Wild storm hit the California Coast last night and took out the power to the vast Bikernet generators. We’ve been down all morning. I’ll jump right on the news, but here’s a couple of tidbits. Advanstar, the promoter behind the Indy dealer show tried to head off the Easyriders V-Twin dealer show in Cincy with a Las Vegas effort, January 23 to 25th. It fell on it’s face and was canceled, but they’re not giving up. Their new Vegas effort is scheduled for November 21. We’ll see what happens next.

I ran across an ad for a cool rigid roller kit for three grand from Tedd’s Cycle. It’s a single loop frame. E-mail teddcycle@aol.com for more info and put in a good word for Bikernet.

DAYTONA BIKE WEEK UPDATE–As Daytona Bike Week quickly approaches, the list of complaints grows and grows. Yeah I know, the motels hit us hard at bike week, the rooms start at about a $150 a night, not cheap, but if you want to play you gotta pay! Just a suggestion you can save money by sharing a room and that will cut it in half. You can also save money on food. Food vendors line Main Street and Beach Street and all the streets off of Main. Two people can usually eat for $15–$20, not bad. You can splurge on the high dollar restaurants once or twice during the week. I don’t like spending my time in the restaurants though, there is too much to do and see. The food the vendors provide is top quality food, more than just burgers and hot dogs . The best food on Main Street is a vendor in the Full Moon saloon parking lot selling pork chops. They cost (I paid $17 for one last year), but they are huge, more than enough for two people. So maybe you can offset the cost of the rooms with some savings on the food.

The next thing everyone complains about are the COPs. They can be a pain in the ass, that is for sure. I’ve attended bike week since 1988 and got one ticket, speeding and it cost me $125. I was trying to out run a thunderstorm and got popped by the radar gun. I was polite and didn’t get an attitude and that was that. Did I like paying the fine? No!

The guy had me red handed and there was no sense in making things worse by mouthing off. So there’s my advice, present your paper work and take your medicine. It is better than spending Bike Week in jail and still having to pay for the motel room. It seems every year they have a point of emphasis, high handlebars, blue dot taillight lenses and no dark glasses at night (which is common sense), and the list goes on. It is part of bike week. Be cool while you are there and you won’t have problems with the man. If you choose to argue, don’t. You’re going to lose the argument and get a free stay at the gray-bar motel. Chalk it up to experience and let it go and enjoy the rest of your stay.

Another complaint I always hear is how big the crowds are and that you can’t ride. Well what kind of Bike Week would it be if only say a thousand bikes and a thousand bikers showed up? Man that would be fun! To me one of the best things about Bike Week is seeing all the bikes and all the people. The part about you can’t ride is not true. You can head out of town to ride to places such as Orlando and St. Augustine to name a few. It really is about what you like to do and how bad you want to do it. Most who complain about the crowds and not being able to ride , belong to the “Pissing and Moaning Club About Everything.” Daytona really is about what you make it. It isn’t perfect, but what really is?

One of the great things about Daytona Bike week is that all of the industry’s vendors and all the top bike builders show up to show off their new products and their new creations. For me this is the best part of bike week, seeing things that you normally only read about. Even if you hit some bad weather while at bike week, the worst day there beats the best day at home, especially if you have been snowed in all winter.

Daytona has always been for me a ringing of the bell to signal the beginning of the riding season and that spring is near after a long winter. Yeah it costs you some bucks to go, but the memories I have from past bike weeks are priceless! On down the road in the later years of my life, I would rather have the memories that the money paid for! You can’t put a price tag on that.

Oh by the way “THE MEANEST” and I look forward to seeing your son and my cousin Jose in Daytona. I hope he sheds some light on his ideas for the 6th Annual Run For Breath “In Memory of Justin Pullin” awards he is going to do. I have heard he is going to try and rival Mr. Bandit’s creation this year? We will see!. I hope to see you all in Daytona, ride safe and enjoy the sun!

Looks like you have all weekend to try to get at leastone fence sitter over to our side. Senator Harrison said he won’t fight itbut didn’t think he would vote for it.

Missouri needs our help

I got an e-mail from a buddy in Missouri…and he’s asking for our help. Onceagain, the enemies of bikers are using all kinds of statistics…includingthat people going to Sturgis and other places on vacation ride THROUGHMissouri WITH their helmets on. I would like to see everyone send e-mails tothe following legislators on the House Transportation Committee (who couldbe voting on the helmet revision in a few days) – explaining how they asfreedom loving bikers do not and will not travel through Missouri and spendout tons of vacation money until the helmet law is repealed.

REMEMBER…be cordial, be nice, get to the point and thank them forlistening. Missouri is NOT our state and we sure don’t want to piss them offand get on them mad at FORR. But we do want them to understand that they AREloosing tourism dollars by maintaining their archaic mandatory helmet law.

John Silk asked me to get in touch with you about money spent on out ofstate rides. I asked fifty (50) riders to send me there receipts for a outof state week-end ride. They spent $12,938.50, which comes out to $258.75each. This may not be to scientific, but it does say that bikers do spendmoney and will spend it at the out of the way places that need the money themost. ONE: Recently, when I went to McDonald’s, I saw on the menu that you could have an order of 6, 9 or 12 Chicken McNuggets. I asked for a half dozen nuggets. “We don’t have half dozen nuggets,” said the teenager at the counter.

“You don’t?” I replied. “We only have six, nine, or twelve,” was the reply. “So I can’t order a half dozen nuggets, but I can order six?” “That’s right.” So I shook my head and ordered six McNuggets.

TWO: The paragraph above doesn’t amaze me because of what happened a couple of months ago. I was checking out at the local Foodland with just few items, and the lady behind me put her things on the belt close to mine, picked up one of those “dividers” that they keep by the cash register and placed it between our things so they wouldn’t get mixed.

After the girl had scanned all of my items, she picked up the “divider,” looking it all over for the bar code so she could scan it. Not finding the bar code, she said to me, “Do you know how much this is?”

I said to her “I’ve changed my mind, I don’t think I’ll buy that today.” She said “OK” and I paid her for the things and left. She had no clue to what had just happened.

THREE: A lady at work was seen putting a credit card into her floppy drive and pulling it out very quickly. When inquired as to what she was doing, she said she was shopping on the Internet and they kept asking for a credit card number, so she was using the ATM “thingy.”

FOUR: I recently saw a distraught young lady weeping beside her car.

“Do you need some help?” I asked.

She replied, “I knew I should have replaced the battery to this remote door unlocker. Now I can’t get into my car. Do you think they (pointing to a distant convenient store) would have a battery to fit this?”

“Hmmm, I dunno. Do you have an alarm too?” I asked.

“No, just this remote thingy,” she answered, handing it and the car keys to me. As I took the key and manually unlocked the door, I replied, “Why don’t you drive over there and check about the batteries. It’s a long walk.”

BIKERNET HISTORY LESSON– The US standard railroad gauge (distance between the rails) is 4 feet, 8.5 inches. That’s an exceedingly odd number.

Why was that gauge used? Because that’s the way they built them in England, and English expatriates built the US Railroads.

Why did the English build them like that? Because the first rail lines were built by the same people who built the pre-railroad tramways, and that’s the gauge they used.

Why did “they” use that gauge then? Because the people who built the tramways used the same jigs and tools that they used for building wagons, which used that wheel spacing.

Okay! Why did the wagons have that particular odd wheel spacing? Well, if they tried to use any other spacing, the wagon wheels would break on some of the old, long distance roads in England, because that’s the spacing of the wheel ruts.

So who built those old rutted roads? Imperial Rome built the first long distance roads in Europe (and England) for their legions. The roads have been used ever since.

And the ruts in the roads? Roman war chariots formed the initial ruts,

which everyone else had to match for fear of destroying their wagon wheels. Since the chariots were made for Imperial Rome, they were all alike in the matter of wheel spacing.

The United States standard railroad gauge of 4 feet, 8.5 inches is derived from the original specifications for an Imperial Roman war chariot. And bureaucracies live forever. So the next time you are handed a spec and told we have always done it that way and wonder what horse’s ass came up with that, you may be exactly right, because the Imperial Roman war chariots were made just wide enough to accommodate the back ends of two war horses.

Now the twist to the story…

When you see a Space Shuttle sitting on its launch pad, there are two big booster rockets attached to the sides of the main fuel tank. These are solid rocket boosters, or SRBs. The SRBs are made by Morton-Thiokol at their factory in Utah.

The engineers who designed the SRBs would have preferred to make them a bit fatter, but the SRBs had to be shipped by train from the factory to the launch site. The railroad line from the factory happens to run through a tunnel in the mountains. The SRBs had to fit through that tunnel. The tunnel is slightly wider than the railroad track and the railroad track, as you now know, is about as wide as two horses’ behinds.

So, a major Space Shuttle design feature of what is arguably the world’s most advanced transportation system was determined over two thousand years ago by the width of a horse’s butt.

ROGUE BAD COP FILES– Cop among 4 arrested in parking lot brawl Massachusetts – Closing time at a local bar over the weekend erupted into a parking-lot melee, ending with the arrest of four people, including an off-duty Westwood cop who has been placed on administrative leave.

Police from six area towns responded when the fights erupted at the American Athletic Club early Saturday morning.

Detail officers working at the AAC called for outside help just before 2 a.m., after employees tried to break up a fist fight on the dance floor between Ricky Tomasello, 28, of Canton and another man, police said.

The parking lot outside the East Main Street bar was even worse, detail officers said.

“The parking lot crowd was out of control,” Sgt. David Sacco said in a police report. “I estimate, at one point, at least 25-30 people were involved in some kind of physical altercation.”

