The Long and Winding RoadPro-Hobby Street Rod/Custom Vehicle Bill Passes Massachusetts Legislature, Vetoed by Governor The road to success is often marked with unsuspected twists and turns. This is exactly what SAN members in Massachusetts have experienced over the last month in working to pass a titling and registration bill for street rods and custom vehicles. After working tirelessly for the last two legislative sessions it seemed like the end was in sight when the measure was approved by the Legislature in the closing days of 2008. However, it was ?pocket vetoed? by Governor Deval Patrick after he failed to sign the bill within 10 days of receiving it. The SEMA Government Affairs office will work to uncover and mitigate concerns raised by the Governor as the bill may be reintroduced this year. It was through the persistence of one particular individual, Methuen City Councilman Joe Leone, that the bill was even given consideration amongst the chaos that exists in the closing days of a legislative session. An avid enthusiast and owner of a FFR Roadster, Leone worked to educate lawmakers on the positive benefits that this bill would have on the enthusiast community. ?We are deeply indebted to Joe for his determined efforts to get the bill through the Legislature,? said Steve McDonald, SEMA Vice President of Government Affairs. ?From countless e-mails, phone calls and visits to the State House, he helped to ensure that this pro-hobby bill would receive attention from lawmakers and has pledged to continue in this effort.? In quoting Hollywood legend Clint Eastwood from his new movie Gran Torino, Leone joked with SEMA staff in saying, ?I finish things…that?s what I do.? Based on the SEMA-model Street Rod/Custom Vehicle bill, the bill defined a street rod as an altered vehicle manufactured before 1949 and a custom as an altered vehicle at least 25 years old and manufactured after 1948.

The bill allowed kit cars and replica vehicles to be assigned a certificate of title bearing the same model-year designation as the production vehicles they most closely resemble. Special thanks are also due to Dana and Lenny Schaeffer of Chop-Shop Customs; Paul Saulnier of the Dominators Car Club; John Buchanan of the Mass Cruisers Car Club; and to the officers and member clubs of the Massachusetts Association of Automobile Clubs.

To date the SEMA-model bill has been enacted in one form or another in Washington state (1999), California (2001), Illinois (2002), Missouri (2004), Rhode Island (2004), Hawaii (2004), Montana (2005), Maine (2005), Colorado (2006), Arkansas (2007), Virginia (2007), Nevada (2007), Florida (2007), Idaho (2008), Iowa (2008) and Tennessee (2008). The New York, New Jersey and Wyoming Legislatures have already or will introduce the SEMA model for the 2009 legislative session.

A SEMA member has recently passed a similar bill for motorcycles in Montana.

HARLEY RIDERS CAPTURE ESCAPED CONVICT–Harley-Davidson folks help capture, handcuff escaped inmateFrom Sandy Louey and Chelsea Phua:

Placer County authorities have captured an inmate who escaped this morning during a medical appointment in Auburn – thanks to some folks at a Harley-Davidson dealership.

The helpful people at Harley even handcuffed the escapee.

David Lee Todd (photo left), who was wearing an orange jumpsuit, was taken into custody around 12:45 p.m. at the Auburn Harley-Davidson, 12075 Locksley Lane near Highway 49, said Dena Erwin, spokeswoman for the Placer County Sheriff’s Department.

Todd had run from a Tires Plus employee onto the grounds of the Harley-Davidson dealership. He gave up after being surrounded by eight employees and customers, one of whom had a pair of handcuffs that were used on Todd, she said.

Todd, 49, escaped after he was transported from the Placer County Jail to the Auburn Imaging Center on Professional Drive for a medical appointment, Erwin said.

He was being wheeled into the center after complaining of pain from a fall. In the middle of the appointment, Todd, who was in custody for multiple burglary and robbery charges, bolted from the wheelchair and ran out of the center about 9:45 a.m., Erwin said.

He pushed a woman in the parking lot out of her Dodge Durango and took off in it. The woman was not injured, Erwin said.

Deputies found the vehicle about half a mile away on Park Drive.

Authorities said more than 40 sheriff’s employees, including K-9 teams, a helicopter, and the California Highway Patrol helicopter, were involved in the morning-long hunt.

Todd, who had been in custody since Dec. 9 on charges of robbery and a burglary warrant, was taken back to the Auburn jail. He faces additional charges of escape, carjacking, assault with a deadly weapon, battery on a peace officer and car theft, the Sheriff’s Department said.

