NEW MODEL OF THE YEAR–A young inventor has created a motorbike with a twist – it uses two wheels but they are positioned right next to each other, giving it the illusion of being a powered unicycle. And even better, it might help save the planet.

Ben Gulak has spent several years building the electric Uno that uses gyroscopic technology – like the infamous Segway commuter device – to stay upright.

The bizarre-looking contraption has only one switch – on or off – and is controlled entirely by body movement. The rider leans forwards to accelerate to speeds of 25mph and back to slow down. It has two wheels side-by-side and has been turning heads wherever it has been ridden.

BIKERNET MARRIAGE ADVISORY REPORT–On their wedding night, the young bride approached her new husband and asked for $20.00 for their first lovemaking encounter. In his highly aroused state, her husband readily agreed. This scenario was repeated each time they made love, for more than 30 years, with him thinking that it was a cute way for her to afford new clothes and other incidentals that she needed.

Arriving home around noon one day, she was surprised to find her husband in a very drunken state. During the next few minutes, he explained that his employer was going through a process of corporate downsizing, and he had been let go. It was unlikely that, at the age of 59, he’d be able to find another position that paid anywhere near what he’d been earning, and therefore, they were financially ruined.

Calmly, his wife handed him a bank book which showed more than thirty years of steady deposits and interest totaling nearly $1 million. Then she showed him certificates of deposits issued by the bank which were worth over $2 million, and informed him that they were one of the largest depositors in the bank.

She explained that for the more than three decades she had ‘charged’ him for sex, these holdings had multiplied and these were the results of her savings and investments.

Faced with evidence of cash and investments worth over $3 million, her husband was so astounded he could barely speak, but finally he found his voice and blurted out, ‘If I’d had any idea what you were doing, I would have given you all my business!’

ENGINE TECHNOLOGY OF THE WEEK–The MYT (Massive Yet Tiny) Engine is an internal combustion engine of new design the features multiple firings in one cycle, producing enormous torque in a small area.

How it Works ~
The reason why the MYT Engine is so huge in displacement is because of frequent firing. It fires 16 times in one rotation, making it equivalent to 32 cylinder, four stroke engine.

The basic principle is the following. There are two disks each connected to four pistons in a toroidal cylinder. The disks rotate alternately generating the four stroke principles between the pistons. There is no need for valves since the position of the pistons allow wide open port to breathe air.

The part count is less than 25 parts even though it’s 32 cylinder equivalent. (Each piston fires twice during one rotation, making total 16 firings in one main shaft rotation.) RIDER MAGAZINE CIRCULATION NUMBERS CLARIFICATION– My name is Jill Anderson and I’m the Circulation Director for Affinity Media, publishers of Rider, American Rider and the Cruiser Buyers’ Guide.

I would like to take this opportunity to set the record straight regarding the growth in Rider’s circulation:

1 The numbers we publish on the statement of ownership and for our ABC report are completely factual and auditable.

2 The Post Office and ABC have different requirements for how our various programs are classified. But, if you add up the paid circulation numbers for single copies and subscription from both re ports, you will see that they are very close (ABC June statement = 144,132 average and October 08 Statement of Ownership shows 146,734).

3 The ABC statement covers January through June 08 issues; the Statement of Ownership covers December 07 through November 08 issues, so the comparison is not perfectly aligned from a date standpoint.

The e-mail from Mr. Kanter implies that our single copy sales cannot possibly be correct. If he were to actually read the ABC statement that Rider filed, he would see that ABC classifies our Motorcycle Riders Club of American (MRCA) subscriptions as single copy sales in the explanatory notes in paragraph 9d. ABC requires this because of the every-other-issue nature of those subs. ABC considers a subscription to be copies sent with continuous service, no breaks.

The Post Office considers MRCA subs to be subscriptions. They are looking at what our MAIL ED paid copies are within our total distribution.

Finally, I want to pass on the results of our recent ABC audit, which will report on the next statement. ABC showed that we under-reported newsstand sales for the December 07 and June 08 statements by 580 sold copies. If our single copy sales are inaccurate as Mr. Kanter implies, it is because they were reported too low!

We would be happy to give instructions on how to read publisher statements and statements of ownership if TAM Communications would accept our help!

