Hey,

Another whacky week in paradise. We’re headed north this weekend to the Paughco factory. Rick Krost, the boss of U.S. Choppers, Jeremiah a local nutcase and I will pick up the frame for our 1915 5-Ball Factory Racing bike for the ride to Sturgis next year.

That means next week we’ll bring you the first installment of the build. I’m waiting on a concept sketch from Chris Kallas. He always brings our projects to life.

Speaking of projects, we’re trying to reach out to Berry Wardlaw of Accurate Engineering to receive reports on the Assalt Weapan that’s being tuned for a run at the Maxton Mile. Let’s hit the news then I’ll bring you more content updates from the staff:

KOPP WINS 2008 GRAND NATIONAL TWINS FINAL AT HEARTLAND PARK —Smith is Second, Coolbeth Third as Harley-Davidson Wrecking Crew Fills the Podium.

TOPEKA, KANSAS (October 4, 2008) ? Latus Harley-Davidson/Screamin? Eagle rider Joe Kopp won the final event of the 2008 AMA Grand National Twins flat track series, leading every lap on the tight Heartland Park half-mile to take his fourth victory of the season. Two restarts stretched the race to 27 laps, and in the final five-lap segment Kopp out-dueled Moroney’s Harley-Davidson/Screamin’ Eagle rider Bryan Smith, who finished second. Harley-Davidson Screamin’ Eagle factory rider Kenny Coolbeth, who clinched the 2008 AMA Grand National Twins championship on Sept. 7 in Monticello, N.Y., was third. All three were aboard Harley-Davidson XR-750 motorcycles.

?How long was that race, 30 laps?? said Kopp, who led the series early in the season. ?I really needed this, it’s a great way to end the year.?

Kopp was the fastest qualifier for the event, and opened a lead on the pack at the start of the scheduled 25-lap main. The first red flag dropped on lap 13 for a crash by R&D Machine rider A.J. Eslick. On the restart, Kopp again moved out to a comfortable lead while the rest of the field engaged in furious pack racing behind him. Blue Springs Screamin’ Eagle rider Jared Mees went down on lap 23, bringing out the second red flag and setting up a restart for a five-lap sprint to the finish, per AMA rules. This time, Smith got off the line with Kopp and the Harley-Davidson Wrecking Crew riders battled for the distance. Smith was able to get past Kopp on the backstretch, but never officially led a lap. Coolbeth was engaged in a wheel-to-wheel race for third with Zanotti Racing rider Jethro Halbert. Coolbeth got past Halbert on the last lap and held on to take the last podium position by just 0.006 seconds. Chris Carr was fifth, followed by Suzuki rider Jake Johnson. Mees could not finish the race following his crash.

The final standings show Coolbeth with 249 points and six wins in a season that earned him a third consecutive AMA Grand National Twins championship. Smith prevailed over Carr in a fight for second place in the Grand National Twins final standings. Smith led Carr by just one point before the Topeka event and finished the season with 197 points. Carr finished third with 191, followed by Kopp with 181. Mees finished the season with 120 points and ninth in the standings.

THE EUROPEAN COMMISSION WILL REQUIRE ALL VEHICLES TO RUN LIGHTS ON CONSTANTLY–Commission will introduce dedicated Daytime Running Light (DRL) from 2011 to increase road safetyThe European Commission (EC) has announced today that dedicated Daytime Running Light (DRL) will be introduced on all new cars from the year 2011 onwards.FEMA’s position on the issue is very clear:

– FEMA is in principle not opposed to dedicated DRL as long as it is strictly different from a motorcycle dipped-beam headlight.

– The adoption of dedicated DRL appears to be the “least worse” solution in terms of road safety, even though European motorcyclists ? along with pedestrians and cyclists ? still have reservations regarding the fact that responsibility to watch out for other road users is further taken away from the car driver.

All in all, FEMA is satisfied that the European Commission adopted the ?precautionary principle” regarding the use of automatic switch – which has not been made mandatory – as it previously did by not harmonising the use of dipped-beam headlights.

FEMA is pleased by the fact that the European Commission took the point of view of motorcyclists into account.

?Full House? was again the theme on sunday october 5th when the Rick?s Team opened the gates and workshops of the manufacturing facilities ? again with a great response. Several thousand visitors crowded the showrooms and workshps of Rick?s, RiMePos und Wild Air H?rby. The Rick?s team had polished up assembly, CNC-machining, metal-workshop, polishing and all other rooms, with guided tours going through the halls all day. Staff members were available for questioning and even held production running, so that CNC-parts were manufactured, polished and could be even mounted “live? to the bike projects waiting in the workshop area.

Highlight in the open-air outdoor programm was hungarian Stunt-Pro Erdos Csaba, invited by Rick?s on his premiere stuntshow to germany. The incredible hungarian artist performed motorcycle stunts that seemed to defy gravity ? and burned his name onto the tarmac of ?Flugstra?e 1?, Rick?s home adress.

Most “connoisseurs? got their kicks in the well-equipped metal workshop, where fender, tank extensions and other parts are handcrafted to perfection. Likewise a full studio as every year, ?Wild Air? Hoerby is Rick?s in-house, next door airbrusher who has painted the majority of Rick?s projects, both by airbrush and handdrawn. ?Our order-books are full for the winter season?, states Knoerzer who has just extended his machine park with another CNC station, extending capacity at all production levels. MYRTLE BEACH UNDER ANTI-MOTORCYCLE SIEGE– As promised, we will continue as much as possible try to update you with May Rallies as much as possible. Please note meeting was almost 3 hours long.

I would like to first and foremost say THANK YOU to all of you for your PRAYERS and words of support and encouragement as I represented US ?bikers? on this panel.

The NAACP, at this point is taking a neutral position. The purpose of this public forum was not to change to laws, but to bring everyone to the table for clarity of the new ordinance. The weather wasn?t pleasing nor inviting with rain and 40mph winds, the public forums was scheduled to continue as planned. The public forum was called by the NAACP, however the attendance was supported by a diversified group of people.

The panel consisted of: Mickey James, President of the Myrtle Beach NAACP, Myrtle Beach Mayor, John Rhodes, Myrtle Beach City Councilman, Michael Chestnut, Myrtle Beach Chief of Police, Warren Gall, Horry County Councilman, Marion Foxworth, North Myrtle Beach Public Safety, Manager William Bailey, Conway National Bank, Terrence Herriot and Horry Georgetown Bikers Association/Out of State Bikers, Violet Lucas.