On Nov. 21, Todd was caught on videotape kicking in the door and burglarizing the pro shop at the Raspberry Hill Golf Course on Musso Road in Auburn, investigators said. He allegedly stole candy from the shop.

THE BIKERNET SVENMEISTER INVESTIGATION, THEY COME CLEAN–As many of you may know, Svenmeister Hardcore Kustoms isn’t a full blown bike shop- the Svenmeister and his wife Logan started the company a few years back when building bikes out of the backyard. Recently, we have managed to work our way up to a two car garage and a detached ‘lil body shop with plans in the coming year to complete some extensions?proud of where we started, we will retain the title of “Garage Builders.”

The motorcycle industry has treated us nicely?at times people have made us feel like an Arlen Ness Company. However, due to the poor US economy and the steady decline of chopper mania, we have had to make some radical changes within our business and to our services.

Starting this February, we will no longer be doing tune ups or minor repair jobs, instead we plan to concentrate our energies on building only complete motorsikles and hot rods. We’ve just recently started a build on a chopped and sectioned 1951 Ford F1 that we plan to debut this spring. There’s a 1950 Chevy truck waiting outside just waiting to loose some weight. Also, Jamison’s one of a kind Roadster should find it’s way to the paint booth soon and of course we might get lucky and be allowed to put a sticker on Bob’s Coupe which he’s about to finish.

And none of it will help the American economy. We need to keep that money here in America. You can keep the money in America by spending it at yard sales, going to a baseball game, or spend it on prostitutes, beer and wine (domestic ONLY), or tattoos, since those are the only businesses still in the US.

Lake Worth Bike Night’s Jerry Graves Memorial– Biker’s rally to support Michaele “Hot Rod” Graves and honor his father, fallen chopper builder, Jerry Graves.

Lake Worth, Florida, Fl, January 29, 2009 An outpouring of sympathy from the area motorcycle community is fueling a memorial on Thursday, January 29, 2009. Lake Worth Bike Night is hosting a special Jerry Graves Memorial starting at 7PM. A portion of the proceeds from Lake Worth Bike Night’s fund raising efforts will be donated to Michaele Graves “Hot Rod”, son of Jerry Graves. Lake Worth Bike Night founder, Adam Raizen felt moved by Jerry’s passing and compelled to organize this event.

Jerry Graves was the owner of Graves Custom Cycles. His custom chopper designs are known throughout Palm Beach County and the country. A sample of his work has appeared in The Art of the Chopper, a book featuring national motorcycle designs.

The following quote is from The Art of the Chopper. “I’ve got building motorcycles on my mind all the time,” says Graves. “Generally it’s the last thought on my mind before I go to bed and the first thing I think of in the morning. If I get up in the middle of the night to pee, I’ll sketch what I couldn’t get out of my head on the bathroom mirror.” Samples of Graves work will be featured all throughout downtown Lake Worth.

Lake Avenue and Lucerne Avenue venues will be alive with music on this special night. Two of the bands scheduled to appear are Slip and the Spinouts and The Dillengers.

Custom bike builders Mike Pruss, Mike Beland, Adam Chandler, Cyril Huze, Billy Lane, Chop Shop Customs, Thunder Cycle, “Chiki” Vagabond and more to be announced will be attending. So many great people in the industry coming out to support this sad but needed cause. An array of vendors will also be set up at various downtown locations.

DAYTONA BEACH, FLA. –January 28, 2009–The Seminole Hard Rock Roadhouse will return to the Doghouse Bar and Grill on Main Street in Daytona. In keeping with The Doghouses’ reputation as “the place to party in Daytona,” this year’s Seminole Hard Rock Roadhouse line-up will feature some of the industry’s best custom bikes, builders, and special events. In addition the Doghouse main stage will feature nightly live music from Bike Week favorites Rebel Son and DB Bryant, as well a special one night appearance of Confederate Railroad on Wednesday March 4th.

The Seminole Hard Rock Roadhouse wouldn’t be complete without top name custom bike builders and their bikes. Christian Clayton of Sucker Punch Sally’s will be showing his Hard Rock Bike. In addition Clayton has teamed up with Ami James of Miami Ink to produce a limited amount of Love Hate Choppers. The two prototype production models, “Love” and “Hate” will be making their first public debut only at the Seminole Hard Rock Roadhouse.