Official World Championship on Discovery Channel tonight!–Big Fish Entertainment, the specialist TV production company, has created a program celebrating the annual Sturgis Rally and Official World Championship of Custom Bike Building. Scheduled to be broadcast tonight (Tuesday, Dec 9) at 10pm (EST) on Discovery Channel, ‘Sturgis Motorcycle Mania’ will feature the Official World Championship of Custom Bike Building as a main element of the show.

The 60-minute show is also repeated at 11pm (EST) and again at 2am on Wednesday, Dec 10.This year the 5th World Championship, held at Champions Park on Lazelle Street, was won by Canadian builder Roger Goldammer, with his land speed record bike Goldmember. The victory was the third Championship win in five years for the master builder from Kelowna, British Columbia, who was competing against the best custom bike builders from around the globe.

Hope you’re having some fun this holiday season and taking some time to visit friends. Time is the evil specter in this warm and fuzzy mix. Between work, shopping, projects and dealing with winter weather, it’s tough to carve out time to just relax and spend time with friends, but it’s the code of the west for this season.

As I write this I’m pointing the evil finger at myself. I could burn right through December working on bikes for next year, and now I have my son’s sorta wrecked Dyna in the shop for Christmas repairs. This weekend is a good example of tight schedules. Duane Ballard and Chris Callen, from the Cycle Source, are stopping by on Friday, plus my son to help with his bike. Larry Settle, who owns a shop in Harbor City, is rolling over to check my workmanship. Saturday will host the Moon Eyes Christmas party, and Boat Parades in Long Beach where dear old mom lives. Sunday will be the Century Motorcycle Christmas party in San Pedro.

Sunday will rock with the Dave Mann Chopper Fest in Ventura. We better get to the news, before Scott Long calls. He wants me to find out what’s wrong with his new Panhead engine from V-Twin. Hell, look what Jerry did with our T-Shirt Drive for our brothers and sisters in Iraq in Afghanistan? He took the time and made the effort for the troops in the Christmas spirit.

BIKERNET/ROLLIN’ SIXES/BIKERS CHOICE CHRISTMAS T-SHIRT DRIVE FOR THE TROOPS–Hey Bandit, We were up late last night moving boxes and folding shirts so we could be ready for wrap day tomorrow. Max and Linda from “The Tamiami Community Veterans & their Wives” met us at the hall. I was just going to write “The Tamiami Community Veterans” but all of a sudden my instincts for survival (which has keep me alive thru alot of stuff) just kicked in, so I will add the part about “& their wives”. I don’t want to be mauled by golf carts LOL.

We got everything set up and ready to start at 9.00 am the next day. The next day we got up and headed out to the hall to see who would show up to help us wrap. WOW, bro did we get a shock. There had to be I’m guessing 60 to 70 people already wrapping shirts, Christmas and military music blasting from the speakers and I do mean blasting. I felt like I just arrived at bootcamp on Santa’s Sleigh. Man, I’ve got to tell you bro we all had goose bumps as we walked in. No way did we expect that many folks to show up.

I can’t say enough about these people. You know how they say look up to and respect your elders, I guess that is really true, because I look up to and respect every one of them. At the end when they were done they came up to me, me the guy who needed their help and said thanks for letting them help out. That just blows me away. The generations behind me could learn alot from them.

We wrapped a little over 1,600 t-shirts plus other stuff and filled 43 boxes. The boxes in the pic’s are two deep. I know to some it’s not a lot but hey it’s not bad for something that started with a couple of guys talking thru late night emails. Thanks for all of your help man. This is turning into quite a thing. This is what Christmas is really about bro. I think we as a people have forgotten what it really means. It’s not big tv’s, expensive video games, or new cars (not in my neighborhood). It’s about people coming together to help each other and ease their pain. For a couple of days anyhow.

Expanded for 2009 to include Touring and Dyna models, the Custom Seat Program from Harley-Davidson Genuine Motor Accessories lets Harley-Davidson owners express their personality with pattern, color and texture, creating a custom leather seat that is hand-built to their specifications. SELLING IN A SLUMPING MOTOR OIL MARKET– HOUSTON ? U.S. vehicle production is dropping, miles driven are declining, and 2008 motor oil consumption will likely slide more than 5 percent from a year ago. But despite the grim trends, one industry expert sees some bright opportunities for motor oil marketers.

