LATEST STORY–Horry staff suggests vendor limits during motorcycle ralliesCouncil members mull Waterway rally boundary

Horry County could reduce the number of vendors east of the IntracoastalWaterway to cut back on congestion during the area’s motorcycle rallies,according to a proposal from county staff Tuesday.

The presentation was given to Horry County Council members, who differedon what to do regarding the area’s fall and spring rallies.

Councilman Brent Schulz, who represents parts of Myrtle Beach and NorthMyrtle Beach, said he wanted to get rid of all the vendors in hisdistrict.

But Councilman Bob Grabowski said reducing vendors even by half was toodrastic.

Both men are serving on a county committee that will make arecommendation to Horry County Council on what should be done about therallies. The measure requires approval by the full council.

The county’s efforts come after Myrtle Beach passed a set of ordinancesaimed at curtailing the rallies. The city also raised property taxes forits residents earlier this year to fund those efforts.

Bike rally vendors must get permits to operate. For the Harley-Davidsonspring rally, the county issued nearly 400 vendor permits, 350 east ofthe waterway.

Council members suggested limiting the total number of vendors east ofthe waterway to 200, said County Administrator Danny Knight. They alsosuggested breaking the county into vending zones and limiting thepermits to half of what was issued this year in those areas.

County staff’s original proposal said vendors would only be allowed atshopping centers greater than 35 acres east of the waterway.

But Councilman Harold Worley said he was concerned such a rule wouldunfairly punish smaller establishments that also host vendors. Staffwill be modifying their proposal for the committee’s next meeting onOct. 22.

County staff’s original proposal called for issuing only 100 permitseast of the waterway, where much of the complaints from permanentresidents regarding noise, congestion and rowdy behavior areoriginating. Of those 100 permits, 50 would be located both north andsouth of U.S. 501.

Another 100 permits would be issued for vendors between the WaccamawRiver and the waterway.Another 200 permits would be issued west of the river, the proposalsaid.The price of a permit would be modified: $1,500 east of the waterway,$1,000 between the waterway and the river and $500 west of the river.The permits currently cost $700, plus a $100 hawkers license.

Staff also proposed banning outdoor entertainment, such as wet T-shirtcontests, burn-out pits and concerts, unless a special event permit isapproved by the county.

Robert Kelley, a local hotelier representing a group of about 80businesses, said he is pleased the council is looking at all sides,unlike the city.”A possible worldwide recession stands before us, and what does theMyrtle Beach City Council do?” Kelley told County Council members. “Theywant to drive away 500,000 people who love coming here year after year.”

Sharon Kemerer, a Myrtle Beach resident who is also a sales manager at alocal resort, asked the council to consider the economic ramificationsof curtailing the bike rallies.

“This is a tourist area with a tourist-based economy,” she said. “Ifpeople want to live in a quiet, sleepy area, at least along the coast,they should have moved somewhere else.”

But Garden City Beach resident Judy Price implored the council to dosomething about unruly behavior during the rallies. Speakers blareprofanity across the area, she said, and scantily clad women advertisebike washes, sometimes in the view of children.

“We have been told to get over it, quit whining about the noise andleave for the rallies,” she said. “Some people can’t leave. Childrenhave to go to school. People have to work. And some people are elderlyand sick.”

MADMAN DAVE ZIEN TO BREAK 1 MILLION MILES ON A HARLEY-DAVIDSON–Dave Zien is really on a roll. He’s trying to hit 1 million miles on the same motorcycle, his 1991 FXRP, and he’s almost there. Wants to hit it around the second week in November. Check out our web page, www.hupy.com and watch the Zien mileage tracker change each day. He’s at 985,460 now. He called me a couple of minutes ago from Fort Stockton, Texas. Yesterday around this time he was in Pensacola, Florida, after returning from San Diego. He’s on a Coast to Coast marathon, trying to do it three times in a row. He did a Bun Burner night before last, 1,542 in 24 hours.

He wants to roll up to LA and the Bikernet Headquarters, after hitting San Diego again, and maybe on up to Sacramento before returning to LA. He’d like to have Jay Leno ride the bike for a few miles, just to be a part of this historic event. Not sure if that will happen but it would be great. Vicki and I would fly out to be in the audience if that took place on October 22 or 23rd.

When he makes his million mile mark, we want him to roll into downtown Milwaukee as the speedometer rolls over from 999,000.

