Hey,

This is an interesting day. I’ve been watching CSPAN, which covers the actual hearings and debates. I watched a lengthy interview with the brilliant guy who is taking over the Health care end of the government.

He explained the repeal of Obamacare in a solid, easy-to-understand terms. It’s amazing when the story is told properly. His goal is care, the kind of care you want for a reasonable price, not just numbers insured. The media uses the numbers insured. I didn’t have insurance for 20 years as a young person. I was healthy and when I wanted to see a doctor I paid for it. For a young person it’s as if you were told to buy another and pay payments and insurance monthly.
 
 

 Take the mandatory out of the equation and give folks a choice whether to have insurance of not is the key. He also mentioned Tort reform which will save the country trillions over the next 10 years. And no more mandatory or fines for not signing on the dotted line.

I’ve also listened to the new head of the EPA. Suddenly it all makes so much sense. Trump needs to refine how he tells the story. He has the media and the public in a panic, when the true story would clear the air.

Let’s hit the news.

SCOOTER DATA FILES– We decided to track some new data, here are the results.

As of the end of 2015, I had been in the scooter business for almost 12 years. My team has done a great job of building one of the top dealerships in the country. We are dead set on making Gainesville, FL the scooter capital of the world and building the single greatest scooter dealership in existence.

Over the years we have represented many scooter distributors and we consistently have more knocking on our door to get us to represent their product. We take this very seriously and we cherish the relationships we have built with our distributors.

The number of warranty hours billed per brand (distributor).

Here’s the thing… All distributors have their own warranty. Many cover specific parts for a specific amount of time (for example: electrical components for 90 days). They all do it. Honestly, I don’t like it. There are basically “limits” to the warranties the scooters come with. I’ve always referred to as the‘nickel and diming effect.’ Personally, I feel like warranties should be simple, easy to understand, and easy to remember.

For that reason, New Scooters 4 Less, has always taken distributor warranties and made them better. It costs us money, but it’s what’s best for our customers. So no matter what the “limits” are to the warranties the distributor provides, we remove them and make it easy. For example, we may only get a parts warranty from Wolf Brand Scooters and Bintelli Scooters, but WE (New Scooters 4 Less) provide a 1-year parts AND labor warranty.

In short, we cover the labor at our expense. The only distributors (that we represent) that currently provide a parts AND labor warranty are Vespa, Genuine, and Adly (and now GenZe, a new distributor we picked up). Even some of them have limitations within their warranties though.

Genuine Scooters overall are the best value. For every Genuine Scooter we sell, we can expect 6.7 minutes of warranty labor. As a dealership, will this affect the way you sell? For sure!

We know that by selling a Genuine Scooter, our customers are going to have very little (if no) issues. Issues = headaches. Customers hate headaches. Dealerships hate headaches. Enough said. The scooters are awesome. I have not found a 50cc scooter I like more than Genuine. These numbers further prove why. (Note: we ONLY sell Genuine 50cc scooters ? Buddy Scooters and Roughhouse Scooters. This data doesn’t include the Genuine Stella or other models.)




BIKERNET ATTENDS DAYTONA PODCAST–

The Podcast went well. I had Edge and Mark listening to it at a Waffle House that we stopped at on the way down to Daytona. You and Pat were cracking them up.

WIllie’s Chopper Show was one of the largest shows I’ve seen there in years. I didn’t make it to Destination Harley-Davidson but people were saying that it was crowded.

Nashville Bike Week got canceled but it looks like Loretta Lynne is going to have a 3-day event and Carrie Repp is heading the charge. They are talking September for it.

NEWS FROM THE HILL –
Infrastructure Boost Coming, RFS Bill, Hearing on Tolls

During his run for President, Donald Trump indicated that a cornerstone of his policy objectives would be a large influx of spending and activity to boost the nation’s infrastructure; meaning improved and new roads and highways, bridges, tunnels, water supply, sewers, etc.

Currently, his administration appears to be in the initial stages of putting together a fleshed-out plan to achieve this. Over in Congress, there has been an assurance that lawmakers would be reviewing legislation that leverages public-private partnerships, and private investments through tax incentives, to spur $1 trillion in infrastructure investment over 10 years.

Bill Shuster, the chairman of the House Transportation and Infrastructure Committee, says he’s eyeing summer or early fall for a package in Congress. But the actual timeline, it seems, could change at any moment – depending on the progress of other Republican priorities. The MRF is closely following developments as any large infrastructure package could be a breeding ground to insert safety initiatives plugged by NHTSA as well as other safety-minded non-profits.