The public forum was opened by the Mickey James, President of the Myrtle Beach NAACP, an introduction of myself as representation of Horry Georgetown Bikers Association and the bikers out of State, our letter reads as follows.

On behalf of Horry Georgetown Bikers Association and the Bikers out-of-state, We would like to first say thank you to the NAACP for their collective efforts and neutral position with the calling of this Public Panel Forum. We in addition, would like to say thank you to each of you for your presence here this afternoon. We trust that we all can agree that there is a certain fraction of people that choose to misbehave, or are simply ignorant to self control and proper etiquette pretty much in every community around the nation. However, for the purpose of this meeting, as we focus on the May Rallies, We do not wish for the negative actions of a few to totally diminish the collective efforts of the positive, good, hard working individuals that choose to vacation within this area. Despite all of the negative media attention that surrounds the City of Myrtle Beach, and its newly placed Ordinances, many of the bikers desire to return to the area to enjoy their vacations and the May Rallies as they know and love. Although, we can agree with some of the City of Myrtle Beach Ordinances, there are some that we do not agree with.

Nonetheless, as we plan our vacations to the surrounding areas, which includes the City of Myrtle Beach; We understand that the City of Myrtle Beach want us to comply with its laws and ordinances. We (the bikers), do not wish to be discriminated, unfairly treated, targeted or harassed, for It is our intention to merely enjoy our vacation, and simply return home to our families and our employment.

We do understand that the migration of so many people in one month can be overwhelming and trying. However, on behalf of the Horry Georgetown Bikers Association and the Bikers out-of-state, we believe if we all collectively communicate and work together we can accomplish a more positive and beneficial outcome during the May Rallies. While it appeared that we all agreed with some of the ordinances, there were some that was clearly not agreed with and the primary complaint was the helmet laws. There were a variety of questions…..Q) How will people know when they are within the City limits? A) We will have all major entrance points clearly marked. Q) How do you planned to enforce the Helmet Law? A) The Myrtle Beach Police Dept will be handling that as we do not have the plan in place at this time. Q) When enforcing the new helmet law, will this be a criminal offense as the State doesn’t have a helmet law? A) no it will not be a criminal offense, it will be an infraction, that will not hold criminal punishments that would affect your license. Q) If the helmet law holds no criminal punishment, then why put forth such an ordinance? A) The Helmet law was to enforce safety and minimize fatalities or head injuries….this set of questions an answers goes back and forth and eventually minimized to move forward. Other questions as to the noise ordinance and meter decibels….Q) will the equipments and officers be certified, otherwise this procedure will be dismissed/illegal/not valid? A) yes, they will be certified/trained. Q) Will this test be done at a quiet stationary area, as the decibels readings can pick up surrounnding sounds and give off an inaccurate reading. A) We have not set up any special check points. Q) If someone have been cleared at a noise ordinance check point, will you provide a slip/receipt to this finding. A) We are not equipped to do this. Q) How do you propose New Ordinances if you’re uncertain how you will enforce them and if the charges are not criminal? A) We only proposed ordinances that were already set in motion, the only new ordinance was the helmet law, which is clearly for concerns of your safety, the initial proposed ordinance were a lot harsh and we toned down and elimated a lot of what was proposed. The only ordinance that offers a criminal and immediate affect was “walking out of a restaurant without paying”. Q) How will you inform the public nationally of these new ordinances? A) We will do a nationwide campaign to inform the public.

U.S. TRANSPORTATION SECRETARY LOBBIES FOR HELMET LAWSThere’s a big difference between promoting helmet usage and advocating helmet laws, and U.S. Transportation Secretary Mary Peters made it clear to Congress that she prefers the latter as her cornerstone to motorcycle safety.

In testimony before the U.S. Senate Appropriations Committee Transportation Subcommittee on March 6, Secretary Peters revealed her desire to promulgate nationwide helmet laws; “I support giving the information to states so that they can act on those laws,” she told Senators, adding “And I certainly have made myself available to a number of states, and, in fact, have called governors when I see substantial increases in the number of motorcycle deaths in a state, especially a state that has repealed a helmet law.”

Calling upon the federal government to ease lobbying restrictions imposed at the behest of motorcycle rights organizations across the country, Peters has requested legislation that will allow her to divert motorcycle safety funding to convince states to enact mandatory helmet laws.

Peters has sent letters to House and Senate leadership urging legislation to allow states to utilize federal funds intended for motorcycle rider training and awareness programs to promote helmet laws instead.Why doesn’t she lobby for helmets in cars?

SIKH SEEKS FREEDOM FROM CANADIAN HELMET LAWBaljinder Badesha, a 39-year-old father of four who immigrated to Canada in 1989 and had been an avid motorcyclist in his native India, disputed a $110 ticket for riding his 2003 Yamaha Shadow motorcycle without a helmet in 2005 has is now in court fighting Ontario’s motorcycle helmet law on religious grounds.

With the Ontario Human Rights Commission at his side, Mr. Badesha argued that Ontario’s helmet law violates his religious freedom, since Sikhist beliefs prevent him from wearing anything over his turban.

But Ontario Court Judge James Blacklock ruled that while the law prohibiting anyone riding a motorcycle without a helmet does violate his right to freedom of religion, it’s justifiable in terms of the benefit that society gains in possible reduced health costs and the possible loss of people’s loved ones.

The Crown’s case centered on increased costs to the health system should helmet-less Sikh motorcycle riders end up suffering head injuries, though Badesha’s attorneys pointed to a study that concluded that, assuming half of all Sikh motorcyclists wear turbans, the increase in serious injuries would be between .43 and 2.83 Sikh riders a year. The study also projected that medical treatment for traumatic brain injuries would increase from $151,700,000 to $151,834,685 — a .00005-per-cent overall increase in the province’s annual health-care budget.

Badesha has announced that he will appeal the decision, and backed by the local Sikh community he now intends to challenge the constitutionality of the law rather than focusing his fight solely on his ticket. He and his supporters will also lobby politicians to change the law.