CALIFORNIA EPA ISSUES FROM NEW CITIZEN KIWI MIKE–I think Calif has even a bigger issue brewing in which the big plan is in the name of clean air is to do away with alleged polluting motorcycles. I think there will be a day when many motorcycles will not be able to be operated on our Calif roads especially since a recent law was passed to phase out big rig diesels older than 2007 (going off memory) from our road starting in 2012.

My truck is paid for and only gets operated on California roads to go out of state to shows back east.

I think my classic Indians just might be outlawed one day and considered gross polluters.It could be that the insurance companies won’t insure them, that could be a different angle too.I think we’re all going to get screwed mate.

On another note I’ll be sworn in as a US citizen this Thursday. I had to go into LA immigration office early Jan which I got there at 7.15 a.m. and talk about a bunch of city assholes not allowing motorcycles to park in the paid city parking structures. I got turned away from three of them and had to park way down the road in a lot that was approved for m/cs. I thought I was saving the country gas by riding my old ’53 Chief and saving space on the freeway only to be discriminated against in LA.

SPEAKING OF THE ECONOMY–S&S Cycle would like to address recent rumors stemming from the auctioning of several pieces of manufacturing equipment. In a down economy rumors fly, so here are the facts: Like other companies in the manufacturing industry, S&S has conducted layoffs, and is selling excess equipment. ?These are appropriate measures that we took in response to the slowing economy? says CEO George Smith. Smith went on to say ?people may not be aware of this, but while we are clearing out some of our machinery, we are also investing in new machines, and increasing our efficiency and overall capability.?

Although slowing sales are a factor, some of the machines being sold have already been replaced in production by a new manufacturing cell that was made fully operational just last summer. This system allows for the consolidation of machining centers and results in greater efficiency.

A redesign of the plant layout is also being implemented to increase the flexibility and scope of S&S?s manufacturing capacity.S&S is about to launch an aggressive and dynamic marketing program which will start with a dual presence at the V-Twin Expo in Cincinnati, Ohio. S&S will be showing performance enhancement products under the S&S name as well as vintage engines and parts under their recently acquired Flathead Power brand.

The following week at the Dealer Expo 2009 in Indianapolis, Indiana, S&S will debut a new line of off-road performance products and parts for metric cruisers.

BIKE CLUB THIN BLUE LINE BLURS– The Iron Brotherhood has an eye-catching, if ominous-looking, Web site home page: A human skull, its mouth open and its eye sockets painted blue, faces the viewer. A German Iron Cross frames the skull. Meanwhile, lightning bolts flash across the black background while the opening guitar riffs from Black Sabbath’s “I Am Iron Man” play.

Heavy metal rock band? Biker gang? Perhaps even a neo-Nazi or white-supremacist group? Guess again. Iron Brotherhood is an off-duty law-enforcement motorcycle club formed in 2006.

“We are bikers who happen to be cops who share a common bond,” states a brief overview of the male-only club. “We are dedicated to our profession and our brotherhood.”

The group is just one of an increasing number of off-duty law-enforcement motorcycle clubs (LEMCs) sprouting across the country and blurring the lines, at least in appearance, between the good guys and the allegedly not-so-good guys.

In fact, given the skulls, tattoos, leather vests or poses on “hogs” that appear in photo galleries, the average bloke would be hard-pressed to distinguish, say, the Hell’s Angels from the Iron Pigs, Wild Pigs, Untouchables, Renegades, Blue Steel or City Heat, a Chicago-based club that has a Twin Cities chapter.

There are “striking similarities in self-presentation,” notes Mitch Librett, a retired New Rochelle, N.Y., cop, criminologist and author of “Wild Pigs and Outlaws: The Kindred Worlds of Policing and Outlaw Bikers” (Crime, Media and Culture Journal).

“The ‘colors,’ slogans, and monikers adopted by the members are often indistinguishable,” adds Librett, a motorcycle enthusiast himself and assistant professor of criminal justice at Bridgewater State College in Massachusetts.

Librett adds that both outlaws and lawmen attracted to the biker culture embrace living on the edge, though on seemingly opposite sides of the law. Indeed, quite a number of local Twin Cities cops who are members of City Heat belong to high-adrenaline, high-risk units such as SWAT, the bomb squad or street narcotics.

To be sure, there is nothing illegal about this off-duty association. Many cop-biker fraternal organizations are established and regularly conduct fundraising “runs” for worthy causes.

They include Blue Knights International, for example, which has donated more than $7 million in goods and cash to the Cystic Fibrosis Foundation, Toys for Tots, Make-A-Wish Foundation and others.