Inside, Tomasello and an unidentified man — for whom police are now seeking an arrest warrant — parted as the crowd moved toward the door, police said, only for the other man to fight with a man identified as Westwood Police Officer Ryan McCarthy.

CLUB TRIAL FALLING APART–A major Winnipeg trial involving members and associates of the Hells Angels could be in jeopardy.

This after a bombshell letter from the province’s top crown attorney questioning tactics and conduct of Winnipeg police officers when dealing with informants.

The prosecutor goes as far as to suggest the officers may have committed criminal acts.

Jay Prober is one of the defense lawyers in the case.”We want to know how long the crown has had this information. We want to know how many police officers are involved. We want to know who the police officers are,” says Prober. “We would like to know what is the misconduct that constitutes unethical conduct, breach of police internal policy, breach of the charter and may be criminal in nature.”

The five men accused in the case have been behind bars for almost two years.

BUILD-OFF IN HAWAII A MAJOR SUCCESS– We’re back from Honolulu where Arlen and Corey Ness led 1000 bikers around Oahu to the Hard Rock Cafe for the contest. Led by a 450 pound Polynesian biker carrying the BBO trophy high, Lei bedecked Arlen and Corey astride their super choppers thundered to the podium. I opened the sealed envelope in which was the tally of the votes cast by the thousands who’d attended the event and presented the trophy to Corey Ness. It was a fantastically successful event…thanks to the work of your buds, Deacon and Chris.

DAYTONA ALERT–3RD POLICE SHOOTING THIS YEAR–PALM BAY — Agents from the Florida Department of Law Enforcement are investigating a Tuesday evening incident in which Palm Bay police shot and wounded a man.

It was the third police shooting in Brevard County this year: One each also took place in Melbourne and West Melbourne. One suspect has been killed.

DAYTONA DEBATES BAR HOURS– DAYTONA BEACH — Members of the public can tell the City Commission tonight whether the city should allow the sale of alcohol at bars, nightclubs and restaurants after 2 a.m.In a preliminary 4-3 vote two weeks ago, commissioners agreed to stop alcohol sales one hour earlier than the current 3 a.m. limit, with some exceptions.Extended sales would be allowed for New Year’s Eve, July 4, Labor Day, Speed Weeks, Bike Week and Biketoberfest.

Alcohol sales are prohibited after 2 a.m. in other Volusia County cities, although the county has similar exceptions for sales until 3 a.m. on special events and holidays.

STURGIS MAIN STREET 1984–A reader from S&C sent this shot of Sturgis just 20 years ago.

MEMBERS FOUND DEAD–Three members of the Hells Angels motorcycle club Nomads have been found dead in a stream in the southern Dutch town of Echt. The victims had reportedly suffered multiple gunshot wounds, but police on Monday dismissed concerns of a gang war.

The male victims have been identified as 54-year-old P. de V. from Geleen, 34-year-old S. W. from Nieuwstadt and the 33-year-old C. P. from Geldrop. The oldest victim was the president of the Oirsbeek-based Nomads.

Police said on Monday the deaths did not indicate a gang war had started, but admitted a motive for the murders was not yet known. No revenge actions were expected and police have not increased surveillance of the Hells Angels group.

Despite this, German police are monitoring two clubhouses in Viersen and Willich, news agency ANP reported over the weekend.

They were last seen at about 8.30pm on 11 February in front of the Nomads clubhouse. Family members reported two of the victims as missing last Friday morning. The first body was found at about 10am on Friday and the other two were discovered on Friday night.

The men are expected to be buried in the Nomads grave in the southern city of Sittard. The funeral will be held on Wednesday and Hells Angels members from across the globe are expected to attend.

BAD COP INVESTIGATION CONTINUES– Ex-Fed gets 12 years for molesting 6-yr-old girl Texas – A retired FBI agent with a history of molesting children was sentenced Thursday to 12 years in prison for repeatedly sexually abusing a 6-year-old girl in 2002 at his Southlake home.

John H. Conditt Jr., 53, pleaded guilty to aggravated sexual assault of a child in October. His punishment came after a four-month pre-sentencing investigation.

Under cross-examination Thursday morning, Conditt testified that he may have molested the girl, whom he knew, more than 10 times before she told her father and Child Protective Services about it. Her father and mother are also FBI agents.

TWO SAUDI’S MOVED TO AMERICA– Two Saudi’s moved to America with their families. One moved to New York, and the other moved to Level Plains, Alabama.

While they were beingprocessed at immigration, they made a pact that one year from their arrival date they would meet and see which one best assimilated into the American culture.

One year later, they met for breakfast in Atlanta. The first man said, “Well my friend, my son plays in the Little League, my wife is a Girl Scout leader, my daughter is a cheerleader at her high school, and I ate a Big Mac for lunch yesterday.”

Here are some pic of John’s belt drive. The S&S Sportster will also be sporting a EMC Super Charger. It mounts on the left side. Shifting linkage is internal and mounts to the forward controls. Very clean and very cool.

“Wow Bob, looks like you guys had a hell of a party last night.” The Mailman comments.

Bob, in obvious pain, replies, “Actually we had it Saturday night, this is the first I have felt like moving since 4 am Sunday morning. We had about fifteen couples from around the neighborhood over for the party and got a bit wild. Hell, we even got so drunk that around midnight we started playing WHO AM I.”

The Mailman thinks a moment and says, ” How do you play that?”

Bob continues between hung over gasps, “Well, all the guys go in the bedroom ! and we come out one at a time with a sheet covering us and only our “units” showing through a hole in the sheet. Then the women try to guess who it is.”

The Mailman laughs and says, “Damn, I’m sorry I missed that.”

“Probably a good thing you did,” Bob responds, “your name was guessed four or five times.”

RIGHT-OF-WAY (ROW) LAWS IN DEMAND–I cannot believe what I have read. A man, Gary Lee Butler kills people, and permanently injures others by loosing control of his vehicle and he has to pay less that $200.00 in fines, and that is all!?! Either the attorney for the victims was asleep at the wheel, or the attorney for the accused was that good. Either way, can this be related to motorcycles?

The fact that the victims were on motorcycles, should have nothing to do with the outcome of this situation. I cannot realize how a person can take the life of another through negligence, and not have to do time. Not to mention the families of those who were killed. I tell you, that if someone killed my wife or son like this, and the justice system let then walk, they wouldn’t be walking on this earth for long!

I can’t believe this story isn’t bigger than it is! If I didn’t read bikernet, I’d never know about it. Do you really believe that this is related to the victims being on motorcycles?

THE STEALTH REPORT–This past Saturday, Valentine’s day (2-14-04), we held our annual Valentine’s Day event at the shop. There was food, music, a hot lips contest and a poker run, the usual event day happenings. As the day unfolded I watched from a distance at a mini view of our society. You see we had our local generic HOG club, two nationally known clubs, one of those being a one percenter club. There were newbies, rubs, and long time riders. At first each group stayed with their own, sort of feeling things out. As the day wore on and everyone got more comfortable with each other, everyone mingled together and if wasn’t for colors on their backs, you couldn’t tell who was who.

As I thought about this for a while, I tried to think what these people had in common, very little I suppose. There were people from all walks of life, with different incomes and different races. It seemed as though all of the differences had faded out of sight for a short time. The only thing these people had in common was riding motorcycles, in this case Harley-Davidson motorcycles. As to whether or not you are a H-D fan, you have to admit they are doing something right to have survived now for over 100 years. I don’t agree with everything they do, but there is nothing that draws people together like the motorcycles that roll out of Milwaukee.

On this day I saw people who would normally not associate with each other shake hands and wish each other well. On this day people didn’t see colors, color of skin, or income level, they saw each other as a fellow rider, even if some of them were as green as apples. The last event of the day was a 50/50 raffle and a one percenter won it and guess what! The HOG club congratulated him along with everyone else there.

I thought and wondered how it would be if the leaders of countries all rode bikes and attended an event like this once a year and forgot about boundaries and all the political crap they usually fight over and put it all aside, how the world as a whole would be a better place.

I am sure most of our readers remember a song by John Lennon called “Imagine.” If I’m not mistaken that is the title. The song pretty much summed up the day.

I know a day like this is not realistic every day, but it was nice to see for one day, no differences, no conflicts, just talking bikes and talking about the upcoming rides of the season to come, Daytona,Laconia, Sturgis, and the one I am personally proud of, the 6th Annual Run For Breath “In Memory of Justin Pullin.”

The Florida Department of Highway Safety and Motor Vehicles say 69,551 people were arrested in 2002. The last year I could find records for. Just Do Your Math. Some One Is Making A lot of Bucks Here. That does not count how they have hurt people by refusing to let them drive and earn a living.

BIKERNET CARIBBEAN REPORT–Yeap I’m as lost as bat in a baseball stadium. I have totally lost track of time, dates and all the regulated shit that divides our life. All I know is that it’s time to ship everything across the Atlantic to the Daytona shores. The builds have been headache after headache and just when we thought it was almost done, some wicked-evil shit lurks.

Which reminds me; I really fucking hate when other mechanics do a shit job, leave it there and when it’s time to work on a bike, you are surprised by their incompetence. I tend not to take work when someone else did it before, and I really hate doing it, but sometimes you get fooled. I always leave everything to do my new chops for Daytona, this time I left my stuff to work on customer?s chops that are going to the US. We have been trying, but it’s not easy. We are still trying to get the new place together, and the fucking clock is ticking in a crank stupor. I swear I’ve never seen that fucker turn around so fast. Well, what’s done is done and what not is not, there’s nothing we can do.