Following the ruling, the World Sikh Organization of Canada (WSO) issued a statement expressing disappointment at the court’s decision and asserting that wearing a turban doesn’t substantially raise the risk either to the rider or to others on the road. The organization pointed to the Sikh motorcyclists in other jurisdictions who have been riding without helmets for many years. India, Hong Kong and Britain exempt Sikhs from wearing motorcycle helmets, as do the Canadian Provinces of Manitoba and British Columbia, where a human-rights challenge precipitated the exemption. Similar challenges have failed in the United States.

“We are confident of winning the battle this time,” Badesha said. “We don’t believe a helmet is safe. Every day riders with helmets die in road accidents. If I’m supposed to die today, I will die, and nothing can save me.”

CYCLE SALES SLIDEEconomic pressures, weakening dollar and decreased discretionary spending have contributed to the first downturn in the motorcycle market in 14 years, and according to a recent LA Times article, especially hard-hit are small-displacement dirtbikes and Harley-Davidson.

On the up side, motorcycle sales in 2007 were over the 1-million mark for the fifth straight year, and battery and tire sales indicate that ridership and enthusiasm for the sport remain high.

According to the Times article, the U.S. Department of Commerce estimates a 2.2% sales drop in 2007, but some manufacturers are estimating a slide of up to 8-10%.

In a regulatory filing, Harley-Davidson Inc. said industry wide U.S. sales of large displacement motorcycles (over 650cc) fell 5 percent last year. Harley’s large-motorcycle domestic market share dipped to 49.4% from 50%, while their closest competitor Honda had a U.S. market share last year of 14.2%, down from 15.1%.

Bloomberg news services reported recently that Yamaha is experiencing its first profit drop in eight years, Kawasaki claims sales are down but less than the industry average, and Honda and Suzuki each admit losses that parallel the industry overall; but there’s also some bright spots including Ducati, KTM, Victory, and overall scooter sales.

On another positive note, industry market research group Freedonia has predicted an expanding global demand for motorcycles of 6% annually due primarily to emerging markets such as Asia and South America.And while declining motorcycle sales industry-wide has taken a toll on Harley-Davidson’s stock price, one of the country’s largest financial institutions, Citigroup, has removed the Milwaukee motorcycle manufacturer’s stock from its “recommended to sell’ list, citing sales trends that had “stabilized somewhat”.

HONDA TO CEASE U.S. MOTORCYCLE PRODUCTION IN OHIOAfter nearly 30 years, Honda Motor Co. plans to stop producing motorcycles in the United States next year, ending production at its first U.S. plant and consolidating the Marysville Motorcycle Plant production at a new state-of-the-art manufacturing facility in Kumamoto, Japan which will be capable of producing 600,000 motorcycles a year.

“This move allows us to improve the competitiveness and appeal of our products by applying the latest technologies and production systems at one efficient location,” Akio Hamada, president & CEO of Honda of America, said in a statement. “Obviously, the motorcycle plant has a lot of historical significance,” he said. “It was Honda’s first plant in North America. It started producing motorcycles on Nov. 10, 1979. So obviously, there’s a lot of emotion involved in this kind of decision.

The sprawling plant, in Marysville, Ohio, employs 450 workers. Honda said there will be no layoffs when production ends in spring 2009. “There were a lot of people who felt disappointment,” said plant manager Jan Gansheimer, noting that many of the employees are motorcycle enthusiasts who have spent much of their careers at the plant.

Mirroring the rest of the industry, Honda’s U.S. motorcycle sales fell in 2007, but the company said that its decision to end Ohio motorcycle production was not based on a softening American motorcycle market.

Honda’s manufacturing venture in America began at the Marysville plant in September, 1979, where its first product was a motocross machine. Over time, a $165 million capital investment was made in the facility, which became the worldwide supplier of some of Honda’s most popular models, such as the luxury touring Gold Wing. The motorcycle plant reached its peak production in 1997 when it turned out 174,000 vehicles, including all-terrain vehicles. In 2005, ATV production was moved to South Carolina. Last year, the Ohio factory built nearly 61,000 motorcycles, 44,000 of which were Gold Wings and VTX cruiser motorcycles.

HORSEPOWER VS. HORSESENSEWhile speed and power typically dominate two-wheeled trends, a safety movement may be afoot featuring such hot topics as airbags from Honda, inflatable vests from Dainese, and “uncrashable” bike concepts from BMW.

So it shouldn’t seem surprising that “Motorcycle News” is reporting that Honda and Yamaha are working with twelve car manufacturers to test and develop technology intended to “…reduce rear-end shunts, head-on collisions and drivers who turn right across a road in the face of oncoming traffic, a common cause of motorcycle accidents.”

The systems, which will begin testing in Japan this month, enable automobiles to communicate speed and road position to other vehicles, and warn of potential accidents via voice alerts and navigation system messages.

Fueled by government funded safety campaigns and worldwide legislative initiatives, these tests could signal a gradual revolution in motorcycle safety.

MINNESOTA BIKERS FIGHT TICKETS FOR ROAD BLOCKINGA judge has dismissed charges of obstructing legal process and running a stop sign against one of about 60 bikers stopped last summer near St. Joseph, MN for blocking an intersection during a run. The ruling by Stearns County District Court Judge Frank Kundrat comes after one of the other bikers was found not guilty of a stop sign violation after a trial.

Scott Reichert recently took his case to court and was acquitted after the prosecution had presented its case and before Reichert had to put on a defense. Reichert, a member of the club Street Legal, originally considered just paying the fine he told the St. Cloud Times newspaper, but then he saw the police reports that hinted at a possible motive that police wanted to target some of the BPMs.

The July 7 run from the BPM clubhouse was intercepted by as many as 19 law enforcement agents, including members of the state Gang Strike Force and an agent from the Bureau of Alcohol, Tobacco, Firearms and Explosives. The BPMs have been identified as a criminal gang based on criteria established by the Legislature, said Minnesota Gang Strike Force Commander Ron Ryan in defending their actions that day, A report filed in case by the Gang Strike Force cites two examples of criminal activity tied to the BPMs: one incident is from 1971; the other is from 1968.

