MOTORCYCLISTS–GET OUT AND VOTE–THAT’S AN ORDER!–In a matter of days, Americans will make the decision as to who will bethe 44th President of the United States. Presidential elections bring outthe largest number of voters, and the top of the ticket can have adefinite impact on the down ballot races. Those races, specifically the435 seats in the House of Representatives and the 35 seats in the UnitedStates Senate (there are 2 special Senatorial elections this year inaddition to the 33 seats in this cycle) should be of serious interest tous.

In the next Congress we will see debate begin on the re-authorization ofthe Interstate Highway funding act, which has historically been thedefining piece of legislation for us. It is imperative that we support ourfriends in Congress in those down ballot races and not let them get buriedin what could be a landslide vote for President in some states. A defeatof Congressmen who are supportive of our issues could turn what weperceive to be potentially a positive piece of legislation on its ear.

The days of “transfer penalties”, sometimes referred to as “helmet lawblackmail”, could be on the horizon if we don’t get out and vote.

There are over six million Americans who ride motorcycles. Our challengein the coming year will be to convey the message to those who hold publicoffice that:

? Motorcyclists are overwhelmingly registered as voters.
? Motorcyclists show up at the polls on Election Day in a far higherpercentage than almost any other demographic group.
? Motorcyclists are mindful of the voting records and views onmotorcycling of the candidates for congress.
? That when those six million motorcyclists are face to face with theirballots, they will lean to those candidates who are supportive of ourissues.

We can make those points a reality on November 4th. Then, when that factbegins to resonate through the halls of Congress, our problems will beginto fade away.

Everything that we do as activists in the motorcyclists’ rights movementis important. Nothing, however, is as important as voting. It trumpseverything else that we do.

This report is not meant to sway anyone to vote for any particularcandidate for federal office. It is intended to motivate you to get outand vote. Remember, elections are won on Election Day – the actualelection is the only poll that counts.

If you haven’t already taken advantage of early voting, get to the pollson November 4th. Ride your bike, wear your leathers, wear your vest, oryour colors. Bring your helmet into the polling place, or rev your bikewhen you leave. Do it – but most importantly vote.

Think of voting as something that is the most important maintenance taskyou’ll do to keep your bike on the road. Vote as if your riding in futureyears depends on it – it does.

SPECIAL THANKS TO ALL VANCOUVER TOY RUN PARTICIPANTS!–The B.C. Coalition of Motorcyclists and the Lower Mainland Christmas Bureau would like to thank all of the wonderful volunteers, sponsors and riders who came together to support the 30th Annual Vancouver Toy Run on October 5th.

The Toy Run raises much needed toys and funds to provide underprivileged families assistance at Christmas time. This event is one of the most important toy raising events in the Lower Mainland and it directly supports ten local Christmas Bureaus. This year we lucked out with a beautiful sunny day and the ride raised over 4,000 toys and $21,000 in monetary donations with an estimated 5-7,000 people in participating.

The ride left Coquitlam Centre at 10:00 am and proceeded full parade style through Coquitlam, Port Moody, and Burnaby to Vancouver where it ended at the PNE grounds. In celebration of the Vancouver Toy Run’s 30 years of serving the community, the British Columbia Motorcycle Drill Team, sponsored by Megson Fitzpatrick, Motorcycle insurance specialists, gave a special performance at the Coquitlam Centre parking lot before the ride left.

TOUGH CALIFORNIA COP GETS BUSTED–Corruption trial begins for ‘America’s sheriff.’ Carona is charged with conspiracy, mail fraud and witness tampering. Prosecutors say many bribes came from Don Haidl, a wealthy businessman. Carona’s alleged mistress is being tried with him on same charges His wife will be tried later on a single conspiracy charge

SANTA ANA, California (AP) — Six years ago, Orange County Sheriff Michael Carona looked into national television cameras and told the abductor of a 5-year-old girl not to eat and not to sleep: Deputies were right behind him.

The abductor was quickly caught and the way Carona handled the case propelled him into the national spotlight and prompted CNN’s Larry King to nickname him “America’s sheriff.”

On Wednesday, opening statements got under way for the square-jawed, three-time sheriff charged in a federal public corruption case. He is charged with conspiracy, mail fraud and witness tampering. Carona, 53, has vigorously denied the charges.

Also charged are his alleged mistress, who has pleaded not guilty to conspiracy, mail fraud and bankruptcy fraud; and his wife, who has pleaded not guilty to a single count of conspiracy.

Deborah Carona will stand trial after her husband, but his alleged mistress — an attorney — is being tried with him.

The trial is expected to last two months and a series of conversations secretly recorded by one of Carona’s former assistant sheriffs and closest friends promises to figure prominently in the case.

In court papers, the government accuses Carona, who has since stepped down, and his friends of accepting nearly $700,000 in cash, gifts, kickbacks and questionable loans in exchange for political favors beginning in 1998.

Prosecutors say many of those bribes came from Don Haidl, a wealthy businessman.In exchange, authorities say, Carona made Haidl an assistant sheriff and put him in charge of a new reserve deputy program that allowed him to hand out badges and concealed weapons permits in a pay-to-play scheme.

Haidl pleaded guilty last year to tax fraud and agreed to become an undercover informant.

A judge rejected a defense motion to suppress the tapes but did bar some portions where Carona makes sexually explicit and racially offensive remarks.

WEIRD NEWS: NBA PLAYER SUSPENDED OVER MOPED ACCIDENT–The Golden State Warriors suspended 22-year old guard Monta Ellis for 30 games without pay for violating his contract after he seriously injured his ankle in a Moped accident and then compounded his mistake by lying about spraining his ankle playing pickup ball. The high-scoring high-paid guard probably never imagined that trouble would cost him about $3 million – there’s no doubt Ellis violated Paragraph 12 of the NBA’s uniform player Contract, which prohibits a player from engaging “in any activity that a Reasonable person would recognize as involving or exposing the Participant to a substantial risk of bodily injury,” including “driving Or riding a motorcycle or Moped.”

Ellis, who agreed to a six-year deal worth $66 million in July, underwent surgery to repair a torn ligament and is unlikely to be healthy enough to return before mid-December anyway, but the suspension means the guard won’t be paid during his absence.

He was the second-leading scorer for the NBA’s highest-scoring team last season, averaging 20.2 points, 5.0 rebounds and 3.4 assists.

BOOZEFIGHTER URGENT ALERT– Urgent help is needed for Brother Slick of Chapter 94. There was an altercation that had occurred when a fellow Boozefighter was assaulted by a drunk, during a benefit, that Chapter 94 was performing for a young paraplegic student that had suffered injury in a school sports function. This drunk disrupted the benefit with the sole purpose of starting a fight and assaulting one of our members. Anyway, Brother Slick jumped in to defend a fellow Boozefighter. Needless to say, the drunk was slightly injured and is now pressing charges against Brother Slick and asking for a ridiculous amount for damages. Brother Slick has retained a lawyer but desperately needs monetary help with the lawyer fees.

Brother Slick retired from military service of 20 years and now flies a “FLIGHT FOR LIFE” helicopter for a hospital in Pueblo, Colorado. Brother Slick has spent most of his entire life in the defense of you and our freedoms and now flies helicopters to save lives. Chapter 94 is asking you for help. PLEASE, donate what you can to help Brother Slick with his legal fees.

BUB EXHAUST NEWS–BUB to sell its own-brand exhaust product lines direct to dealers in North AmericaBUB Enterprises, speed-demon Denis Manning’s aftermarket exhaust manufacturing business, has announced that it has started to sell its well known own-brand Harley-Davidson replacement and aftermarket exhausts designs direct to dealers in the USA and Canada.

