Could we sweep out front so we could eliminate street sweepers? The Port of Los Angeles is trying to eliminate trucks with more rails. What else could be taken off the streets?

The Lid: Wounded Warrior Project Scandal Was Fake, But Vindication Was Not Broadcast– Originally published by The Lid

The story below was sent to me by my colleague Brian Kolfage, who along with being a great American, husband, and father, is himself is a wounded warrior. Brian was one of the people who did the investigation for this story.

Many of you may remember that the Wounded Warrior Project (WWP) was involved in a huge scandal two years ago when led by the NY Times, the charity was accused of spending less than half of raised money on the wounded warriors themselves.

Since then the accusations have been proven false, but as scandals tend do go, when they are proven to be bogus, the correction never gets as much publicity from the MSM as the scandal, The WWP has a four star rating from Charity Navigator (its highest rating) and has been audited by the Better Business Bureau.

Sadly the despite the truth, despite the fact that our wounded heroes are still being helped by the WWP donations are way down.

As I sit here reflecting after 20 years involved with motorcycle legislative organizations, fighting for our rights, I am amazed at WV Legislative Session with 2 Helmet Bills tossed around the House and Senate. SB 549 blindsided us.

Thanks to Senators Maynard and Cline for sponsoring this bill. This biker and many others are all asking the same question. To those who are working with the lawmakers, do you want help with this bill or do we stand down?

ABATE of WV, State Motorcycle Rights Organization went legally defunct in 2008 with business license revoked for failure to file. Those still in charge did charity poker runs using the ABATE of WV banner for the next 2 years.

I have a big problem with charity puke poker runs that do not support States Motorcycle Rights Organizations. We work very hard, are very passionate about what we do for ALL bikers, even those who don’t care. To give that money away, without supporting those who work with the lawmakers, take the time to travel without so much as a dime to help support us, what are you thinking?

Motorcycle rights are more than the helmet bill. If you don’t understand that, then delete this.

One man made a difference with HB 2135. He walked that bill all the way to the Senate. Went to Charleston on his own money, cultivated relationships with the lawmakers and has learned the hard facts of passing legislation on such a controversial bill. Kudo’s to Jeff Stewart for giving us information and the power for a Call to Action across the US for support on a Tourism agenda. It helped and thanks to so many of you.

However, we need a clean bill. We have bowed to the lawmakers demands the past 2 decades for insurance mandates, driver certification, mandated safety programs teaching riders’ skills, and passed stricter Right Of Way/Careless Driving laws, which are the largest cause of injury and fatalities to the motorcyclist.

We have supplied facts and statistics proving that helmets do not save lives, Safety and Education Awareness does. I repeat, HELMETS SO NOT SAVE LIVES. We have the facts and the statistics that motorcycle injuries and deaths decreased in Freedom of Choice states. So why should we sell our constitutional freedoms short?

For those of you who want to wear a helmet, that is your choice. For myself and many others, we want the Right To Decide Freedom of Choice. The majority of us are licensed, registered, insured, trained, certified, experienced and responsible riders.

I will be surprised, but happy if this bill passes. We can amend if necessary. If not, it is time to take a look at fighting this battle on the judicial level.

Monster Energy Pro Circuit Kawasaki’s Savatgy Regains Points Lead in Detroit–

Monster Energy Pro Circuit Kawasaki’s Joey Savatgy and Adam Cianciarulo were main players in one of the wildest races this season, with Savatgy earning his third-straight runner-up finish while Cianciarulo was third.

In addition to grabbing his fourth podium of the season, Savatgy regained the point’s lead and sits nine points ahead of second. Cianciarulo moved to fourth in the standings and is 11 points back of his teammate.

Coming into the evening, Savatgy clocked in the second-fastest lap time in qualifying on the slick and tricky track. He rode through the pack in his heat race to finish second. In the main event, Savatgy got a great start and was in the hunt for the lead, taking over the top spot on Lap 3. He ended up going down but got going again in third, staying with the front pack. Savatgy traded positions with second and third a few times before finishing less than a second behind the winner. Savatgy ended the night claiming the coveted red plate and a nice cushion between him and second place, nine points back.