Reichert and attorneys representing the dozens of bikers stopped that day contend that the officers and sheriff’s deputies were looking for more. If that’s the case, a box-score review of the stop could be considered a lopsided defeat: The nineteen officers wrote about 60 citations for riders failing to stop at a stop sign and two for riders having a small amount of marijuana. They arrested one biker for disorderly conduct, but found no one wanted on warrants and no illegal weapons.

About five dozen other cases could be headed for separate trials, according to lawyer Stephen O’Brien, the Minnesota Aid to Injured Motorcyclists (A.I.M.) Attorney representing the remaining bikers.

A few weeks after Ms. Anderson’s unique Valentines present, pop star Prince threw a post-Oscar party in his Beverly Hills mansion, which featured room after room of exotic dancers dressed in various themes with one featuring a scantily clad woman enthusiastically using a motorcycle as a prop.

Many industry experts would agree, if this trend of women shedding clothing at the sight of a motorcycle becomes popular, currently struggling two-wheeled sales could see a marked improvement.

BIKERNET TECH EDITOR GETS A FLAT TIRE, PANICS–If you ride your motorcycle enough sooner or later you will get a flat tire.Riding home on I-95 after judging a bike show in South Florida I got a roofing nail in my rear tire.

The bead on the Continental Milestone did its job and I was able to get the bike stopped safely.

The thing was to get off the highway and wait for a brother with a trailer to come and get me.

Ladies and Gentlmen….START YOUR LAWYERS!– Lawsuits in Myrtle Beach are already starting. Their city attorney is going to be a busy boy.

A Virginia legal firm that specializes in motorcycle law has filed the first law suit to challenge Myrtle Beach’s new ordinances targeting the spring motorcycle rallies.

The suit filed in Horry County’s 15th Judicial Circuit on behalf of two Myrtle Beach residents and motorcyclists, William and Carol O’Day, challenges the city’s new helmet and noise ordinances.

The suit questions whether it’s OK for the city to supersede state law in both cases. The state says people 21 and older do not have to wear helmets while riding bikes, and it doesn’t spell out exact noise standards.

Through its ordinances and amendments, the city declares the failure to wear a helmet a civil infraction, defines noise standards for motorcycles and specifies what kinds of mufflers meet its regulations.

”It’s pretty simple,” said Tom McGrath, whose Motorcycle Law Group filed the suit. “It’s really a question of whether it’s constitutional. Does state law prevail?”

Greenville attorney Suzanne Coe said Friday she planned to file suit in federal court in Florence on Monday morning, challenging the three ordinances and amendments that have so far gone into effect. That suit had not been filed as of ate Monday afternoon.

Coe, who is preparing a suit on behalf of The Dog House, The Masters’ Club and Myrtlebeachbikeweek.com, among other business, said the ordinances are vague, interfere with people’s First Amendment rights and could interfere with interstate commerce, because many of the businesses that participate in the rallies are based in other states.

Coe could not be reached this morning for comment on when she expects to file her suit.

Rescue Boat at Alton Bay to pick up a special gift from Mount Gay Rum, on to Wolfboro for a surprise from Jagermeister, then return to the NASWA.

?Live music, raffles, a silent auction of valuable items and fan-fare all make this run much more of a party than a Memorial. Peter would have wanted it that way,? says Cynthia Makris, general manager of the NASWA Resort. The Marine Leathernecks Motorcycle Club is an important guest of this event in honor of Makris? long-time devotion to the group and its support throughout his illness.

Hamsters USA celebrate raising over $500,000 for special kids– Over the past three years, international motorcycle group Hamsters USA has raised over a half million dollars for children with special needs, served by Children?s Care of Rapid City, in the Black Hills of South Dakota. The group makes it a priority to give back to the community, and each year during the first week in August, the Hamsters? community is the Sturgis/Spearfish area of the Black Hills.

Hamster spokesman Grady Pfeiffer of Escondido, California, says the group is a tight brotherhood known for their big hearts when it comes to children. ?For 30 years now, Hamsters have stepped up to help out those in need, especially kids,? he says. ?We are really pleased to be able to help make a difference in their lives.?

The most recent fund raiser was held at the Hamsters USA annual meeting and 30th birthday celebration during the Sturgis Rally. Over $185,000 was raised for Children?s Care through live and silent auctions.

Scott Webster of Mentor, Ohio, newly inducted into the Hamsters organization this year, said he was proud to be part of such a generous organization. ?It is truly an honor for me as a new Hamster to help children have an optimistic and healthy future,? says Webster. ?My hat goes off to this group for what they do.?

Hamsters USA evolved from a 1978 gathering of friends at Daytona Bike Week.

Children?s Care in Rapid City is a non-profit organization providing physical therapy, occupational therapy, speech/language pathology, psychological services, and educational services to children from birth to age 21. Services are provided on an outpatient and outreach basis to over 1200 children from across the nation each year. It is affiliated with Children?s Care Hospital & School, based in Sioux Falls. The organization as a whole served over 2600 children last year.

I’VE BEEN EVERYWHERE MAN–This weekend I finished up the solo version of ‘I’ve been everywhere, man’. I got the idea of doing this project after contributing to a group effort with Two Wheeled Texans. All 92 cities, towns, communities and dried up places were visited by me and a photo taken to record the moment. All the photos were then set to Brian Burns version of the great song done originally by Hank Snow then made famous by Johnny Cash.

The project covered 10,641 miles and included 24 distinct riding days. Along the way I discovered some interesting facts such as Round Lake was formally known as Clabberville and ceased to exist the turn of the century. And places like Val Verde and Mill Creek are communities, not fully recognized towns with city limit signs. The bike, a BMW R1150GS performed flawlessly with my longest single day of 1,024 miles and this weekend I finished up with 1,245 miles over a day and a half.

Sixth Annual Chopper’s Art Show Raises $2500 Benefit Denver Boys And Girls Club, and Was a Huge Success–DENVER–October 1, 2008–Denver 81 is proud to announce today that their sixth annual Chopper’s Art Show raised over $2500 for the Boys and Girls Club of Metro Denver.

The show featured several nationally known artists and motorcycle builders, and an art signing by featured artist Sara Ray. Ray specializes in hot rods, pinups, rockabilly posters, nose art and World War II scenes. Her artwork has graced record covers, magazines, Fender and Gretsch Guitars, t-shirts, posters, art and military museums and most recently, a line of Sucker Punch Sally’s customs.

