California Unification Rally Draws 3,000 to State Capitol

On May 21,2023, over 3,000 motorcyclists gathered at the California State Capitol in Sacramento to talk biker’s rights, and to send a message to the state legislature that a change in how California deals with issues important to riders is needed. Speakers from the Modified Motorcycle Association (MMA) of California, ABATE of California, the Motorcycle Riders Foundation (MRF), the National Council of Clubs (NCOC) and other groups took to the podium to stress the importance of all riders – as well as other consumer advocates including those in the automotive industry – coming together to present a unified front. Rally organizer and MRF State Representative ‘Chappy’ Patrick Carver and his team of volunteers did yeoman’s work in organizing the event. Chappy is also the President and lobbyist for the MMA of California and works closely with the MRF on legislative issues being addressed in Congress. Numerous long-time California activists, including ABATE lobbyists Jim Lombardo and Bobby T, ABATE officers David ‘D-Man’ Seiler, Chuck Pedersen, and MMA/ABATE Liaison Dave Battles were on hand as well.

For California riders, a major concern continues to be the issue of being unfairly profiled by law enforcement. Following a concerted, years-long effort by motorcycle clubs from around the country, the NCOC, the MRF, state motorcyclists’ rights organizations and thousands of independent riders, anti-profiling resolutions have now been passed in both the U.S. Senate and House of Representatives with bi-partisan support. On a local level, five states have passed standalone anti-profiling laws. California and other states are working to have similar legislation enacted.

Other topics of discussion at the rally included protecting the rights of consumers to repair their machines, the unrealistic rush to outlaw internal combustion engines in favor of electric vehicles, ongoing issues associated with unregulated self-driving autonomous vehicles, and the appropriate labeling and availability of E10 or lower petroleum fuels.

MRF Executive Director Mark Buckner addressed the rally, emphasizing the importance of the challenges and opportunities facing riders today. Buckner discussed MRF’s recent Bikers Inside the Beltway lobbying campaign in Washington, D.C., highlighting the issues discussed with members of Congress and their staff. Those issues included ongoing efforts to end unfair profiling; H.R. 906, the Repair Act, seeking to stop manufacturers from limiting the ability of consumers and independent shops to repair products; H.R, 1435, the Preserving Choices in Vehicle Purchases Act, seeking to amend the Clean Air Act to prevent a ban on internal combustion engines; ensuring that Congress and executive branch agencies including the National Highway Traffic Safety Administration (NHTSA) provide appropriate oversight regarding self-driving vehicles; ensuring that consumers will continue to be able to purchase E10 and lower ethanol fuels at a reasonable price; and building strong, bi-partisan motorcycle caucuses made up of motorcycle-friendly legislators in Washington, D.C.

Overall, the California Unification Rally was a resounding success, with unity and opportunity the messages of the day.

Baker’s Dozen Fight for Bikers

On Tuesday, 13 members of the House of Representatives sent a bipartisan letter to U.S. Department of Transportation (DOT) Secretary of Pete Buttigieg seeking the formation of the Motorcyclist Advisory Council (MAC). As you may remember, the MAC was first established by Congress in 2015 and renewed with passage of the Infrastructure Investment and Jobs Act in 2021.

Unfortunately, despite the requirement that the MAC be established within 90 days after the law is passed, DOT has failed to act. In the past, the MAC has provided a critical forum for policy makers, roadway engineers, and motorcyclists to discuss ways roadway and barrier design, construction and maintenance practices and intelligent transportation systems can better meet the safety needs of the nearly 9 million motorcyclists in this country.

One important part of the reestablished MAC, as outlined in the text of the law, is the expansion of membership seats. The inclusion of manufacturers, motorcyclist rights organizations and safety professionals will provide for a more expansive knowledge base and information sharing on the council. As prescribed in the law, the MAC will be required to submit biennial reports on their findings.

Establishment of the MAC was one of the Motorcycle Riders Foundation’s priorities during the recent Bikers Inside the Beltway event in D.C. Thank you to Rep. Gallagher for leading the letter and to the 12 other lawmakers listed below for supporting our efforts to seat the MAC.

NHTSA Responds to Questions from Congress

Just before the end of 2022, Rep. Tim Walberg of Michigan and 26 of his colleagues in Congress sent a letter to the National Highway Traffic Safety Administration (NHTSA) regarding recent crashes that involve motorcycles and cars believed to be in self-driving mode.