On March 2nd Reps. Bob Goodlatte (R-Va.), Jim Costa (D-Calif.), Steve Womack (R-Ark.), and Peter Welch (D-Vt.) announced the reintroduction of the “RFS Reform Act” (H.R. 1315) and the “RFS Elimination Act” (H.R. 1314). The lawmakers introduced similar bills in previous congresses but all failed to advance. The RFS Reform Act eliminates corn-based ethanol requirements, caps the amount of ethanol that can be blended into conventional gasoline at 10 percent, requires the EPA to set cellulosic biofuels levels at production levels, and decreases the total volume of renewable fuel that must be contained in gasoline sold or introduced into commerce for years 2017-2022.

It is unclear whether the measures have a better chance of passage in 2017-2018. The RFS is a divisive issue with President Trump indicating during his run for President that he was supportive of ethanol and ethanol producers. The MRF will continue to monitor any and all legislation affecting ethanol in the nation’s fuel supply and continue working through a coalition in D.C. to find common sense changes to the RFS ensuring that the integrity of our motorcycles is not compromised.

Recently, the Senate Appropriations Subcommittee on Transportation held a hearing to examine infrastructure funding needs and options. The hearing was largely positive, as participants recognized the critical need to invest money to repair and improve America’s roads and bridges, but also voiced concern over undesirable revenue-raising mechanisms such as tolling.

There were multiple witnesses who we expected to strongly advocate for tolling, but in the end expressed a strong preference for direct federal spending. The MRF is working with the Alliance for Toll-Free Interstates to voice its opposition to toll roads and was included as a signatory to a letter that went to Committee members indicating this. EXECUTIVE & REGULATORY UPDATES –
Federal Trim Down Coming?

Surrounded by his Cabinet, President Trump signed an executive order this week calling on each federal agency to report within 180 days with a reorganization plan “to improve the efficiency, effectiveness, and accountability of that agency.” The next step would be for these recommendations to be presented to the President and Congress to “eliminate unnecessary agencies” after soliciting public input and considering whether certain functions could better be performed by the private sector or the states.

“Today there is duplication and redundancy everywhere,” the President said. “This order requires a thorough examination of every executive department and agency to see where money is being wasted, how services can be improved and whether programs are truly serving American citizens.”

This action was also promised during Trump’s run for the presidency though it’s unclear how drastic any changes might be at this juncture. As an underlying principal of the MRF, the organization strongly believes in less government interference in motorcycling and ridership. Specifically, the MRF has voiced concerns about the EPA, Department of Transportation, NHTSA, the Federal Highway Administration and the Center for Disease Control and Prevention. As such, we will be monitoring plans from these Agencies very closely.

Las Vegas BikeFest Included in the 2017 American Motorcyclist Association Gypsy Tour–
American Motorcyclist Association announces new era for Gypsy Tours
17 road rides scheduled between March and November.

The 2017 AMA Gypsy Tour, a national series of premier road-riding events, features 17 road rides between March and November in all sections of the country.

AMA Gypsy Tours and the rallies that include them, are among the largest and most popular U.S. motorcycle gatherings.

“We have a great slate of rallies on the 2017 Gypsy Tour series,” said Marie Wuelleh, AMA recreational riding and volunteer manager. “These great rides are put together by experienced organizers, who promise all participants a memorable experience.”

Originally, a Gypsy Tour was an overnight event with organized road rides and other activities of interest to motorcycle enthusiasts, where groups of riders would converge on a single destination. Gypsy Tours were staged in different parts of the country and typically occurred on the same weekend every year. The “National” Gypsy Tour referred to the whole series of these events.

Laconia Motorcycle Week, which dates to 1916, is a 2017 AMA Gypsy Tour Heritage Event and part of the 2017 AMA Gypsy Tour, a national series of premier road-riding events, which has been newly reorganized for the 2017 riding season.

“We are proud that this event has been running for so long, and we are happy to be a part of the 2017 AMA Gypsy Tour series,” said Charlie St. Clair, executive director of Laconia Motorcycle Week.

The original Laconia event was a social gathering of about 150 riders organized by the Bay State Motorcycle Club riders and New Hampshire Motorcyclists at Weir Beach on Lake Winnipesaukee near Laconia, N.H. Over the years, the event grew to attract as many as 430,000 motorcyclists.

The AMA has been sanctioning Gypsy Tours since 1924.