This week we even took two precious days out of our busy schedule to participate in the largest car show in the Caribbean, if not Latin America. We brought our bikes as a display for a local cleaning products company called Angel Guard. We were the only ones with custom bikes there, amid a sea of old cars and dealers trying to sell the latest four wheeled fantasies. I had a really good time walking down aisle after aisle of classic cars and we even managed to score a 63′ Impala for Wicho. I wish I had more moola to spend and more time; there were some sweet deals. The show claimed to have over 100 thousand in attendance during the two days, which is pretty impressive, if not almost unbelievable.

I tell you I can’t wait to get out of here and head to the Hawaiian shores. I want to see my friends over there and do nothing but surf & hang out, and I really don’t want to wait ’til July 4th to do so.

DAYTONA DUI WARNING–Florida is Aggresively pushing a new program, “You Drink You Drive You Loose”. Directives came out of Tallahassee to law enforcement to get on board with this.

It is a election year and the state wants to look like it is doing everything to protect its people and also at the same time make the Mothers Against Drunk Drivers happy.

I think it is more a Money Maker than any thing else. Look at the amount of people ticketed the multiply that by $16,000 per person (Average what it costs a person Charged with a DUI according to one of the courses Counterattack) I am putting some more together and also looking how motorcyclist fit into this picture.

WHY DO YOU THINK COPS AND LAWYERS REFUSE TO BLOW? OKAY, OKAY I know you are going to say because They Suck! But in all reality it may be because they know machines can be programmed, malfunction, misread etc. OF COURSE THE OPTION IS TO MAKE SURE THE COP TAKES YOU TO THE HOSPITAL FOR A BLOOD TEST. The hospital in most cases does not care one way or the other. They will do the test fairly and with out prejudice. After all they are not adding another notch to their belt for busting a drunk driver.

If the cop will Not Take You To The Hospital you can Bet Your Ass he knows you are really Not DUI and wants the bust any way. So It Will Look Good On His Record or for some other reason like they did not like your attitude or you are a BIKER!

The refusal is BullShit and a tool some times misused by arresting officers. There are numerous reports that people have requested Blood Tests in lieu of Breath Tests which is legal under the law. Yet the arresting officer will refuse to take the accused to a hospital and write on his report the accused refused the breath test and leave out the part about them requesting a Blood Test. This results in the accused loosing their license through a Motor Vehicle Administrative Hearing for failure to submit.

In many cases the accused wins their court case but still have lost their drivers license.

This is not justice in my eyes. It is the only offense where Double Jeopardy applies to my knowledge. You can kill some one and be found not guilty and even though you did it not be retried.

In the case of the Motor Vehicle Department who Claims That Driving or Riding is a Privilege, You can loose your Right To Drive because a Cop Said. BULLSHIT JUST IN CASE YOU DID NOT KNOW ? SOME ? COPS DO LIE AND EVEN PLANT EVIDENCE ON SUSPECTS. Granted This is Not Fair To All The Good Cops Out There BUT IT IS UP TO THEM TO CLEAN THEIR OWN DIRTY LAUNDRY. DAYTONA DUI STATS–For some, it’s easy: Just don’t blow it.

More people arrested for drunken driving in Florida are refusing to take the alcohol breath test, fearing it’s a piece of evidence that could clinch a DUI conviction.

Some attorneys say refusing to take a breathalyzer can give drunken drivers a slim advantage against a DUI charge, but it can also work against them.

In 2002, almost a third of the 69,551 people who were charged with DUI snubbed the alcohol breath test, according to the state Department of Highway Safety and Motor Vehicles. Refusals to take the alcohol breath test climbed statewide between 1998 and 2002, the latest year in which statistics are available from the state’s drivers license division.

“People want to provide as little evidence to the state as possible,” said Volusia County Judge Freddie J. Worthen, who hears DUI cases routinely in Daytona Beach.

“The breathalyzer is evidence.”

While some police officers said privately they would never submit to an alcohol breath test, others pointed to the penalties for refusing the test and say a defendant’s best bet is to take a deep breath and blow.

That advice seemed to be lost on Ponce Inlet Police Chief Steve Thomas and former Daytona Beach police Detective Minokah Lipps. Each was arrested on a DUI charge and both refused the breathalyzer. The charges against Thomas were dropped, and Lipps pleaded no contest to a reduced charge of reckless driving. However, as a result of her arrest last September, Lipps was fired Friday by Daytona Beach police.

“The bottom line? Take the test,” said well-known DUI defense attorney Flem Whited, who represented Thomas and Lipps. “I always tell my clients that if they have refused the breath test, I hope they have someone to drive them around.”

But the alcohol breath test is not mandatory, according to state law.

In 2002, 19,669 of the 69,551 people arrested for DUI in Florida rejected the test. In Volusia County, 922 of the 2,853 people charged with drunken driving refused it. Comparable figures for Flagler County were not available.

The first time a motorist refuses the alcohol breath test, his license is automatically suspended for one year; the second time, it’s lost for 18 months and the driver is charged with a misdemeanor.

Many motorists believe those sanctions are better than being convicted of a DUI, and they’re willing to gamble that a judge will reinstate their license after a review.

Whited said roughly 75 percent of the 400 people he defends on DUI charges annually have not taken the alcohol breath test.

COMMON MISCONCEPTIONS

One common misconception surrounding the alcohol breath test is if one submits to it and indicates an alcohol level over the limit, a DUI conviction is assured.

When Ponce Inlet Police Chief Thomas was stopped on Herbert Street in Port Orange in January 2002 by a patrol officer who suspected the chief was driving drunk, Thomas refused to take the alcohol breath test. In a report provided by Port Orange, Thomas was quoted as telling the arresting officer: “If I blow, I will be over the .08.” That’s the legal blood alcohol threshold for drivers in Florida.

The DUI charge against Thomas was dropped because a judge ruled that the stop made by Port Orange police was unlawful.

Statistically, refusing to take the test appears to give drivers a narrow advantage in the overall conviction rate.

Of the 35,619 DUI defendants who took the alcohol breath test in Florida in 2002, about 69 percent — 24,672 — were convicted; of the 19,669 motorists who refused, about 57 percent — 11,296 — were convicted.

The remaining 14,263 motorists who received citations for drunken driving in 2002 were charged based on other factors, said Robert Sanchez, a spokesman for Division of Highway Safety and Motor Vehicles.

County Judge Worthen said he has seen several defendants who had submitted to alcohol breath testing cleared of DUI charges. That’s because their attorneys were armed with good video of the arrest scene.

“If a defendant does very well on the video, the jury tends to discount the breathalyzer test,” Worthen said.

First Assistant State Attorney David Smith agreed, saying jurors are easily convinced by visuals.

“The video overrides the breathalyzer,” Smith said. “If a person looks good on video, the fork is in us (the prosecution). When you’ve got walking and talking on video, it’s hard to sway jurors from that.”

Former Daytona Beach Detective Lipps was arrested and charged with DUI in Ormond Beach this past September. Lipps, who was once honored by Mothers Against Drunk Driving for making 23 DUI arrests in one month, refused to take the alcohol breath test — but like the others, her video proved persuasive.

Because of a blunder at the state agency that reviews the driving records of motorists who refuse the alcohol breath test, Lipps’ license was reinstated. Then prosecutors dropped DUI charges and agreed to a reduced charge after they viewed the video of her arrest.

“She did not look impaired in the video,” said Linda Pruitt, a spokeswoman for the State Attorney’s Office.

Attorneys like Whited are also adept at pointing out the weaknesses inherent in the alcohol breath test, such as poor servicing of a machine, inaccurate readings and inadequacy on the part of the machine’s operator.

“We can argue that any number is incorrect,” Whited said. “It doesn’t scare me. We can argue about a lot of things — the machine is old. It hasn’t been serviced.”

And drivers are not always as drunk as they think they are and taking the alcohol breath test could sometimes work in their favor, said Daytona Beach police spokesman Sgt. Al Tolley.”Some people may feel very drunk, but when they blow, the level of alcohol in their system could be lower than they think it is,” Tolley said. “How does anyone really know when they’re at the limit?

LEGISLATIVE MOVES

While examples such as Thomas and Lipps frustrate MADD officials, executive director Andy Hindmann said he’s counting on stiffer penalties instituted by the Legislature in 2002 to punish those who refuse to take the alcohol breath test.

The law states that anyone who refuses to take a breath test after being arrested for DUI a second time will automatically lose his or her license for 18 months and be charged with a misdemeanor.

The option of taking the alcohol breath test won’t exist for some motorists, though.

MADD officials are hailing a state law that took effect Feb. 1. The statute requires drivers convicted of DUI a second time to equip their vehicles with breath devices linked to the ignition. The device keeps the car engine from starting if the driver’s blood alcohol reading is higher than .05.

As far as MADD is concerned, Hindmann said, the organization frowns on anyone refusing to take the alcohol breath test.

“It doesn’t matter if the person is a cop, or a judge, or anything else,” Hindmann said. “A drunk driver is a drunk driver.”

CONFLICTS CANCEL BIKE WEEK PARADE–DAYTONA BEACH — Bike Week officials released a plan Thursday to cancel the Harley-Davidson parade that has been a tradition on the last day of the event.

Historically, the parade would begin each year at the Bellair Plaza on Atlantic Avenue and travel to an area known as Harley Heaven near Daytona International Speedway.

The Daytona 200 by Aria has also been held in recent years on the last Sunday of Bike Week, but this year the motorcycle race is scheduled for the last Saturday of the event. Bike Week runs from Feb. 27 to March 7.

Daytona Beach Harley-Davidson pulled out as parade sponsor rather than continuing without a race on the same day. The business usually supplies about $5,000 to the city for police and traffic services during the parade.