The response from government regulators has some key takeaways:

  • “NHTSA is actively working to educate consumers and the media that automated driving system (ADS) technologies are not self-driving technologies, and that drivers must always remain engaged in the driving task.”
  • “Crashes involving motorcycles account for less than 2 percent of all reported crashes involving ADS.”
  • “NHTSA is conducting research on how vehicles equipped with crash avoidance technologies react to motorcycles, bicyclists and other vulnerable road users in various scenarios.”

The Motorcycle Riders Foundation is committed to aggressively working with lawmakers to address obvious safety gaps in the deployment of this new technology. While we appreciate that NHTSA is conducting research on this topic, on this topic, motorcyclists are not “vulnerable road users”, motorcyclists are simply road users.

Additionally, it’s unacceptable that consumers falsely believe this technology, deployed on our roads, allows them to sit back and relax while in the driver’s seat. The safety of the nearly 10 million bikers on our nation’s roadways requires that all roadway users act in a responsible manner.

Bikers Inside the Beltway: Holding Common Ground

Bikers inside the Beltway – with the encouragement and direction of the Motorcycle Riders Foundation, since the first Bikers inside the Beltway in 2009, thousands of bikers have met with their elected representatives and educated them about issues of importance to all street riding motorcyclists.

Specifically… the National Highway Traffic Safety Administration (NHTSA) has less than 30 days of their 120-day requirement to report to the Senate and House Committee(s) on Appropriations and answer how the agency may be “conducting activities that encourage states to adopt legislation, regulation, or other policies that unjustly profile motorcycle riders.”

The words of former U.S. Representative David Price from North Carolina may well apply to the recent efforts of the Motorcycle Riders Foundation “… Understand that not every battle can be won on the first try and that politics is a matter of striking a balance between … compromising and finding common ground where you can, and fighting where you must.”

The MRF found and is holding common ground among the nation’s state motorcyclist rights organization, motorcycle club members, and all freedom loving motorcyclists who, as the Motorcycle Profiling Project demonstrates, are susceptible to being profiled while riding a motorcycle.

The MRF’s victories, realized in the waning hours of the 117th Congress in December, should drive home Congressman Price’s words, and demonstrate the positive results when common ground is identified and held. Those victories came from the year-after-year vigilance of MRF members writing, calling, and meeting with members of Congress during the Motorcycle Riders Foundation’s annual Bikers inside the Beltway.

Now is the time for you to register to attend Bikers inside the Beltway – May 15 & 16, 2023.

As in years past, Bikers inside the Beltway will be dual-faceted to accommodate in-person visits to Congress plus visits to local district offices.

Motorcycle Riders Foundation: Coalitions Rejuvenated

The Motorcycle Riders Foundation (MRF) 2023 legislative agenda includes a diverse set of issues that strike at the core of who we are as bikers.

Historically, the MRF has fought many battles to defend individuals and the aftermarket motorcycle businesses’ rights to customize and repair motorcycles. Our successful defense against the EPA’s “Color and Chrome” only initiative and the regulations/enforcement related to it helped define the MRF and what we stand for to this day.

The MRF has long supported the Recognizing the Protection of Motorsports Act (RPM Act), which would ensure that modifying motor vehicles into racing vehicles used for competition would not violate the Clean Air Act. We anticipate an updated version of the RPM Act will be introduced this Spring. The MRF and our partners will work diligently for passage of this commonsense piece of legislation. Importantly, some of these parts and technology we are looking to protect are used in the EPA allowances for one-per-lifetime custom bikes and Tier 1 eligible motorcycles we fought for two decades ago.

The MRF agenda also strongly supports the desire to protect a consumer’s right to repair, and ownership of data related to their vehicles. A recently introduced bill, H.R. 906 The Repair Act, helps protect consumers’ ability to utilize independent repair shops and aftermarket parts to work on vehicles, including motorcycles.

These issues are becoming increasingly important and drawing the attention of the aftermarket industry and bike customizers. The EPA has restarted a campaign of increased enforcement and it is threatening shops and individuals with legal action.

MRF President Kirk “Hardtail” Willard recently appeared on Cycle Source Magazines “Shop Talk” radio show to discuss these issues and this week traveled to Daytona Bike Week to join independent motorcycle shop owners and others in the aftermarket industry to discuss the many issues facing this industry. The meeting was hosted by Chris Callen of Cycle Source Magazine and moderated by industry icon Bob Kay. Hardtail had this to say about the meeting, “It was encouraging to see both the level of concern and willingness in this group to engage in our efforts and educate other players in the aftermarket industry.”

The MRF won’t tackle these challenges alone, we are aggressively looking to put back together our coalition that was so effective in past battles. In the past the coalition included, the aftermarket industry, media and print publications, other custom vehicle organizations, and other motorcyclists’ rights groups. Lastly, our Master Mechanic and technical expert Dave “Dad” Dwyer is looking to schedule a meeting with the EPA in Detroit to discuss our growing concerns.