City Heat also promotes charity runs on its Web pages. But some of the more mainstream and family-oriented outfits such as Blue Knights express concern over a recent surge of “fringe” elements. They also point to problems such as the confrontation between Seattle members of the Iron Pigs LEMC and the Hell’s Angels last summer at the annual Sturgis, S.D., motorcycle rally.

An off-duty cop shot and wounded a Hell’s Angel. Investigators decided the officer acted in self-defense. The brawl that led to the shooting reportedly stemmed from a dispute over vest patch insignia.

“We have strived to be the very opposite of anything outlaw,” said Mike Ripsch, the Blue Knights’ outgoing president and a retired cop from Illinois.

“But the sad fact of the matter is that, if somebody does something wrong or acts questionable and it becomes known that he is a cop (LEMC or not), the brush is wide and it affects us all,” Ripsch said. “Some of our own do a pretty good job of shooting ourselves in the foot at times.”

Added Librett: “I really have to question why any police officer would feel that emulating the (outlaw) lifestyle is an attractive way to spend their free time. There is a danger there.”

The Mongols Patch Court Case

The Feds were trying to set a precedent so that they could eventually take trademarked property from anyone and then anyone’s personal property for whatever reason.

Judge Florence-Marie Cooper of the Central District issued an interesting order last week barring the government from seizing any property displaying the “Mongols” trademark. The word “interesting” gets thrown around a lot on the internet (to the point of dilution), but this dispute is darn “interesting.” [Rivera v. U.S., Case No. 2:09-cv-2435-FMC-VBKx (C.D. Cal.; Aug. 3, 2009)] [link to opinion at Scribd ].

In October 2008 it was widely reported that the United States seized the “Mongols” trademark. The Mongols are a motorcycle club, and in late 2008, the government obtained an indictment against certain members of the club. Based on this indictment, the government sought forfeiture of various items of Mongols property, one of which the Mongols registered mark. The seizure order extended to items of property bearing the mark. Plaintiff Ramon Rivera was a member of the club who was not included in the indictment. He brought suit to enjoin the government's seizure of his property bearing the mark.

Trademark/Seizure: The court agreed with Rivera and held that the mark was not subject to seizure. Based on the indictment. Basically, the entities who owned the mark were not indicted, and none of the defendants who were indicted had a “forfeitable interest” in the property. On the propriety of forfeiture, it was a basic case of wrong parties. It's tempting at a quick read to come away with the impression that trademarks are never subject to forfeiture, but the court didn't need to get to that point. And it's not true anyway, trademarks are subject to involuntary conveyance under certain limited circumstances. See Evan Brown's discussion of a recent case here where the court issued an injunction preventing transfer of the “Bodog” trademarks, essentially agreeing with the plaintiff's premise that the mark was an asset that had been transferred in an attempt to evade creditors. (I was counsel in that case and there was an interesting domain name component to it as well. Speaking of which, I wonder if the government went after the domain names here.) I think this particular type of a mark is probably not subject to forfeiture, and in any event, the government didn't seem to make any effort to dress up its obviously punitive approach.

Seizure of Property Bearing the Mark: Interestingly, the government argued that separate from whether it was entitled to seize the mark, it was entitled to seize property bearing the mark. Supposedly, seizure of the property baring the mark was “necessary to preserve the availability of the mark for forfeiture.” The court didn't buy this, and also rejected the government's argument that continued use of the mark would tarnish it. I'm not sure how the government made this last argument with a straight face, but it did. The discussion delves into areas that are pretty far outside my range of experience, but it was fun to wade through the court's order.

The First Amendment: The final part of the court's order was the real zinger and one I'm guessing the government did not see coming. The mark sought to be seized was not a typical trademark, but a “collective membership mark,” which as the court observes “directly implicate the First Amendment's right to freedom of association . . . in their use and display.” The court basically smacks down the government's entire approach to the case, noting that: [the items sought to be seized by the government] were expressive and denote[d] association with the Mongol Nation. [Because the mark] act[ed] as a symbol that communicates a person's association with the Mongol Nation, and his or her support for their views . . . [seizure of the property] to silence this expression constituted an attack on a particular viewpoint. Seizure of property bearing a Mongols membership mark should be considered viewpoint-discriminatory. Needless to say, the government did not make a sufficient showing that “a compelling reason” existed to justify the seizure.

