We have lots to report today, and I want to just let it fly. I spoke to Dr. Hamster, my best friend and brother recently. He’s a successful Chiropractor and recently decided to sorta move to the desert. Then his plan expanded to opening a series of treatment centers. He put himself in the position of a 120-mile commute twice a week. Not good.

The other day he looked at me and said. “The plan has issues.” We made a pact to evaluate our lives and figure out how to reduce over-burdening projects and ride and race more. Hang on for the results.

HILLSBOROUGH BANS WORKERS FROM BIKER GANGS–
TAMPA — Hillsborough County is banning employees from participating in certain biker gangs and other criminal groups after a firefighter associated with the Outlaws motorcycle gang was accused of taking part in a bar fight in Key West.

In a memo Friday, County Administrator Mike Merrill outlined a new policy effective immediately barring membership in groups or gangs considered criminal organizations by the state or federal government.

Involvement in these organizations “will not be tolerated as these affiliations are contrary to the mission of public service,” Merrill wrote. “This directive is a reminder of our continuing obligation to represent all the citizens of Hillsborough County.”

The list of banned organizations is guided by the 2015 FBI National Gang Report, and it includes the Outlaws, as well as Crips, Bloods, Almighty Latin King and Queen Nation, Hells Angels Motorcycle Club and the Pagans.

Violating the rule can result in termination of employment.

The announcement comes after an arrest warrant was issued in Key West for Clinton Neal Walker, a Hillsborough County firefighter and suspected member of the Outlaws motorcycle gang. He is accused of taking part in a September bar fight involving as many as 15 Outlaws members.

Walker, 33, of Bradenton, is wanted on a misdemeanor battery charge. According to an arrest warrant, Walker and other Outlaws members beat up the manager and an employee at a downtown Key West bar.

Walker was placed on paid administrative leave pending the outcome of an internal investigation.

According to the warrant, Walker is a “confirmed active member” of the Outlaws, considered by authorities to be the state’s dominant motorcycle gang. It is strongest in South Florida but has chapters in Tampa and St. Petersburg.

Hillsborough County officials have known for months that Walker and at least one other firefighter were suspected members of the Outlaws. In August, Fire Rescue Chief Dennis Jones said the county was close to issuing a policy regarding association with biker groups but discussions were complicated by concerns over constitutional rights.

Jones said Thursday those conversations were on hold while county officials wait to see if the Florida State Fire Marshal asks lawmakers in Tallahassee to address the issue. He said participation in biker gangs by fire and rescue personnel was a “broad issue that impacts fire departments across Florida.”

Apparently, the county decided not to wait on the state to act.

The city of St. Petersburg and Pinellas County do not prohibit employees from participating in motorcycle gangs.

“However, should the need ever arise, we would certainly be open to discussing a human resources policy change to address it,” said Benjamin Kirby, a spokesman for St. Petersburg Mayor Rick Kriseman.

A DISCUSSION WITH THE NATIONAL MOTORIST ASSOCIATION– Maybe the plan should Change. China put 20 percent of their energy profits in renewable energy efforts. Tesla just powered an island with solar and batteries and shut down the diesel fuel generating system. The locals still have jobs but clean ones.

Great to hear from the NMA. I’ve been involved in Motorcyclists Rights for over 40 years. I’m old. I’ve been pushing to take on the EPA for over 5 years.

My initial contention revolved around freedom, motorcycling and building motorcycles. The footprint created by custom motorcycles or modified motorcycles is minuscule.

Then the EPA tried to ban all performance products for autos and motorcycles. As you know it was stopped, but they said they would come after us and they have.

The attack on Harley and the connection to CARB is nasty.

Then I watched Cowspiracy a documentary about the agricultural industry. Amazing. I’m waiting to watch Climate Hustle.

And finally as many of us believe, climate change has happened since the planet came into being. The human footprint was pushed by the Obama administration. It needs to be revisited. The climate will continue to change long after we eliminate every car on the planet.

I’m trying to do what I can for balance. We are working on several reports and looking for more information. I’m also hoping to host a panel at the V-Twin Expo in February and would be happy to have an NMA rep involved. With enough ammunition we might be able to create a class-action lawsuit against the EPA—basically around the destruction of the aftermarket performance industry for motorcycles, cars and trucks.