“The points lead is good, but frustrated for sure because that win was within my grasp,” said Savatgy. “In the main, I put myself in position and had a little gap in the lead and made a mistake. Once I got back into my groove, I caught back up and almost won. So my speed there is encouraging and we’re really happy to leave with the points lead.”

Like Savatgy, Cianciarulo was able to charge the track in practice and come away with third in qualifying. He won his second heat race of the season in impressive fashion. The good gate pick helped him shoot out to the main event holeshot, leading the first few laps before briefly going down. He remounted in fourth and started his race back to the front. Even with a time gap, Cianciarulo charged and passed for the podium spot with two laps to go.

“I feel good with the result after not getting much riding in this week with my knee injury last week,” said Cianciarulo. “I put myself in a good position tonight and coming out of here we are optimistic as we closed the points gap. Couldn’t be more excited to have a shot at the championship and it’s looking like this thing will go down to Vegas.”

Re-imagining a Harley-Davidson Trike

With all do respect, you failed to mention the trike conversion business that has been very successfully converting thousands of new and used motorcycles to trikes for the past 25 years through dealers across the country. These are not custom made trikes out of your garage.

In fact, companies like Roadsmith trikes (which I admittedly am associated with) have been offering independent rear suspension and many other features and options for riders that want a smoother riding, better handling trike with more options than the Triglide or Freewheeler has offered.

I understand the popularity and ease of purchase of the factory trikes, but those that do their research find that a company specializing in motorcycle trikes and only motorcycle trikes always does it better.

You should have given your readers a better overview of the industry not just a promo for a certain model.

If you’d like a comprehensive overview of the industry I’d be happy to talk with you. Our company has been building trikes for 45 years now.

Ace Cafe Orlando, the first North American outpost of the celebrated London-based motor-diner, is rolling toward its scheduled spring 2017 opening in Central Florida. THE CLIMATE CALAMITY REPORT–
You won’t read or see this on CNN or the alphabet networks

Scott Segal, director of the Electric Reliability Coordinating Council, offered the following remarks regarding the pending executive order on energy independence reportedly ready for release by the White House tomorrow. ERCC is a group of power-generating companies working on common sense and balanced energy and environmental policy. Member companies provide power to millions of consumers across the United States:

“Yesterday, US Environmental Protection Agency (EPA) Administrator Scott Pruitt announced the intention of the White House to release an executive order directed at restoring principal elements of US energy independence.

Among other items, the executive order appears to include a formal statement of intention to rescind or revise regulations that address greenhouse gas (GHG) emissions from existing power plants under a stayed rule called the Clean Power Plan (CPP).

The order may also address rules targeting new power plants and may make best efforts to restore the proper balance of authorities between the federal government and the states.

The order may also call for reconsideration of the controversial methodology known as the Social Cost of Carbon, and may have the Council on Environmental Quality rescind its guidance document requiring considerations of climate impacts every time the government approves a project.

There are other provisions as well dealing with coal leasing on federal lands, the effect of various previous Presidential actions, and potentially other topics.

As Americans consider this important development, there are several key points to keep in mind.

Some have suggested that reversing the CPP constitutes a historic change in policy. While it is clear that CPP has been the subject of much discussion over the past several years, the fact is that the regulation has been frozen by the US Supreme Court since February 2016 in the first stay of a rule of general applicability ever imposed in the history of the High Court.

This extraordinary legal result was indicative of the widespread belief that opponents of the rule were likely to prove that the rule was illegal. Further, the continued diversification of the power industry with new sources of natural gas and better performance by renewables has continued to diminish the environmental significance of CPP and related rules.

In light of increasing use of natural gas, what is the significance of changing course on CPP? The executive order still plays an important role. Changes in the energy mix today have in large measure been driven by market principles. The energy market has a significant degree of flexibility and pragmatism in making decisions that are cost-effective.