Art show attendees enjoyed music, food and cocktails while browsing the collection of artwork and photographs from local and national artists. The proceeds were raised by silent auction with almost all the pieces being purchased with the proceeds going to the Boys and Girls Club of Metro Denver.

“This year’s show was a huge success not just because we had a great time but because we raised money for the Boys and Girls Club,” said Nikolas Pew, Curator. “It all came together and everyone had a great time”

The Sixth Annual Choppers Art Show took place on Saturday, Sept. 13 at the JazzB Gallery at 719 W. 8th ave.

SOUTH SIDE CUSTOM THREATENED BY NEW YORK STATE POLICE–That’s Right — South Side Kustoms has to ask for help this time. New York State DMV, walked in here a few days ago and basically tried to shut South Side Kustoms down.

Why you may ask? Well after my 8th bike on the road, and the projected bikes for the rest of the year and next year’s projection. New York State decided to tell me, after my 8th bike. That we need to be a registered dealer in New York State.

Yes this was news to me….

Yes we are a registered builder with VIN Number assigment, but the Federal Government and Albany both seemed to be clueless ( up until now) on whether us custom builders (manufactures) needed to be registered dealerships. So apparently South Side Kustoms CAN NOT sell our bikes, until we become compliant.

Well with our economic situation in the good ol’ USA as of late, $4,000 is a lot to come up with all at once.

$4,000.00 you ask? Yes-

Almost $1,500 in NYS Registration Dealer ( Includes dealership for 2 years/signs/paperwork/dealer plates/etc.)$500.00 FINE – for being non-compliant even though we asked many times and told NO you don’t need this$2,000- For Store front with display area / locking office with locking file cabinet (NYS REQUIREMENT), bonding because you have to be bonded as a dealer.

I really don’t want to have to leave this state, I love Buffalo and the Western NY area. But if it doesn’t work here, I may just have to pack up, and get out of dodge.

MYRTLE BEACH MAY RELINQUISH ILLEGAL HELMET LAW– I received a telephone call on Friday, September 26, 2008 and a follow-up call this morning (September 29, 2008) from The Tony Spinnato (Chapter Cord G-Town ABATE, BOLT Member / Bikers Of Less Tolerance, BADD Member / Bikers Against Drunk Drivers) as representative for the Harley side?.The call basically states and reiterates, following the NAACP meeting on Thursday, September 25, 2008, there was collective support and effort from both sides, collectively together, we all represented UNITY.

We both had separate and independent conversations with the Mayor Rhodes briefly following the meeting. During my conversation with Mayor Rhodes, he stated perhaps/maybe we all can come to the table with some sort of agreement. As we left, Mr. Spinnato was speaking with Mayor Rhodes following the meeting.

The long and short of Mr. Spinnato?s telephone call was as follows: Mayor Rhodes, says the City of Myrtle Beach is willing to consider relinquishing the helmet law ordinance. Mr. Spinnato says Mayor Rhodes asked that we collectively meet prior to the next City Council Meeting to discuss having said placed on the Minutes for discussion.

Please understand the removal of the City of Myrtle Beach helmet law ordinance isn?t official, before this is, can, or will be done, the Myrtle Beach City Council will have to vote on removal of same at the City Council meeting.

BIKERNET FREE SEX JOKE–Two bikers rode into a gas station in Indiana for a fill-up, because they heard about a contest being offered by the station to patrons who purchased a full tank of gas. When they went inside to pay, the men asked the attendant about the contest.

I just returned from the Motorcycle Riders Foundation, Meeting of the Minds. Damn, there’s a lot going on from both ends of the spectrum. I learned a lot and specifically from Elaine from FEMA, the Federation of European Motorcycle Association. She made a presentation in Scandinavia that may have prevented motorcycling from being banned due to their Vision 1 goal–No highways deaths for a year.

One country, I believe Holland decided to try anything to come up with a year of highway use without one fatality. They found that as long as motorcycles shared the roads, the objective was not attainable. Consequently the answer became banning motorcycles. Elaine broke down accident avoidance into several sectors and basically pointed out that if you segmented these elements into percentage figures you would come to the conclusion that 25 percent involves motorcycle training, 65 percent community training and 10 percent equipment (motorcycles and gear). In other words, if we want to prevent accidents 65 percent is on the community. We need to train the community to share the roads, respect motorcycling, enhance awareness, build safer roads, move obstructions, keep people focused while driving and I probably missed an item or two. I’ll post her full report shortly.

MARYLAND MAKES A MOVE TO SAVE MOTORCYCLISTS– Here’s a press release from the Maryland State Highway Administration. MD. SHA officials say lawmakers passed three laws this summer to make highways safer for motorcycles. An SHA statement said drivers who fail to yield the right of way and cause a serious crash could pay $1000.00 in fines and have their license suspended. The previous penalty was $150.00 for failure to yield and no specific penalty for causing injury or even death. Also passed in June were laws making L.E.D.’s legal to make motorcycles more visible and a law classifying three wheelers as motorcycles.

The SHA said more than half the motorcycle crashes in the state are not the motorcyclists fault. From The Carroll County Times 9/26/08. Keep the great information flowing. Bikernet is the best source of info out there. Keep up the good work.

At one point before U.S. involvement, England was surrounded by Nazis and fighting on several fronts for Europe’s life. They experienced some solid wins along the north coast of Africa against Mussolini’s troops. One campaign was headed by Australian troops. “They sang at that time a song they had brought with them from Australia,” said Churchill, “which soon spread to Britian.”

MYRTLE BEACH AT WAR WITH MOTORCYCLISTS, THE INSIDE STORY–I imagine you are already hooked up with every sort of news service, miningfor data on the Myrtle Beach situation If you don’t already know, you might also be interested in some tidbitsabout recent past battles with Myrtle Beach regarding bikers. I believe itwas some seven or eight years back when there was a push to keep us out.Truthfully at that time the “worst” part of the two weeks was the Atlantic Sport Bike Week (commonly andregretfully referred to here in the South as Black Bike Week – by bothblacks and whites).

Numerous individuals, including myself, set up acampaign via the now-defunct Sons of Liberty Riders email list, andcontacted every hotel, restaurant, rental agency, bar, gambling cruise shipline, etc. owner regarding the loss of income should we be stopped fromvisiting their city and asking them where they stood on the matter.