Bikernet Special Report: Doug Mr. Sidecar Bingham: The Last Round-Up

Thank you so much for the article, stumbled on this while trying to find a Bingham S/C for sale. Don’t want to burst your bubble, But that picture was my first race with Doug, and must have been in about 1980.

Doug had an idea for a “dual sport” class of Sidecar racing. So we put together a Yamaha 500 with a mark one sidecar, and were wildly successful in the smallbore class.

There are too many stories of our adventures to get started here. I do miss my friend.

DAN ROUIT R.I.P.

So very sorry to report that Trailblazer Hall of Famer Dan Rouit passed away on November 16th. Dan had a love of motorcycles from an early age and competed in amateur and pro flat track events, excelling in Short Track.

In 1978 he suffered a broken neck in a fall while hiking, which changed his life forever. He and his dad had dreams of a flat track museum and in 1991 Dan and his soon-to-be-wife, Kathy, pooled resources and constructed a building to display historic motorcycles and memorabilia. It soon filled up but thanks to the generosity of his cousin Joe, a 30 by 60 foot building was added and the Dan Rouit Flat Track Museum was ready for visitors to enjoy.

Another expansion, with an additional 30 by 60 feet, soon followed. Today it holds approximately 90 flat track motorcycles and lots of memories. Dan was a remarkable man who was a quadriplegic for 38 years, but continued to live and love life. Our condolences to his wife Kathy and his many, many friends who will miss him dearly.

MEMORIAL FOR DAN

Dan’s memorial will be held on Sunday, December 4th 2016 from 11am to 3pm at the Dan Rouit Museum. Mike Keith, and others, are helping with the service and set up. BOB NICHOLS STILL AT IT AT 95

Nichols had a great year despite spending 5 weeks in the hospital. His vintage Indian won 36 races in a row, including the 1/2 mile, TT and drags at Sturgis. The bike was piloted by Jim Ottely, who also races two of his own motorcycles. Bob is working on a new one with a goal of 10,000 rpms.

GRAND CHAMPIONSHIP ICE RACING

The 2017 AMA Ice Race Grand Championship is scheduled for February 17-19 in Cadillac, Michigan. It will feature a grand prix race on Friday and oval track racing on Saturday and Sunday. JOE PARKHURST

Larry Lawrence has written a wonderful article about Trailblazer Hall of Famer Joe Parkhurst. Joe died at 74 in 2000 and left a legacy in motorcycle journalism that is hard to beat. He launched Cycle World in 1962 and it became, and remains, the largest motorcycle magazine in the world. He was also a very nice guy. Loved the photo. 50 YEARS AGO IN CYCLE NEWS

Main story was Hopetown race at Simi Ranch for the first “International Moto-cross scrambles ever held in this country” The Dirt Diggers and A.C.A. hosted it. Malcolm Smith, Bud Ekins and Paul Hunt were the only local men who could keep Torsten Hall in sight.

40 YEARS AGO

An audit found the California Parks and Rec mismanaged the ‘Green Sticker’ fund. The Sierra Club stopped the planned Gila Bend to Yuma off road race. Roger DeCoster won the Trans-AMA Motocross in Puyallup, Wa. Alex Jorgenson and Springer were on the cover battling for the win at Ascot National. Tom Brooks won the Check Chase Hare & Hound in Parker, Arizona.

AMA SUPERCROSS

The first race of the season will be on January 7th in Anaheim, California. Round two will be in San Diego on January 14th and then back to Anaheim for Round 3 on January 21st. They will finish out January on the 28th for Round 4 in Glendale Arizona. The Anaheim events will take place at Angel Stadium. Gates open for practice and qualifying at noon with the main events starting at 6:30pm.

2017 DAKAR

If you are planning on entering the Dakar race, you had better get hopping. It will start on January 2nd in Asuncion Paraguay and end on January 14th in Rio Cuarto, Buenos Aires. The route is very tough and will take the participants through three countries, Paraguay, Buenos Aires and Argentina. For more info: www.dakar.com

March 16 begins the AMA Pro Racing American Flat Track 18 round schedule at Daytona with a TT. There will be six miles, seven half miles, two short tracks and three TT’s. Four Nationals will be on the west coast. The Arizona Mile on May 13th, Sacramento Mile on May 20th, Calistoga Half Mile on July 29th and Perris Short Track on October 7th.