By contrast, CPP would lock in a particular energy mix based on governmental fiat, depriving the system of flexibility, locking in investments, endangering capital projects, and harming energy security. So, there is a big difference indeed between market trends and rule by regulation.

What about the CEQ guidance on the National Environmental Policy Act (NEPA)? President Trump and other leaders have long argued about the strategic and economic importance of renewing our nation’s energy infrastructure. Indeed, the development of shale resources has played a major role in economic recovery and job creation across the country.

Moving oil, gas, and electricity around the nation is of critical significance to advancing economic and security objectives. The uncertainty and delay created by the NEPA guidance and by the use of the Social Cost of Carbon methodology has undermined our energy and infrastructure goals to the detriment of job creation, security, global competitiveness, and the achievement of our geopolitical goals. The executive order appears designed to put us back on the right path.

The executive order has been described as saving coal jobs – is that right? In short, yes. The executive order is focused around reliable and affordable baseload power production, and policies which stress baseload production will continue to have a role for coal. In addition, lifting the moratorium on leasing makes additional projects possible.

The bottom line for Americans to consider: it is possible to have an effective climate change policy based more on market principles than command and control regulations.

It is possible to keep up international dialogue without the straight jacket of regulations that exceed legal authority.

And it is possible to review existing policies in ways that remove impediments to safe, affordable and reliable domestic energy production. While we will review any final executive order, it appears that the executive order under discussion is a strong step in the right direction.”

THE BAD COPS FILE–
Video Proves FBI Uses Local Cops To Profile Bikers.

The Motorcycle Profiling Project (MPP) recently received a video capturing a typical motorcycle profiling stop that occurred in September 2016. One of the victims explained to the MPP that a group of Ft. Worth Gang Task Force officers in four vehicles conducted a stop on four motorcyclists wearing motorcycle club insignia. On video, a Ft. Worth officer admits that he has engaged in a pattern of profiling and stopping individuals based on their associations with motorcycle clubs in order to photograph and gather intelligence.

Although disturbing, motorcycle profiling stops are becoming more common, so this admission is not shocking. What is shocking is the explanation for why a policy of profiling exists in the first place.

On video, in response to one of the bikers commenting that they were good guys, a Ft. Worth officer says,

“Unfortunately, for you all at least, the FBI leaves it upon us to take pictures and make contact with everyone associated with. And even though y’all don’t claim 1%, y’all associate with 1%’ERS. So, we kinda gotta stop y’all every once in a while too, you know what I mean?”

Experts Confirm Federal Profiling Model

Is this officer’s statement true? At best, is this happening just in Ft. Worth? Just in Texas? Or is the FBI encouraging local PD’s everywhere to make contact with all 1%’ERS and associates through profiling stops in order to photograph and document the movements and associations of hundreds of thousands of people?

Dr. Will Dulaney is a biker’s rights activist, veteran with multiple deployments, and Associate Professor of National Security at a major military college. He has written about, testified, and consulted in both state and federal RICO and state gang enhancement cases for well over a decade. Dulaney analyzed the video and concludes that it serves as proof that a federal model of motorcycle profiling exists.

“What the law enforcement officer acknowledges in the video is import because he establishes video-graphic evidence supporting the fact a federally controlled system of motorcycle profiling exists”, says Dulaney.

Dulaney argues, “In over a decade of sifting through discovery evidence and testifying in federal RICO and state gang-enhancement trials across the US a model of law enforcement behavior has emerged.

The model is simple: specific federal agents use various federal, state, and local police “motorcycle gang” task forces to profile members and friends of motorcycle clubs. The profiling ranges from pre-textual traffic stops intended to document identities and update gang crime databases to the systematic deprivation of civil rights; with violations of the 1st, 4th, and 14th Amendments being most prevalent.”

Note: This model is being presented in a peer-reviewed paper to academics and policy makers this June during the annual meeting of the International Journal of Motorcycle Studies at the University of Colorado in Colorado Springs.