We’re organizing a big landing party and plan on inviting all kinds of riders and organizations to participate. Hopefully, we can land at the Harley-Davidson Museum, but that’s up in the air right now. Keep watching the mileage tracker, and if you want to be a part of this historic event, give me a call and I’ll see if we can’t arrange for you to fly in and cover this first hand for Bikernet. Dave would even let you ride his fossil FXRP. Now that’s something you can’t say you’ve done before?rode a Harley with 1 million miles on it.

AM I TOTALLY NUTS? YOU DECIDE —As if the sorry state of the publishing industry AND the economic mess our country is facing isn’t enough of a problem, I have decided there isn’t enough to worry about. So next weekend (October 25/26) I am planning on racing my 1931 Harley-Davidson flathead motorcycle at the Maxton Mile in Maxton, NC to attempt to set a land speed record.

As the publisher of American Iron Magazine, the world’s best selling motorcycle magazine on the newsstand, I sometimes wonder how I get myself into these weird situations. But there you have it, I am committed (or perhaps should be committed) to race my vintage Harley as fast as it will go in a straight and flat one mile course.

If you have any interest in watching me try my hand at land speed record racing, I’d like to invite you to Maxton, a small town near the North Carolina/South Carolina border. Please spread the word to anyone you think might get a kick out of this. The race weekend is open to old and new motorcycles, cars and trucks. So there will be plenty of fast paced action all weekend. Bring ear plugs and a comfortable seat as it can get pretty loud and there are no stands or bleachers at this 1.9 mile long old World War II bomber landing strip that we use as the race track.

In case you are not familiar with LSR (Land Speed Racing) the idea is to go as fast as you possibly can in a long straight away, and your speed is recorded by radar at the end of a 1 mile run. You then have almost another mile to slow down.

We will be working with the owners of Wheels Through Time museum in preparing my 77 year old Harley-Davidson motorcycle for the race. We will be featuring a series of articles on this event as well as the preparation of the motorcycle in future issues of American Iron Magazine and will have updates on-line at www.aimag.com .

HARLEY-DAVIDSON REPORTS 2008 THIRD QUARTER RESULTS — Milwaukee, Wis., October 16, 2008 — Harley-Davidson, Inc. (NYSE: HOG) today announced its results for the third quarter ended September 28, 2008. Revenue for the quarter was $1.42 billion compared to $1.54 billion in the year ago quarter, a 7.7 percent decrease. Net income for the quarter was $166.5 million compared to $265.0 million in the third quarter 2007, a decrease of 37.1 percent. Third quarter diluted earnings per share were $0.71, a 33.6 percent decrease compared to last year?s $1.07.

?In the U.S., dealer retail sales of new Harley-Davidson motorcycles in the quarter were in line with our expectations,? said Jim Ziemer, Chief Executive Officer of Harley-Davidson, Inc. ?Although Harley-Davidson retail motorcycle sales in international markets overall continued to grow double digits in the quarter, unit sales in several European countries slowed more than we anticipated during September as a result of deteriorating economic conditions. We continue to carefully monitor all markets in light of the potential impact of the current economic realities.?

For the full year 2008, the Company has narrowed its shipment expectations to 303,500 to 306,000 Harley-Davidson motorcycles. The Company has narrowed its expectations for diluted earnings per share for the full year to $3.00 to $3.10 from the prior range of $3.00 to $3.18.

?We also have been able to maintain Harley-Davidson Financial Services? position as a stable, consistent source of financing for dealers and retail customers during these turbulent conditions in the credit markets,? Ziemer said. ?Prudent management and customer access to credit will continue to be priorities at HDFS.?

?During the third quarter, we completed our acquisition of Italian motorcycle maker MV Agusta Group, expanding our opportunities in Europe. Our 105th Anniversary Celebration at the end of August drew tremendous, highly enthusiastic crowds. And we opened the Harley-Davidson Museum, with its broad appeal to riders and non-riders alike. So even in the midst of economic uncertainty, we continue to broaden our appeal, plant seeds for the future and give people unparalleled experiences and reasons to ride,? Ziemer said.

?Going forward, we expect the global economy and consumer concerns to continue to create challenges for Harley-Davidson through the end of the year and in 2009. I remain confident about our future as we continue to manage and reinvest in the business,? said Ziemer.

Motorcycles and Related Products Segment ? Third Quarter Results

Revenue from Harley-Davidson motorcycles was $1.05 billion, a decrease of $131.7 million or 11.1 percent versus the same period last year. Shipments of Harley-Davidson motorcycles totaled 74,704 units, a decrease of 11,831 units or 13.7 percent compared to last year?s third quarter.