Convoluted factual and procedural context to the case. The court reaches the right result I think and the order contains some good discussion of the issues. The last time I recall something like this coming up was when the government seized a domain name and propagated – or forced propagation – of its own message. Congrats to Rivera's lawyer!

NATIONAL MOTORCYCLE CRASH STUDY UNDERWAY,Southern California motorcyclists who crash their bikes may play an unintentional role in improving motorcycle safety nationwide, as the pilot portion of the federal government’s much-anticipated Motorcycle Crash Causation Study kicked off at various locations throughout Los Angeles in December.

Data will be compiled from LAPD accident reports and information recorded by mechanical sensors and cameras placed at intersections until at least 27 accidents have occurred and are documented — a milestone that will likely be reached by March.

According to Doug Hecox, spokesman for the Federal Highway Administration, the Department of Transportation entity managing the pilot study, the pilot is “purely to test the methodology” that will be applied to the broader Motorcycle Crash Causation Study, which is expected to kick off in about a year in a handful of different states. Final results of which won’t be available until at least 2013.

Much has changed since the last such motorcycle accident study, the 1981 Hurt Report; about 11 million street bikes have been sold in the U.S. The average rider’s age has increased from 27 to 41, and the overall rider population has grown to roughly 7 million. Traffic mix, driving/riding laws, and more powerful motorcycles are some other variables.

In 2005 Congress authorized over $2 million to fund a new motorcycle crash causation study under a federal transportation reauthorization bill (a.k.a. SAFETEA-LU), with the caveat that federal funds be matched from a nongovernmental source. Much of the matching funding has come from national motorcycle organizations, some of which hail the report as long overdue and necessary for planning safety countermeasures, while other groups fear yet another typically lopsided anti-motorcycle government report.

FEDS DECLINE TO INCREASE TARRIFS ON EUROPEAN MOTORCYCLES,U.S. trade officials have decided not to include motorcycles on their lengthy list of European products that will soon face increased tariffs in retaliation for a European Union ban on imports of hormone-fed beef from America.

In public comments submitted to the Office of the U.S. Trade Representative opposing the possible 100% import duties, many motorcycle organizations, industry groups, manufacturers, dealers and others pointed to the extensive economic impact on businesses and jobs affected by such retaliatory tariffs, as well as a hardship for motorcycle enthusiasts. Also, motorcycle usage should be encouraged for fuel efficiency and easing traffic congestion and parking.

U.S. Trade Representative Susan Schwab noted her office received approximately 600 comments regarding which of more than 100 European goods should be subjected to the tariffs.

“An interagency committee of trade experts and economists reviewed the public comments and provided recommendations to the USTR with respect to modifications that would result in a more effective action, while taking account of effects on the U.S. economy, including consumers,” she said regarding the list of European Union products slated for tariff increases beginning March 23; but their beef with the EU will no longer threaten to double the price of imported Euro motorcycles and scooters.

MYRTLE BEACH SAYS NO TO BIKERS,Myrtle Beach has launched a website and printed brochures advising visitors that from the city’s perspective, the May motorcycle rallies are over.

The Website bears a message from Mayor John Rhodes stating that the ?Harley-Davidson Dealers Association Spring Rally and the Atlantic Beach Memorial Day Bikefest will not be held in Myrtle Beach?, and lists 15 new laws the City Council has passed to discourage bikers from coming to town. Designed by the Myrtle Beach Chamber of Commerce, the top of the site proclaims; “effective 2009, Myrtle Beach, SC will no longer host motorcycle rallies.”

To deter bikers, the city implemented stricter noise and muffler rules, will be enforcing a municipal helmet law, require eye protection while riding and a variety of restrictions on vendors, parties and motorcycle parking. The city passed a property tax increase to fund the anti-rally campaign.

But the Myrtle Beach Bike Week website counters this, saying that the rallies have not been cancelled. The Myrtle Beach Harley-Davidson website is still encouraging motorcyclists to come. It states that 90% of the events and most of the businesses that cater to the 500,000 bikers who come to the region during three weeks in May are in Horry County, which has not adopted any new ordinances and welcomes riders to the 69th annual event, scheduled for May 8th – 17th 2009, if the rally goes on.

MAKING NOISE ABOUT NOISENumerous communities around the country are attempting to regulate noise, and specifically loud motorcycle exhausts. Although enforceability is questionable, Gettysburg, Pennsylvania is planning a controversial new ordinance to curtail incessant noise.