2017 ARENACROSS

The first race is in Cincinnati, Ohio on January 7-8, and then on to Grand Rapids, Michigan on January 13-15. It won’t be until April 1-2 that the schedule brings them to Sacramento. The last one is in Las Vegas on May 5-7. www.arenacross.com

DAE-IL USA Inc., dba Custom Chrome Case Settles for $70,000

In 2011, the Air Resources Board (ARB) determined that motorcycle parts distributor Dae-IL USA, Inc., dba Custom Chrome, was advertising, offering for sale, and/or selling aftermarket critical emission control parts that were not exempted from California’s anti-tampering laws.

Such motorcycle aftermarket critical parts replace vital original emission components such as catalytic converters, and thus must be evaluated by ARB to demonstrate continued emissions compliance.

Custom Chrome provided all needed information during the agency’s investigation of the matter, and ARB subsequently settled the case in conjunction with the state’s Office of the Attorney General in June 2015 for $70,000. This civil penalty is applicable to approximately 280 illegal exhaust parts sold in the state between 2009 and 2012, at a rate of $250 per unit. Furthermore, the company has agreed to institute a voluntary buyback program to retrieve these parts from its dealers and end users.

K & N Engineering, Inc. Case Settles for $521,000

In May 2015, K & N Engineering, Inc. (K&N) settled its case with the Air Resources Board (ARB). A routine investigation by ARB revealed that K&N sold, offered for sale, and/or advertised, aftermarket performance parts that were not exempted from California’s anti-tampering laws. Such performance parts replace vital original emission components such as the air intake system and thus must be evaluated by ARB to demonstrate continued emissions compliance.

K&N has agreed to pay a penalty of $390,750 to the Air Pollution Control Fund and $130,250 to the School Bus and Diesel Emission Reduction Supplemental Environmental Project. K&N has taken steps toward future compliance by applying to ARB and receiving over a dozen Executive Orders in accordance with K&N’s established practice of applying for Executive Orders.

While ARB contends that K&N’s actions did not retroactively exempt the Subject Parts, K&N’s actions demonstrate its commitment to environmental compliance. K&N has agreed not to install, sell, offer for sale, or advertise in California any aftermarket part in violation of the California Code of Regulations, title 13, section 2220 et seq. or Vehicle Code section 27156.

TED WAS IN HIDING–
remember Ted, the white haired Harley-Davidson model? I’m sure he did things for EZR catalogues, etc. too… I ran into him in the alley behind Melrose.

Wondered why I hadn’t seen him around the neighborhood last year or two.

Turns out a dump truck driver mistook him and his motorcycle for street garbage and rolled over his foot. Shouting and screaming didn’t slow the guy down. His radio was on high.

Bones were sticking out every which way. Luckily a top rated leg trauma surgeon was on duty when Ted was wheeled in, and he managed to save the foot.

Ted was in hospital an entire month, then re-habbed for ages, then wheel-chaired for another year or so… total time out: 2 years.

The bill: over $700,000.

Truck driver’s response at deposition: ‘these motorcycle guys are always flipping me off’. Wonder who won that lawsuit.

OFFICIAL NEWS FROM THE MOTORCYCLE RIDERS FOUNDATION (MRF)– A quick note to let you know that President-Elect Trump has officially tapped Elaine Chao to lead the Department of Transportation under his Administration. She will be the top influencer in what priorities DoT, NHTSA, and the Federal Highway Administration pursue over the next 4 years.

Many of you are already familiar with Ms. Chao. She worked under the George W. Bush Administration serving as Secretary of Labor AND served as Deputy Secretary of Transportation. Notably, she is married to Senate Majority Leader Mitch McConnell (R-KY) which suggests there will be a VERY close working relationship between DoT and the Senate moving forward. It also signals that Trump’s pledge to create a billion-dollar infrastructure plan which will provide money for states to improve highways, roadways and surface transportation programs is a very real possibility in the first year of his Presidency.

Currently, Ms. Chao serves on the Board of Directors for News Corp, Wells Fargo, Ingersoll Rand, Vulcan Materials Company, Centerra Group LLC and Protective Life Insurance Co. This suggests she will be giving up a very lucrative life once confirmed by the Senate to serve as Secretary of Transportation.