Revenue from Parts and Accessories (P&A), which consists of Genuine Motor Parts and Genuine Motor Accessories, totaled $259.0 million, an increase of $7.5 million or 3.0 percent over the year-ago quarter. Revenue from General Merchandise, which consists of

MotorClothes apparel and collectibles, totaled $84.0 million, an increase of $0.8 million or 1.0 percent over the year-ago quarter.

Gross margin for the third quarter of 2008 was 34.0 percent of revenue compared to 38.4 percent for the third quarter last year. This decrease is primarily due to higher product costs and the allocation of fixed costs over fewer units than last year?s third quarter. Third quarter operating margin decreased to 16.4 percent from 23.2 percent in the third quarter of 2007. Operating margin for the third quarter of 2008 includes the impact of a one-time $16.6 million expense related to the value of acquired in-process research and development at MV Agusta Group.

Motorcycle Retail Sales Data

During the third quarter, worldwide retail sales of Harley-Davidson motorcycles decreased 9.6 percent compared to the third quarter of 2007. U.S. retail sales of Harley-Davidson motorcycles decreased 15.5 percent for the quarter. The heavyweight motorcycle market in the U.S. decreased 3.1 percent for the same period.

Retail sales of Harley-Davidson motorcycles grew 11.3 percent in the Company?s international markets during the third quarter of 2008 compared to the third quarter of 2007. Third quarter retail sales increased 12.4 percent in Canada; the Europe Region was up 2.9 percent; the Asia Pacific Region was up 17.5 percent; and the Latin America Region was up 41.6 percent.

During the first nine months of 2008, worldwide retail sales of Harley-Davidson motorcycles decreased 6.0 percent compared to the prior year. In the U.S., Harley-Davidson motorcycle retail sales decreased 11.9 percent for the first nine months of the year while the U.S. heavyweight market was down 4.0 percent for the same period. International retail sales increased by 12.6 percent for the first nine months of 2008.

MV Agusta

On August 8, 2008, the Company completed the purchase of the privately-held Italian motorcycle maker MV Agusta Group. The Company acquired 100 percent of MV Agusta Group shares for total consideration of 68.3 million euros ($105.1 million), which includes the satisfaction of existing bank debt for 47.5 million euros ($73.2 million). As a result of the acquisition, the Company recorded $87.9 million of goodwill and the $16.6 million one-time expense related to the value of acquired in-process research and development. These results are included in the quarterly financial data.

Financial Services Segment

Harley-Davidson Financial Services (HDFS) operating income for the third quarter was $35.6 million, a decrease of $13.9 million or 28.0 percent compared to the year-ago quarter. The decrease is primarily due to a $9.4 million write-down of finance receivables held for sale to fair value. In addition, last year?s third quarter included a $3.5 million securitization gain compared to no securitization transaction during the third quarter of 2008.

Income Tax Rate

The Company’s third quarter effective income tax rate was 38.2 percent compared to 35.5 percent in the same quarter last year. The third quarter increase was due primarily to a non-deductible in-process research and development charge for MV Agusta Group and the expiration of the federal research and development tax credit as of December 31, 2007. In October 2008, the federal research and development tax credit was reinstated for two years retroactive to January 1, 2008 continuing through December 31, 2009. The Company expects its full year effective income tax rate in 2008 will be approximately 35.5 percent.

Harley-Davidson, Inc. – Nine Month ResultsFor the first nine months of 2008, revenue totaled $4.30 billion, a 0.9 percent decrease from the year-ago period. Diluted earnings per share were $2.45, a decrease of 16.9 percent compared to the same period last year.

Through the first nine months of this year, shipments of Harley-Davidson motorcycles were 226,898 units, a 9.0 percent decrease compared to last year?s 249,413 units. Harley-Davidson motorcycle revenue was $3.26 billion, which is down 2.2 percent compared to last year?s $3.33 billion. P&A revenue totaled $706.6 million, a 0.5 percent increase over last year?s $703.1 million.

General Merchandise revenue totaled $244.8 million, a 5.5 percent increase compared to $232.0 million during the same period in 2007.

HDFS operating income was $107.7 million, a 38.0 percent decrease from last year?s $173.6 million.

Cash FlowCash and marketable securities totaled $504.9 million as of September 28, 2008. Cash used by operations was $221.2 million, and capital expenditures were $153.7 million during the first nine months of 2008. For the full year of 2008, capital expenditures are still expected to be between $235 million and $250 million.

Stock Repurchase

The Company repurchased 2.5 million shares of its common stock at a cost of $100.1 million during the third quarter of 2008. On September 28, 2008, the Company had 232.8 million shares of common stock outstanding.