While Manning says he is looking to explore importer/distributor opportunities for sales in Europe, the decision to move away from distributor sales in North America “is predicated solely on sustaining the company’s ability to remain price competitive in an ever-changing market that is fraught with double-digit increases in manufacturing costs.”

Manufacturing in California since 1976, the company now occupies a 40,000 sq ft factory and 15,000 sq ft race shop and R&D facility at Grass Valley, Ca., and opened a second 40,000 sq ft factory at Janesville, Wisconsin, five years ago. Manning says they will self-distribute North American dealer orders from both locations, which gives them two-day shipping to most dealers in the United States.

The company has made huge investments in manufacturing plant and processes in recent years, with robotic polishing, metal cutting six-axis laser and hydro-forming.

Its research and development facilities includes multiple dyno set-ups and, in January 2009, the company will have completed a long-term project to build and equip its own in-house CARB recognized emissions testing and certification facility.

Until recently, the company distributed exclusively through Drag Specialties and Parts Unlimited, and will continue to develop and manufacture the legendary Rinehart Racing exhausts program that remains exclusively available through Drag Specialties.

Newstalgia is one of the largest distributors of custom wheels for hot rods and motorcycles in the country. He describes himself as ?a hot rodder with a passion for blending the old with the new?.

You can see that on his radical 1964 Panhead custom featured in the December issue of IronWorks magazine. The old motor is surrounded with brand-new innovative parts and adaptations of old parts. He says the bike gets lots of looks when he rides it at shows and other events.

LONDON, England (October 29, 2008) ? RM Auctions, in association with Sotheby?s, entered the history books again tonight selling a superb McLaren F1 supercar for ?2,530,000 at the highly anticipated Automobiles of London event.

I finished our burnt Panhead patio table and removed that from the list. I just finished a railing for the back of my mom’s house. She just turned 86 and of course I spaced on her birthday. She’s getting a tad feeble. Most of the parts are in to start the 5-Ball Factory Racer project and it will slip onto the lift this weekend. Check the tapered leg Pauchco Springer. Next week I’m attending the SEMA show in Vegas and may have some very exciting news for our industry in the Sunday Post 11/9. I recently hooked up with an agent for the first Chance Hogan book and he wants me to write a movie treatment. I don’t have a clue, but I’ll finish it in the next two weeks. CALIFORNIA COURTS GOING TO WAR WITH THE MONGOLS–Oct 23, 2008 ? Washington, DC – By Michael Doyle; McClatchy Newspapers – Uncle Sam could end up owning the name of the Mongols, a West Coast motorcycle gang accused by federal prosecutors of “crimes and acts of violence.”

Like other motorcycle outfits including the Hells Angels, the Brotherhood Nomads, the Misfits and the Wicked Women, the Mongols trademarked their name. Now, culminating a three-year undercover investigation, federal prosecutors are hoping to take that name away from them. The move is sure to face court scrutiny.

“This trademark is subject to forfeiture,” U.S. Attorney Thomas O’Brien in Los Angeles declared Tuesday. “If the court grants our request .. . . then if any law enforcement officer sees a Mongol wearing his patch, he will be authorized to stop that gang member and literally take the jacket right off his back.”

The apparently unprecedented trademark forfeiture move comes as authorities in Los Angeles filed a 177-page indictment charging 79 Mongols with an assortment of racketeering, drug and money laundering offenses. Raids pulled in gang members in California, Washington and Colorado, among other states.

While prosecutors target tattooed gang members who bear nicknames like “Risky,” “Bullet” and “Suicide,” however, outside legal experts question the notion of seizing a gang name.

“It’s an interesting theory, but you’ve really got to wonder whether it would have any practical effect,” noted David B. Smith, formerly the deputy director of the Justice Department’s asset forfeiture office. “My hunch is the Mongols are just going to keep wearing their patches.” Smith, the author of “Prosecution and Defense of Forfeiture Cases,” added in an interview Wednesday that while the Justice Department’s move was “pretty clever,” he wondered “what a judge and jury would think about the case.”

Free speech scholar Rodney Smolla, dean of the Washington and Lee University School of Law, added Wednesday that the Justice Department action poses the possibility of “a violation of the First Amendment.” The consequences certainly could be unusual. If the Justice Department succeeds, the federal government will own rights to the name Mongols. The government could then charge violators with trademark infringement; or, at the least, have one more reason to confront gang members on the street.

The Mongols gang has more than 50 chapters in California cities, as well as in a dozen other states. Its greatest strength is in Southern California, where prosecutors say about 400 of the gang’s 600 members live. “Members often commit their crimes and acts of violence with the conviction that they cannot be prosecuted because they believe victims and witnesses are afraid to testify against them,” the indictment states.

Prosecutors identified for potential forfeiture the Mongols name, a home in West Covina, Calif., and “at least” $5 million. Forfeiture would follow conviction. The money and home are conventional forfeiture targets. The trademarked name isn’t.

The self-described Mongol Nation formally filed for a trademark on the name Mongols in July 2003, Patent and Trademark Office records show. The applicants explained they were “promoting the interests of persons in the recreation of riding motorcycles.”

“The membership patch can only be worn by a member, and only if the member is in good standing,” noted the application prepared by the Mongols’ attorney, Michael Doram. The trademark application was signed by Mongols Chief Executive Ruben “Doc” Cavazos, who was among the men arrested Tuesday.

In January 2005, the trademark was granted. In April this year, records show, the Mongol Nation transferred the trademark registration to a newly established Pasadena, Calif., company called Shotgun Productions. Doram also represents Shotgun Productions. “I will have no comment to offer,” Doram said by e-mail Wednesday. The transfer of the trademark registration could potentially complicate the forfeiture scenario, as Shotgun Productions is not named in the new indictment.

More typically, authorities will seize money and property, disabling alleged criminal enterprises while boosting state and federal agency coffers. Last year, the Justice Department reported asset forfeitures totaling $1.5 billion, including a Cessna 441 airplane in Florida, $2.9 million in cash in Beverly Hills and a $14 million home in Las Vegas. Local law-enforcement agencies like the results.

Last year, for instance, the Justice Department reported transferring to the Fresno, Calif., Police Department nine seized vehicles with a combined value of $143,000 while the Gainesville Police Department in Florida got some free electronic equipment.

But even before the latest intellectual property venture, the technique has been controversial. Earlier this year, for instance, conservatives criticized the Bureau of Alcohol Tobacco, Firearms and Explosives for its “Always Think Forfeiture” slogan. The agency once distributed Leatherman tools engraved with the phrase, prompting congressional complaints. “The slogan will not be used in the future in any capacity,” bureau spokeswoman Deb Satkowiak said in May.

THE BIKERNET EXCLUSIVE DAVE ZIEN 1 MILLION MOTORCYCLE MILES REPORT–Thanks for posting that clip from Rogue about Zien on the verge of 1 million miles on one bike, his 1991 FXRT.

I’ll keep you posted on the Zien mileage quest. He broke down in Yuma and ended up in the hospital on top of it with some heart problems. He rented a car last Friday and drove up to Sacramento for the NCOM convention, waiting for a remanufactured motor from the factory. Hopefully, it will get bolted in and he can get on the road again this week.

I’m going to meet him somewhere, probably Florida, and ride back to Milwaukee with him for his last 1,000 miles. I wish I had a better idea of when he’ll reach his mark, but I hope it’s soon. We’ll have snow up here before too long.