At this juncture, her confirmation process is likely to go smoothly; Democratic leader Chuck Schumer has already come out praising her as the pick. Other organizations like The American Association of State Highway and Transportation Officials (AASHTO) have also come out in support of her.

On a personal level, Chao has been described as ideological, but very conservative. However, insiders report that her pick is not for ideological purposes but rather a pragmatic choice – she is connected in D.C. and quote, “gets shit done,” according to one person I spoke with this morning.

UNCLE MONKEY ON THE MEDICINE MAN–
For my son Saxsin it has been a rough couple of months. His health has been kicking his ass. It meant trips to the doctor, to a specialist here, a specialist there. It was taking its toll on his body.

His weight has been dropping and he looked like he should be an extra on the Walking Dead. Last week was a new battery of tests. Monday brought a call to reschedule his appointment from next week to as soon as possible. It was there when he got the bad news that it is Type 1 Diabetes.

A few hours in the doctor’s office, a couple more at the pharmacy as they went over the extensive insulin program that he needs to start immediately. Today, is Saxsin’s first meeting with the dietary specialist at the hospital followed with meeting with auxiliary supports. The news is not the greatest. He spent most of his free time breaking down.

Life has a way of coming at you like that. In a blink of an eye your whole life is turned upside down. What you thought you knew, what you thought the years coming up would be like are drastically changed. Maybe a divorce, maybe the loss of a love one, maybe bad news from the doctor.

The question becomes how you handle it. Sure you can plant your feet and jut your chin out and take the blow square on the chin but that is a good way to get yourself knocked out. Instead you have to learn to roll with the punches, let your body absorb the hits, let the momentum throw you to the ropes, so you can come back swinging.

For Saxsin as devastating as having Type 1 Diabetes is it is a blessing. We now know what has been kicking his ass. We know that we can work to keep it in check with insulin, diet, and lifestyle.

This new could always be worse. It could have been cancer, could have been notice that his future would be measured in months – not years. For others it means the nightly arguments are finally over, and the disrupting individual will finally will be out of the picture. Yet for others, it means laying a love one to rest and not having to spend years caring for an invalid who may never be more than a shell of the person they once were. For some people bad news can be good news.

My son has a long road in front of him being only in his early twenties. But it is a well-travelled road. He is not the first one to have diabetes, not even the first in our family to have diabetes because my uncle lived with it.

As Saxsin reached out to the rest of his family to let them know about the doctor’s final diagnose, my father admitted that he had been diagnosed this summer himself with Type 2.

ALLSTATE’S ONCE IS NEVER ENOUGH (O.N.E.) PROGRAM–
An awareness campaign created to help reduce the number of motorcycle crashes involving other vehicles at intersections by encouraging motorists to “look twice, because once is never enough.”

Since it was established in 2009, Allstate has worked closely with local traffic authorities to install 179 Watch for Motorcycles signs in 41 different cities across 21 states at dangerous intersections for riders.

While the success of the program speaks for itself through the number of signs in the ground, the ultimate goal of the O.N.E. program is to empower the larger riding community, which is why for the first time, Allstate has donated and installed a sign on a fellow rider’s property at his request.

Longtime rider Jason Large of Jackson, OH reached out to Allstate hoping for a way to protect riders on the major Ohio state route he lives on. Allstate was inspired by Jason’s desire to help keep his fellow riders safe, which is why he was selected for the special installation. The sign was officially installed on Jason’s property today! The hope is that Jason’s persistence and passion to advance motorcycle safety in his community will inspire other riders to do the same.

The O.N.E. program is the flagship initiative of Allstate’s Rider Protection Project, a collection of programs and applications built to help keep riders riding, safely. Other programs in Allstate’s Rider Protection Project include:

The Rider Risk Map – an interactive map on Facebook (facebook.com/AllstateMotorcycle) that lets riders flag a location that may be especially dangerous for fellow riders

The Rider Protection Zone – a traveling rider experience that visits several of the highest-profile motorcycle rallies around the country, spreading the word about motorcycle safety and advocacy through in-person safety demonstrations and social media, using the hashtag #Watch4Moto

“Yes, they help me sleep at night.”