Loretta Lynn’s Ranch Cuts Ties With Nashville Bike Week– Ranch Shares Plans to Embrace the Motorcycle Community

Loretta Lynn’s Ranch announced it would no longer be hosting Nashville Bike Week and has officially removed it from their 2017 Calendar of events.

Loretta Lynn’s Ranch representative, Patsy Lynn Russell stated that Nashville Bike Week failed to meet the terms of their contract. The Ranch has not been provided any further information pertaining to it. Patsy stated, “We want to express our regrets to the motorcycle community at large. Our family and employees were looking very forward to hosting this event and meeting rally-goers at the Ranch.”

Since the announcement, Loretta Lynn’s Ranch has received positive support, including countless calls and inquiries about the possibility of another motorcycle-friendly event at the Ranch. “We were overwhelmed at the wishes and will be working on a new multi-day event to embrace the motorcycle and music communities,” shared Patsy. Before arriving in Nashville, President Trump made a stop in Detroit, Michigan to talk jobs. During the campaign he visited Michigan and promised to fight hard for American jobs. Since the election, Ford has announced that 700 new jobs will be brought back to their plant in Flat Rock, Michigan.

Fiat-Chrysler has announced that they will create 2,000 new jobs in Michigan and Ohio. And just this week, General Motors announced that they’re adding 900 jobs in Michigan!

THE POLITICS OF ROAD BLOCKS FROM THE NMA– In Montana, one state lawmaker has taken aim at random roadblocks. House Bill 146 would require law enforcement to give at least 48 hours public notice, which includes information to the news media, before setting up temporary road blocks. HB146 has already passed nearly unanimously in both the state house and senate and is now awaiting signature from Governor Steve Bullock.

In a short interview with the NMA, sponsor Representative Daniel Zolinikov (R-Billings) said he worked closely with the Montana Highway Patrol to write the bill. He discovered that local municipalities were misusing roadblocks and he wanted to bring local roadblocks up to the standards of the state highway patrol. Representative Zolinikov said since the highway patrol supported HB 146, the bill had little opposition from local police.

Currently there are few Montana roadblocks reported with the NMA’s Roadblock Registry even though we know that they indeed occur. We need Representative Zolnikov’s type of bill in these top ten roadblock states, most below the Mason-Dixon line. The number of driver-sourced reports to the NMA database are from the past five years:

Kentucky 147 reported roadblocks

Illinois 141 reported roadblocks

Even though Montana HB 146 is a start, does this sort of legislation hamper the real issues that are going on with roadblocks? Below are some thoughts on the politics of roadblocks and language for sample legislation from our Roadblock.org website.

After reviewing the many court decisions involving roadblocks and related search and seizure cases the trends are fairly obvious, and ominous.

Personal privacy is an endangered right. The judicial rationalizations that legalize roadblocks for law enforcement purposes can be characterized as contorted, convoluted, and blind to the Pandora’s box of abuses they can unleash.

The principle of individual privacy, the right to be left alone, has repeatedly been diluted and undermined in the name of safety, national security, or crime prevention. Depending on the courts to reverse this trend is an exercise in futility.

Re-gaining our personal privacy and giving substance to the concept of the right to be left alone are battles that will have to be fought in the legislative arena.

The fight will range from state to state and multiple sessions of Congress. Not until political fortunes rise and fall based on this issue will we experience a return to personal privacy and the right to travel without the unbridled interference of law enforcement agencies.

Ideally, a constitutional amendment that removed all ambiguity from the 4th Amendment to the US Constitution would be our first choice. That is, a clear and simple statement that the courts could not pervert.

Such an amendment should state that no person could be stopped, detained, or involuntarily questioned for law enforcement purposes, without Probable Cause to believe that they had, or were in the process, of committing a crime.

Political reality suggests that such an amendment would be incredibly difficult to pass. Therefore, the next best option is legislation, similarly worded, that would prevent any and all units of government from exercising enforcement actions that are not based on Probable Cause, or at least reasonable suspicion that a crime has been or is being committed.

Federal legislation promoting this concept would be difficult to pass. However, a state by state grass roots effort could be successful.

Momentum for anti-roadblock legislation could be initiated by starting in those states that already take a dim view of police roadblocks for enforcement purposes. After passage in several states where roadblocks have been discouraged the effort could be transferred to states that have succumbed to the use of roadblocks. The use of the Initiative and Referendum process is another viable alternative.

Model Legislative Language:
The stopping and detaining, involuntarily, of any person for any law enforcement purpose must be preceded by probable cause or, at a minimum, reasonable suspicion, that said person has or is committing a crime. The right to travel cannot be diminished nor limited as a condition for obtaining a government privilege or license.