Kevin Kilian, vice president for special events at The Chamber, Daytona Beach/Halifax Area, said organizers were unable to reschedule the parade for the last Saturday of Bike Week.

“The police can’t staff it (Saturday) because that’s the busiest day of the week,” he said. “Without the police, it can’t be done.”

Participation in the parade has fallen off in recent years as the final Sunday of Bike Week has become more of a travel day, Kilian said

The Bike Week Festival Task Force, a city advisory board in charge of staging the parade, plans to look at bringing the parade back next year.

RIGHT-OF-WAY LAWS NEEDED IN FLORIDA– DAYTONA BEACH — A man was killed Friday night when his motorcycle ran into a sport utility vehicle that turned in front of him on South Nova Road, police said.

The motorcyclist, whose identity was being withheld until family members can be notified, was southbound on Nova Road at 8:59 p.m. when the accident occurred, said police Sgt. R.C. Rhoulhac.

As the motorcyclist approached the intersection of Forest Glen Boulevard, the SUV, which was northbound on Nova Road, turned into his path, Rhoulhac said.

“It appears the SUV made a left turn onto Forest Glen Boulevard and the motorcycle hit the tail end of the vehicle,” Rhoulhac said.

The impact from the racing-style motorcycle spun the SUV, driven by 19-year-old Amanda Frier of Lakeland.

The motorcyclist, who was wearing a helmet, died at the scene, Rhoulhac said. Charges, if any, are pending an investigation.

DAYTONA BAD COPS CLEARED– A six-month state investigation has cleared several Daytona Beach police officers accused by fellow officers of extorting money from drug dealers, stealing cash from a convenience store murder scene and paying prostitutes for sex with crack cocaine.

Two Daytona Beach police officers and one defense attorney relayed most of the accusations to State Attorney John Tanner’s office last spring, and Tanner passed on the information to the Florida Department of Law Enforcement in August. But FDLE agents were not able to find proof of the allegations that would hold up in court, said Dave Donaway, FDLE’s chief of investigations for the Orlando region.

“It’s easy to make allegations,” Donaway said. “It’s a different story to try to prove them.”

No Daytona Beach officers will be charged, the prosecutor who reviewed the case announced Feb. 2. Because of that, The News-Journal will not publish the names of the officers who were investigated.

SENATE APPROVES SAFE-TEA, AWAITS HOUSE ACTION Despite the threat of President Bush’s first veto since taking office, the U.S. Senate voted 76-21 on February 12, 2004, to pass S. 1072, a six-year $318 billion transportation bill to fund highway, mass transit and safety programs.??

The Senate rejected, by 56-42, an amendment to the Safe, Accountable, Flexible, and Efficient Transportation Equity Act (SAFE-TEA) that would have required states to enact primary enforcement seat belt laws or forfeit federal highway funds. The Senate measure also does not include motorcycle safety objectives proposed by Senator Lisa Murkowski of Alaska, though similar pro-motorcycle language will hopefully be amended into a version of the bill now making its way through the House of Representatives.

Once passed by the House, both versions of the bill will go to a conference committee to iron out any discrepancies between the two, and a final bill will be submitted to President Bush for his signature or veto. Bush has indicated that he would veto the legislation if costs exceeded $300 billion, and the White House has proposed an alternative $256 billion reauthorization package.?

EX-CONGRESSMAN JANKLOW JAILED FOR KILLING BIKER As South Dakota’s Attorney General he prosecuted criminals, and during his four terms as governor he built prisons?now former Congressman Bill Janklow will be spending time behind bars for an auto accident that killed a biker and likely ended a political career that spanned three decades.

On January 22, Janklow, 64, was sentenced to 100 days in jail and ordered to pay $10,400 in total fines after being found guilty on December 8 of second-degree manslaughter, speeding, reckless driving and running a stop sign, causing the collision that took the life of 55-year-old Minnesota motorcyclist Randy Scott at a rural intersection near Trent, S.D. on August 16, 2003.

South Dakota does not require minimum sentences, so Circuit Court Judge Rodney Steele was free to impose anything from no jail time and no fines to a total of 10 years in prison, 14 months in jail and $11,400 in fines.

Janklow’s resignation from Congress took effect two days prior to his sentencing date, and he began serving his time in the Minnehaha County Jail in Sioux Falls on February 7. After 30 days of incarceration, Janklow will be allowed to leave jail on a work release program during the day for up to 10 hours to perform community service. After he completes his jail term, he will be on probation for three years, during which he will not be allowed to drive. Janklow also received a suspended imposition of sentence, which means if he completes his jail time and a term of probation the felony conviction will be removed from his record.

The former Republican congressman plans to read while in jail and will probably do some work preparing to defend himself against a wrongful death lawsuit filed by Scott’s family.

ROW, ROW, ROW Even before the tragic death of motorcyclist Randy Scott at the hands of lead-footed Congressman Bill Janklow, many states began pushing for stricter sentencing guidelines for drivers convicted of felonious acts resulting in the death or severe injury of a motorcyclist or pedestrian. Known as right-of-way laws (ROW), motorcyclists’ rights organizations are sponsoring such legislation across the country to put offenders behind bars and get the public to pay more attention to riders on the roadways.

A great idea recently surfaced in North Carolina, where Concerned Bikers Association (CBA) Legislative Director Sam Nobles is putting together a unique lobbying tool — a leather riding vest made solely of “In Memory Of” patches to help make a statement about their ROW bill when he testifies before the state legislature!

“This year when our Legislature takes up the Right of Way Bill, they will get to see for themselves what their failure to pass the bill has cost us,” said “Cotton” Tedder, CBA President and member of the National Coalition of Motorcyclists (NCOM) board of directors.

“I want it covered with names as a tribute to all of the brothers and sisters we have lost,” explains Nobles. “I’ve still got a lot of leather left to cover, so if you have a memory patch that you would like included, please send it in. They don’t need to have died on their bike, and they do not even have to be from North Carolina. The vest is symbolic — the names are to show just how many of us have been lost. It will make a dramatic statement to all the legislators who see it.”

And the CBA is willing to share their memorial vest with those in other states who are lobbying for increased penalties against right-of-way violators.

“This is a way to have your lost brothers and sisters remembered one more time, in a setting where they can indirectly contribute to our cause,” said Nobles.

RIDING ABREAST Only a handful of states prohibit motorcyclists from riding two abreast, but in Wyoming it’s even illegal for two motorcycles to stop side-by-side for a traffic light. That’s why State Representative Wayne H. Johnson of Cheyenne has introduced HB0024 at the request of ABATE of Wyoming to allow “no more than two (2) motorcycles to be operated abreast in a single lane by consent of each operator.”

In addition to removing statutory restrictions on lane sharing, HB0024 would also require a motorcyclist passing another motorcyclist in the same traffic lane to first match the speed of the motorcycle being overtaken.

FEELIN’ BLUE? South Dakota has joined a short list of states that allow motorcyclists to use “Blue Dot” taillights; so-called because a small blue plastic lens insert creates a purplish hue when the brake light is actuated. Riders argue that the after-market lighting device enhances safety through increased visibility.

The new law allows that “A motorcycle may display a blue light of up to one-inch diameter as part of the motorcycle’s rear brake light,” and it passed the House of Representatives by a vote of 69-1 on January 31, and the Senate 34-1 on February 9. Governor Michael Rounds signed HB 1151 into law on February 13, joining Minnesota, Nevada and Washington with similar laws on the books. Most states only allow blue lights on the rear of road maintenance and emergency vehicles.

Pennsylvania is currently pursuing such legislation through the introduction of HB 2133, by Representative Kerry A. Benninghoff of Bellefonte, which reads; “Auxiliary lighting may be added to a motorcycle to protect the driver, including blue dot illumination, standard bulb running lights and various colors of valve stem caps, light-emitting diode (LED) pods and strips, light wire, neon tubes and strobe lights.”

LET THERE BE LIGHTS Three new laws passed the Oregon legislature last year that will allow motorcyclists to become more visible to other highway users.

“Visibility is especially important for motorcyclists,” said Stan Porter, manager of Motorcycle Safety and Vehicle Safety Standards Programs for the Oregon Department of Transportation (ODOT).?

Effective January 1st, the three new changes are:

— Motorcyclists can now use three headlights on their motorcycles; whereas in the past, two was the maximum allowed.

— Motorcyclists will also be able to use auxiliary lights, either fog lights or driving lights, at all times if the auxiliary lights are no brighter than the headlight and the auxiliary lights are aimed correctly. All other vehicles in Oregon must turn off their auxiliary lights during times when the law requires drivers to dim their high beam headlights.

— Motorcyclists may use an intermittent pulsing or flashing brake light, as long as the flashing does not interfere with the rear turn signal function.

These new regulations were passed at the request of the Governor’s Advisory Committee on Motorcycle Safety, the Oregon State Police Motorcycle Unit, the TEAM OREGON Motorcycle Safety Program and by Oregon motorcyclists.

“All three of these new laws will allow the motorcyclist to be more easily seen by other highway users,” Porter said. “The addition of one more headlight and the use of auxiliary lights at all times will allow the motorcyclist to see better at night and during times of limited visibility. The flashing brake light will certainly gain the attention of those highway users behind motorcyclists.”

Porter added, “The Legislature was very supportive of enhancing the ability of motorcyclists to become more visible to other highway users. With the help of legislators that are motorcyclists themselves, these new options were passed and signed by Governor Ted Kulongoski.”