As of September 28, 2008, there were 16.7 million shares remaining on a board-approved share repurchase authorization. An additional board-approved share repurchase authorization is in place to offset option exercises.

Undercover Investigation Reveals Hormel Supplier’s Abuse of Mother hogs and hoglets–For more than three months, PETA went undercover at an Iowa pig factory farm, which supplies piglets who are raised and killed for Hormel products. PETA found rampant cruelty to animals – committed by workers and supervisors.

The farm changed ownership and management during PETA’s investigation, but that made no difference to the animals who were born and confined there: Abuse and neglect were widespread during PETA’s entire investigation.

The following are just some of the abuses that were documented:

Multiple pigs were beaten with metal gate rods, and lacerations were found on more than 30 sows – which is probably evidence of more abuse.

A worker hit a young pig in the face four times with the edge of a herding board, and investigators witnessed dozens of similar incidents involving this worker and 11 other workers.

Two men – including a supervisor – were witnessed jabbing clothespins into pigs’ eyes and faces. A supervisor also poked two animals in the eyes with his fingers.

The findings on this Iowa pig farm, however, were not limited to cruelty to animals. PETA also documented an apparent violation of the Federal Food, Drug, and Cosmetic Act, and PETA has filed a complaint with the Food and Drug Administration. Animals who were to be killed for human consumption were sprayed with a substance that contains gentian violet – a chemical that is linked to certain cancers – thereby making their flesh “adulterated” under federal law.

BIKERNET CHRISTMAS PARTY BLUES–Joe wakes up with a huge hangover after attending his Company’s Christmas Party. He didn’t even remember how he got home from the party. As bad as he was feeling, he wondered if he did something wrong.

Joe had to force himself to open his eyes, and the first thing he saw is a couple of aspirins next to a glass of water on the side table. And, next to them, a single red rose!

Local builder scoops first Cologne Custom Championship at INTERMOT Expo–Christoph Madaus (Madaus Design, www.twintrax.de) from Cologne won top honors and 5,000 Euro expenses contribution towards competing at the 2009 Official World Championship of Custom Bike Builing (Sturgis, SD, August 2nd to 5th) at the latest official Affiliate event to be held.

The prestigious INTERMOT Expo draws up to 300,000 visitors, and is acknowledged worldwide as one of the most important motorcycle industry events on the global calendar. As a new feature, this year saw the show become affiliated to the OWC program for the first time with the launch of the Cologne Custom Champoionship, an invitational custom bike event designed to showcase the ‘best-of-the-best’ from the previous two years of the affiliate program and European Championships in Europe.

Christoph followed that up with 15th place at the European Championship in Mainz, Germany, in March this year and, having won many admirers for both the design and engineering innovation and execution of his project, the bike will now make its US debut at Sturgis next year as a result of this win.

Featuring two S&S 1340cc 45 degree air-cooled v-twin engines mounted one behind the other, many have commented that not only has Christoph pulled off something that many would have thought impossible (the bike is a “runner” and was seen to be so by the AMD/OWC personnel present at the Big Twin Show last year), but that he has done so to a level of engineering and finish values that are of OE production bike standards.

Second place was taken by Tobias Guckel’s much admired ‘Seppster II’ (TGS Motorcycles, www.tgs-motorcycles.de), which pulled second place in this year’s European Championship and third place in this year’s World Championship.

Third place went to Andreas Bergerforth’s ‘Open Mind’ (Thunderbike, Germany, www.thunderbike.de) which pulled 5th in the World Championship and is the reigning European Championship winning build.

The results reinforced the validity of the plan to develop the Cologne Custom Championship as a biennial invitational for Europe’s top bikes as a celebration of excellence that exposes the engineering quality of the contemporary custom industry to many hundreds of thousands more riders than would normally be exposed to it, and we here at AMD would like to extend the thanks of all those involved in the custom motorcycle industry for their generous support in making such a showcase possible.

The next INTERMOT Expo and Cologne Custom Championship will be staged in the same venue on October 13-17, 2010.

WHEELS THROUGH TIME MUSEUM ANNOUNCEMENT–This past weekend, the Wheels Through Time Museum in Maggie Valley, NC held the Grand Opening of its newest exhibit, MotorCops: A 100 Year Love Affair Between Police and The Motorcycle.” The museum, which houses one of the world’s premier collections of rare American motorcycles and unique automobiles, hosted over 2000 visitors during the opening weekend in a tribute to the long-standing relationship between motorcycles and law enforcement.