Also, nice to see Colleen Schwartz’s pictures on Bikernet. She’s cool and does amazing photography. She was at our party during the 105th with Doc Robinson, Heavy Duty magazine. Later in the week, Rogue and I attended her party at her studio grounds. Great party, with bands, dancing girls and custom bikes, mostly from Dave Cook.

I love passionate people. I don’t even have to agree with them (most of the time) but my FAVORITE passionate people are the ones who are passionate about freedom. Maybe that is what attracted me to motorcycling or maybe it was the other way around. I know I feel passion for the ride and I feel passion about keeping motorcycling free of excessive restrictions. I want to enjoy my ride by accessorizing it as I see fit. I want to wear apparel of my choosing and I want to know that if the general public violates my right of way they will be punished and my insurance will cover my injuries.

Sometimes I think we are living in better times today than we were 20 years ago, and other times I think that as we grow as a motorcycling community, we have slipped into complacency leading us to a place we really don’t want to go. What made our ride a wonderful free experience didn't happened by chance. Our freedom to enjoy our ride is constantly threatened.

Many bikers are unaware of the vast network of men and women who are fighting for our freedom. These champions sacrifice their own personal wealth, time with their families, and yes, even precious time they could be riding because they have committed themselves to protecting the rights of every motorcyclist to ride free.

I started riding in 1985. I remember being taken to an ABATE meeting in a smoky downstairs of a bar where the members talked about some legislative issues I didn’t understand. Then they went on to talk about a blood drive they produced for the American Red Cross. The thought of some greasy hard-playing bikers lines up outside a Red Cross trailer stuck in my head. I wondered if the people receiving the blood knew where it came from…..

Something else stuck in my mind for years. It's so unfair that many bikers don’t even know about rights issues and who is fighting to protect them. I was told by my peers if I was going to ride I needed to belong to ABATE, an organization protecting my rights. I joined 23 years ago. I don’t understand why every biker hasn’t heard this same message. It feels like those who don’t join are taking advantage of those who joined and work for our freedoms.

I hear excuses and ignorant statements many times like: “I don’t have time to go to more meetings” or “They are the people who are against helmets.” Someone needs to tell everyone that those statements are bullshit! No one is forced to attend meetings, you can still join, and Rights Groups are not against helmets, just the law. Wear one if you like.

Membership money is used to support legislative efforts and often training programs. Of course we could use your help, if you wanted to get involved, but if not, we still need membership regardless!!! We watch for discrimination and injustice. Rights groups fight unfair noise limits, motorcycle bans, parking restrictions. RESCUE RIDERS TO GET GRANT– With the rise of motorcycle crashes, in part due to more bikes on the road because of high gas prices, there is an increasing need for trained volunteer emergency responders. Rescue Riders, based in northern Illinois, is a volunteer group of bikers who are trained in emergency response. Hupy and Abraham, S.C., the largest financial sponsor of Accident Scene Management, Inc. (ASMI), has agreed to donate enough money to Rescue Riders to train an additional 350 new volunteers for Illinois and Wisconsin.

?There is a great need for trained volunteer responders not only on the scenes of accidents but also in the event of larger emergencies,? said Michael Hupy, president of Hupy and Abraham, S.C. ?We commend the efforts of the Rescue Riders in educating motorcyclists, and are pleased to present this donation to help support this endeavor in Wisconsin and Illinois.?

ROAD CONTRACTORS AND MOTORCYCLE SAFETY–The August 29, 2008 issue of the Daily Reporter, contained an article by Attorney Jason Abraham entitled, ?Attorney Says Contractors Should Be Bike-Minded.?

The intent of the article was to raise awareness that contractors working on road projects need to post warning signs to alert motorcyclists about adverse conditions. Attorney Abraham wants this signage to be a requirement. Hupy and Abraham, S.C. hosted a large meeting two years ago at their office in Milwaukee dealing with this exact problem. It was attended by over 100 area bikers and local and district supervisors of the Wisconsin Department of Transportation.

A Power Point Presentation explained the hazards most likely to cause problems for bikers, including loose gravel at work sites, uneven surfaces during repaving operations, steel plates across roadways and reflective deceleration striping.

The recent article which appeared in the Daily Reporter reminded George Torres of the meeting at Hupy and Abraham, S.C. Mr. Torres is a Director/Highway Commissioner for Milwaukee County. In an email dated September 5, 2008 to Hupy and Abraham, S.C. investigator, Tony ?Pan? Sanfelipo, he indicated that he was passing the article with Attorney Abraham?s concerns along to his Transportation Engineering section and they would incorporate a signing policy that will require their contractors to put up signage at County managed construction projects to let bikers know about these dangerous conditions.

We hope other counties in Wisconsin will follow the lead of Milwaukee County and we?re grateful that Attorney Abraham took the time to remind contractors to ?think about motorcyclists? when doing these projects

Would the Last Honest Reporter Please Turn On the Lights?— By Orson Scott Card.

Editor’s note: Orson Scott Card is a Democrat, a newspaper columnist and author, and in this opinion piece he takes on both while lamenting the current state of journalism.

An open letter to the local daily paper ? almost every local daily paper in America:

I remember reading All the President’s Men and thinking: That’s journalism. You do what it takes to get the truth and you lay it before the public, because the public has a right to know.

This housing crisis didn’t come out of nowhere. It was not a vague emanation of the evil Bush administration.

It was a direct result of the political decision, back in the late 1990s, to loosen the rules of lending so that home loans would be more accessible to poor people. Fannie Mae and Freddie Mac were authorized to approve risky loans.

What is a risky loan? It’s a loan that the recipient is likely not to be able to repay.

The goal of this rule change was to help the poor ? which especially would help members of minority groups. But how does it help these people to give them a loan that they can’t repay? They get into a house, yes, but when they can’t make the payments, they lose the house ? along with their credit rating.

They end up worse off than before.

This was completely foreseeable and in fact many people did foresee it. One political party, in Congress and in the executive branch, tried repeatedly to tighten up the rules. The other party blocked every such attempt and tried to loosen them.

Furthermore, Freddie Mac and Fannie Mae were making political contributions to the very members of Congress who were allowing them to make irresponsible loans. (Though why quasi-federal agencies were allowed to do so baffles me. It’s as if the Pentagon were allowed to contribute to the political campaigns of Congressmen who support increasing their budget.)

Isn’t there a story here? Doesn’t journalism require that you who produce our daily paper tell the truth about who brought us to a position where the only way to keep confidence in our economy was a $700 billion bailout? Aren’t you supposed to follow the money and see which politicians were benefiting personally from the deregulation of mortgage lending?

I have no doubt that if these facts had pointed to the Republican Party or to John McCain as the guilty parties, you would be treating it as a vast scandal. “Housing-gate,” no doubt. Or “Fannie-gate.”

Instead, it was Senator Christopher Dodd and Congressman Barney Frank, both Democrats, who denied that there were any problems, who refused Bush administration requests to set up a regulatory agency to watch over Fannie Mae and Freddie Mac, and who were still pushing for these agencies to go even further in promoting sub-prime mortgage loans almost up to the minute they failed.

As Thomas Sowell points out in a TownHall.com essay entitled “Do Facts Matter?” ( http://snipurl.com/457townhall_com ] ): “Alan Greenspan warned them four years ago. So did the Chairman of the Council of Economic Advisers to the President. So did Bush’s Secretary of the Treasury.”

These are facts. This financial crisis was completely preventable. The party that blocked any attempt to prevent it was … the Democratic Party. The party that tried to prevent it was … the Republican Party.