Town officials haven?t fully explained why the ordinance is necessary, other than to acknowledge that neighboring municipalities have similar regulations, but the borough does not. ?We ought to be regulating our noise pollution,? said one Councilman.

?How do you pull over 50 motorcycles when one is being loud?? said police chief Joe Dougherty. ?It?s violating someone?s constitutional rights.?

When asked if the department owns noise equipment, Dougherty quipped: ?I?m sure we do, but I don?t know where it?s at. If I looked for it, I could find it, but we only have one person trained to use the equipment.?

The ordinance is currently being reviewed for legal sufficiency, including enforceability.

Meanwhile, a bill recently introduced in New Hampshire would prohibit motorcycle exhaust modifications, reduce permissible motorcycle noise levels, increase fines for motorcycle noise violations, and requires all motorcycles to have functioning tachometers.

House Bill 95 authorizes fines of up to $500 for operating a motorcycle that has aftermarket mufflers installed, or does not have a working tach.

A similar law was enacted in Denver that requires motorcycle mufflers to have a factory-issued U.S. Environmental Protection Agency sound-test stamp. But some who have protested the ordinance since it took effect in July 2007 have gone as far as to take the issue to court, arguing that the ordinance is vague and unenforceable.

One ?victim? of the ordinance is Jeffrey Lubbert, who was pulled over on his motorcycle in August 2007 when an officer testified that he heard exhaust pipes that were ?louder based on my training and experience,? according to court documents.

Lubbert fought the citation that he was issued, making it the ?test case? for the ordinance, according to his lawyer, Colorado Aid to Injured Motorcyclists (A.I.M.) Attorney Wade H. Eldridge.

Factory-issued pipes come with the EPA stamp and meet the 82-decibel standard. But aftermarket mufflers may not come with the stamp, while still meeting the 82-decibel standard, argues Eldridge. It is nearly impossible to have the pipes certified and officers do not carry decibel readers.

?It?s unreasonable to stop someone and say your pipes are louder than normal when you don?t know what normal is,? argues Eldridge, who specializes in defending bikers. ?That just doesn?t cut it.?

GANGING UP ON BIKERS– In an ongoing effort to reduce crimes committed by criminal street gangs, many states have passed or are considering anti-gang laws that loosely define ?gangs?, violate Constitutional protections and can be used to harass and intimidate motorcycle clubs and mainstream motorcycle groups.

North Carolina recently joined with California and Ohio in enacting tough gang legislation that enhances penalties by adding years onto the sentences for those convicted of a crime who are members of a gang.

The N.C. Street Gang Suppression Act is the state?s first attempt to legally define a street gang, and it makes membership against the law. The law defines gangs as ?any ongoing organization, association, or group of three or more persons? that has a primary activity of committing felony acts, has members involved in gang activity and has a common name, identifying sign or symbol.?

It also gives law enforcement and government the authority to seize property associated with gang activity.

Likewise, the Michigan legislature has enacted a set of ?Gang Bills? and sent Senate Bill 291 to the governor?s desk on January 6th. Based upon a similar definition of a ?gang?, the bill states that ?If a person who is an associate or a member of a gang commits a felony or attempts to commit a felony and the person’s association or membership in the gang provides the motive, means, or opportunity to commit the felony, the PERSON is guilty of a felony punishable by imprisonment for not more than 20 years.?

In Utah, a newspaper ad for a Toys For Tots event and flyers distributed by the Vagos Motorcycle Club spurred one Garland, UT citizen to form a Neighborhood Watch and spearhead a grassroots effort to toughen state gang laws, resulting in five bills being introduced to toughen punishment for involvement in gang activity and to make associating with or being a member of a criminal street gang illegal in the Beehive State. The latest in a spate of gang legislation, the sponsor of the bills along with gang investigators spent months researching other states? gang laws to find ideas that may be effective in Utah, such as anti-gang loitering legislation and declaring gang-free zones.

WEIRD NEWS: NIGERIAN RIDERS WEAR FRUIT TO COMPLY WITH NEW HELMET LAW–As many as 98% of Nigeria?s motorcyclists shunned the new national helmet law when it went into effect January 1st, leading to scores of arrests, near-riots and sometimes violent confrontations with traffic police. Professional motorcycle taxi drivers called Okada have now resorted to wearing fruit shells, pots or pieces of rubber tied to their heads with string to avoid arrest and impoundment of their vehicles.