The museum announced this past weekend’s grand opening in late July, offering free admission to all law enforcement officials, public servants, and family members. The exhibit, which will run for the final sixty days of the museum’s operations in North Carolina, has already attracted visitors from over 30 states and 9 countries.

“MotorCops” gives visitors an in-depth look into the 100 year history of motorcycle law enforcement, which began with Detroit Police Department’s employment of the first official motorcycle officer in 1908. Since that ground-breaking decision, thousands of departments across the country have opted to use motorcycles as patrol vehicles due to their maneuverability and reliability. Today, there are over 3400 police motorcycle units in the U.S., translating to tens of thousands of motorcycle officers who protect and serve our country every day.

The exhibit, which is featured in the main gallery of the museum’s 38,000 square foot facility, combines hundreds of photographs, first-hand stories, memorabilia, and machines from the earliest days of our two- and three-wheeled patrolling past. Artifacts such as official patrol uniforms, department pictures, patches, and other memorabilia have been donated by countless current and retired officers from around the country and are displayed in an arrangement providing a unique glimpse into the lives of those who have protected and served over the past 100 years. Particular highlights of the exhibit range from official Harley-Davidson archived photos to machines such as the late Steve McQueen’s 1909 Pierce and a 2001 Harley-Davidson Police Motorcycle ridden by actor Morgan Freeman in the hit film “Evan Almighty”.

Wheels Through Time Museum Curator, Dale Walksler, was thrilled with the results from the opening weekend. “We’re proud to display our newest exhibit highlighting the 100 year history between police and motorcycles,” said Walksler. “We surpassed our own expectations for this weekend, hosting over 2000 visitors, many of which were motorcycle officers from around the globe. This weekend, we entertained visitors from as far away as India, Hawaii, and hundreds of cities and states in between.”

Ian Kinning, a 28 year motorcycle police officer from Glasgow, Scotland had been planning to attend the grand opening since he caught word of the exhibit in early August. “It brings me a sense of pride that officers like myself and millions of others are being honored for their efforts to serve their the cities, states, and countries, said Kinning. “The museum did a wonderful job preserving our history, and sharing it with each and every one of those who care. And the best part is that they all run.”

Michael Hupy Answers MRF Call for Support– At the Meeting of the Minds this past September in Denver, Colorado, it was brought to the attention of attendees that the MRF was going through some tough financial times. In order to continue providing quality conferences and workshops as well as maintaining the top notch office and lobby efforts in Washington, D.C., there needs to be a further financial commitment from the motorcycle community.

On October 12, 2008, ABATE of Wisconsin held its annual State Meeting. In attendance was Attorney Michael Hupy. After several key speakers reiterated the need for increased donations to the MRF, Attorney Hupy stepped forward and presented MRF President Kirk ?Hardtail? Willard with a check in the amount of $5,000.00.

HERSHEY, Pennsylvania (October 14, 2008) ? Strong sales results from RM Auctions? Vintage Motor Cars of Hershey event last week are evidence the collector car market remains healthy.

The single-day event, held October 10th at the famous Hershey Lodge, captured the attention of the collector car market as enthusiasts were eager to see the impact of the current economic climate on the global hobby. Whilst the October 10th event followed a shaky week on Wall Street, results revealed a positive outlook with total sales surpassing $6.9 million for 84 cars offered, some of which exceeded expectations.

Headlining the single-day sale was a stunning 1933 Duesenberg La Grande Phaeton, considered one of the rarest and most desirable of the open bodied Duesenbergs. A factory supercharged model with just a handful of owners and a continuous history from new, this magnificent example brought an impressive $1,688,500. Other notable sales highlights included a rare and highly desirable 1917 Pierce-Arrow Model 48 Touring Car for $385,000, and an iconic, beautifully restored 1913 Locomobile Model M-48-3 Four Passenger Baby Tonneau for $357,500.

Also stealing the spotlight were a unique series of pedal cars customized by some of today?s leading automotive restorers and designers. Proceeds from the pedal car sales supported the esteemed Antique Automobile Club of America (AACA) association, headquartered in Hershey. Highlights included Josie?s `56, a miniature pink Cadillac complete with actual stock fabric from a 1956 Cadillac, real chrome and 24 karat gold plating for $34,500 and Fifth of Fiesta, so named as is exactly one-fifth the size of an actual 1953 Oldsmobile Fiesta for $23,000.

FULL THROTTLE HITS ALL THE EVENTS– What a great weekend full of events! Full Throttle Magazine was set up at all the major events around the area including Spooks N Scoots, Crystal River Harley-Davidson’s Anniversary Party and the largest event of the weekend COTEE RIVER BIKE FEST!!!