Yet when Nancy Pelosi accused the Bush administration and Republican deregulation of causing the crisis, you in the press did not hold her to account for her lie. Instead, you criticized Republicans who took offense at this lie and refused to vote for the bailout!

What? It’s not the liar, but the victims of the lie who are to blame?

Now let’s follow the money … right to the presidential candidate who is the number-two recipient of campaign contributions from Fannie Mae.

And after Freddie Raines, the CEO of Fannie Mae who made $90 million while running it into the ground, was fired for his incompetence, one presidential candidate’s campaign actually consulted him for advice on housing.

If that presidential candidate had been John McCain, you would have called it a major scandal and we would be getting stories in your paper every day about how incompetent and corrupt he was.

But instead, that candidate was Barack Obama, and so you have buried this story, and when the McCain campaign dared to call Raines an “adviser” to the Obama campaign ? because that campaign had sought his advice ? you actually let Obama’s people get away with accusing McCain of lying, merely because Raines wasn’t listed as an official adviser to the Obama campaign.

You would never tolerate such weasely nit-picking from a Republican.

If you who produce our local daily paper actually had any principles, you would be pounding this story, because the prosperity of all Americans was put at risk by the foolish, short-sighted, politically selfish, and possibly corrupt actions of leading Democrats, including Obama.

If you who produce our local daily paper had any personal honor, you would find it unbearable to let the American people believe that somehow Republicans were to blame for this crisis.

There are precedents. Even though President Bush and his administration never said that Iraq sponsored or was linked to 9/11, you could not stand the fact that Americans had that misapprehension ? so you pounded us with the fact that there was no such link. (Along the way, you created the false impression that Bush had lied to them and said that there was a connection.)

If you had any principles, then surely right now, when the American people are set to blame President Bush and John McCain for a crisis they tried to prevent, and are actually shifting to approve of Barack Obama because of a crisis he helped cause, you would be laboring at least as hard to correct that false impression.

Your job, as journalists, is to tell the truth. That’s what you claim you do, when you accept people’s money to buy or subscribe to your paper.

But right now, you are consenting to or actively promoting a big fat lie ? that the housing crisis should somehow be blamed on Bush, McCain, and the Republicans. You have trained the American people to blame everything bad ? even bad weather ? on Bush, and they are responding as you have taught them to.

If you had any personal honor, each reporter and editor would be insisting on telling the truth ? even if it hurts the election chances of your favorite candidate.

Because that’s what honorable people do. Honest people tell the truth even when they don’t like the probable consequences. That’s what honesty means . That’s how trust is earned.

Barack Obama is just another politician, and not a very wise one. He has revealed his ignorance and naivete time after time ? and you have swept it under the rug, treated it as nothing.

Meanwhile, you have participated in the borking of Sarah Palin, reporting savage attacks on her for the pregnancy of her unmarried daughter ? while you ignored the story of John Edwards’s own adultery for many months.

So I ask you now: Do you have any standards at all? Do you even know what honesty means?

Is getting people to vote for Barack Obama so important that you will throw away everything that journalism is supposed to stand for?

You might want to remember the way the National Organization of Women threw away their integrity by supporting Bill Clinton despite his well-known pattern of sexual exploitation of powerless women. Who listens to NOW anymore? We know they stand for nothing; they have no principles.

That’s where you are right now.

It’s not too late. You know that if the situation were reversed, and the truth would damage McCain and help Obama, you would be moving heaven and earth to get the true story out there.

If you want to redeem your honor, you will swallow hard and make a list of all the stories you would print if it were McCain who had been getting money from Fannie Mae, McCain whose campaign had consulted with its discredited former CEO, McCain who had voted against tightening its lending practices.

Then you will print them, even though every one of those true stories will point the finger of blame at the reckless Democratic Party, which put our nation’s prosperity at risk so they could feel good about helping the poor, and lay a fair share of the blame at Obama’s door.

You will also tell the truth about John McCain: that he tried, as a Senator, to do what it took to prevent this crisis. You will tell the truth about President Bush: that his administration tried more than once to get Congress to regulate lending in a responsible way.

This was a Congress-caused crisis, beginning during the Clinton administration, with Democrats leading the way into the crisis and blocking every effort to get out of it in a timely fashion.

If you at our local daily newspaper continue to let Americans believe ? and vote as if ? President Bush and the Republicans caused the crisis, then you are joining in that lie.

If you do not tell the truth about the Democrats ? including Barack Obama ? and do so with the same energy you would use if the miscreants were Republicans ? then you are not journalists by any standard.

You’re just the public relations machine of the Democratic Party, and it’s time you were all fired and real journalists brought in, so that we can actually have a news paper in our city.

THE END–I’m trying to handle the news on my own. The staff went to attend a memorial for a kid who went wrong and burnt up in a meth lab. Maybe I’m getting old, but I don’t see much use for a life of crime anymore. We’re living in a terror powered society packed with wire-taps and cameras everywhere.

Of course here’s an example of my new world wisdom. I thought for sure that kids growing up in an age of anti-cigarette propaganda would cut off their rock and roll ears before smoking. Not so, Ming the Merciless. Half the young punks I know, male and female, smoke. What the fuck?

With that I’m going to escape to the shop and finish our burnt Panhead patio table. It’s gonna be cool. Maybe Sunday I’ll have a shot for you with a slab of ?-inch glass on top. Then when my next Paughco order rolls the 1915 5-Ball Factory Racer will slip up on the lift.

The Paughco team tore the concept unit designed by Rick Krost of U.S. Choppers down to send me the frame and tank. It’s serial number 1 of this line. I’ve ordered Black Bike 23-inch wheels and Chica is going to make fenders to fit.

We have a batch of hot stuff heading your way including a tech on the electric start kit for kick-only bikes. I’m also working on a Rivera Tech primary install. We have a sizzling passel of fiction, but we struggle to find the time to kick back and ponder each high-drama line. Be patient, and Scotty a road-dawg rider who never leaves the highway, sent me several road stories and I can’t wait to slip into one of his envelopes. Coming soon.

61 Mongols motorcycle gang members arrested on racketeering charges–Dozens of burly, tattoo-covered Mongol motorcycle gang members were arrested today by federal agents in six states from the West Coast to the Midwest on warrants ranging from drug sales to murder after a three-year undercover investigation in which four agents successfully infiltrated the group.

At least 61 members of the Southern California-based Mongol Motorcycle Club were arrested under a federal racketeering indictment that included charges of murder, attempted murder, assault, as well as gun and drug violations, said Mike Hoffman, spokesman for the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Federal and local agents had 110 federal arrest warrants and 160 search warrants that were being served across Southern California and in Nevada, Oregon, Colorado, Washington and Ohio.

The sweep, dubbed Operation Black Rain, was to continue throughout the day Tuesday, agents said.During some arrests, sharpshooters stood guard on surrounding rooftops and motorcycles were lined up and confiscated.

“It’s going to be a large hit to their organization, we are arresting many of their top members,” Hoffman said.The bust was the biggest takedown of a motorcycle gang, said U.S.Attorney Thomas O’Brien.

His office was set to ask a judge for an injunction that would seize the Mongols’ trademarked name, a first for federal authorities. If the order is approved, any Mongol would no longer be able to wear a jacket or ride a bike with the gang’s name.

“It would allow law enforcement to seize the leather jackets right off their back,” O’Brien said.

Among those arrested were the gang’s former national president Ruben Cavazos.

Hoffman said the Mongols had been recruiting members of Los Angeles street gangs to assist in their operations. The Mongols are primarily Latino and formed because the Hells Angels refused to allow Hispanic members.

Four ATF agents infiltrated the gang and were accepted as full members, a difficult process that requires winning the trust of the gang’s top leaders over a period of months, Hoffman said.