Larry Solomon, president of Strategic Resources, a Union, Ky.-based market research firm, provided last month?s NPRA Lubricants and Waxes Meeting an updated projection for U.S. motor oil consumption by private sector passenger cars and light trucks, projecting out to 2013.

Based on his consumption model, Solomon estimated that U.S. passenger car motor oil consumption will decline 5.6 percent to 616 million gallons from 2007 to 2008, before it begins to inch upward next year. Solomon predicted that consumption will rise slowly to 683 million gallons in 2013, not quite returning to the 2004 level of consumption.

Looking at 2008 and beyond, Solomon highlighted key market conditions affecting motor oil demand. The vehicle population is aging, and annual drain intervals are exceptionally depressed in 2008. Gasoline?s peak at over $4.23 per gallon in July caused consumers to extend drain intervals significantly, to just 2.8 oil changes per year. ?This all means that motor oil consumption has turned out to be exceptionally depressed in 2008,? said Solomon.

Private sector vehicle registrations continue to rise at about 1.75 percent per year, Solomon continued, while passenger car and light truck production has declined in recent years. How is this possible? ?The answer is quite simple: reduced passenger car and light vehicle scrappage rates,? said Solomon, explaining that the lower the percentage of vehicles scrapped, the more older, higher mileage vehicles on the road. Average vehicle age in the U.S. has climbed from 9.1 years in 2003 to 9.7 years in 2007.

Volatile gasoline prices and the recent economic downturn have negatively affected annual miles driven, Solomon continued, which are estimated to decline 0.5 percent from 2007 to 2008.

OECD Workshop In Europe on Motorcycle Safety: Integration by default seen as fundamental–The objectives of the OECD/ITF (International Transport Forum) Workshop in Lillehammer, Norway, on 10-11 June 2008, were to identify the real problems of motorcyclist safety, discuss practical solutions to these problems, and propose a set of measures to improve safety.

?Motorcycles must be fully integrated into the transport system and transport policies? was one of the main messages expressed by nearly 100 experts from 21 countries, representing the main stakeholders involved in motorcycle safety.

During the workshop, participants identified a top 20 list of measures to be implemented in the short term to make motorcycling safer. Among the practical measures identified:
? The overarching principle was the need to support continuing dialogue and co-operation between the various actors involved in motorcycle safety (including policy makers, researchers, manufacturers, and motorcyclists themselves).
?Including motorcycles more fully in transport policy and infrastructure policy/management, in order to develop an integrated approach, was seen as fundamental.
? Motorcycle crash counter-measures need to be developed on evidence-based research focusing on car driver and motorcycle rider behaviour. Evaluating the success or failure of the measures introduced is a key aspect for developing effective safety programmes.
? Better training is a key to improve motorcycle safety. We need to develop an efficient progressive approach to motorcycle training, which builds on existing standards, and focuses on risk awareness and risk avoidance as well as an understanding of the limits of rider/motorcycle capacities.
? A component on awareness and acceptance of motorcyclists should be included in the general training for all drivers.
? Collaborating with motorcyclists to develop and implement programmes on safety issues that affect motorcycling communities is essential.

After a successful Biketoberfest training session at their Daytona location, Bert Baker and James Simonelli completed the final staff training at J&P?s headquarters in Anamosa Iowa. The 65 person group included sales and tech specialists, product specialists, catalog personnel, purchasing, quality control and marketing staff.

BAKER has proven that the more technically savvy the sales staff is, the better the end user is satisfied. The training presentation included a brief BAKER company history, a discussion of the similar sales philosophy between the two companies, a full product line technical review, and a Q&A/new products wrap up. Rather than the typical ho hum PowerPoint presentation normally associated with product training, Bert and James kept things light, entertaining, and amusing in the typical BAKER fashion. LEGISLATIVE ISSUES ACROSS THE ATLANTIC–The second edition of the European Road Safety Day ? which took place in Paris on October 13 – had the objective to discuss EU road safety targets and means to achieve them, with a special focus on urban accidents and vulnerable road users.

The European Commission?s initiative stressed once more the necessity to enhance dialogue between stakeholders in order to find out specific solutions, which take all road users? needs into account. Only a balanced traffic mix can guarantee mobility for all.

Fortunately, the use of motorcycles – but also scooters and mopeds – is recognised more and more by European citizens as a solution to beat increasing congestion on our roads. This trend is making road authorities more aware of the specific needs of these vehicles and their users, and interesting national initiatives are emerging throughout Europe.