There were over 70 bikes in the bike show and we had to turn them away because we had a limited time for Rev. Jim to judge them all in. Cotee River New Port Richey was packed with people both on Saturday and Sunday. The Daisy Duke Contest had some of the hottest women from around the state of Florida and turned out great. Fortunately, we had a show that was compelling, entertaining and interesting?and brands wanted to be a part of it.?

?The Chopper Challenge? is aimed at the 18-49 demographic, as well as the 35-40 million current motorcycle owner/operators in the U.S.

The series premiered with a Geico (Gecko character inspired) bike, built by master bike builder, Kirk Taylor of Custom Design Studios. BIKERNET ECONOMIST STUDY– We have been hurt in the past few years because the Euro is now available in 500-Euro bills. The $100 U.S. bill used to be the drug dealer’s currency of choice. Every bill printed by our treasury is a virtual loan, to be repaid when someone spends the bill. The longer the bill is held, the better the deal for us. Drug money circulates a long time, is hoarded, swallowed, lost in the toilet, sunk in cigarette boats.

The 500-Euro is now much more convenient for the drug trade, far surpassing our puny $100 bill. Clearly the only thing to do is to issue $1000 and larger U.S. bills. Yes, we’ll be helping out drug dealers, but remember: Country First.

We’ll switch off the phones and I’ll roam through a junk metal plant looking for ? and 1-inch square tubing to make some railings for Mom’s house. She’s 84 and laid up. I asked for a bid to build the railing and the price came in at over $1,800. Bullshit. We’ll make them in a half day.

I know there’s another shop project, before we clean off the lift and I roll the 1915 Paughco 5-Ball Factory Racing frame into place for mock-up.

I’ve ordered 23-inch Black Bike Wheels, Avon Tyres and a Paughco narrow classic front end is on it’s way. Then we’ll start the build with the 100-inch Crazy Horse engine and a 5-Speed JIMS trans.

The plan is to wrap up shop projects so that next week we can focus on our Bikernet EPA study. Information is pouring in from Cal State Northridge, the EPA and Chris Maida at American Iron. We’ll bring you updates as all this stuff begins to make sense. In the meantime, keep your fingers crossed.

The event was witnessed by an FIM official, but the record still awaits official FIM ratification.

WHATTA DAY–My 84-year-old mom just got out of the hospital and I’m waiting for my care-giving orders from my brother. My son dropped off two of my Grandkids. “The X will pick ’em up tomorrow,” he said and peeled out.

We try to keep it quiet around this joint on News day, since it’s like producing a monthly magazine in a day. We’re clamoring over press, product releases, rumors, photos, and bad jokes from dawn to dusk. So today went to shit.

The plumbing flooded the gym and went on the fritz. Jeremiah dropped off a plumber and a homeless biker who needed an engine rebuilt. The grandkids can’t figure out the cooler scooter, so we had to stop and clean the battery terminals. The phone keeps ringing and the economy sucks. Wish I could get the feds to bail me out, just this Thursday. Hell, let’s party.

WASHINGTON UPDATE FROM THE MRF– The US House passed the Health Insurance Restrictions and Limitations Act of 2008 (HR 6908) last week. This bill, as previously reported by the Motorcycle Riders Foundation (MRF), would force insurance providers to disclose upfront, in writing, any activity they are unwilling to provide full payment for an injury sustained while participating in said activity. Currently the insurance providers need only refer to the federal loophole known as the “source of injury exclusion provision” to limit payment for any injury based on the source of the injury.

The bill passed with unanimous consent by the US House and is now being considered by the US Senate Committee on Health, Education, Labor and Pensions (HELP). The Senate has passed legislation that was farther reaching than HR 6809 in a previous Congress so the outlook remains bright but time is running short. The MRF will keep you informed on this important issue.

NHTSA Proposes New Helmet Standards

In a notice of proposed rulemaking (NPRM) earlier this week, the National Highway Traffic Safety Administration (NHTSA) set forth its proposal to modify the current safety standard for helmets, Federal Motor Vehicle Safety Standard 218 (FMVSS 218). The proposal focuses mostly on the least important part of any helmet, the DOT label. The NPRM outlines what NHTSA would like to see on the back of your helmet. A new label to replace the current football shaped sticker with the letters DOT printed in a contrasting color to the background.

NHTSA claims that due to entities printing and selling “Doing Our Thing” that closely resembles the DOT sticker the federal standard has been undermined and needs an upgrade to a bigger better sticker.