TEXAS COP FIRED FOR TACKLING MOTORCYCLIST A police officer who was videotaped tackling a motorcyclist off his bike after a high-speed chase has been sentenced to two years’ probation, fined $600 and ordered to undergo anger management counseling. A patrol car videotape of the Sept. 6 chase shows Garland police officer Glen Shaw running up to a seated Randall James Ling, then knocking him off his parked motorcycle before falling out of the camera’s view. Shaw, who along with two other officers was fired Jan. 14 after an investigation by the Texas Rangers, pleaded guilty to a misdemeanor assault charge. Shaw also permanently gave up his Texas peace officer’s license as part of the plea deal, Pat Batchelor of the Dallas County district attorney’s office told The Dallas Morning News. Garland Police Chief Mitch Bates said he hoped the firings would protect his department’s integrity. The two other officers, William Mott and Demarcus Banda, were fired for making “untruthful” reports about the case, Bates said. The motorcyclist, Ling, was indicted on a felony for fleeing authorities.

WEIRD NEWS: SUSPICIOUS BIKER JACKET SPARKS ALARM As the United States raised its terrorism threat level to orange alert, the second-highest of five color-coded levels of alert, a female passenger was removed from a Paris-to-Cincinnati flight just before take off from France because of suspicious looking wires poking out of her leather motorcycle jacket.

As it turned out, the biker jacket was designed to heat up like an electric blanket to keep the wearer warm while riding, said security officials, who later determined the woman was not a security threat.

However, as a precaution, Delta Flight 43 was kept about a mile away from the terminal at Cincinnati/Northern Kentucky International Airport after it landed in a secured cargo area used for Air Force One during presidential visits, and U.S. officials re-screened passengers and baggage.

Motorcycle Right Of Way Laws–The Randy Scott Law–A Country-Wide Update

Bikernet continues to follow Motorcycle Right-Of-Way laws throughout the country. If we can’t tell people to watch out for bikes, it’s about time we reminded them through legislative efforts as a tribute to all downed bikers in Randy Scott’s name. Here’s the lastest news:

NORTH CAROLINA–Sandy Lee, a member of the Brunswick County chapter of Concerned Bikers Association/ ABATE of NC was taken out by a left turner. How ironic that Sandy spent probably at least 3 or 4 days a month thispast legislative session at our state legislature supporting and following up with discussions on our Right of Way bill. We got that sucker through the house, through the senate committees, only to have it shot down by a long time problem senator. The very thing she fought so hard to improve, ended up being the way she left this world.

Sandy didn’t let the fact that her husband Ray’s bike was not running stop her from riding. He followed her, in the truck, as they made their way to breakfast Saturday morning to meet their kids.

Their son had just returned from Iraq, and she was real anxious to see him.

Sandy wasn’t afforded the opportunity. Some woman in a grand marquis turned left in front of her, actually cut across two lanes to do it. Sandy hither right front tire well at about 40 mph. By the time Ray got out of histruck and got to her, his wife of 40+ years was gone. The woman driving the car was charged with a right of way violation.

This leaves a huge hole. And the rippling effect is devastating as well. This chapter is facing pain coming and going over this. Sandy and Ray were dedicated to their beliefs. They joined the Brunswick Co. chapter when they learned how active politically and locally the membership was. Sandy and Ray lived in SOUTH CAROLINA, justover the state line from Brunswick Co.!!! In a helmet-free state. But they traveled in and out of NC so much, they had no problem stepping up to the plate and helping out a lot. The S.C. ABATE chapter that would have been their chapter, had they stayed with SC ABATE, would have been Horry Co. Chapter.

I tried to reach the chapter president, and other members who I know are close to Sandy tonight with no luck. Finally I did get one person and she left no doubt in my mind, just how hard the news was on them all, both from the standpoint of losing a friend, and HOW they lost someone very special.

Here’s to Sandy Lee, the kindest, most ladylike females to grace motorcycle, full of grit and loving life to the end.

THE ISSUE– Inattentive, distracted, careless or reckless vehicle operators violate the right-of-way of vulnerable roadway users such as motorcyclists, bicyclists, and pedestrians. The more common Right-of-Way violations are those that occur at intersections, stop or yield signs and vehicles turning left (in front of you). These operators are responsible for many near-miss and actual collisions that injure, maim, and kill thousands of people on the roads.

It’s a nationwide problem, and Colorado is no exception. Far too often in cases of right-of-way violations, the penalty issued is the same as “dinging” a car, an infraction or minor offense, that carries a small fine. It may also include a plea bargain to a lesser violation. The victims and their families are rightfully outraged and bitter.

In 2003, eleven state legislatures considered Right-Of-Way legislation. A number of bills were signed into law. Each bill sought penalty enhancements to complement existing laws, increasing accountability.

THE CURRENT GOAL– The time has come for us in Colorado to make a difference. We understand that the problem exists. The initial and necessary first component must be to document, catalogue, and archive individual case histories into a database. This will be the very foundation that establishes a compelling need change. The PEPCO Data Alliance has been created to assimilate and gather this information.

It is imperative that individuals, families, and their friends, who have been directly affected, supplement the effort by providing documentation.

YOU CAN HELP– We are asking for information covering the last decade. Anyone who rides motorcycles, bicycles, walks are at risk. We are coalition-building and encouraged input, skills and knowledge. This is an Alliance of The Future: We in Colorado, through our efforts, seek to achieve:

TEXAS–A BILL TO BE ENTITLED AN ACT,relating to the penalty for failure to yield theright-of-way.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OFTEXAS:

SECTION 1. Section 545.153, Transportation Code, is amended by adding Subsection (e) to read as follows:

(e) If it is shown on the trial of an offense under this section that as a result of the commission of the offense:

(1) a collision causing property damage occurred, the offense is a misdemeanor punishable by a fine of not more than $4,000, confinement in jail for a term not to exceed one year, or both the fine and the confinement; or

(2) a collision causing serious bodily injury or death occurred, the offense is a misdemeanor punishable by a fine of not more than $4,000 and confinement in jail for not less than 30 days and not more than one year.

SECTION 2. Section 11, Article 42.12, Code of Criminal Procedure, is amended by adding Subsection (n) to read as follows:

(n) A judge granting community supervision to a defendant convicted of an offense under Section 545.153, Transportation Code, shall require as a condition of community supervision that the defendant submit to not less than 30 days of confinement in jail if the offense resulted in serious bodily injury or death.

SECTION 3. (a) The change in law made by this Act applies only to an offense committed on or after the effective date of this Act. For purposes of this section, an offense is committed before the effective date of this Act if any element of the offense occurs before that date.

(b) An offense committed before the effective date of this Act is covered by the law in effect when the offense was committed, and the former law is continued in effect for that purpose.

SECTION 4. This Act takes effect September 1, 2003.

(B) THE FINES COLLECTED PURSUANT TO THIS SECTION SHALL BE EQUALLY DIVIDED BETWEEN THE MOTORCYCLE SAFETY FUND, ESTABLISHED BY SECTION NINETY-TWO-G OF THE STATE FINANCE LAW, FOR MOTORCYCLE RIDER TRAINING COORDINATING ORGANIZATIONS DESIGNATED UNDER SECTION FOUR HUNDRED TEN-A OF THIS CHAPTER AND THE COUNTY TRAFFIC SAFETY BOARD IN THE JURISDICTION WHERE THE VIOLATION OCCURRED; PROVIDED, THAT IF THERE IS NO COUNTY TRAFFIC SAFETY BOARD IN SUCH JURISDICTION, THEN TO THE LOCAL DEPARTMENT OF PUBLIC WORKS.

This act shall take effect on the first of November next succeeding the date on which it shall have become a law.

NORTH CAROLINA–A BILL TO BE ENTITLEDAN ACT TO PROVIDE PENALTIES FOR PERSONS WHO CAUSE INJURY OR DEATH WHEN FAILING TO YIELD THE RIGHT-OF-WAY UNDER CERTAIN CIRCUMSTANCES.

The General Assembly of North Carolina enacts: SECTION 1. Chapter 20 of the General Statutes isamended by adding a new section to read:”fl 20-160.1. Failure to yield causing injury or death; penalties. Notwithstanding any other provision of law, a personconvicted of failure to yield while approaching or entering anintersection, turning left at a stop or yield sign, entering aroadway, upon the approach of an emergency vehicle, or athighway construction or maintenance shall be punished in thefollowing manner, in addition to any other punishment:

(1) When there is no great bodily injury or death resulting from the violation, the violator shall be fined two hundred dollars ($200.00) and the violator’s drivers license or commercial drivers license shall be suspended for 30 days.

(2) When there is great bodily injury but no death resulting from the violation, the violator shall be fined five hundred dollars ($500.00) and the violator’s drivers license or commercial drivers license shall be suspended for 90 days.

When a death results from the violation, the violator shall be fined one thousand dollars ($1,000) and the violator’s drivers license or commercial drivers license shall be suspended for six months.”

SECTION 2. This act becomes effective December1, 2003, and applies to offenses committed on or after thatdate.

Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Section 304.351, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 304.351, to read as follows:

304.351. 1. The driver of a vehicle approaching an intersection shall yield the right-of-way to a vehicle which has entered the intersection from a different highway, provided, however, there is no form of traffic control at such intersection.

2. When two vehicles enter an intersection from different highways at approximately the same time, the driver of the vehicle on the left shall yield the right-of-way to the driver of the vehicle on the right. This subsection shall not apply to vehicles approaching each other from opposite directions when the driver of one of such vehicles is attempting to or is making a left turn.

3. The driver of a vehicle within an intersection intending to turn to the left shall yield the right-of-way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard.

4. (1) The state highways and transportation commission with reference to state highways and local authorities with reference to other highways under their jurisdiction may designate through highways and erect stop signs or yield signs at specified entrances thereto, or may designate any intersection as a stop intersection or as a yield intersection and erect stop signs or yield signs at one or more entrances to such intersection.