These are challenging issues, but with your continued support and the help of other like-minded advocates we will fight to defend the rights and freedoms we cherish.

Censorship: Michael Shellenberger testifies before Congress

EXPOSED: America’s Secret Censorship-Industrial Complex

U.S. government officials, agencies, and contractors are violating the First Amendment

Over the last three months, a small group of independent journalists, including Leighton and I, have, thanks to the Twitter Files, exposed the ways in which social media platforms have, under pressure from U.S. government agencies, censored ordinary Americans and spread disinformation.

Today, at 10 am ET, journalist Matt Taibbi and I will testify before Congress and reveal the existence of a secret censorship-industrial complex in the United States.

Our findings are shocking. A highly-organized network of U.S. government agencies and government contractors has been creating blacklists and pressuring social media companies to censor Americans, often without them knowing it.

We and others have already reported on some of the actions of this complex, including its disinformation campaigns. But the extent of its censorship was unknown to us until very recently. And, as importantly, we now understand the ways in which this complex simultaneously spreads disinformation and demands censorship.

What my 68-page testimony to Congress shows is an effort by U.S. government intelligence and security agencies to wage “information warfare” against the American people.

I do not doubt that some people will try to justify the behaviors we have documented. They will say such censorship is necessary for “fighting disinformation.”

But there is no moral or legal justification for the acts of state-sponsored censorship we document, much less for the fundamentally unAmerican censorship-industrial complex.

I believe that any reasonable person reading our report, no matter their politics, will be horrified by what is taking place and demand an end to it.

With our testimony, we are calling on Congress to defund and dismantle the censorship-industrial complex immediately.

Democracy depends on freedom of speech. Both are under attack.

The Censorship-Industrial Complex
My verbal testimony to Congress

In his 1961 farewell address, President Dwight Eisenhower warned of “the acquisition of unwarranted influence… by the military-industrial complex.” Eisenhower feared that the size and power of the “complex,” or cluster, of government contractors and the Department of Defense would “endanger our liberties or democratic processes.” How? Through “domination of the nation’s scholars by Federal employment, project allocations, and the power of money.” He feared public policy would “become the captive of a scientific-technological elite.”

Eisenhower’s fears were well-founded. Today, American taxpayers are unwittingly financing the growth and power of a censorship-industrial complex run by America’s scientific and technological elite, which endangers our liberties and democracy. I am grateful for the opportunity to offer this testimony and sound the alarm over the shocking and disturbing emergence of state-sponsored censorship in the United States of America.

The Twitter Files, state attorneys general lawsuits, and investigative reporters have revealed a large and growing network of government agencies, academic institutions, and nongovernmental organizations that are actively censoring American citizens, often without their knowledge, on a range of issues, including on the origins of COVID, COVID vaccines, emails relating to Hunter Biden’s business dealings, climate change, renewable energy, fossil fuels, and many other issues.

I offer some cautions. I do not know how much of the censorship is coordinated beyond what we have been able to document, and I will not speculate. I recognize that the law allows Facebook, Twitter, and other private companies to moderate content on their platforms. And I support the right of governments to communicate with the public, including to dispute inaccurate and misleading information.

But government officials have been caught repeatedly pushing social media platforms to censor disfavored users and content. Often, these acts of censorship threaten the legal protection social media companies need to exist, Section 230.

“If government officials are directing or facilitating such censorship,” notes George Washington University law professor Jonathan Turley, “it raises serious First Amendment questions. It is axiomatic that the government cannot do indirectly what it is prohibited from doing directly.”

Moreover, we know that the U.S. government has funded organizations that pressure advertisers to boycott news media organizations and social media platforms that a) refuse to censor and/or b) spread disinformation, including alleged conspiracy theories.

The Stanford Internet Observatory, the University of Washington, the Atlantic Council’s Digital Forensic Research Lab, and Graphika all have inadequately-disclosed ties to the Department of Defense, the C.I.A., and other intelligence agencies. They work with multiple U.S. government agencies to institutionalize censorship research and advocacy within dozens of other universities and think tanks.

It is important to understand how these groups function. They are not publicly engaging with their opponents in an open exchange of ideas. They aren’t asking for a national debate over the limits of the First Amendment. Rather, they are creating blacklists of disfavored people and then pressuring, cajoling, and demanding that social media platforms censor, deamplify, and even ban the people on these blacklists.