The importance of road infrastructure has now also been recognised as a priority to improve road safety and FEMA warmly welcomed the final vote of the Directive on Road Infrastructure Safety Management, supported by the European Parliament and the Council.

Of course, there is still a long way ahead before it becomes natural to integrate PTWs by default in all transport policies. But we are hopefully going in the right direction…

Oil Filters

S&S OIL FILTERS NOW AVAILABLE–When you are the leader in engine manufacturing you worry about the little things and how they might affect your product. You may not think an oil filter is important to how an engine runs, but it really is. Single and dual cam engines have very different ways of filtering oil?the single cam filters it after it leaves the engine, the dual cam engine filters oil before it makes its way into the engine. Because of this, different flow rates in the filter media are required.

S&S offers filters specifically for single cam engines?PN 31-4101 black and 31-4102 chrome?that feature a micron rating of 25. This is just enough for this type of engine to allow proper oil flow and no restriction. For the dual cam engines S&S offers two filters?PN 31-4103 black and 31-4104 chrome?with an anti-drain back valve and 7 micron filer media.

You may think the smaller filter media is the way to go for all bikes, but you would be wrong. More restrictive flow on a single cam engine will back oil up trying to exit the engine resulting in a filled crankcase, sumping and plenty of oil carryover. Exactly what you don?t want to happen.

Invest in your engine?whether it is an S&S or any other?buy purchasing the right filter for it. The black S&S filters have an MSRP of $10.45 and the chrome are just $12.95 and you can count on them working properly.

I’m running star hub wheels with a juice on back- I made a spacer kit and axle on the lathe to fit it all correctly… what do you think boss?

MYRTLE BEACH UPDATE–Delay OK on City’s Rally Plan Common sense to have hearing procedure in place.

The Myrtle Beach City Council is smart to delay implementing seven of the city’s new motorcycle rally ordi- nances.

Enforcement of the new rules, including a controversial requirement that riders wear helmets, cannot realistically take place until the city has in place the administrative hearing procedure to deal with the infractions.

The hearing procedure will be ready by Feb. 28, and that is now the effective date for the helmet requirement, which takes the city’s standard on helmets higher than S.C. state law.

The ordinances and amendments were to take effect Dec. 21. Besides helmets, other regulations delayed more than 60 days include the juvenile curfew; the 2 a.m. closing time for bars; use of parking lots for camping or party spots; parking oversized vehicles on public streets; convenience store security; motorcycle parking spaces; hotel check-in procedures; and alcohol consumption in parking lots.

Trying to enforce the ordinances without having the hearing procedure in place would have invited administrative and legal trouble. The procedure obviously must be drawn carefully, and it makes no sense to rush into enforcement.

The council also voted on the initial draft of an ordinance establishing $100 fines for the new civil infractions. There was discussion about $100 fines being more likely to deter violation of the rules; however, $25 fines would be in line with state standards – an argument the city attorney is expected to make. The second vote on the fines could come at the regular Dec. 9 meeting.

Overall, the city is acting a bit less rambunctious about cracking down on motorcycle rallies. There’s no doubt the big May events are viewed by many Myrtle Beach residents as a plague on the community.

In September, the council approved the new rules in response to residents’ complaints. From seemingly wanting to end the rallies – not a realistic solution even though that would please many residents – the city government is backing off a bit.

Some motorcycle tourism seems a lot more desirable as tough new economic realities are apparent to everyone. In these times, taking a hard look at all plans makes sense for individuals, families, small businesses, large corporations and governments at all levels.

Horry County Council members have a less draconian strategy for easing the negative impact of the rallies. The county will limit its vendor permits for the rallies to 400 total. Sales also will be limited to five consecutive days for the Harley-Davidson rallies and four consecutive days for the Bikefest rally.

The county vendor permits apply to the many unincorporated areas along U.S. 501 and U.S. 17, including shopping, restaurant and entertainment areas.

In North Myrtle Beach, the level of concern about the May rallies was evident in the small number of residents at that city’s public forums on the rallies. The third such event is Dec. 9. At the second forum, the message was that all visitors, bikers and otherwise, are welcome as long as they obey the law.

Myrtle Beach remains on track for making the rallies less unbearable. The delay for implemention is more than a little prudent.