Preferential right-of-way at an intersection may be indicated by stop signs or yield signs as authorized in this section:

(a) Except when directed to proceed by a police officer or traffic-control signal, every driver of a vehicle approaching a stop intersection, indicated by a stop sign, shall stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection, or if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic in the intersecting roadway before entering the intersection. After having stopped, the driver shall yield the right-of-way to any vehicle which has entered the intersection from another highway or which is approaching so closely on the highway as to constitute an immediate hazard during the time when such driver is moving across or within the intersection.

(b) The driver of a vehicle approaching a yield sign shall in obedience to the sign slow down to a speed reasonable to the existing conditions and, if required for safety to stop, shall stop at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway. After slowing or stopping the driver shall yield the right-of-way to any vehicle in the intersection or approaching on another highway so closely as to constitute an immediate hazard during the time such traffic is moving across or within the intersection.

5. The driver of a vehicle about to enter or cross a highway from an alley, building or any private road or driveway shall yield the right-of-way to all vehicles approaching on the highway to be entered.

6. The driver of a vehicle intending to make a left turn into an alley, private road or driveway shall yield the right-of-way to any vehicle approaching from the opposite direction when the making of such left turn would create a traffic hazard.

7. The state highways and transportation commission or local authorities with respect to roads under their respective jurisdictions, on any section where construction or major maintenance operations are being effected, may fix a speed limit in such areas by posting of appropriate signs, and the operation of a motor vehicle in excess of such speed limit in the area so posted shall be deemed prima facie evidence of careless and imprudent driving and a violation of section 304.010.

8. Notwithstanding the provisions of section 304.361, violation of this section shall be deemed a class C misdemeanor.

9. In addition to the penalty specified in subsection 8 of this section any person who pleads guilty to or is found guilty of a violation of this section in which the offender is found to have caused physical injury, there shall be assessed a surcharge of up to two hundred dollars. The court may issue an order of suspension of such person’s driving privilege for a period of thirty days.

10. In addition to the penalty specified in subsection 8 of this section any person who pleads guilty to or is found guilty of a violation of this section in which the offender is found to have caused serious physical injury, there shall be assessed a surcharge of up to five hundred dollars. The court may issue an order of suspension of such person’s driving privilege for a period of ninety days.

11. In addition to the penalty specified in subsection 8 of this section any person who pleads guilty to or is found guilty of a violation of this section in which the offender is found to have caused a fatality, there shall be assessed a surcharge of up to one thousand dollars. The court may issue an order of suspension of such person’s driving privilege for a period of six months.

12. The surcharges imposed pursuant to subsections 9, 10, and 11 of this subsection shall be collected and distributed by the clerk of the court as provided in sections 488.010 to 488.020, RSMo. The surcharges collected pursuant to subsections 9, 10, and 11 of this section shall be credited to the motorcycle safety trust fund established under section 302.137, RSMo.

(c) Fatality.–A person whose violation of a right-of-way requirement listed in subsection (d) causes a fatality shall be fined $1,000 in addition to any other penalties; and the person’s driver’s license, commercial driver’s license or nonresident’s operating privilege shall be suspended for six 1 months.

(d) Right-of-way requirements.–Following are the right-of- way requirements referred to in subsections (a), (b) and (c): Subchapter B of Chapter 33 (relating to right-of-way).

Section 3112(a)(1) (i) and (ii) and (3)(ii) (relating to traffic-control signals). Section 3113(a)(1) and (3) (relating to pedestrian- control signals).

OHIO–Here in southwest Ohio, this past summer, we lost three brothers to people that don’t believe that motorcycles have the same rights as they do. In addition, another couple both lost their left legs to the same problem.

Here are the case outcomes A women crosses the yellow line, rips a man’s leg off. He dies. She gets community service and probation.

A young girl turns left in front of a biker, kills him. Charged with a misdemeanor.

An eighteen year old boy crosses the yellow line and runs into the middle of a pack of motorcycles. He kills one man and tears the left legs off of a man and women. Several others are hurt. He is charged with three misdemeanors. If he is found guilty of all three, he will be facing one year in jail.

I belong to ABATE and we work hard to change the laws but the state critters just won’t listen. From reading your newsletter, I see that my state isn’t the only one with this problem. What the hell are we going to do?

HOOKER MURDERS CUSTOMERS AT LAST RESORT BAR– It would be a stretch to say that The Last Resort biker bar and its gregarious, gray-bearded proprietor, Al Bulling, have gone Hollywood.

Truth is, the self-proclaimed ?world famous? drinking establishment Bulling opened on U.S. 1 nearly 25 years ago has lost none of its gritty, ramshackle ambiance.

It continues to cater to an unpretentious crowd, including throngs of motorcyclists who flocked there even before The Last Resort became known as the last hangout of notorious serial killer Aileen Wuornos ? the place where she was arrested on Jan. 9, 1991.

But after more than a decade of being in the semi-limelight ? descended upon by the media when Wuornos was executed in October 2002, and sought after for various projects, including a Japanese documentary that year ? Bulling and his bar have made it to the big time ? featured in the critically acclaimed movie ?Monster.?

Bulling, 63, plays a bartender in a nonspeaking role. The Last Resort plays itself. And Charlize Theron, a beautiful blond actress who never looked so bad or acted so good, according to the critics, plays Wuornos ? the hard-bitten, low-rent, highway prostitute who murdered seven middle-aged men before she was coerced into confessing by her female former lover.

Theron won a Golden Globe for her portrayal and is nominated for a best actress Oscar. The movie also was named one of the top 10 films of 2003 by the American Film Institute.

But Bulling, who considers the 28-year-old actress ?one hell of a lady? and a good friend, said he was most impressed with the way she captured the essence of The Last Resort?s most infamous regular.

?Charlize did such a great job,? said Bulling, who attended the New York premiere and after-theater party last month. ?In the movie it was Aileen, the way she smoked a cigarette, the whole attitude, it was Aileen,? he said on a recent afternoon.

He leaned against the pool table in the dark and smoky bar, where $15 souvenir Wuornos T-shirts and $5 bottles of ?Crazed Killer Hot Sauce? are on sale.

Of course, during the time Wuornos hung out at Bulling?s establishment, no one at the bar knew that the scruffy hooker was routinely killing her johns with a .22-caliber gun she kept in her purse.

She stayed in a cheap motel down the road when she had the money, and slept on an old car seat in back of The Last Resort when she didn?t, including the night before she was arrested. It was cold and ?you can?t put people on the street,? the proprietor said.

?She never propositioned anyone in the bar, and she paid for her own drinks,? adds Bulling, who?s kept the car seat at his house as a souvenir, and still has the bra Wuornos gave him to display along with all the other donated women?s undergarments that decorated his business until recently. Held together with safety pins and a Band-Aid, he now keeps it in a dated plastic Ziploc bag.

?Probably one-quarter (of the movie) is The Last Resort,? estimates Bulling, who first met Theron and writer-director Patty Jenkins when they spent several days at his bar in December 2002 to get a feel for the place. They and a film crew came back in February. The rest of the movie was shot in other parts of Florida, including the courthouse in Sanford.

And there?s also a scene focusing on the ?Welcome to Daytona Beach? sign on the International Speedway Boulevard overpass, according to Bulling. But don?t expect a flattering travelogue. ?The Last Resort is an institution. … It has its reputation and its followers, and (the movie) probably will draw a few more,? he said. ?I?m not sure it has anything to do with why people come to visit or live in your community.?

BIKERNET CARIBBEAN REPORT– Hey guys, another week goes by and even closer to Daytona Bike Week, so hell’s heat is full on.As you might know, or not, the Discovery Channel Biker Build off’s are full on, two of them are already done. I know this might spoil a bit of the surprise at the end but I’m between my duty as the one that brings the latest news and “ruining the end of the movie”. So I have decided to let the cat out. Chica and Hank Young went against each other in a ride to the Louisville Kentucky Easyriders Show. I respect both builders (and friends) a lot so I was kind of disappointed when I found out they were going against each other, knowing that only one of them can be victorious and both building kick ass chops in the old school way. It was going to be tough. The people chose Chica’s bike over Hanks. I bet it was a hard decision to make since both were really cool bikes.

At the same time, Russel from Exile Cycles and Eddie Trotta paired at the “Great American Motorcycle show ” in Atlanta where Trotta left with the win. The cool thing about this shows is that, if they even had half the fun we did at the ones we took part on, they had a blast. The show also brings the best in the industry and how they put a bike together in 30 days, no pre-done scripts, no nothing, maybe some editing but what happens, happens. Keep your eyes peeled for upcoming airdates.

Keeping on with the Biker Build Off’s, there is going to be an interview, yes here on Bikernet with no other than Hugh King, the creator of this way cool series, coming soon. I for one am eager to see what the man has to say. On the same line, Arlen and Cory Ness are going against each other in Hawaii this coming weekend, so we will expect the results for the upcoming news.

Speaking of Daytona, we will be there across from the Wreck, at the end of the Main Street Bridge. It will be the little Chopper corner with West Coast Choppers across the street, Choppers Inc. Indian Larry, Hank Young, Fabricator Kevin and Caribbean Custom Cycles in the same lot (across from Jesse), Biker Spot magazine and a Horse booth will also be there. Chica will join us now and then. I will also have a couple of the latest frames that Diamond Engineering has done for us, so you can check them out there.