“Mrs. Smith, I assure you there is absolutely nothing in these that could possibly help you sleep!” She reached out and patted the young doctor’s knee and said, “Yes, dear, I know that. But every morning, I grind one up and mix it in the glass of orange juice that my 16-year-old Granddaughter drinks. And believe me it definitely helps me sleep at night.” You gotta love Grandmas!

EUROPEAN SUCCESS THROUGH FEMA–
autonomous cars to be tested with motorcycles.

Vehicle authorities will cooperate with motorcyclists’ organizations and conduct their own test program with different brands of semi-autonomous cars.

In response to the letter motorcyclists’ organizations FEMA, MAG NL and KNMV sent to RDW, with regard to the European type approval of the Tesla by RDW, a meeting took place recently where the motorcyclists’ worries were addressed. RDW is the Netherlands Vehicle Authority that issued the European type approval for Tesla.

A driver of a Tesla – and other advanced cars – can leave key actions to the vehicle, while in the opinion of the motorcyclists’ organizations this equipment is not or not sufficiently tested with motorcycles. In the discussion about the concerns that motorcyclists have with admitting (semi) autonomous vehicles on the roads, it soon became clear that many of the concerns of the motorcyclists’ community are shared by RDW.

RDW proposes – in cooperation with the motorcyclists’ organizations – to conduct their own test program with different brands of cars with Advanced Driver Assistance Systems. RDW also believes – as do the riders – that testing with motorcycles should be part of the test protocol for European type approval.

Dolf Willigers, General Secretary of FEMA: “We are very pleased with the outcome of this first meeting with the experts of RDW. We are going to act together and we will see in the field tests to which extent the technique takes motorcyclists into account.”

VETERANS NEWS AND VIEWS–
Citizens Against Government Waste (CAGW) has named Veterans Affairs (VA) Secretary Robert McDonald Porker of the Month for giving bonuses to senior executives involved in the ongoing hospital wait-times scandal.

A USA Today report last month found that in 2015 the VA provided $177 million worth of bonuses to VA employees, including more than 300 executives, some of whom were closely involved in the wait-times debacle.

The department awarded the bonuses despite numerous VA inspector general reports over the last year revealing that thousands of veterans continue to languish in the VA system. New VA data released in June found that the number of patients who waited over a month to receive care exceeded half a million in the first five months of 2016.

On May 23, Sec. McDonald failed in epic fashion when he compared veterans’ wait times for medical care to lines at Disney theme parks. These comments, along with the payment of bonuses to failed VA executives, clearly show the secretary’s disregard for veterans and his inability to reform the deteriorating VA system.

For rewarding incompetent VA bosses and failing to ensure that veterans get timely care, Sec. McDonald is the November Porker of the Month.

Fund will provide monthly assistance to those who lost homes in wildfires

In a video message released this evening, Dolly Parton announced a new effort by The Dollywood Company and The Dollywood Foundation to establish a fund to assist the victims of the Great Smoky Mountain wildfires in Tennessee. The new My People Fund will provide $1000 each month to Sevier County families who lost their homes.

BIKERNET GUN NUT REPORT–
California: Bullet Button Guns Must be Purchased and Received by Dec 31st

Recently the California Department of Justice Bureau of Firearms sent out a notice to California firearms dealers with information regarding the recently passed “assault weapon” legislation, SB 880 and AB 1135. Persons who are wanting to acquire a firearm equipped with a “bullet button” or that will be considered an “assault weapon” under the new laws, must be processed and received by December 31st, 2016.

With California’s 10 day waiting period, the DROS process must be started no later than December 21st. Given that unforeseen circumstances do arise, it is recommended that you plan accordingly.

Waiting for Additional Answers from DOJ

With the passage of Prop 63 and the recently passed package of gun control bills, many Californian’s are concerned about what is to come once these laws are implemented. Rest assured that your NRA is doing everything possible to continue the fight both legislatively and legally. Further, know that the California Department of Justice, who is tasked with implementation, still needs to promulgate rules. These rules could provide additional hurdles that may require further legislative and legal action on behalf of gun owners.