In the state capital of Kaduna, hundreds of motorcyclists staged protests against the crash helmet directive, storming major roads chanting war songs and causing panic and traffic jams. In Lagos, at least 2,500 violators of the directive have so far been arrested as the Federal Road Safety Commission intensified the enforcement campaign for both riders and passengers. In Osun State, the Nigerian Tribune reported that no fewer than 73 motorcycles have been impounded by the FRSC because their operators failed to abide by the use of crash helmet.

The regulations have caused chaos around Africa’s most populous nation, with motorcyclists complaining helmets are scarce, too expensive, dirty and some passengers refuse to wear them fearing they will catch skin disease or be put under a black magic spell.

REPORT CARD FROM Kennedy High School Chopper class–2009 chopper class is proud to announce some of it’s sponsors for this years builds. This SPS chassis will be running a BAKER 5 speed transmission thanks to Bert Baker and James Simonelli and will have a S&S 84″ Generator SH motor, thanks again to Howard Kelly and D.J. as well as all the S&S staff for there support.

On our third build which will be one of the main builds for next years class, we are using a frame from Guilty customs mated to a Kiwi Indian leaf spring front end. This bike is looking for a motor and transmission as well as other parts to get in line so please let me know if you want to help out. We are also getting parts coming in from Bikers Choice thanks to Larry Middleton.

This bike will run POR 15 in our custom built tanks, NAMZ wiring components used on the builds, and Spectro oils in each build. I will be at the V-twin dealer expo Feb 6,7,8 set up with the Limpnickie lot space #2619 so please come by and say hi and let me know if any other companies want to be apart of what we do here with the kids.

Big Twin Motors (Naples) and Fred Kodlin (Germany) win Verona International–The first annual Verona International Custom Show took place at Motor Bike Expo in Verona over the weekend of January 16-18. With fierce competition, especially between the Italian builders, the judges finally chose Big Twin Motors of Naples for the Italian prize, and Fred Kodlin Motorcycles from Germany for the International prize. Both winners receive a contribution towards the expense of competing at this year’s 6th annual Official World Championship of Custom Bike Building, at Champions Park, Lazelle St, Sturgis over August 2-5.

Motor Bike Expo is the first World Championship “International Affiliate” to offer two Sturgis prizes, one to the best bike from a domestic builder, and the other to the top international competitor.

Banishing fears that the quality of the show and attendance could be affected by the move away from Padua, Motor Bike Expo reported comparable crowds to last year and exhibitors were pleased with the level of business conducted.

Cory Ness, on stage to present the winning builders with their trophies, commented that Motor Bike Expo was the best European show he had attended in the past five years.

Inside sources at Padua, who staged their own show over the same days in direct opposition to Verona, reported a drop of over 70% in attendance from the previous year.

FLORIDA DECISION SHORT-LIVED– It appears that the Florida Legislature tabled HB 5007A to let everyone believe it was a dead issue and then snuck the same wording into CS/SB-40a and it has passed both the house and the senate and sent to the governor.

This bill contains the changes to funding for Florida Motorcycle Safety Education Program. The bill will have the money moved from motorcycle rider education to the Florida Department of Transportation.

People can e-mail and phone Governor Charlie Christ and ask him to remove it from the bill before he signs it.

In 2008 the Florida legislature raised the fee for motorcycle licensing and not 6 months later they are raiding the fund. This is Not A New Fee it has been going on for years. It Is A Increased Fee No one has ever explained how this money is being spent. But I cannot see where it is on rider education.

The last I heard the now Mandatory Classes are $295.00 and Up.

69TH ANNUAL BIKE WEEK (AKA CRUISIN? THE COAST BIKE WEEK) WILL STILL BE HELD ALONG MYRTLE BEACH?S GRAND STRAND IN MAY 2009– South Carolina?s Grand Strand And Horry County, S.C. Welcome Bikers.

January 19, 2009, Myrtle Beach, S.C. ? Myrtle Beach Harley-Davidson wants bikers to know that although the City of Myrtle Beach, S.C., has passed some laws designed to discourage bikers from attending the 69th Annual Spring Bike Week, May 8-17, the popular event is still on. From Murrells Inlet to Little River, other communities within Myrtle Beach?s home county of Horry are gearing up to welcome bikers.

The majority of the events for Bike Week will take place in Horry County, outside of the Myrtle Beach City limits. Newly-passed Myrtle Beach rules and regulations WILL NOT affect bikers who visit or impact any of those activities and events.