Damn, we’re into December and 2008 is almost toast. Never a dull moment around here. I was going to get right to the news, but then a couple of calls rolled in. A brother who owns a shop reported that Santa Cruz, California H-D went out of biz. He also reported that he bought a Panhead engine from Ted’s V-Twin and is having nothing but problems. There are very reputable engine builders out there who gladly stand behind their products, like S&S and Accurate Engineering. Be careful.

The Panhead top end kept flooding. He took the cylinder off and discovered the wrong gasket blocking the oil passage. Can’t seem to reach customer service at V-Twin. We’ll keep you posted.

The pipe issue tied in quite well with an issue going on out in Fredericton, New Brunswick. I ran your stuff first and the point was driven home with the two sides of the story that followed. It is a real event that has the police and a shop owners doing a little verbal battle but there seems to have been a middle ground that was reached. I will do a follow up this week.

FREEDOM VS. GUN CONTROL– For those who fought for it, freedom has a flavor the protected will never know. It is now closer to reality than you think………….

You're sound asleep when you hear a thump outside your bedroom door. Half-awake, and nearly paralyzed with fear, you hear muffled whispers. At least twopeople have broken into your house and are moving your way.

With your heart pumping, you reach down beside your bed and pick up yourshotgun. You rack a shell into the chamber, then inch toward the door and open it. Inthe darkness, you make out two shadows. One holds something that looks like a crowbar. When the intruder brandishesit as if to strike, you raise the shotgun and fire. The blast knocks boththugs to the floor. One writhes and screams while the second man crawls to thefront door and lurches outside. As you pick up the telephone to call police, youknow you're in trouble.

In your country, most guns were outlawed years before, and the few that areprivately owned are so stringently regulated as to make them useless. Yours wasnever registered. Police arrive and inform you that the second burglar hasdied. They arrest you for First Degree Murder and Illegal Possession of aFirearm. When you talk to your attorney, he tells you not to worry: authorities willprobably plea the case down to manslaughter.

“What kind of sentence will I get?” you ask.

“Only ten-to-twelve years,” he replies, as if that's nothing. “Behaveyourself, and you'll be out in seven.”

The next day, the shooting is the lead story in the local newspaper. Somehow,you're portrayed as an eccentric vigilante while the two men you shot arerepresented as choirboys. Their friends and relatives can't find an unkind wordto say about them. Buried deep down in the article, authorities acknowledgethat both “victims” have been arrested numerous times. But the next day'sheadline says it all: “Lovable Rogue Son Didn't Deserve to Die.” The thieves havebeen transformed from career criminals into Robin Hood-type pranksters. As thedays wear on, the story takes wings. The national media picks it up, then theinternational media. The surviving burglar has become a folk hero.

Your attorney says the thief is preparing to sue you, and he'll probably win.

The media publishes reports that your home has been burglarized several timesin the past and that you've been critical of local police for their lack ofeffort in apprehending the suspects. After the last break-in, you told yourneighbor that you would be prepared next time. The District Attorney uses this toallege that you were lying in wait for the burglars.

A few months later, you go to trial. The charges haven't been reduced, asyour lawyer had so confidently predicted. When you take the stand, your anger atthe injustice of it all works against you. Prosecutors paint a picture of youas a mean, vengeful man. It doesn't take long for the jury to convict you ofall charges.

The judge sentences you to life in prison.

This case really happened.

On August 22, 1999, Tony Martin of Emneth, Norfolk, England, killed oneburglar and wounded a second. In April, 2000, he was convicted and is now servinga life term.

How did it become a crime to defend one's own life in the once great British Empire?

It started with the Pistols Act of 1903. This seemingly reasonable lawforbade selling pistols to minors or felons and established that handgun sales wereto be made only to those who had a license. The Firearms Act of 1920 expandedlicensing to include not only handguns but all firearms except shotguns.

Later laws passed in 1953 and 1967 outlawed the carrying of any weapon byprivate citizens and mandated the registration of all shotguns.

Momentum for total handgun confiscation began in earnest after the Hungerfordmass shooting in 1987. Michael Ryan, a mentally disturbed Man with aKalashnikov rifle, walked down the streets shooting everyone he saw. When the smoke cleared, 17 people were dead.