Thisstimulated some good conversation but what happened in the end was that theNAACP came in and threatened to sue based on how law enforcement and trafficcontrol measures were different during Black Bike Week than during the NorthCarolina/South Carolina Harley Davidson Bike Week. The result was that nowboth weeks are equally treated to the same “welcome” to Myrtle Beach.

There was also a mayor there a few years back who made a public comment tothe effect that when he sees a biker with a tee-shirt that proclaimssomething indecent, his first instinct is to just run the biker over andkill him.

My mother owns property in North Myrtle Beach and is on the condoassociation board and I have been very proud of her for standing up over 20+years to repeated attempts to make that 20-unit building enact a “nomotorcycles” policy. And it is hard.

I quite understand why people wish todo this. Individuals who own a property and their yearly maintenance duesare designed according to expenses of upkeep. When you have people peeingin the elevators and ice machines, asking young non-black families why theyare here because it is “OUR” week, blocking traffic by using the streetsliterally as a place to hang out for hours (I have experienced this formyself – taking over 1.5 hours to go one block) it is very hard to stand upagainst such a ban. But she did and now my father continues the battle!I’m so proud of them.

Internally, the black community has struggled with some success to policethemselves. It is a different culture from my own yet I am working todevelop more relationships there. I really have to hand it to them for whatthey have achieved and working to achieve.

On the other hand, the predominantly white HD-based rally has grownexponentially. There are so many of “us” who are either young andinexperienced, or recently riding after a 20-year hiatus – who feel theyhave something to prove. They trailer their bikes for sometimes less than300 miles of travel and proceed to enter the drunk trick riding events. None of this helps us and is exactly what has brought us to this situation.Just like in the motorcyclists’ rights movement – – it will be a few whochampion the many.

MYRTLE BEACH RALLY LAWSUITS BEING FILED–Related Content Listof new ordinances Complete coverage of biker rallies Attorney Suzanne Coe ofGreenville said she will fire the opening salvo against the city of MyrtleBeach on Monday by filing a lawsuit to try and stop the city from enforcingthe three anti-motorcycle-rally ordinances that took effect this week.

Coe said she’ll file suit on behalf of several businesses, including The DogHouse, the Masters’ Club and MyrtleBeachBikeWeek.com in federal court inFlorence first thing Monday morning, and ask a judge to issue a temporaryrestraining order to prevent enforcement of the noise-ordinance amendment,the nuisance-law amendment and the new ordinance that restricts people fromusing Myrtle Beach as the focus when advertising unpermitted events such asthe bike rallies.

“It’s a First Amendment issue,” Coe said Friday afternoon. “People areafraid to speak, to advertise or hold events for fear they will be chargedwith crimes.”

Coe contends the newly adopted ordinances and amendments interfere withinterstate commerce, because many of the businesses that participate in themotorcycle rallies in Horry County are from out of state. She also said thenew laws are vague, especially when it comes to defining nuisances.

“How do you draw the line between what’s a rally and what’s just an event?”she said. “This is basically just a hammer on businesses.”

City Manager Tom Leath had not heard about Coe’s intended suit Fridayafternoon, and said the city doesn’t usually discuss pending legal matters.

But challenges to the 15 ordinances the city passed last week to curb theMay motorcycle rallies are not unexpected, he said.

“If we are sued on any grounds, we will vigorously defend ourselves,” Leathsaid.

Coe said this suit targets only the three ordinances and amendments thattook effect this week, immediately after the city council gave them finalapproval Tuesday. Twelve other ordinances go into effect in 90 days, and Coesaid she will challenge those, as well.

DAYTONA TWIN TUNER EX FI CONTROLLER GETS EXEMPTION ORDER D-641 BY ARB– DAYTONA Twin Tec has gained an Executive Order from CARB allowing its Twin Tuner EX fuel controller for 2001-2008 Twin-Cam models to be used on bikes in California.

According to details on the Exemption Order, it will only remain valid: “?provided the installation instructions for the Twin Tuner EX will not recommend tuning the motorcycle to specifications different from those of the Daytona Twin Tec LLC.”

Daytona Twin Tec claims the Twin Tuner provides users with the easy ability to adjust the bike’s fuel injection system to optimize the use of other performance modifications such as camshafts, free flowing exhausts and low restriction air filters. Fitment of the Twin Tuner is done by the removal of five wires from the Delphi ECM connector, insertion of those wires into the mating connector of the controller, then inserting five new wires from the Twin Tuner into the ECM connector, and connecting one ground wire.

Adjustments to the bike’s fueling are made using the mode and up/down push button switches on the Twin Tuner in the RPM and throttle position ranges required by most applications. The fuel trim value is displayed on a LED display. The Twin Tuner also has an advanced mode, where users can access the optional USB interface and PC Link Tuner software to make precise fuel adjustments. The PC Link Tuner software uses the same RPM rows and throttle position columns as the Dynojet Power Commander, allowing user-created Dynojet Power Commander files to be re-used.

Second, let me apologize for not being there to accept the trophies. We had planned all week on riding that particular day, and it was our last chance. We were set up as part of the Limp Nickie Lot at the County Line Saloon, and we didn’t have many chances to ride the whole time we were out there.

Apparently I won a few prizes from your sponsors too. I have spoken with Ray from W8less and gotten squared away with him. I am actually amped to use his new rotors. I guess I also won a set of pipes, but I really was not told from whom. Any help with this would be greatly appreciated.

KRAWIEC RACES V-ROD TO FINAL ROUND AT MEMPHIS NHRA DRAGS–Screamin? Eagle Rider Gains on Smith in NHRA Pro Stock Motorcycle Title Chase

MEMPHIS, TENN. (Sept. 28, 2008) – Screamin? Eagle/Vance & Hines rider Eddie Krawiec raced a Harley-Davidson V-Rod to the final round of NHRA Pro Stock Motorcycle eliminations at the O?Reilly Midsouth Nationals at Memphis Motorsports Park. Krawiec retained his second-place position in the Countdown to One championship points standings, and gained 17 points on the series leader, NitroFish Buell rider Matt Smith. Krawiec is now 42 points behind Smith with two events left on the schedule.