?Many tourists wrongly believe that Myrtle Beach is synonymous with the 60-mile-long ?Grand Strand? that is visited by more than 14 million tourists annually,? said Mike Shank, marketing director for Myrtle Beach Harley-Davidson. ?In reality, the City of Myrtle Beach is just a small town inside of Horry County. It only has 25,000 residents. To the north, south and west of Myrtle Beach is the much-larger Grand Strand community where there are many restaurants, bars, recreational facilities and accommodations. Horry County has more than 250,000 residents and they are preparing their businesses to welcome bikers.

?Unfortunately, information being sent out by Myrtle Beach and its Chamber of Commerce paints good, law-abiding motorcycle riders with the same broad brush as those who have broken laws in the past. In addition, their misinformation does not accurately portray the views of Horry County residents. The majority of people and businesses look forward to biker tourism and many rely on Bike Week to provide a significant portion of their yearly income.?

The City of Myrtle Beach and the Myrtle Beach Area Chamber of Commerce have initiated an aggressive media campaign that gives the erroneous impression that new laws the city recently passed apply county-wide. However, those laws, which have reportedly been passed to discourage bikers from attending rallies in the area, apply only to the areas within the city limits of Myrtle Beach ? not throughout the Grand Strand and Horry County.

?Awareness of the new laws will ensure that bikers who plan to come to the Grand Strand have nothing to worry about,? said Shank. ?There will be plenty of activities and places to congregate outside of the city limits and throughout Horry County. It?s unfortunate that the City of Myrtle Beach and the Myrtle Beach Area Chamber of Commerce don?t want biker business in May; but we hope bikers understand that many businesses both within the City and throughout Horry County look forward to bike week during the month of May. As long as you obey the laws and respect our community, you?ll always be welcomed by the citizens of Horry County.?

VICTORY SHOWS RADICAL CONCEPT MACHINE– VICTORY Motorcycles shocked the industry when it showed its radical design concept, the Vision 800, at the Cycle World International Motorcycle Show in Long Beach in 2005. However, that design concept went on to become the Victory Vision, with many of the styling cues retained.

Now for 2009 the Minnesota based manufacturer looks set to do the same thing again with the launch of it’s CORE concept. Having revolutionized the touring market, it appears that Victory is now set to do the same to the Sports Cruiser class.

When Victory’s design team, led by Industrial Design Director Greg Brew and Lead Industrial Designer Michael Song, set out to create the CORE, the idea was to build a motorcycle using the minimum of elements… engine, frame, wheels and front suspension only.

“CORE is pure motorcycle,” said Song. “We wanted to strip everything not critical and build a motorcycle that uses some of the production technologies we have incorporated into the Victory Vision. The frame and engine architecture of the Victory Vision was our inspiration ? but we wanted to make a statement beyond ‘custom’ and create something completely unique.”

In order to achieve a unique frame, the design was cast in aluminum, using a sand mold. It is made up of five pieces, formed from AL 356-T6 aluminum alloy and incorporates the bike’s fuel tank, airbox, battery box and the electrical system.

Suspension is limited to the front only, but takes the form of adjustable WP 48mm upside down race forks. These are fitted with equally race-inspired four-piston radially mounted twin calipers, which operate on dual 320mm discs. Braking at the rear is by a single piston caliper and 240mm disc.

A Victory Freedom 106/6 Stage 2 power plant with closed-loop fuel injection, which was debuted in the 2009 production line, is used in the CORE, along with a six-speed transmission. Maintaining the bare minimum styling, the high level, wrapped stainless steel exhaust is muffler-free.

Away from the frame the single most striking feature of the CORE is the carved mahogany seat, which also incorporates an LED taillight.

Talking about the CORE concept Greg Brew said: “CORE represents the heart of Victory Motorcycles. We want to create a new design language, but never in a way that interrupts the function of the motorcycle. EAST TROY, Wis. (January 19, 2009) ? Buell Motorcycle Company today announced its 2009 Racer Appreciation Contingency Effort (RACE) with more than $1 million in cash contingencies posted for Buell racers competing aboard liquid-cooled 1125R and air-cooled XBRR and XB model motorcycles.

?Supporting grassroots racing is very important to Buell Motorcycles and to me personally, as I know the commitment it takes for a privateer racer to pursue that dream,? said Erik Buell, Chairman and Chief Technical Officer of Buell Motorcycle Company. ?We?re very proud of our dealer teams and privateer racers and we?re pleased to support their efforts in any way we can, including through the Buell Racer Appreciation Contingency Effort.