The changes the proposal outlines will require including the word “certified”, the manufacturer’s name, and the model of the helmet. The proposal also calls for the sticker to be larger and placed higher up from the bottom of the helmet. The new sticker has one other change, it’s not a> sticker. The NPRM calls for the new label to be a “water decal” to be applied under the helmet’s final clear coat.

A few problems arise with this portion of the proposal. What about helmets that don’t have a clear coat such as leather clad or the popular matte finish? What about the cost to manufacturing, which will certainly be higher than the government estimates? Lastly, how does this affect the 30 helmet choice law states? The answer to that one is, it doesn’t – other than the fact that when you choose to wear a helmet it would have to be DOT certified.

NHTSA also called for some changes to the testing of helmets. None of the changes provide for a more real world condition, just adjusting some of the allowable ranges for helmet puncture and retention.

What is troubling about the proposal is the underlying theme of “safer crashing”. We at the MRF believe that it is best to focus on crash prevention instead of injury mitigation. Helmets do not prevent crashes, educated riders and motorists do.

It’s true that motorcycle fatalities are near historic levels, but so are new unit sales and registrations. With the soaring price of fuel, expect that to continue for the foreseeable future.

So what does NHTSA expect this proposal to do in the real world? Let us refer to some of NHTSA’s own numbers from the proposal. First since this only really affects the 20 mandatory universal helmet law states and the District of Columbia where according to NHTSA’s numbers 15 percent of the riders in those jurisdictions use “novelty” helmets that don’t meet the current FMVSS 218. Reading further NHTSA says that this proposal, if enacted, would realistically reach 5 percent of the 15 percent of riders who now use “novelty” helmets in universal helmet law states. Using NHTSA’s method of guessing at helmet effectiveness, that amounts to about 17-32 lives a year. Now we can certainly all agree that any life saved is a huge success, but the original reason for this proposal was to bring down fatalities significantly. The low double digit decreases don’t really dip the numbers down enough to make this necessary. Again, all life is precious but with government resources running on empty, The MRF believes this is time and money better spent on motorcycle safety programs that focus on avoidance of the crash.

These 1.4kw, 1.7kw & the all-new 1.6kw performance quality starters combine many desirable features into a rugged, great-looking (chrome & polished finish), get-the-job-done unit.

All motors are manufactured in the U.S.A. and Canada using only 100% new parts. Each motoroffers the finest technology available to spin that big high performance engine to life. . . starter clutches utilize 20% oversize rollers, whereas the idler gears are manufactured from cold-headed steel. The end frames are cold-chamber die cast & machined on precision fixtures. Armature hairpins are resistance-fused to the commutator.

The 1.4kw models are great stock replacement motors that also work well with big-inch motors using compression releases. Its design utilizes a coil-wound motor assembly (motor field coilsare copper wound).

The 1.7kw model is the ideal motor for large displacement or hard starting motors, provided4 gauge battery cables are used to reduce voltage losses & the battery used is rated at 300 CCA(minimum).

Its design utilizes a permancent magnet motor coupled to the OEM-style offset gear reduction design that generates high output & torque in a small unit.

No larger than OEM 1.2kw motors, it fits into all Big Twin applications. However, harder on a battery than a coil wound starter, this model is not the best solution for a bar-hopper because there’s a chance the charging system won’t keep the battery fully charged.

The new 1.6kw model is a motor with components designed to produce 1.6kw output with a 300 CCA battery, which is the environment in which the starter operates. Operating with lessload on the battery than the 1.7kw permanent magnet motor above, this coil wound starter is the ideal choice for custom builders.

Note: the motor section of this starter is approx. 1/2″ longer than the OEM unit, requiring modification to or replacement of the oil reservoir filler tube on FL models.

Finally, our 2.0kw model is designed specifically for our Direct Drive Belt Drive Kit. Here thestarter motor sits between the pulleys and drives off of the starter ring gear located on the back side of the front pulley. This re-located starter enables the custom builder to lower the seatingposition of the rider, making for a real cool custom !

SAFERIDER project: FEMA (FEDERATION OF EUROPEAN MOTORCYCLISTS ASSOCIATION) needs motorcyclists? views — In the past, FEMA has found that the development of Intelligent Transport Systems (ITS) often creates two types of problems for motorcyclists:

1. The first is that motorcyclists are generally forgotten in these developments (e.g. Intelligent Infrastructure, V2V communications, etc.);

2. Secondly, transport engineers often simply try to apply what works for cars to motorcycles, completely overlooking the specific characteristics and needs of the motorcycle and the motorcyclist.