Krawiec defeated Smith in the third round at Memphis when Smith fouled by just 0.005 seconds. In the final round, Krawiec beat Schumacher Electric Suzuki rider Craig Treble off the line but lost when his motorcycle shut down just after the start.

?We had an electrical gremlin that popped up in the final qualifying round on Saturday, and we thought we had it fixed,? said Krawiec, who made the fourth final-round appearance of his career at Memphis. ?My Harley-Davidson was flawless in the first two rounds on Sunday, but the problem reappeared in round three and the bike shut off at the top of first gear. Luckily Smith fouled so we won that round. We thought we had it solved for the final, but the bike just shut off a half-second after I launched. I had him by .040 on the tree, and I think the race is over if we can get down the track.?

Krawiec qualified in seventh position for the event with a run of 7.002 seconds, and made two runs under seven seconds to defeat Hector Arana and Chris Rivas in the first two rounds at Memphis.

?We made up some ground on the leader this weekend,? said Krawiec. ?With two races left we?ve just got to stay consistent. We?ve got a month off to go to the shop and get the bike sorted out and ready for Las Vegas.?

Screamin? Eagle/Vance & Hines rider Andrew Hines qualified fourth at Memphis with a 6.992 ET. Hines defeated Joe DeSantis in the first round, but fouled by 0.010 seconds to hand a second-round win to Indicom Electric Buell rider Angie McBride.

After three rounds of the five-round NHRA Pro Stock Motorcycle Countdown to One series for the championship, Smith leads with 2319 points. Krawiec holds down second place with 2277 points. Rivas is third with 2240 points, followed by Angelle Sampey 2217, Steve Johnson with 2200, and Hines in sixth with 2187 points.

VERTICLE LICENSE PLATES ILLEGAL IN FLORIDA– It appears that some of the law enforcement agencies around the State of Florida are trying to get a jump on issuing tickets for Vertical License Plates on Motorcycles.The law does Not Go Into Affect Until October 1, 2008.

I did hear from a rider in Palm Bay that a friend of his has received one and now reports from Panama City Beach during the Thunder Beach Rally.

Here is a sample, “We went to Thunderbeach this weekend, which is held here in Panama City Beach. Some friends of mine were pulled over for vertical license plates, even though their bikes were registered in Alabama. The cops are already using this just to pull people over. It is expected that this will be a issue at Biketoberfest as well!”

THE REAL PROBLEM WITH MOTORCYCLE ACCIDENTS–Subject: The bottom line is, pay attention when you're behind the wheel. Bikers, Motorcyclists' Lives depend on it.

We have the Right to travel these roads of the USA as Bikers, Motorcyclist. We embrace Risk every time we mount our motorcycle, but the risks increase substantially with multiplied numbers of motorists and increased allowable distraction to driving. The other side of the coin is legislative. The government wants to put the safety responsibility on motorcyclists, with expanded helmet laws and forced training mandates. The heat should be on the killer car people. It's bullshit as you will see.

Drivers don't think that multi-tasking should be banned by the law. Can we force driver training for drivers? In fact, no training is dangerous.

Does this sound familiar. Motorists are thinking of their Freedom and Rights too.

Distracted drivers who are busy communicating, being entertained, guided or dining are being aggressive because they are willfully imposing their own level of risk on others. Distracted drivers are not only a danger to themselves but to motorcyclist. Forcing higher risk on others is aggressive. Maybe the distracted/aggressive driver thinks, Oh, I can handle it, but can others? I consider distracted driving as a form of aggressive driving. Drivers who use communication devices and drive distracted as a result are being aggressive drivers. A large danger to motorcyclist.

Internet access from a moving vehicle is a reality today, and getting bigger each month. Research on cell phone use by drivers shows that many drivers become dangerous due to distraction. They are especially at risk and dangerous–unless they train themselves. We don't know of any training programs for Internet access in cars, or for other multi-tasking activities. We recommend that these be put in place by the industry and government. But in the meantime, drivers can train themselves, but will they?

Can the distracted driver be trained? Attitude dictates the answer.

First, drivers must acknowledge that they need to train themselves, and if they don't, they become a danger to themselves and others. So until they go through the training, they ought not to allow themselves to use the equipment while the car is moving.

Second, they need to practice the equipment over and over again while the car is not moving, until they can do whatever it is with closed yes and while talking to a passenger.

Third, they cautiously begin to use features, one at a time while the car is moving in the right lane without too much traffic, thus gradually increasing the times and places of use. We also recommend monitoring yourself and keeping a Driving Log or Diary where you record the errors you've seen yourself make.

Unless drivers voluntarily train themselves, it's likely that government regulations and restrictions will be the reaction–like Band-Aid mandatory helmet laws for motorcyclist. A very poor solution in any case.

Helmets are not the answer. In fact they're a hindrance to defensive riding.

Researchers at the University of Utah have found that drivers using cell phones, even hands-free devices, experience a decrease in the ability to process peripheral vision, creating a potentially lethal “tunnel vision.” This “inattention blindness” slows reaction time by 20% and resulted in some of the 20 test subjects missing half the red lights they encountered in simulated driving.

“We found that when people are on the phone, the amount of information they are taking in is significantly reduced,” says associate professor David Strayer. “People were missing things, like cars swerving in front or sudden lane changes. We had at least three rear-end collisions.” The Utah study is only the latest investigation into the effects of driving and cell phone use, and most of the others have also demonstrated some degree of impairment. And while most studies have focused on the distractions of dialing or holding a phone, the Utah research tried to focus on the distractions caused by having a conversation. New York is the only state to have instituted laws against the practice, but 30 more states have similar legislation pending.

Imagine if this testing included cell phone use while monitoring a GPS, messing with a CD changer and being distracted by a baby crying in the back seat.

Distracted driving contributes to 25 percent of all automobile crashes, according to the National Highway Traffic Safety Administration.Joseph Tessmer, a NHTSA statistician, estimated 20% to 30% of fatal accidents are due to distractions, but said it's impossible to know for sure because only a few states document distractions in accident reports. But the correct argument is that multi-tasking can lead to driver distraction when drivers haven't properly trained themselves to use the new car gadgets. This is true for older devices like the familiar radio and CD as well as the new, GPS systems, DVD players, phones, and e-mail. Multi-tasking becomes severe occasions for drivers to make more mistakes, when they fail to train themselves properly. This increased training is a joint responsibility of the individual driver and the government? ..How about common sense!