BIKERS ARRESTED FOR WEARING BANDANAS–
Louisiana motorcyclists in the Bossier/Shreveport area may be experiencing a mechanism of profiling that many are unaware of. It has been reported to the MPP that 17 motorcyclists in the area have recently been arrested for wearing bandanas, scarves, and even a bubble shield while riding because it conceals their identities in public.

Local law enforcement contends that covering your face in public is a violation of Louisiana’s anti-mask law, LSA-R.S. 14:313, which carries a 6 month to 3 year term of imprisonment. Although every incident has not been confirmed, the MPP spoke to one motorcyclist directly and confirmed that he was arrested for concealing his identity on November 8, 2016.

The law used to justify targeting motorcyclists for wearing masks in Louisiana exists elsewhere. At least 15 states have what experts call “general anti-mask laws” that could be applied to motorcyclists. Applying anti-masking laws to motorcyclists covering their heads and faces with protective gear is an abuse of statute and demonstrative of motorcycle profiling. An exemption for public safety ought to be obvious.

Motorcyclist Arrested For Concealing Identity

While visiting Louisiana to attend and speak at a state Confederation of Clubs and Independents meeting in Alexandria, the MPP became aware of the alleged arrests for concealing identities in public. The MPP spoke to a member of a motorcycle club in the Bossier/Shreveport area that was able to confirm the validity of the rumors.

Although a traffic pretext was used to justify the stop, the MPP evaluated his citation and he was indeed arrested for concealing his identity, an alleged violation of state code LSA-R.S. 14:313. This individual was on his way to vote in the 2016 National Election. He was denied this opportunity. He was forced to pay a bond in order to obtain his release and as of this writing the issue has not yet been resolved.

(Notably, this same individual has been experiencing a pattern of harassment while riding his motorcycle. Nine days after the mask arrest he was again stopped and harassed for a series of pre-textual infractions preceding more questions about his club affiliations.)

Masks or hoods, wearing in public places prohibited; penalty; exceptions; permit to conduct Mardi Gras festivities, how obtained.

No person shall use or wear in any public place of any character whatsoever, or in any open place in view thereof, a hood or mask, or anything in the nature of either, or any facial disguise of any kind or description, calculated to conceal or hide the identity of the person or to prevent his being readily recognized.

Whoever violates this Section shall be imprisoned for not less than six months nor more than three years.

This Section shall not apply:

To activities of children on Halloween, to persons participating in any public parade or exhibition of an educational, religious, or historical character given by any school, church, or public governing authority, or to persons in any private residence, club, or lodge room; or,

To persons participating in masquerade balls or entertainments, to persons participating in carnival parades or exhibitions during the period of Mardi Gras festivities, to persons participating in parades or exhibitions of minstrel troupes, circuses, or other dramatic or amusement shows, or to promiscuous masking on Mardi Gras which are duly authorized by the governing authorities of the municipality in which they are held or by the sheriff of the parish if held outside of an incorporated

All persons having charge or control of any of the festivities set forth in paragraph (2) of this Section shall, in order to bring the persons participating therein within the exceptions contained in paragraph (2), make written application for and shall obtain in advance of the festivities from the mayor of the city, town, or village in which the festivities are to be held, or when the festivities are to be held outside of an incorporated city, town, or village, from the sheriff of the parish, a written permit to conduct the festivities. A general public proclamation by the mayor or sheriff authorizing the festivities shall be equivalent to an application and permit.

Applying Law To Motorcycle Safety Gear Is Absurd

Originally the Louisiana law against wearing masks and hoods in public was motivated by the Ku Klux Klan wearing hoods and masks concealing their identity while they terrorized and intimidated others.[1] Louisiana’s law makes exemptions for Halloween and Mardi Gras, but none for public safety. Although clearly not the intent of the law, motorcyclists covering their faces to avoid bugs, wind, and rain may be subject to arrest.

Considering Louisiana’s mandatory helmet requirement based on public safety, the absurdity of applying anti-mask laws to motorcyclists is further demonstrated. Every helmet covers a motorcyclists head similar to a hood and all motorcyclists wear eye protection. The very act of riding a motorcycle legally requires concealment. A motorcyclist wearing a full face helmet could be arrested for concealing their identity if anti-mask laws apply. Remember, a full face helmet is considered the best protection among experts that advocate helmets.[2]