For those of you who are as crazy about Kool Kars as you are of your beloved chopper, I don’t know if you seen the new magazine that is out in the street called Ol’ Skool Rodz. Geno and the team put together one cool rag about Rat Rods and anti high end Kars. Greasers, Cats, Betties and everything else is there. It?s kinda Viva Las Vegas but every month. Right now it feels like the world is turning really fast and we need it to stop to get off. Daytona insanity, a show, all the deadlines looming and a couple more tech articles for Bikernet are pending. A couple shoots for The Horse are due for next week and we are waiting for our cover shot on our local magazine, “Biker Spot”. Plus we got a new design in the works for Chopper Freak, and needless to say at this point, finish the fucking new shop before heading out to the Shores of Daytona Beach. Gennaro, aka “Chicago Greaser” is cruising around the island with some friends and I’m trying to be a partial tour guide / host. Let’s not even talk about the bikes I have to finish by Tuesday. If you are confused by this paragraph, just imagine how I feel…..????

I just got my new “super secret” frame from Diamond, which I will not share, yet! A couple gas tanks from Twisted Choppers and a couple seats from PDQ upholstering, you gotta see them cause they are all wicked cool. Thanks to all of them, it’s good to have friends. I’m just waiting for a couple more things and, Hey Discovery, I’m ready!!!!! Three more bikes for this year which I’m really excited about….

HARLEY-DAVIDSON ANNOUNCES DAYTONA 2004 BIKE WEEK SCHEDULE–MILWAUKEE (February 10, 2004) – The official Harley-Davidson schedule of events is now complete for the 63rd annual Bike Week at Daytona Beach, Fla.

Harley-Davidson events will run from March 1-6. Highlights will include: the Harley-Davidson and Buell indoor show, Harley-Davidson and Buell demo rides, the Harley-Davidson Traveling Museum, the Ford/Harley-Davidson Super Duty Display, MDA Auction and Bike Raffle, motorcycle stunt shows, musical entertainment and the Ride-In Show Contest.

One is an American Indian passingthrough from Lame Deer. Another is a Cowboy on his way to Billings for alivestock show, and the third passenger is a fundamentalist Arab student,newly arrived at Montana State University from the Middle East

Their discussion drifts to their diverse cultures. Soon, the two Westernerslearn that the Arab is a devout, radical Muslim and the conversation falls intoan uneasy lull.

The cowboy leans back in his chair, crosses his boots on a magazine tableand tips his big sweat-stained hat forward over his face. The wind out sideis blowing tumbleweeds around, and the old windsock is flapping; but stillno plane comes.

Finally, the American Indian clears his throat! And softly he speaks, “At onetime here, my people were many, but sadly, now we are few.”

GET THIS FINE FOR KILLING THREE BIKERS– Charter van driver Gary Lee Butler will pay $11.67 in fines for each of the six Mid-Iowa motorcycles riders involved in a deadly crash in Tama County nearly 19 months ago.

Butler, 49, of Des Moines was found guilty of failing to maintain control of a van owned by Brown’s Crew Car Co. of Wyoming and for driving on the wrong side of U.S. Highway 30 near Chelsea on June 22, 2002.

He was fined $35 for each of two traffic offenses by Judge Amanda Potterfield on Thursday. He has until Feb. 27 to pay the fines.

“I suppose I should be happy he was convicted of something,” said Wayne Wierson of Ames, who was the only one of six riders not physically hurt in the accident. “No amount of punishment can bring these guys back.”

Arlen Pickering, 53, of Story City; Douglas Sampson, 51, of Ames; and Ross Holland, 57, of Boone, were killed when Butler crossed the center line and slammed into each of them head-on.

Richard Vauble and James Olson, both of Ames, were seriously injured but survived the crash. Vauble lost his right leg above the knee, and Olson spent nearly four months unconscious in a hospital bed.

At the time of the accident, Butler was returning to Des Moines after dropping off a Union Pacific Railroad crew in eastern Iowa.

The Iowa State Patrol and Tama County Attorney Brent Heeren said Butler likely fell asleep at the wheel.

Last month a jury found Butler not guilty of vehicular homicide and serious injury by vehicle charges. Prior to trial, Heeren dismissed three aggravated misdemeanor counts of involuntary manslaughter.

“It’s hard on all of us,” Wierson said. “I am really disappointed in the justice system. I am not after retribution or revenge, just some sort of justice.

“I don’t know if we are victims of the system or whether I am being paranoid that people who ride motorcycles don’t count as much as other people,” he said. “For the widows and the two people seriously hurt, it doesn’t seem to be quite right.”

*J.C. “Pappy” Hoel Lifetime Achievement Award recipient Annie Brokaw grew up with motorcycles. She learned to ride in 1947 at the age of 11 on a Royal Enfield running parts at her dad’s motorcycle shop, married a motorcyclist, competed in eduros, trials, ice racing, motorcycle ice hockey, flat track (oval and TT), road racing, field meets, drag racing and Pikes Peak International Hill Climb, winning many, most of which were in men?s classes. Annie helped organized new riding clubs and participated in promoting motorcycle events in several states. Her current love is dual sport riding and boasts, “Unfamiliar dirt roads are explored nearly every ride. As a 68-year-old lady it’s rewarding to still be able to tackle really rough trail rides. The future looks good!”

John Paul DeJoria, noted owner of John Paul Mitchell Hair Systems, was helped by a fellow motorcyclist when he was down and out and has never forgotten. His personal and company motto is: Success unshared is failure. Today as a successful business man and United Nations trouble-shooter and ambassador, DeJoria works to benefit motorcycling through his sponsorships and considerable fundraising efforts with such noted events as the MDA Love Ride and his Love, Peace and Happiness Ride. He credits his code of brotherhood and helping others to his life long association with motorcycling.

The Early family, father Lloyd Sr., and brothers Lloyd Jr. (Gunner), and Bob, have been involved in the Sturgis Motorcycle Rally in once capacity or another since 1937. Lloyd Sr., was a lifetime member of the Black Hills Motor Classic, working the race track and encouraging his sons to follow. His son Bob never owned a push bike, instead equipped his bicycle with a Whizzer motor, a glimpse into who he would become, a noted mechanic and proficient off-road racer. Bob was a life member of the Jackpine Gypsies Motorcycle Club, Harley Owners Group and the American Motorcycle Association. Growing up at the track, it was only a matter of time until brother Gunner stepped up, serving several years on the Black Hills Motor Classic Board of Directors and eventually as its president for six years. Gunner later went on to open Gunner?s Lounge, a famous watering hole on Sturgis? Main Street.

Harry Tagaris opened Harry’s Motors in Denver, Colorado in 1927 and it has remained a family run business ever since. Throughout the years Harry’s Motors has sold Super X, Indian, BSA, Zundapp, BMW, Norton, Ducati and Moto Guzzi motorcycles. The family has promoted hill climbs, TT races and half-mile flat track racing; sponsored racers; successfully competed in races; been instrumental in starting several motorcycle clubs; help launch the Motorcyclist Magazine; built trophy winning motorcycles; and restored classic and antique motorcycles. With each passing generation the shop has been handed to the next, however their professionalism, talent and love of motorcycling has been consistent with the dreams of Harry who began this small shop so long ago.

During the past 25 years, Jerry Hatfield has strengthened the appreciation of American motorcycling history through his research, writing and television appearances. He has written 12 books and over 20 articles on motorcycle history. He has contributed articles to motorcycle magazines in the US and the UK, appeared in several television documentaries and served as a research consultant for the AMA, ABC, Indian Motorcycles Japan, Women?s International Motorcycle Association and Motor Books International.

David Mann created his first motorcycle painting in 1963. In 1971 he was hired by Easyriders magazine and began capturing the essence of the biker lifestyle for generations of riders. His paintings derive from personal experience, and his honesty and love of machines can be seen in each piece he creates. His imagination and wit, coupled with his attention to detail are hallmarks of his style, one that is wholly his own. Known as the Norman Rockwell of the biker world, he is noted for documenting the freedom and passion that surrounds motorcycling.

People who know Bruce Rossmeyer call him the “Big Man with the Huge Heart” due to his efforts in raising millions at motorcycle runs and auctions, all of which goes to helping children. Bruce serves on the Board of Directors of the Boggy Creek Gang Camp, founded by Gen. Schwarzkopf and Paul Newman. The largest event benefiting the camp is Bruce’s Ride for Children. He is a major player in Joe DiMaggio’s Children?s Hospital and serves on the Board of Directors of the Boys and Girls Clubs of Broward County, raising considerable funds for both. Bruce owns several Harley dealerships in Florida, however in spite of a demanding schedule he is committed to using his creative ability and business experience to benefit children and families in need while continuing to promote motorcycling and the generous people who ride.

Some 30 odd years ago Perry Sands was the local “go-to” guy for the custom hungry Southern California biker. His true passion was performance and he realized that nothing out there would live up to his standards. He knew he needed to create his own and within a few years Performance Machine disc brake systems were the standard for any well sorted custom. The presence of his product on high-end bikes persists to this day. Wheels came next and Perry was again the innovator in both custom and race applications. Everything from cast magnesium wheels for Kenny Roberts to beautifully machined billet units for local customers. A keen sense for machinery and an ability to push the envelope of manufacturing has kept PM on the cutting edge.

Dal Smilie has been active in on and off-road motorcycle rights lobbying at a state and federal level for over 25 years and a leader on the AMA Board of Directors for over 20. Smilie was the youngest person ever elected to the AMA Board and is the longest to serve at 22 years. Additionally, Dal finds time to race. He has picked up four national AHRMA motocross championships since turning 50. His love of motorcycling in all its forms is clear through his association with the AMA; as a 23 year member of the Antique Motorcycle Association of America; as a volunteer with the AHRMA for 15 plus years; as a rider with over 500,000 miles on road bikes, having won BMWMOA’s high mileage contest twice. He has received the MSF’s Award of Excellence, their highest honor, fought to get legislation passed to start Montana?s rider funded safety program and has been named by four different governors to head the Montana Motorcycle Safety Advisory Committee.