The second sentence is to prevent the state from conditioning the issuance of a driver’s license by requiring the applicant to give up certain rights, e.g. allowing police officers to stop and detain you without probable cause or reasonable suspicion as a condition for the granting of a driver’s license.

California: Several Firearm-Related Bills Scheduled to be Heard Tuesday, March 21

On Tuesday, March 21, several firearm- and hunting-related bills are scheduled to be heard in their respective committees.

In the Assembly Public Safety Committee:

Anti-gun bill, AB 7 would further extend California’s ban on the open carry of an unloaded firearm while in or upon a public place or public street within a prohibited area located within the unincorporated area of a county. In the Assembly Water, Parks, and Wildlife Committee:

Pro-hunting bill, AB 986 would recognize the many sacrifices our veterans have made by reducing sporting license fees in recognition of their service. Please use the TAKE ACTION button below to contact the members of this committee and urge them to SUPPORT AB 986.

In the Senate Public Safety Committee:

Anti-gun bill, SB 464 would increase the storage and security requirements of all firearms in the inventory of a licensed firearms dealer. California already has some of the strictest laws in the country regarding how dealers must store and secure firearms. This bill simply places more costs and mandates on law-abiding business owners. Earlier this week, anti-gun bill, AB 424, was passed out of the Assembly Public Safety Committee by a party-line vote. AB 424 would remove the authority of a school district superintendent, his or her designee, or equivalent school authority to provide written permission for a person to possess a firearm within a school zone. AB 424 will now move to the Assembly Appropriations Committee.

(March 17) – After a 63-year hiatus, Indian Motorcycle returned to flat track racing in grand fashion, as Jared Mees outclassed the field to take top honors at the Daytona TT American Flat Track season opener. Mees’ dominating performance was complimented by a 2nd place finish from Indian factory rider and 2016 Grand National Champion Bryan Smith.

All eyes were on Indian heading into the season opener after assembling a team featuring three of the sport’s most decorated riders and armed with Indian’s state-of-the-art Scout FTR750. The season-opening victory brought dramatic validation to Indian’s bold re-entry into the sport it had once dominated, reigniting the Indian Motorcycle vs. Harley-Davidson rivalry that had carried the sport throughout its glory days.

“Carrying the torch for the return of one of motorcycle racing’s most iconic and historic brands, makes this victory truly special for me,” said Mees. “We knew we had a special bike this year that would give us a real shot at every race this season, and to start off on top is huge. But this victory isn’t mine alone. The entire team was critical to this victory, and I couldn’t be more optimistic about our prospects for the remainder of the season.”

Piloting Indian’s new state-of-the-art Scout FTR 750, Mees finished first and third in the evening’s first two heats. The main event began with Mees taking lead in lap 1 heading into the first turn, and the three-time Grand National Champion never looked back. Meanwhile, Smith ran the majority of the main event in the fifth position before catapulting from fifth to 2nd over the final five laps, joining Mees on the podium. After such an impressive showing by the new Indian ‘Wrecking Crew’ in Daytona, it’s clear that Indian Motorcycle Racing will be a force to be reckoned with in 2017.

“With such a storied history of success in flat track racing, it was imperative that Indian bring every possible resource to bear to be successful, and to be atop the podium in Daytona is the ultimate validation for us,” said Gary Gray, Product Director for Indian Motorcycle. “This season is more a marathon than a sprint, and this is merely the beginning. While we’re proud to get off to such a great start, our eyes are fixed on a championship.”

Indian Motorcycle Racing, backed by Allstate Insurance, will look to stay on top as American Flat Track heads to the Atlanta Short Track on March 25.

GOOD WEEK AHEAD—
We have some terrific content flying at Bikernet and Bandit’s Cantina. I spoke to Milo Segal about my last Cantina Chapter. He’s working for a video game producer and he’s interested in some of my books.

We are working on the next Cantina Chapter and the twists never seem to end. Then I will work on the wild story behind the Hamster bronze sculpture. Cantina members will see exclusive reports on the project and the bike I’m using. Controversy surrounds this antique. It is real, yet it’s not.

We will wrap up the story about Biker’s Choice line of stock replacement parts. This is a terrific program to help aftermarket shops get parts they once purchased from Dealers, but the new rules prevent it.

We are also working with Markus Cuff on a line of perfect prints of classic vintage motorcycles, the best of the best. We can’t own a $200,000 antique, but we can enjoy a stellar print of the rarest of rare.