Aline Delhaye, FEMA General Secretary, says: ?If motorcyclists want to avoid the implementation of inappropriate new technology on motorcycles, then they have to get involved in the development of ITS technology and provide expertise at the proposal stage, to make sure motorcyclists’ needs and wants are well known by transport stakeholders. This is the reason why FEMA decided to become involved in EU Research programmes, like SAFERIDER?.

The SAFERIDER project aims to study the development of new devices to improve the comfort and safety of riders through passive technology such as warning devices to alert the rider of a potential crash or provide information about black spots or traffic. BIKERNET POLITICAL JOKE FACTORY–While walking down the street one day a US senator is tragically hit by a truck and dies. His soul arrives in heaven and is met by St. Peter at the entrance.

“Welcome to heaven,” says St. Peter. “Before you settle in, it seems there is a problem. We seldom see a high official around these parts, you see, so we’re not sure what to do with you.”

“No problem, just let me in,” says the man.

“Well, I’d like to, but I have orders from higher up. What we’ll do is have you spend one day in hell and one in heaven. Then you can choose where to spend eternity.”

“Really, I’ve made up my mind. I want to be in heaven,” says the senator.

“I’ m sorry, but we have our rules.”

And with that, St. Peter escorts him to the elevator and he goes down, down, down to hell. The doors open and he finds himself in the middle of a green golf course. In the distance is a clubhouse and standing in front of it are all his friends and other politicians who had worked with him.

Everyone is very happy and in evening dress. They run to greet him, Shake his hand, and reminisce about the good times they had while getting Rich at the expense of the people.

They play a friendly game of golf and then dine on lobster, caviar and champagne.

Also present is the devil, who really is a very friendly guy who has a good time dancing and telling jokes. They are having such a good time that before he realizes it, it is time to go.

Everyone gives him a hearty farewell and waves while the elevator rises…

The elevator goes up, up, up and the door reopens on heaven where St. Peter is waiting for him.

“Now it’s time to visit heaven.”

So, 24 hours pass with the senator joining a group of contented souls moving from cloud to cloud, playing the harp and singing. They have a good time and, before he realizes it, the 24 hours have gone by and St. Peter returns.

“Well, then, you’ve spent a day in hell and another in heaven. Now choose your eternity.”

The senator reflects for a minute, then he answers: “Well, I would Never have said it before, I mean heaven has been n delightful, but I think I would be better off in hell.”

So St. Peter escorts him to the elevator and he goes down, down, down to hell.

Now the doors of the elevator open and he’s in the middle of a barren land covered with waste and garbage.

He sees all his friends, dressed in rags, picking up the trash and putting it in black bags as more trash falls from above.

The devil comes over to him and puts his arm around his shoulder. “I don’t understand,” stammers the senator. “Yesterday I was here and there was a golf course and clubhouse, and we ate lobster and caviar, drank champagne, and danced and had a great time. Now there’s just a wasteland full of garbage and my friends look miserable. What happened?”

The devil looks at him, smiles and says, “Yesterday we were campaigning. Today you voted.”

HARLEY-DAVIDSON DESERT PROVING GROUND OPERATIONS TO RELOCATE–Harley-Davidson Motor Company has reached an agreement with Chrysler to test motorcycles at the automaker’s Arizona Proving Grounds (APG) in Yucca, Ariz.

The agreement commences on July 1, 2009. “We will begin moving testing operations from our current Arizona testing facilities in Mesa beginning April 2009 with full utilization of the new facility by July 1,” said Senior Vice President Ron Hutchinson.

Harley-Davidson will improve and occupy several buildings at the APG’s 3,650-acre facility and use an existing five-mile, high-speed, banked oval track for vehicle testing. Other features at the APG include:

The Motor Company will also be constructing a durability road and a vehicle dynamics road course that will be used exclusively for Harley-Davidson and Buell testing.

The decision to relocate the testing operations was prompted when General Motors’ announced plans to sell its Mesa testing facility, a portion of which Harley-Davidson currently leases for testing.

“We are pleased with the new facility and anticipate a smooth transition with little impact to our continued ability to test current and future Harley-Davidson and Buell motorcycles,” said Hutchinson.

Chopper challenge

BIKERNET SPONSORS CHOPPER CHALLENGE–In a highly secret meeting between Bandit and Chopper Challenge Boss, Eric Harryman a sponsorship agreement was signed in blood to promote the next series of Chopper Challenge TV series for 2009 on Bikernet.

Again it will air on CMT and we’ll bring you inside information on the contestants and where you can view last year’s bike line-up during events. Hang on for more reports as filming begins in early 2009.