Bill Waltermire’s children always thought it was cool that their dad raced motorcycles. Before the war Bill raced TT?s but switched to flat track after the war, calling racing his therapy. His wins on Indians and Harleys are many and legendary however his family will tell you they are most proud of his generosity and willingness to help strangers. They fondly remember many nights when Bill would bring home a biker he didn?t even know whose bike had broken down or who had been involved in an accident and needed a place to rest. His favorite bikes have always been Indians and he still owns the first motorcycle he purchased new, a 1946 Chief.

The Sturgis Motorcycle Museum and Hall of Fame will be holding their fourth annual Induction Breakfast during the 2004 Rally on Wednesday, August 11th. The breakfast begins at 9:00 a.m. at the Holiday Inn in Spearfish, SD (Exit 14). Tickets are available for a $20 donation per person or $160 per table of 8. SHAMROCK SECRET INVESTIGATION– This is how I finish off my pipe seams. I trust you will just keep this between us, because one of the things that sells my pipes is the ability to get all those seams to look like one solid pipe. Kinda like a pinstriper guards his paints and brushes, you know…..

With respect for Irish Rich we edited the following to maintain his secrets. –Bandit

First, I use a small …. grinding disc. You use it in the same motor you’d use for a cut-off disc. I knock the weld down until it is not quite level.

Then, I take an old …. sander, and I lock the pad solid, so it can’t sand in a ….. pattern. It acts as a small …. sander this way.

I then use a …. disc to knock the weld down flush with the pipe surface, and ….. out the seam.

Next, I use a ….. disc to ….. out the scratches, and smooth out the adjoining surface.

Next, I use a ….. disc, with the Roloc pad you’d use for the Roloc grinding discs.

That’s how I do it. It’s a lot of work, but the finish comes out beautiful, and your ceramic coater/plater will love you for it, because you’ve done 3/4 of his work for him. If you do it right, the seams are virtually invisible.

ROGUE’S BAD COP INVESTIGATION–GARLAND -The Garland Police Department released a squad car videotape of a violent confrontation between officers and a motorcyclist Friday after fired police officer Glen Shaw pleaded guilty to a misdemeanor assault charge.

Mr. Shaw was sentenced to two years probation, fined $600, and ordered to undergo anger management counseling. If the terms of his probation are violated, Mr. Shaw will serve one year in jail.

As part of his plea agreement, he also signed a permanent relinquishment of his Texas peace officer?s license, according to Pat Batchelor, chief of the public integrity section of the Dallas County District Attorney?s office.

Garland police chief Mitch Bates suspended Mr. Shaw for 15 days without pay following the September 6, 2003, incident in which Mr. Shaw was found to have used excessive force against motorcyclist Randall James Ling.

Mr. Ling, who allegedly led Mr. Shaw and other officers on a high-speed chase on the Bush Turnpike, was later indicted for felony fleeing.

One side of the saloon is a semi sports bar, for those that just want to play darts, shoot pool, or just want a cold beer or other adult beverage. The other side,,,,,well that is a little more involved.

Softail’s is biker owned and operated, and does business 365 days a year. So bikers are welcome the year round. We won’t BS you, we started this group in order to drum up even more business. However, this group isn’t going to disappear the week after bike week is over. We hope to keep you informed about events, and happenings in the area so you can keep up with the atmosphere in the Daytona Beach area between Bike Week and Biketoberfest. As the Daytona area becomes less and less bike friendly, we find ourselves in a unique position of being out of the area of the Daytona city laws that seem to make bikers miserable.

We’re going to have checkout space at Safeways for issue 42. I know for most of you that doesn’t mean much, but for us that means that we have to have a killer cover, taking advantage of the in-your-face location of the magazine.

It was great seeing all of you that attended the Cincinnati show. We are going to be set up at the Detroit Autorama from the 27th to the 29th of Feb. That’ll be our next presence at a major venue. Then I think we’ll be set up at The Last Resort again in Daytona, but I won’t be going. I know that Kevein, Eric, Jose and a few others will be there, while Geno and Hank will be manning our booth a TLR.Oh, Chopper Dave is supposed to judge the bike show at TLR; I forgot to mention that.

EVIDENCE CUSTODIAN FACES FELONY DRUG CONSPIRACY CHARGES–DELAND — The former evidence manager for the Sheriff’s Office was on his way to jail Wednesday, charged with stealing nearly a half million dollars’ worth of drugs from the sheriff’s evidence compound. Volusia County Sheriff Ben Johnson watched as Timothy W. Wallace, 47, was led away in handcuffs.

Wallace faces charges of conspiracy to traffic in cocaine and conspiracy to traffic in marijuana. The first-degree felony counts each carry a 30-year prison penalty.

Wallace’s bail was set at $300,000, according to the Sheriff’s Office. There may be additional charges, authorities say.

Wallace, a three-year veteran of the department, has been under investigation for about a month in the theft of nearly 900 grams of cocaine and 370 pounds of marijuana, according to the Sheriff’s Office. He was fired Feb. 5, after a two-week unpaid suspension.

The sheriff said Wallace was putting those seized drugs back on the street. Investigators have recovered a small portion of the narcotics, but Johnson is doubtful they will recover more.

SOUTH DAKOTA JANKLOW STATEMENT– (MCNW) ABATE of South Dakota has issued a statement in response to the sentencing of Representative Bill Janklow. The motorcycle rights organization felt that the sentence should have included more jail time but that the courts were consistent in their penalties.

ABATE’s research found that many states with similar accidents result in no penalty at all or at the most a small fine, and the penalty awarded to Bill Janklow was stiffer than in many similar cases in South Dakota. The ABATE statement said “Dakota justice system has clearly demonstrated that a person’s political, social or economic stature has little bearing on the final outcome of such a case and that the final outcome was based on the circumstances and evidence surrounding this case”.

Back in the 60’s, there was a Bike shop on San Fernando Blvd.The guy that owned it built a couple of bikes that I recall seeing there as he was working on my old Knucklehead.One was a two wheeler called the Six Pack,Corvair powered,owned by Norm Grabowski.Norm claimed to have been the builder, but I always saw the other guy working on it.

The other was a Ford Cobra powered trike called The BoneShaker.Now, what I recall was that his name was Boyd De France. No one seems to remember him. Is he lost in history, or am I not remembering right ?

ONE MAN’S OPINION–Dear Mr. Walker, As a Republican, a biker and a parent of three, I resent the fact that the Congressman got off so easy. We in Connecticut, and many other states I have political friends and/or biker friends, have been watching the prpceedings of the Janklow case and I must say, no one is happy with the results. In fact, many are totally disgusted with the judge’s light sentencing.

As Republicans, we’re disgusted with his actions since in a position like his, he should be setting an example, not being the cause to do so.

As bikers, we feel it’s another case of where because it’s an accident invovlving a biker, the motorcyclist victim and victims family suffers at a loss of justice. Am I saying bikers get discriminated against or treated differently? Yes, I am. Ask any biker.

As parents, we feel that Randy Scott was our son too, killed by another driver who lacked respect for the law.

No matter what the excuse is or who you are, people are responsible for their actions. It was not the first time Janklow broke laws, laws that he was supposed to honor and uphold. Probably even helped to get enacted in his state. He above all should have accepted his responsibility instead of making his excuses and trying to weasel out of the punishment. He should have served at least a full year and the felony conviction should not be up for discussion. It’s permanent and after 5 years or whatever it is in SD, he can apply and ask for pardon as most convicted felons have a right to do.

His attempt to get a re-trial is another sign he has NOT accepted the responsibility for his actions and in my opinion shows his contempt for the law, the family of Randy Scott and the citizens of SD.

I’m sorry if I offend anyone in SD who support Janklow, but at least his family can visit, see and talk to their family member. The Scott family only have their pictures, their memories and a cold grave.

ORIGINAL RAKED TREES–Starting to shovel out the garage and get rid of anything I haven’t used in the past 10 years. I was wondering if you knew anything about the value of a 1950 side hack front end w/ adjustable chrome triple trees? Came on my Pan when I bought it back in ’72. Changed the lower legs to single disc in ’80 then took it off for a springer in ’82. Been sitting neglected in the garage since. I’ve been looking on ebay and swap boards for months to get an idea of value but haven’t seen one like it. Any idea what it may bring? With my luck I’d sell it for $500 then find out it’s gold. It’s been heavy chromed pre 1972 and it’s the bolt and castle nut model, not the cam type. heres a few pix, any thoughts?

VIRGINIA HELMET REPEAL–FREEDOM’S COMIN’–RICHMOND — Motorcyclists who show proof of insurance and are at least 21 years old would be allowed to ride helmet-free in Virginia under legislation that narrowly escaped a House committee.

The bill, sponsored by Prince William Delegate Scott Lingamfelter, passed the House Transportation Committee on a 10-to-9 vote Tuesday after a subcommittee recommended killing it.

Even though the bill escaped committee, it faces an uncertain future in the full House.

Should motorcyclists be allowed to ride without helmets?

Jim Cannon, director of the Virginia Coalition of Motorcyclists, says 31 states have repealed helmet laws since 1996.

Doctors say statistics show a dramatic increase in motorcycle injuries and treatment costs after states drop the law. Nancy Martin, trauma program director at VCU Medical Center, said unhelmeted victims spend 50 percent more time in the hospital on average than helmeted victims of accidents.

Yeah, but accidents and overall injuries with decrease, goddamnit. I’d rather die free than chained and safe.