Who are the censors? They are a familiar type. Overly confident in their ability to discern truth from falsity, good intention from bad intention, the instinct of these hall monitor-types is to complain to the teacher — and, if the teacher doesn’t comply, to go above them, to the principal. Such an approach might work in middle school and many elite universities, but it is anathema to freedom and is an abuse of power.

These organizations and others are also running their own influence operations, often under the guise of “fact-checking.” The intellectual leaders of the censorship complex have convinced journalists and social media executives that accurate information is disinformation, that valid hypotheses are conspiracy theories, and that greater self-censorship results in more accurate reporting. In many instances, censorship, such as labeling social media posts, is part of the influence operation aimed at discrediting factual information.

The censorship industrial complex combines established methods of psychological manipulation, some developed by the U.S. military during the Global War on Terror, with highly sophisticated tools from computer science, including artificial intelligence. The complex’s leaders are driven by the fear that the Internet and social media platforms empower populist, alternative, and fringe personalities and views, which they regard as destabilizing. Federal government officials, agencies, and contractors have gone from fighting ISIS recruiters and Russian bots to censoring and deplatforming ordinary Americans and disfavored public figures.

Importantly, the bar for bringing in military-grade government monitoring and speech-countering techniques has moved from “countering terrorism” to “countering extremism” to countering simple misinformation. The government no longer needs a predicate of calling you a terrorist or extremist to deploy government resources to counter your political activity. The only predicate it needs is simply the assertion that the opinion you expressed on social media is wrong.

These efforts extend to influencing and even directing conventional news media organizations. Since 1971, when the Washington Post and New York Times elected to publish classified Pentagon papers about the war in Vietnam, journalists understood that we have a professional obligation to report on leaked documents whose contents are in the public interest, even when they had been stolen. And yet, in 2020, the Aspen Institute and Stanford’s Cyber Policy Center urged journalists to “Break the Pentagon Papers principle” and not cover leaked information to prevent the spread of “disinformation.”

Government-funded censors frequently invoke the prevention of real-world harm to justify their demands for censorship, but the censors define harm far more expansively than the Supreme Court does. The censors have defined harm so broadly, in fact, that they have justified Facebook censoring accurate information about COVID vaccines, for example, to prevent “vaccine hesitancy.” Their goal, clearly, is not protecting the truth but rather persuading the public. That is the purpose of open debate and the free exchange of ideas.

And, increasingly, the censors say their goal is to restrict information that “delegitimizes” governmental, industrial, and news media organizations. That mandate is so sweeping that it could easily censor criticism of any part of the status quo, from elected officials to institutions to laws. This extreme, reactionary attitude is, bluntly, un-American.

Congress should immediately cut off funding to the censors and investigate their activities. Second, it should mandate instant reporting of all conversations between social media executives, government employees, and contractors concerning content moderation. Third, Congress should limit the broad permission given to social media platforms to censor, deplatform, and spread propaganda.

Whatever Congress does, it is incumbent upon the American people to wake up to the threat of government censorship. “Only an alert and knowledgeable citizenry,” Eisenhower noted, “can compel the proper meshing of the huge industrial and military machinery of defense with our peaceful methods and goals so that security and liberty may prosper together.”

MRF: Continuing to Bridge the Gap

Almost a decade ago, the Motorcycle Riders Foundation (MRF) began outreach to motorcycle clubs to find common ground on key legislative items. An MRF board seat, titled Director of Sustaining Member Motorcycle Clubs, was created and that seat is held by Russell Radke. Part of Russell’s mission is to educate the motorcycle club community on what the MRF is working on in D.C. and how our efforts impact all riders.

The National Council of Clubs (NCOC) has, for the past several years, invited the MRF to participate in its meetings to foster that dialogue. Last weekend, leaders of the MRF attended the February NCOC meeting in St. Louis, Missouri. The MRF was represented by Kirk “Hardtail” Willard (MRF President), Fred Harrell (Director of Conference & Events), Russell Radke (Director of Sustaining Member Motorcycle Clubs), Seven Cassel (Membership Director) and Rocky Fox (Government Relations). Also in attendance was ABATE of Wisconsin Legislative Director, Steve Panten.

Four different presentations involved an MRF or ABATE member sharing their views on motorcycling and legislative action. Hardtail gave a presentation on the “The Future of Motorcycling in America.” Rocky spoke on the MRF’s recent victories on profiling in D.C. Seven discussed how best to unite independents and MCs. Steve gave a case study on a recent summit held in Wisconsin between ABATE and motorcycle clubs in the state.

The weekend was filled with lively debate and great questions. The MRF thanks the NCOC and the club community for their hospitality and willingness to work together on issues we all care about.