The agents were required to live away from their families in homes set up to make it look like they lived a Mongols lifestyle, Hoffman said. Four undercover women ATF agents also were involved in the operation, pretending to be biker girlfriends and attending parties with the agents. Women are not allowed to become full members of the gang.

“If you go to a party all the time and you don’t ever bring a girl around, it’s kind of weird,” Hoffman said. “Someone might get suspicious.”

To be accepted in the gang, the ATF agents had to run errands and were subject to a background check by private detectives.

The undercover agents observed a changing dynamic within the Mongols. As the gang recruited more Los Angeles street gang members – many of whom didn’t have motorcycles and came from Latino gangs The Avenues and 18th Street – tensions grew.

The new members remained loyal to the powerful Mexican Mafia gang, which operates within the state’s prison system, Hoffman said.

“That caused kind of a friction between the other guys with bikes,” Hoffman said. “It’s supposed to be a motorcycle club and they were just gangster thugs involved in the narcotics trafficking.”

Outside Cavazos’ home in West Covina, about 18 miles east of Los Angeles, a red, custom-modified Harley-Davidson motorbike sat outside. No occupants were home but several police and ATF agents were seen going through items in the house.

Cavazos authored a memoir of his life called “Honor Few, Fear None: The Life and Times of a Mongol,” published by HarperCollins in June.

HarperCollins publicist Sarah Burningham in New York City said she only handles book-related issues for Cavazos, but would forward an e-mail from The Associated Press requesting comment.

Another former Mongols national president, Roger Pinney, alleged in an interview with The Associated Press that Cavazos was the problem, not the club in general.”They were just on the verge of cleaning up their act,” said Pinney, who is no longer a member and is serving probation from his role in an infamous brawl in Laughlin, Nev., in 2002. “It’s not a club-run deal, it’s individuals who are the ones who decide to commit crimes.”

Pinney said he warned other club members that Cavazos was trouble.”I always said he was robbing from the club,” Pinney said. “He was throwing all the good members out and bringing gang members in. He was trying to be a drug lord or something. He was crazy.”

Pinney doesn’t believe the raid will force the Mongols off the road.”This is all going to blow over. The Mongols aren’t going away, and neither are the Hells Angels,” he said.At least 22 motorcycles were on display outside the Los Angeles Police Department’s main building Tuesday morning. All were modified, chrome-covered Harleys with custom artwork. One had a fiberglass skull on the clutch, another’s kick stand had been modified to make it look like bird talons. Several bore Mongols insignia.

Five Mongols members were sentenced this year to Nevada state prison and two got probation for their roles in a deadly casino brawl with rival Hells Angels during a 2002 motorcycle rally in the Colorado River resort town of Laughlin. Three people died in the fight.

Las Vegas police reported serving several warrants at homes in southern Nevada, where five men were arrested and were being held in federal custody pending an initial appearance before a federal magistrate, said Natalie Collins, spokeswoman for the U.S. attorney’s office in Las Vegas. Collins said she expected the hearing would be later Tuesday.

7th Annual Rally in the Gorge moves up a month in 2009– Seattle, WA ? Sound RIDER! publisher and event promoter, Tom Mehren, announced today changes in the dates for the 7th annual Rally in the Gorge. The event, held in Stevenson, Washington, has been moved up one month and will be held Wednesday, July 29 to Sunday, August 2 in 2009.

The rally will be extended from four to five days. For the fourth year, in a row the event will be designated as the Northwest Regional Rally of the American Motorcyclist Association. ?This is a chance to put the rally on mid-season, rather than at the end of the riding season, which should bode well for the manufacturers and vendors who participate,? commented Mehren from his Seattle office.

Since 2003, Sound RIDER! has produced motorcycle rallies in the Columbia River Gorge. The 2009 Rally in the Gorge features activities for sportbike, sport touring, dualsport and maxi-scooter enthusiasts.

Prior rallies have attracted national support from manufacturers, distributors and vendors including BMW, Triumph, Aprilia, Ducati, Parts Unlimited, Western Powersports, Avon Tyres, Nelson-Rigg and others. Guest speakers have included David Hough, author of the Proficient Motorcycling series; Nick Ienatsch, lead instructor at the Freddie Spencer Performance Riding School; and Ramey Stroud, founder of the Cascade Endurance Center.

Vendor support and clinic instructors for the 2009 event will be announced beginning in January. The rally is held within the boundaries of the Columbia Gorge National Scenic Area, an area rich in great motorcycling roads (both paved and gravel), road-building history and stunning beauty that includes Mt. Hood, Mt. Adams and Mt. St. Helens.

I co-wrote this book with my cousin Nicholas Maurstad, who spent almost two years fighting in Iraq as part of the longest National Guard deployment since the Civil War. Nick’s battalion fought with the Marine Corp near Fallujah through the deadliest period of the war, and his unit took more casualties than any other National Guard unit since the war began. Nick lost four members of his eight-man team, and saw too many other friends killed or wounded. This is their story.

Nick?s battalion lived through more tragedy than a person should experience in a lifetime, but they also had more than their share of success. His squad mates rescued a number of men from an al Qaeda torture house and Nick personally captured Haythem Kudar, the head of al Qaeda in al Anbar province at that time. Nick was almost killed in the process, but was saved by the fact that at the very moment Nick kicked down Kudar?s door the man?s wife was in the process of giving him oral pleasure, which kept Kudar from drawing his pistol until it was too late and the muzzle of Nick?s shotgun was inches from his face.

Col. Bristol, the Marine colonel who commanded the troops in the region, called Bravo Company ?as fine a company as exists in the military today? They are, simply put, a company of heroes? I?m proud to have led them, to have fought with them, and to have bled with them.?

These kids gave everything they had in Iraq, and they lost a lot of their brothers. We?ve tried to present the reality of what Nick and his friends experienced in ?Bristol’s Bastards.? It?s raw, filled with the scatological gallows humor one would expect from a bunch of 20 year olds sent to a meat grinder half-way around the world, but it captures the experiences they lived through. Their story deserves to be told, warts and all, in their own vernacular. To whitewash it and make it pretty would trivialize their sacrifices.

ESTOK RIDES BUELL TO ASRA PRO THUNDERBIKE WIN AT DAYTONA —Bruce Rossmeyer?s Daytona Racing Buell 1125R Is Third in MOTO-ST Eight Hours.

DAYTONA BEACH, FLA. (October 19, 2008) ? Deeley H-D/Buell Canada/Ruthless Racing rider David Estok executed a dramatic last-lap pass to win the ASRA Pro Thunderbike National at the 25th Annual ASRA Race of Champions at Daytona International Speedway. Riding a Buell XB12R motorcycle, Estok drafted past BMW rider Nate Kern as the pair dashed for the finish line. Hal?s H-D/Buell/Hal?s Speed Shop rider Dan Bilansky finished third, also on a Buell XB12R.

Kern was the fast qualifier for the season-ending Pro Thunderbike National at Daytona with a lap of 1:55.748. Kern and Morton?s BMW rider Richard Cooper led from the start of the eight-lap race, with Estok following closely in third place. Cooper crashed and was out of the race on lap three, and Estok closed in on Kern and stayed just behind the BMW rider until the pair exited the final turn of the high-banked Daytona track. Timing the draft perfectly, Estok was able to pull ahead of Kern and take the win.

?Second place is a great spot to be in on the last turn at Daytona,? said Estok. ?I?ve got a great Buell motorcycle and some experience at this track and was able to put both to use today. It?s nice to end the season with a win.?