The British public, already de-sensitized by eighty years of “gun control”,demanded even tougher restrictions. (The seizure of all privately ownedhandguns was the objective even though Ryan used a rifle.)

Nine years later, at Dunblane, Scotland, Thomas Hamilton used a semi-automatic weapon to murder 16 children and a teacher at a public school.

For many years, the media had portrayed all gun owners as mentally unstable,or worse, criminals. Now the press had a real kook with which to beat uplaw-abiding gun owners. Day after day, week after week, the media gave up allpretense of objectivity and demanded a total ban on all handguns. The DunblaneInquiry, a few months later, sealed the fate of the few sidearm still owned by private citizens.

During the years in which the British government incrementally took away mostgun rights, the notion that a citizen had the right to armed self-defensecame to be seen as vigilantism. Authorities refused to grant gun licenses topeople who were threatened, claiming that self-defense was no longer considered areason to own a gun. Citizens who shot burglars or robbers or rapists werecharged while the real criminals were released.

Indeed, after the Martin shooting, a police spokesman was quoted as saying, “We cannot have people take the law into their own hands.”

All of Martin's neighbors had been robbed numerous times, and several elderlypeople were severely injured in beatings by young thugs who had no fear ofthe consequences. Martin himself, a collector of antiques, had seen most of hiscollection trashed or stolen by burglars.

When the Dunblane Inquiry ended, citizens who owned handguns were given threemonths to turn them over to local authorities. Being good British subjects,most people obeyed the law. The few who didn't were visited by police andthreatened with ten-year prison sentences if they didn't comply. Police laterbragged that they'd taken nearly 200,000 handguns from private citizens.

How did the authorities know who had handguns? The guns had been registered and licensed. Kinda like cars.

Sound familiar?

Harley to Sell XR1200 in U.S.–Harley-Davidson has undertaken a super-soft launch of the much ballyhooed XR1200 for the U.S. market. The initial launch will be kept to a limited run of 750 bikes. Up until now, the dirt-track inspired bike has only been available in Europe, the Middle East and some African regions.

In finally offering the inspired Sportster to American customers, it appears as if Harley-Davidson is going to right what many view as one of the most egregious wrongs ever inflicted on the American motorcycling community. News of the Euro-only model was met by the U.S. Riding public with loud dissention and a few boos and hisses.

Dile M.Brown, owner of Knoxville Harley-Davidson and a member of Dealernews editorial advisory board, confirmed that the Motor Co. notified its dealerships via e-mail that the XR1200 would be available.

Word about the release started circulating through the Internet Monday morning after Harley-Davidson of Westminster (Calif.) posted information on its Web site that the store was taking pre-orders through Dec. 15 on the bikes. The site lists an MSRP of $11,179 for the orange and black model.

Harley-Davidson names new vice president– A public relations executive who formerly worked at Kohl?s Department Stores and Miller Brewing Co. has joined Harley-Davidson Inc.

Susan Henderson, the newly named vice president of communications for Harley-Davidson, will develop and direct the company?s global and strategic communications initiatives, according to a press release.

Henderson will report to Jim Ziemer, Harley-Davidson?s CEO.

?Susan is a seasoned communications and public affairs professional who brings more than 25 years of experience to Harley-Davidson. Over that time, she has worked with some of the world?s leading brands to support business growth and deliver shareholder value,? Ziemer said. Most recently, Henderson was vice president of corporate communications at the Wm. Wrigley Jr. Company in Chicago. She had earlier owned a communications consulting firm, where her clients included Gillette.

The head of a DUI program gets busted for A DUI– The leader of a Treasure Coast-wide agency established to provide classes for people convicted of driving under the influence of alcohol or drugs was suspended from her job Wednesday in the wake of her DUI arrest Monday.

The Comprehensive Offender Rehabilitation and Education program will continue to operate normally despite the arrest and suspension of its executive director, Margot “Peggy” Cioffi, 59, of Palm City, program officials said.

The nonprofit agency serves about 5,000 clients per year in Martin, St. Lucie, Indian River and Okeechobee counties, providing educational services to people on probation for DUI and other misdemeanors, among other programs.

“I feel bad for Peggy because this is very out of character for her,” said State Attorney Bruce Colton, the president of CORE’s board of directors. “It’s bad for her and it’s bad for the public perception of the program.