NHTSA surveyed 4,010 drivers in spring 2002 and asked about a variety of potentially distracting behaviors (Royal, 2003, p. 1). The vast majority reported these behaviors on some trips, often on many or most trips. The most common were:

81 percent talked to other passengers on some trips;
66 percent changed radio stations or looked for CDs or tapes;
49 percent ate or drank;
26 percent took incoming calls on a cell phone and 25 percent made outgoing calls;
24 percent dealt with children in the back seat;
12 percent read a map or directions.

Cell phones are one of the most common distractions, a study released by NHTSA and Virginia Tech's Transportation Institute showed. However, according to AAA and NHTSA, it is the intellectual activity of talking on a cell phone, rather than the phone itself, that impairs ability to concentrate and retain control of one's vehicle. http://www.vtti.vt.edu/PDF/100-Car_Fact-Sheet.pdf A recent study that monitored 100 drivers for a year, using specialized instrumentation, reported that nearly 80 percent of the 72 recorded crashes and 65 percent of the 761 near-crashes involved driver inattention just prior to the incident (VTTI, 2005).

In crashes where distractions were reported, the most common distractions were similar in NHTSA's driver survey and crash investigations.

37 percent in survey, 29 percent in crashes: something outside the car – street sign, another driver;
19 percent in survey, 11 percent in crashes: other passengers, including children;
16 percent in survey, 21 percent in crashes: object or controls inside the car;
2 percent in survey, 2 percent in crashes: dialing or using a cell phone.

Other distractions, such as eating, tending to children, talking with others in the car, reading maps and applying makeup also is problematic. A study funded by AAA's Foundation for Traffic Safety found that using a hands-free cell phone and tuning a car radio are equally distracting. Anything that takes drivers' eyes and minds off the road or hands off the wheel is distracting, cautions the NHTSA.

Frequency of the distraction and multi-tasking further increased risk. Looking away from the road for two seconds or longer makes a driver's odds of being involved in a crash nearly twice as high, found a study released by by AAA's Foundation for Traffic Safety and Virginia Tech.http://www.aaafoundation.org/pdf/RiskyDrivingReport.pdf

A survey conducted by AAA Colorado last year showed that 51 percent of teens surveyed around the state admitted to sending or receiving text messages while driving, and 66 percent said they talked on their cell phones while driving. Thirty eight percent of the respondents acknowledged taking their eyes off the road when texting while driving. AAA and its partners hope the study will create more awareness of the need for new driver safety and education. Colorado law prohibits drivers of any age from operating cell phones while holding learners' permits.

“Aggressive driving” is defined as an incident in which an angry or impatient motorist or passenger intentionally injures or kills another motorist, motorcyclist, passenger, or pedestrian, or attempts to injure or kill another motorist, motorcyclist, passenger, or pedestrian, in response to a traffic dispute, altercation, or grievance. It is also considered “aggressive driving” when an angry or vengeful motorist intentionally drives his or her vehicle into a building or other structure or property.

When drivers overstep this line, they become socially and legally responsible. Drivers who allow themselves to be distracted by their multi-tasking activities are increasing the risk factor for themselves and imposing that dangerous limit on motorcyclist, and others–passengers, other drivers, pedestrians. This increased risk to which others are subjected is thus similar to other driver behavior that are considered aggressive and illegal: going through red lights, failing to yield, exceeding safe speed limits, reckless weaving, drinking and driving, driving.

Distracted driving and Aggressive driving, whatever the cause, is an issue for drivers of all ages. The bottom line is, pay attention when you're behind the wheel. Bikers' and Motorcyclists' Lives depend on it.

MYRTLE BEACH, DA BASTARDS, pass rally ordinances [… and Lid Law]– All 15 of Myrtle Beach’s proposed bike rally options have become law, though with some modifications.

At this morning’s city council workshop, rally proponents raised objections to some details and some entire proposals, like the one that requires riders to wear helmets and protective eyewear within city limits.

Of all the proposals designed to curtail the May motorcycle rallies that draw more than 300,000 to the Grand Strand each year, the helmet law is the least popular among rally supporters.

They say wearing a helmet is actually unsafe and that the city’s rule making noncompliance an infraction instead of a crime still supersedes state law.That ordinance didn’t face any changes before it passed 5-1, with Councilman Randal Wallace dissenting. He has never agreed with the helmet law.

The other ordinances passed 6-0, with Chuck Martino absent.

The city planned on limiting parking to one motorcycle per space, but after bikers made the case for multiple bikes in one spot to save parking spaces for other users, the council at this afternoon’s meeting voted to allow no more than two bikes per public space.Councilmembers also passed the 2 a.m. bar-closing law, which says any bar that wants to remain open after 2 a.m. must apply for an exemption and make its security, underage drinking and overpouring policies and procedures clear to the city.

But until this afternoon, the council had been planning to require all official security personnel to be licensed and bonded. Councilmembers removed the bonding requirement before passing the second and final draft of the ordinance.

The juvenile curfew will go into effect in 90 days, as will anti-loitering and public drinking rules and more. Other rules take effect immediately, like stricter noise standards and adding rallies and other unpermitted, unmanaged events to the city’s list of nuisances.

Lawyers representing some of the businesses that object to the ordinances attended both the workshop and meeting. Suzanne Coe of Greenville, an attorney for The Dog House and The Masters’ Club, spoke up several times during both gatherings to warn the city about legal challenges she sees coming.

In the end, though, the city council said it would face whatever legal challenges come up.

Speakers accused the council of discriminating against bikers, attorney Beth Marlow of Charleston, representing Harley-Davidson of Myrtle Beach and Festival Promotions, registered her objections to a variety of ordinances, including the one that allows the city to hold promoters of events that spill over into the city liable for the city’s expenses.

But she said after the meeting that she doesn’t anticipate filing any motions to try and stop the city from enforcing the new laws — yet.

Later today or tomorrow morning, before I race to the airport, I’ll launch our first Mudflap Girl Bike install. We’re building the Mudflap Girl bike for a friend and you’ll see the touring FXR come together right here. Hopefully, Johnny Humble will post another Root Beer Bobber story next week.