Finishing in fourth place aboard a Buell XB12R was Dr. D Racing rider Robert Johnson, followed by Ray Price Harley-Davidson/Buell rider Carl Reid in fifth. Classic Harley-Davidson/Buell rider Art Diaz rode a Buell XB12R to sixth position.

After closing out the eight-race 2008 ASRA Pro Thunderbike season at Daytona, Kern finished with 254 points to win the championship. Estok was second with 197 points, Bilansky was third with 136 points, and Bison Racing/Eagle H-D/Buell rider Walt Sipp was fourth with 115 points.

James Gang/Hoban Brothers Racing Takes ASRA Team Challenge Title

James Gang/Hoban Brothers Racing riders Paul James and Jeff Johnson rode their Harley-Davidson/Buell of Appleton sponsored Buell XB12R to win the 2008 ASRA Team Challenge GT Lights (GTL) class championship with a second-place finish in the 2-hour Team Challenge event at Daytona on Friday, Oct. 17. The team won the GTL class at three of the five Team Challenge events it entered this season, and finished with 152 points to lead the second-place Shakka 4 Life Suzuki team by 40 points. The KRM Racing team won the Daytona round on a Bimota.

Buell Riders Win Five CCS Championships

Buell riders won five MotoSport.com Championship Cup Series (CCS) national championships in sprint racing on Saturday and Sunday at Daytona. Ray Price Harley-Davidson/Buell rider Carl Reid rode a Buell XB12R to win titles in the Amateur Lightweight Superbike, Amateur Lightweight GP and Amateur GT Lights classes. Hal?s Harley-Davidson/Buell rider Joel Spaulding won the Amateur Thunderbike title on a Buell XB12R. Estok won the Expert Lightweight Superbike championship, also on a Buell XB12R.

Two Buell Teams Close MOTO-ST Season in Third Place

Shawn Higbee, Michael Barnes and Steve Crevier rode the Bruce Rossmeyer?s Daytona Racing No. 8 Buell 1125R to a third-place finish in the SunTrust MOTO-ST 8 Hours at Daytona endurance race on Oct. 18, and finished the seven-race MOTO-ST season in third place in the premier Buell Motorcycle Company SuperSport (SST) class. The No. 8 Buell came back from a radiator problem that left the team ninth overall at half distance.

?That?s endurance racing for you,? Barnes said. ?We knew we just had to keep plugging away.?

The No. 83 Buell 1125R ridden by Barnes, Crevier and Dave Estok for Bruce Rossmeyer Daytona Racing with assistance from Deeley H-D/Buell Canada/Ruthless Racing completed 69 laps before retiring with mechanical problems and placed 26th overall. The Hal?s Harley-Davidson/Buell-Brotz Motorsports No. 7 Buell 1125R raced by Dan Bilansky, Clint Brotz and Higbee completed 51 laps before retiring and placed 27th.

The No. 8 Bruce Rossmeyer?s Daytona Racing team, entered by Richie Morris Racing, won two races during the 2008 MOTO-ST season aboard the Buell 1125R. Despite an eighth-place finish at Daytona, the Aprilia USA/Lloyd Brothers Motorsports No.1 Aprilia won the SST season title with 225 points. The Touring Sport Ducati No. 75 entry was second with 207 points, followed by the Bruce Rossmeyer?s Daytona Racing No. 8 Buell with 204 points.

The No. 70 James Gang/Hoban Brothers Racing Buell team of Jeff Johnson, Paul James and Walt Sipp came to Daytona only two points behind the No. 77 Ducati in the MOTO-ST BMW GrandSport Twins (GST) standings, and battled back from an early race off-track incident caused by the No. 77. But while running third in class at about the five-hour mark, the Buell XB12R crashed in the West Horseshoe turn with Sipp aboard. The crash resulted in a cracked frame and fuel leak, which the team repaired, but the bike later developed an oil leak. After replacing the oil cooler, the team finished seventh in class and 23rd overall. The No. 77 Touring Sport Ducati team finished fifth in class and 19th overall and won the 2008 GST class title with 212 points. The No. 69 RightsforBikers.com Ducati won GST at Daytona and was fourth overall, and moved up to second place for the season in GST with 209 points, just one point ahead of the No. 70 James Gang Racing Buell, which finished the season in third place.

?The championship was ours to win at the half-way point of the race,? said Paul James. ?We were running third with a good lead on the No. 77 Ducati. But at some point in an endurance race you?ll be dealt adversity, you just don?t know what will happen or when it will strike. As it has done all season, the team worked hard to stay in the race and we never quit.?

Six new instructors were just trained in Wisconsin and Illinois. California is next!Denise Carey, Instructor Trainer in Texas, tells us that one of her Advanced classes held in Chico, Texas received an extra special visit. Air Evac Lifeteam is a helicopter ambulance service. This company stations their helicopters in rural areas of the country in order to facilitate response times outside of major cities.

Curtis Gates, Regional Coordinator for Air Evac, and son Scott, contacted Denise and were instrumental in bringing ASMI to North Central Texas. Why such interest in ASMI!!! Curtis and Scott are also avid motorcyclists. ?These guys are awesome?, says Denise, ?They were actually able to arrange for one of their helicopters (Lifestar 4 out of Decatur, TX) to come to our Advanced Class. We knew they were supposed to come, but weren’t sure the exact time of day. They do have to take care of business, too. We heard them make their first pass over the site so we immediately stopped what we were doing to watch them land.

Curtis, who also attended the two-day Basic and Advanced Courses, had already given a brief lesson on the do?s and don’ts around a helicopter landing zone (LZ) to the class. ?Curtis tells me that the visit to our class cost an estimated $5,000!!! These crews have to go through extensive training and are genuinely dedicated to the work they do.? Denise would like to thank Curtis and Scott Gates, Air Evac Lifeteam and the Lifestar 4 crew for their cooperation and expertise. Their goals are the same in REDUCING INJURIES AND FATALITIES. OPEN LETTER TO THE CUSTOM BIKE INDUSTRY FROM JOHN GREEN THE BOSS OF ER EVENTS–Times are tough for all of us.It is my obligation to do whatever it takes to keep our lifestyle as active as possible. We must band together and unite during these difficult times.

I am asking all of you with bikes that can bring them to the Shows all shows not just Easyriders Shows to help the cause. If everybody hides out in their garages we will see a great depression in the custom bike industry.

I urge all promoters to work with the builders and vendors in any possible way to keep the Custom Motorcycle industry relevant and current. This may sound self-serving to some but bear in mind that even if you do not participate in the Custom Motorcycle industry you have to appreciate the fact that the Custom World drives the styling and R&D for the Production Motorcycle Industry.

Bottom Line is the everyone from Custom Builders to Production Bike Dealerships should pay careful attention to public awareness of our passion. Keep some of your budgets open for participation in local trade shows and events. I know times are tough and money is tight but be creative and come up with a way to be seen, even if it means buying your staff tickets for a show and asking everybody to show up with their uniforms on.

Here’s what I am doing for the bike competitors for the 2009 Easyriders Bike Show Tour.Bring your bike to an Easyriders Bike Show and I will give you a free space to show your bike. All you have to do is buy the wristbands that you need for the weekend.

The Corner spots and the 10 x 10 spaces will be available for a small fee but the basic space (approximately 5 x 10) is free.

If you haven’t shown your bike before this is a great opportunity. The Easyriders Bike Shows take on a completely different personality when you are part of the show. You get to come into the hall during set up and see what it takes to produce the events. You get admitted into the hall before the public. You get the opportunity to look at the other bikes without the crowds. You get the opportunity to visit with the vendors without the crowds.