TRIAL UPDATE–Bryan Joseph ?B.J.? Mough was shot in the back Feb. 25, 2008 WATKINSVILLE – Jurors watched a video this morning of Richard Harold “Ricky” Gear, the Bogart man accused of gunning down a motorcyclist at the foot of his driveway, as Gear demonstrated that he stood back from the road when he fired the fatal shot.

Oconee County investigators secretly made the video the evening of Feb. 25, as they questioned Gear soon after he shot and killed Brian Joseph “B.J.” Mough of Winder.

In the video, Gear told deputies that a motorcyclist had followed his daughters home after he collided with their car, and that Mough drove past soon after his daughters car pulled into the driveway

“He whipped around and came right at me, like he was going to take me out,” Gear said in the video.

But when deputies asked Gear to return to the place where he fired at Mough, he positioned himself back from the roadway, with a culvert and mailbox between himself and the biker?s path.

“He was right there, like where the mail-lady comes through,” Gear said in the video.

In testimony Wednesday, Oconee County Sheriff Scott Berry told jurors that Gear told investigators he acted in self-defense, but the sheriff ordered Gear arrested after he saw that Mough was shot in the back.

Gear told Berry at the schooting scene that he fired only once at Mough as the biker came toward him while he stood on his own property, the sheriff said.

But when Berry examined the victim at Athens Regional Medical Center, he and a coroner concluded that Mough was shot from behind.

“As I looked at the body of Bryan Mough in the hospital, I didn’t see how that was possible” that Mough was shot as he drove at Gear, the sheriff told jurors.

“We were satisfied the (bullet) came from the right rear,” he said.

Berry took the stand at the end of a full day of testimony from law enforcement officers and emergency medical workers.

Earlier, Deputy William “Ken” Elrod told jurors he was the first to arrive at the shooting scene, and he knew from his experience as a combat medic that Mough would not survive.

“He took two deep breaths and that was pretty much it,” Elrod told jurors.

Authorities allege Gear shot Mough as he drove past Gear’s home outside of Bogart, but Gear has claimed he acted in self-defense after Mough harassed his daughters as they drove along Atlanta Highway, then followed them home and tried to run him down.

A grand jury indicted Gear on charges of malice murder, felony murder, aggravated assault and three counts of possession of a firearm in the commission of a crime. Jurors watched video footage Wednesday that sheriff’s investigators taped with a camera disguised as a flashlight as Berry questioned sisters Chelsea and Samantha Gear about events that led to Mough’s death. Chelsea Gear was animated and called Mough a “jackass” and “douche bag” because of the way he drove. The 21-year-old told Berry in the video that as she and her sister left Target in Athens, Mough’s motorcycle passed close to her car in the same turn lane while traffic pulled onto Atlanta Highway. “He was in my lane,” she said. Mough was in front of the Gear sisters’ car most of the way as they traveled west, but at some point, the car got ahead of the motorcycle. Chelsea Gear complained in the video that Mough followed closely behind her, and as the two westbound lanes of Atlanta Highway narrowed to a single lane at the junction of Monroe Highway near the Pepsi plant, Mough passed her on the left side, in the turn lane. When she reached Burson Avenue, where Mough was stopped for a red light, she made an obscene hand gesture as she turned right into downtown Bogart, Chelsea Gear said in the taped interview.

Instead of continuing on Atlanta Highway toward his home in Winder, Mough followed the sisters’ car and at a stop sign “slammed into the side of (the) car and knocked the sideview mirror out of whack,” Chelsea Gear said in the interview.

About that time, 18-year-old Samantha Gear called her mother to say a man was following them, and Dianna Gear said to her husband, “Rick, get your gun and c’mon,” prosecutor Ken Mauldin told jurors Tuesday, the first day of testimony.

The sisters already had returned home, and Chelsea Gear was inside when Mough drove by, Mauldin told jurors. Richard Gear walked about halfway down his driveway and fired twice at the passing motorcyclist, Mauldin said.

Mough turned around and made a second pass, and Gear fired the third and fatal shot from his .40-caliber semiautomatic pistol, said Mauldin, district attorney for the Western Judicial Circuit.

Gear told Berry that he heard the crunching of gravel between the road and his yard as Mough drove at him, the sheriff said, but investigators found no tire tracks in the gravel to back up Gear’s recollection.

The trial is expected to last at least through Friday, and possibly into early next week.