Unconstitutional Profiling Demands Legislative Relief

Being a 1%’ER, or being associated with a 1%’ER, is not illegal nor does it rise to the level of reasonable suspicion justifying a stop under the 4th Amendment. Profiling stops also amount to Selective Enforcement of the law in violation of the 14th Amendment.

Motorcycle club insignia is also protected by the 1st Amendment and wearing colors is considered expressive conduct.

Evidence of such systemic profiling demands legislative relief at both the state and federal level. Being in a motorcycle club, even a 1% club, is not a justification for the wholesale violation of civil liberties represented by a systematic policy of profiling stops and intelligence gathering. THE BIKERNET BAD JOKE LIBRARY IS OPEN FOR LUNCH– Two elderly women were out for a Sunday drive in a large car and both could barely see over the dashboard. As they were cruising along, they came to an intersection. The stoplight was red but they just went on through. The woman in the passenger seat thought to herself “I must be losing it, I could have sworn we just went through a red light”.

After a few more minutes they came to another intersection and the light was red again, and again they went right through. This time the woman in the passenger seat was almost sure that the light had been red but was really concerned that she was losing it.

She was getting nervous and decided to pay very close attention to the road and the next intersection to see what was going on. At the next intersection, sure enough, the light was definitely red and they went right through, and she turned to the other woman and said, “Mildred! Did you know we just ran through three red lights in a row? You could have killed us!”

Mildred turned to her and said “Oh, am I driving?”

STATE NEWS FROM THE MRF –  South Dakota

Recently, ABATE of South Dakota had a legislative win – they had been working on SB79 this year. This bill allows for motorcycle license plates to be mounted in any way except upside down. This is after their members wanted a vertical plate option.

Happily, the bill passed in March with the voting in favor – the Senate passed it 34-0 and the House 60-7 with 3 excused. The bill was signed by the Governor and will now allow the mounting of a motorcycle license plate in any position except upside down. The law takes effect July 1st. Great job SD!

DON MCLEAN’S “AMERICAN PIE” ADDED TO NATIONAL RECORDING REGISTRY OF THE LIBRARY OF CONGRESS– Tune-In to “CBS Evening News with Scott Pelley” at 6:30pm EDT to Watch Don Discuss the Honor

The Library of Congress added Don McLean’s monumental 1971 hit “American Pie” to their National Recording Registry of 2016. “American Pie” joins Judy Garland’s “Over The Rainbow,” N.W.A.’s seminal album, Straight Outta Compton and the Eagles’ 1976 Their Greatest Hits as aural treasures worthy of preservation as part of America’s patrimony.

“I have been proud to be an American artist who has represented his country around the world for almost 50 years,” states McLean. “I hope I did a good job because I was always aware of the country I came from. America has a vast musical heritage which is diverse and profound. With few exceptions American music is the whole of popular music. We have done it all. Written the greatest songs and produced the greatest artists. I am so proud to be a part of this creative effort.”

Librarian of Congress Carla Hayden today named these recordings and 20 other titles to the National Recording Registry of the Library of Congress because of their cultural, artistic and historical importance to American society and the nation’s audio heritage.

“This year’s exciting list gives us a full range of sound experiences,” said Hayden. “These sounds of the past enrich our understanding of the nation’s cultural history and our history in general.”

Under the terms of the National Recording Preservation Act of 2000, the Librarian, with advice from the Library’s National Recording Preservation Board (NRPB), is tasked with annually selecting 25 titles that are “culturally, historically, or aesthetically significant” and are at least 10 years old. The recordings selected for the 2016 registry bring the total number of titles on the registry to 475, a small part of the Library’s vast recorded-sound collection of nearly 3 million items.

UNCLE MONKEY’S EARLY RIDING SEASON WARNINGS– Early season riding has its own sets of hurdles and obstacles. Winter usually brings a heavy build up of sand and salt along the sides of the roads and intersections.

Hard surfaces quickly give way to slickness of loose sand and mud. There are always the well-shaded edges that hold tight to the blocks of snow and ice that the sun can’t seem to get a good angle at. Slow melting with trickling runoff collecting in pools and feeding to the mud. Back alleys full of soft mud are waiting to engulf a front tire and bury it well up into the fender.