If you love motorcycles I strongly urge you to participate in the 2009 Free Space program at the Easyriders Bike Shows. I can’t afford to do this for more than one year so take advantage of this deal.

You do not have to have a $100,000 bike to participate in the Shows. There are classes that fit every bike at the Easyriders Shows from Modified Stock to Radical. Remember that there are 100 reasons to participate in a show and winning is only one.

The Sergeant Major just stared at her in his serious manner.

“1955, ma’am.”

‘Well, there you are. You really need to chill out and quit taking everything soseriously! I mean, no sex since 1955!’

She took his hand and led him to a private room where she proceeded to ‘relax’ himseveral times.

Afterwards, panting for breath, she leaned against his bare chest and said, ‘Wow,you sure didn’t forget much since 1955!’

The Sergeant Major, glancing at his watch, said in his serious voice, ‘I hope not,it’s only 2130 now.’

I do not recommend any wheelie on a Buell. It is really hard on the Rear shock and the front fork neck bearings! I like to check my neck bearing’s at the 2500 mile service interveral’s. I have replaced alot of these and its usually do to abusive riding. Also the rear shock front mount bolts to the engine case. Lots of stress when you beat on the bike.

PA State Police Radar Cover-Up

This is a guest post by Benjamen Ober, a student at Duke University in the Terry Sanford Institute for Public Policy.

Tim Shingara does not look like a man you would expect to be working for the Pennsylvania State Police (PSP). His shoulder-length hair, thick mustache, tight black t-shirt, torn jeans and intense stare exude the image of a motor-head, not a radio-telecommunications specialist lab technician, specializing in advanced radar operations.

Shingara probably looks the part of a Harley enthusiast because he is a Harley enthusiast. He is a police lab technician by day and a husband, father and biker by night. This more or less average guy’s world was turned upside-down as he was thrust into the midst of a Pennsylvania State Police corruption scandal dubbed “Radargate” by watchdog groups.

J. Michael Sheldon’s Lucky Find

Radargate and Shingara’s uphill battle against the PSP began on November 29, 2002. Ironically, Shingara himself had nothing do to with the beginning of the fiasco.

On that Friday evening, the day after Thanksgiving, Brent Hanlin was hurrying to his father’s hunting cabin in Perry County, Pennsylvania. It was getting late, and Hanlin wanted to get settled in for the weekend before rifle season opened on Monday morning. He was traveling northeast along PA route 533 in his 1994 VW Jetta. Ominous rain clouds darkened the sky and the road was already slick from earlier showers. To make matters worse for Hanlin, the lights on his VW dashboard had been flickering on and off for weeks and finally decided to die, making it difficult to gauge his speed.

As Hanlin passed an intersection, a State Police patrol car began trailing him from a distance. Hanlin noted the patrol car, but continued on without a second thought—he was the type of guy to drive 43 in a 45 zone “just to be safe.” Minutes later, the Trooper turned on his flashing lights and Hanlin realized that he was being pulled over.

The encounter that ensued was not pretty. Hanlin was informed by PSP Trooper Gregory Styers that he was driving in excess of seventy miles per hour. “Impossible,” thought Hanlin. Sure, Hanlin, might have been speeding. He could not exactly tell because his darkened dashboard. But 70 miles per hour? Fat chance. He curtly informed the Trooper that he was mistaken. The situation got worse when Hanlin could not produce either a registration or proof of insurance. Styers decided to detain Hanlin for the evening for a traffic violation and resisting arrest.

Hanlin hired prominent local attorney J. Michael Sheldon to represent him in court. Hanlin insisted that he was going 45 miles per hour at the most. “Sure,” thought Sheldon, “that’s what they all say.” While driving home from his office, Sheldon was suddenly struck by a new thought: maybe it was impossible to hit seventy on the stretch where Hanlin was pulled-over, especially given the road conditions in a 1994 Jetta.

Sheldon visited the scene and determined that it was unlikely that Hanlin could have reached seventy miles per hour. On a flier, he contacted PSP headquarters and asked to speak with their lab expert on radar gun performance.

Enter Tim Shingara. Shingara was the local expert identified by the State Police for Sheldon to interview. Sheldon quickly discovered that he hit a legal jackpot. Shingara openly admitted that State Police radar guns are unreliable. Internal memos noted problems with the radar guns, especially the Genesis model guns, as early as 2002. On August 2, 2003, Corporal William LaTorre officially filed a memo to his superior noting that everything he aimed the gun at was registering seventy-eight miles per hour—including inanimate objects. A tree, rock, road, sky and moving car all registered seventy-eight.

Six months later, Sergeant Thomas Decker reported a similar problem to his commanding officer. According to Sgt. Decker, the Genesis gun would suddenly jump from the mid-fifties to the low-eighties without cause. Later, even after Radargate broke in Philadelphia and Harrisburg newspapers, field officers were reporting problems with the Genesis guns.

Shingara was subpoenaed as an expert witness in Hanlin’s case. According to Shingara’s testimony, the Genesis radar gun registered an “alternator whining” when plugged into a Trooper’s vehicle. Under intense electrical strain, such as the use of a radar gun, the alternator runs constantly in an effort to recharge the car battery. The constant running of the alternator produces an electrical disturbance that is captured by the Genesis gun. Out of the alternator whining, Radargate was born.

Copstoryaccident

Institutional Failure

Radargate was potentially explosive for PSP. The costs would be extraordinary, both in public-image and sheer economic terms. The State Police own nearly one thousand radar guns, more than half of which are the Genesis model, produced by Decatur Electronics. Internal records show that State Troopers use radar guns in roughly 87 percent of speeding tickets.

Records, do not, however, indicate which radar gun was used for issuance of each ticket. Thus, no one truly knows how many of the PA State Police issued tickets might be invalidated if the Genesis model is proven inaccurate. Since the first internal memos filed by Troopers in late 2002, motorists have been issued approximately 200,000 tickets—incurring total fines of more than fifteen million dollars.

The contracting arrangements between Decatur and the State Police are baffling at best. Decatur was chosen and the Genesis model selected because Decatur was the lowest-bidder for the radar contract. This is hardly atypical, as it is normal for state government agencies to award contracts to the lowest bidders. Shingara’s attorney Don Bailey thinks the problem is that government agencies such as PSP have budgetary pressures in conflict with public safety concerns.

Bailey bluntly stated in an interview, “The Genesis II gun was a cheap gun.”

At the same time as Decatur’s radar gun bid, Ford Motors was contracted in early 2002 to supply new squadron cars for PSP. The “cost-effective” Crown Vic model was chosen, in spite of its low battery power. The Governor’s Office was thrilled with Ford’s Crown Vic bid, as PSP was saving the state thousands of dollars. For most cars, battery drain is a relatively minor problem, but squadron cars generally run a radio unit, laptop, lights, A/C, cell phone charger, and radar gun simultaneously. Drain on the battery can have dangerous consequences, such as stalling in the middle of traffic.

The government mismanagement of Radargate goes even deeper. Decatur Electronics acknowledged the problems in the Genesis model and recommended an easy solution to State Police brass. Decatur offered to fix all of the Genesis guns for free, absorbing a loss of thirty thousand dollars. Decatur was hoping to avoid public embarrassment and loss of reputation in the market. They could offer a solution and save face, as no one would blame Decatur for not predicting how the Genesis model would interact with future car models.