Gear, his wife and both daughters are slated to testify.

BIKERNET READER SPOTS EAGLE–A couple of weeks ago I was going to Winchester, VA and saw a huge eagle sitting on a fence post along the side of the road. This weekend I had to go back, so I took the backroads and decided to take my camera along in case I got lucky and saw him again. Well, I got lucky. As I was cruising up a gravel road I saw an eagle sitting on a deer carcass about 100 yds off in a field. I stopped the truck and took a few pictures using my telephoto lens. I took this shot through the passenger window of my truck. I tried to get a little closer, but as soon as I got out of the truck and crunched through some dried leaves, he looked up at me and took off. Another eagle joined him in flight.

The only bad thing about it is whoever shot the deer obviously took the head for a trophy and left the carcass. That seems like a real waste, but I couldn’t get over how big this bird was. Take a look at how the eagle’s body size compares to the deer’s body size and that’ll give you an idea.

PRICE FIXING FINES– Japan-based Sharp Corp., South Korean-based LG Display Co, Ltd., and Taiwan-based Chunghwa Picture Tubes Ltd. were recently found guilty of ?conspiring to drive up the price of LCD panels? forcing consumers ?to pay more for these products? according to the Justice Department. LG Display agreed to pay a $400 million fine, Sharp agree to fork over $120 million and Chunhwa consented to a $65 million fine for fixing prices to gain prominence in the $70 billion worldwide LCD screen market.

But how does buying American enter into the picture since most of the electronic devices that use LCD screens are made outside of the United States anyway? The answer is that we can still buy American by supporting U.S.-based companies even when their products are sourced from overseas.

WHO IS MORE DESERVING OF BIKER CHARITY THAN OUR OWN?–Fellow Riders and Freedom Fighters: Across our nation and throughout the year, “bikers” are called upon to ride for this cause and donate to that charity. And now that the holidays are upon us, requests that we “open our hearts and wallets” will be pervasive.

That’s all well and good. Those of us with something extra should be willing to help those who are truly needy and deserving. But being “needy and deserving” should not be the only test a charity has to pass to get a bucket of biker bucks. We must also consider where the money will actually go, and how it will ultimately be used. Before we let those eagles fly, we need to know whether the net result will be complementary … or counterproductive.

What I Mean By “Counterproductive” Let’s say, for example, your SMRO is asked to sponsor a poker run to raise money to fight some nasty-sounding disease or disorder. Who gets the money? The afflicted patients’ families, their doctors, the hospitals, or some physicians’ research institute? If the answer is “the families”, will it not then be applied to medical bills and insurance premiums? One way or the other, will not most or all of the money end up in the hands of doctors, healthcare firms or insurance companies? And will they not in turn spend at least some of what was OUR money to lobby against freedom of choice and other motorcyclists’ rights?

Everyday and everywhere motorcyclists–our brothers and sisters–are being injured, maimed, crippled and killed in accidents resulting from right-of-way violations (ROWVs) by care-less, negligent, distracted and impaired cagers:

And everyday and everywhere safetycrats … paid with OUR tax dollars and appointed by politicians elected with OUR contributions … ally themselves with healthcare and insurance lobbyists bankrolled by OUR premium payments and OUR charitable donations to condemn motorcyclists for the “social costs” of all this carnage … unjustly and unacceptably blaming the victims for the crimes. Must we continue to donate the dollars directed to deride and defeat us?!?

What I Mean By “Complementary”

Bikers may like breasts, but we are NOT breasts. We do not have to feed the mouths that bite us. And we do not have to look outside of our tribe to find potential beneficiaries who are needy and deserving. According to NHTSA, nationwide last year 103,000 motorcyclists were injured and 5,154 were killed in traffic accidents:

That’s more than 108,000 biker households who suffered loss of income, limb or life, incurring catastrophic medical costs and other expenses to boot. And I ask you:

WHO IS MORE DESERVING OF BIKER CHARITY THAN OUR OWN?

This holiday season, please remember the brothers and sisters in your area who went down, and do what you can to make sure their families have something under the tree. Even a small gift from you could mean the world to them.

Pharmaceutical Commercials–I’m tired of Prescription ads that are forced to list all the downsides. The law or regulation is discriminatory. Why aren’t there warnings with car ads, like SUVs tip over if braking in a severe turns.