Besides the road hazards there are the other drivers on the road. Spring holds a new learning curve for them as they have to relearn to share the road with us, with bicyclists, with pedestrians.

They bitch; they honk their horns unhappy to give up their road monopoly of the winter months. Some are jerks purposely swerving into large puddle to soak the unsuspecting. Some just can’t stand that we enjoy our freedom to ride.

Spring is a time for us to relearn to ride. Winter gets us off balance. We weeble and wooble our way down the street until instinct comes flooding back. We concentrate on the pothole riddled roads, make mental maps of which roads are clear, which ones to avoid, and which ones should be clear by now. We watch for the sand, watch for the other drivers. It’s a lot to look out for.

Soon spring will make way for flowers and warm breezes, a start of another riding season. Another year for Sturgis and poker runs, late night rides and dive bar beers. It’s the time we’ve been waiting for all fuckin’ winter!

WATCH OUT FOR THE CALIFORNIA STATE SPEED CAMERA BILL– Update on CA AB342 (Speed Cams) and Please Support AB1094 Today!

Thank you for all your emails and phone calls this past week to oppose AB 342 (speed cameras in CA). Jay Beeber of Safe Streets L.A. told NMA yesterday that the bill has been tabled by the Privacy and Consumer Protection Committee for now, but there is still a possibility that it can come back in April. Keep the pressure on! Beeber mentioned that phone calls and faxes get the most attention.

Another bill that has the potential to be voted on a consent agenda this week in the Assembly is AB1094. Safer Streets L.A., an organization dedicated to the adoption of scientifically sound and sensible transportation and traffic laws, strongly supports the passage of AB 1094. So does the National Motorists Association.

AB 1094 clarifies that violations of the traffic control signal at freeway on-ramp meters is properly cited under CVC 21455. By providing more specificity as to the requirement to heed the controls imposed at freeway on-ramp meters and how this violation should be cited under the vehicle code. AB 1094 helps both law enforcement and the general public better understand their obligations and responsibilities with respect to this violation.

This should help avoid unneeded confusion and provide savings in both time and resources. NMA and Safer Streets L.A. supports measures such as AB 1094 which provide greater clarity within the vehicle code.

California: One Gun a Month Bill Pulled from Senate Public Safety Hearing

Tuesday, March 28, anti-gun SB 497, was scheduled to be heard in the Senate Public Safety Committee. At the last minute, the bill was pulled from today’s agenda. Thank you to all who contacted the committee urging them to OPPOSE to SB 497. Even though this bill was not heard today it could still appear on a future agenda.

SB 497 sponsored by Senator Anthony Portantino (D-25) would expand the existing one handgun a month law to include ALL guns. Governor Brown vetoed similar legislation in 2016. Governor Brown states in his 2016 veto message, “Given California’s stringent laws restricting gun ownership, I do not believe this additional restriction is needed.”

It is obvious this legislation is another attempt to place more costs and barriers to those exercising their rights and does nothing to address the criminal misuse of firearms or firearm trafficking. Criminals who generally acquire their firearms through illicit means will continue to ignore California’s stringent laws including limitations on the number of firearms that can be acquired within a 30 day time period.

Maybe, over the weekend, I’ll start the Cantina 1916 Excelsior Moto Cycle sculpture techs. And Markus turned us onto the next Girl of Bikernet for the Cantina.

Plus, a Paughco package is due to arrive any day with vintage parts for Dr. Hamster’s Panhead and my Shovelhead turned chopper.

And we are working with Zipper’s, Brass Balls Bobbers, Harley-Davidson, MetalSport and Aeromach on my Grandson’s wrecked Dyna. Dr. John, in Anaheim did a helluva job on straightening the frame.

Several stories mentioned above are flying at Bikernet Trikes and we have new features and techs heading to Bikernet Baggers. And the goddamn Bikernet Blog shares new daily. When I mention non-stop, we’re not messing around.