PSP, however, turned down Decatur’s offer to fix all of the units for free. According to Shingara’s lawyer, Don Bailey, the higher-ups of the State Police wanted to cover up any wrongdoing. If the State Police were found guilty of using faulty radar, the “implications [would be] enormous and quite significant cost wise,” said Bailey. The Governor’s office would inevitably respond by distancing themselves from the top officials in the Police Department.

In all likelihood, the administrative officials at the helm of the State Police would lose their jobs—and potentially jeopardize their mandatory service for the State pension plan.

Bailey, never a man to mince words, candidly asserts, “The reason for any kind of a cover-up of a bureaucratic mistake of any kind is very simple: careers are on the line…gotta get my career, my pension, gotta get outta here sorta thing…They were willing to let bad tickets be written…Probably the leadership at the top of the State Police doesn’t want to write bad tickets. It’s not that they want to do that or get any pleasure out of it. But the issue is, ‘How is my career going to be affected?’”

According to Bailey, the institutional pressure of budget politics and lack of government oversight created circumstances that lead to the organizational panic in which the police turned down Decatur’s simple, free, and easy solution in favor of a cover-up.

Part of the cover-up, in Bailey’s eyes, was a phony study on the accuracy of the Genesis radar gun. In response to Shingara’s testimony in the Hanlin case, the State Police commissioned a study on Genesis radar guns performed through a lab at the University of Pittsburgh. After the study was concluded, the State Police issued multiple press releases indicating that the radar guns had proven consistent and trustworthy beyond a shadow of a doubt. This seemed to assuage the public, as most citizens and media outlets were willing to accept these conclusions.

Unfortunately, it appears that State Police leaders were fudging the truth. Professor Marlin Mickle, the lead experimenter at the University of Pittsburgh, was unavailable for comment in this article, but has elsewhere claimed that the tests conducted in his department were neither conclusive nor aimed at gauging radar accuracy under field conditions.

Mickle says that the tests reflect Genesis radar performance in the laboratory, but the accuracy results do not necessarily transfer to the real world. When subpoenaed by Bailey, Mickle claimed that the State Police had not provided him any background on the on-going legal battle, nor suggested a field test versus a laboratory test. At any rate, police officials could breath a sigh of relief, as the momentary scandal of Radargate had passed.

PSP Retaliation

When the dust had cleared from the Mickle study and the public was placated, PSP turned its sights on Shingara, according to Bailey. Shingara was removed from radar detail, which was both a financial blow and a slap in the face professionally. Shingara was denied additional assignments at work, meaning that he went to work for months with absolutely nothing to do.

In Bailey’s experience, this is a common tactic of PSP officials to isolated and control whistleblowers (public employees who speak out against corruption or malpractice from within the department).

Over the next several months, it became increasingly clear to Shingara that he needed legal representation, prompting him to hire Bailey to sue PSP for unlawful retribution. In addition to being removed from radar detail and assigned no work, Shingara complained of other retaliatory measures, such as withheld promotions and subjugation to “an unfair internal investigation,” according to the lawsuit. Ultimately, Shingara claimed that the police were looking for an opportunity to fire him.

Bailey built a case focused on First Amendment violations by the State Police, which was subsequently filed in the U.S. Third Circuit. According to Bailey, Shingara’s case is a clear-cut example of First Amendment violation in the workplace. Shingara observed a problem in PSP that defrauded the public and compromised the integrity of the State Police. When J. Michael Shelton subpoenaed him, Shingara testified to problems within PSP.

In an interview, Bailey was quick to point out that Shingara had no economic motive for testifying against PSP. Shingara was not guilty of libel, as both internal memorandums and independent studies have vindicated his version of Radargate.

While Radargate was being argued at the Third Circuit (spring 2005), a related civil rights battle raged in the U.S. Supreme Court. Garcetti v Ceballos worked its way through the Ninth Circuit Court of Appeals and was finally argued by the Supreme Court in October 2005. The majority opinion by Justice Anthony Kennedy (joined by Roberts, Scalia, Thomas, and Alito) ruled, “Statements made by public employees pursuant to their official duties are not protected by the First Amendment from employer discipline.” Richard Ceballos, the defendant in Garcetti, had a very simple analysis: “I think government employees will be more inclined to keep quiet [about corruption].”

New Dilemma of State Employees

In lieu of Radargate and the Garcetti ruling, police officers in PSP (and government employees in general) are caught in a bind. In Radargate, for instance, Shingara’s initial report to his superiors was co-authored or verified by at least nine other communications specialists. None of these nine men and women, however, have come forward to corroborate Shingara’s testimony. That is hardly surprising given the financial and professional repercussions reaped by Shingara.

The State Police have made an example of Shingara—“This is what happens to those who break rank and speak out against the State Police.” As if that were not incentive enough to keep quiet about government corruption or malpractice, the Supreme Court has removed even whistleblower protection from state employees.

In the case of Shingara v Skiles et al, the State Police holds all the cards. Institutionally, not many people testify against the State Police because of its reputation and power. PSP is a powerful and influential lobby in Pennsylvania, as evidenced by their Commissioner’s seat on the Governor’s cabinet.

The sheer disparity of power and funds for waging expensive legal battles creates a strong disincentive for insiders to exposure government corruption. PSP officials have virtually unlimited resources in terms of legal counsel. They have a special task force that specializes in handling the legal defense of PSP. Should these lawyers not have enough time or expertise to handle a specific case, it is not uncommon for the State Police to hire outside law firms to run the case.

Conversely, Tim Shingara, although not a poor man, is severely limited in his funds to pay for lawyers. Ironically, his salary as a lab technician was slashed by virtue of his removal from the radar detail and from other special assignments, the very sort of retributive action that led him to sue PSP. Fortunately for Shingara, he has enough money to put up a fight as a radio-telecommunications specialist, unlike many of the young Troopers in the force.

Bailey claims that PSP also has an advantage in terms of public perception. Shingara is fighting against image of the State Police. There is, according to Bailey, a tendency among the general public to view the law enforcement in almost binary terms. The police are the good guys and the accused are the bad guys. It would be impossible for individuals in the State Police, especially high-ranking officers, to be guilty of a systematic cover-up, even in a situation like faulty radar guns.

Looking Ahead

In the grand scheme of things, malfunctioning radar guns are not that important. After all, the cover-up could be for something much greater, like murder, money laundering, drug running, political corruption, or the like. The troubling fact is that, if Shingara and Bailey are correct, the State Police officials had the desire, ability, and organization to pull a cover-up, even on a relatively minor issue. According to Bailey, the current legal climate (especially post-Garcetti) provides further incentive for public officials to keep silence.

The question raised by Bailey is this: Who will speak out against government abuse if not government insiders? As a State Police officer, Shingara is legally forbidden to speak with any member of the media under the threat of being fired. PSP was unavailable for comment on this article. The University of Pittsburgh also refused to given comment on their study of the Genesis II gun and PSP interpretation of the study. Decatur likewise declined to comment on the accuracy of the Genesis II radar guns.

Radargate thus moves quietly toward its undecided, but impending legal conclusion. In July 2005, the U.S. Third Circuit Court ruled against Shingara. The Third Circuit determined that there was not enough evidence of retribution by PSP. Shingara and Bailey are currently fighting through the appeal process. The Third Circuit Court of Appeals will soon decide whether or not they will hear the case.

Regardless of the decision in the Court of Appeals, the losing side will inevitably appeal to the U.S. Supreme Court for final mediation. Shingara v Skiles et al would be an opportunity for the Court to revisit Garcetti.

In light of the outcry by civil rights groups and Congress alike, it is conceivable that the Court will vote to reverse Garcetti. The fates of Tim Shingara, PSP officials, and potentially millions of future whistleblowers thus await judgment.
