Highway Bill Passes… a Year Late

After a 13-month delay and enactment of three separate extensions, Congress finally passed a surface transportation reauthorization bill. This bill, sometimes called the highway bill or the infrastructure bill, has been a hotly debated topic in D.C. for several years. Once signed by the President, the bill will reauthorize many highway programs, provide funding for road and bridge construction and replace the previous highway bill passed in 2015, known as the FAST Act.

Just a week ago, Congress gave itself a third extension running into December. Yet election victories by Republican candidates, especially a win by the GOP in the Virginia governor’s race, seems to have spooked Democrats, and motivated passage of a bill that has been awaiting a vote since the summer.

For the last two years, the House of Representatives and Senate have battled over transportation priorities and funding levels. In both 2020 and 2021, the House of Representatives passed versions of their highway bill, only to be rebuffed by the Senate. Under pressure from President Biden, the Senate finally acted, passing in August a $1.2 trillion infrastructure bill. This action by the Senate, effectively forced the House to accept the Senate version of the bill or continue to pass short term extensions of current law.

However, pressure from the left wing of the Democratic party delayed a vote on the Senate’s infrastructure bill until an unconnected piece of legislation, referred to as the “human infrastructure bill,” was agreed to. That bill, called “Build Back Better,” had an original price tag of $3.5 trillion and effectively held the infrastructure bill hostage. After months of debate, and Tuesday’s election results, House Democrats agreed to vote on a smaller Build Back Better bill later in the month, opening the door to a final vote on the infrastructure bill.

At 11:27pm Friday night, the House agreed to the Senate’s bill and passed a $1.2 trillion 5-year highway bill, known as the INVEST ACT. The final vote in the House was 228 to 206, with 13 Republicans voting in favor and 6 Democrats voting against.

One of the most exasperatingly ridiculous brick walls in Washington DC is, the age-old conundrum of legalizing marijuana.

Throughout the years, marijuana has gone through many transformations in the public eye.

House Veterans Affairs Committee (HVAC) were scheduled to conduct a legislative hearing on Wednesday, October 13th, which included consideration of the bipartisan VA Cannabis Research Act of 2021, HR 2916. So far, there have been no updates, when I wrote this.

The legislation “would direct the VA to conduct clinical research with varying forms of medicinal cannabis to evaluate the safety and effects of cannabis on health outcomes of veterans with PTSD and veterans with chronic pain.”

MRF Update: Fatality Analysis Reporting System (FARS)

Earlier this month, the U.S. Department of Transportation released an interactive website with data from the Fatality Analysis Reporting System (FARS). FARS, which became operational in 1975, containing data on a census of fatal traffic crashes within the 50 States, the District of Columbia, and Puerto Rico. To be included in FARS, a crash must involve a motor vehicle traveling on a traffic way customarily open to the public and must result in the death of a vehicle occupant or a nonoccupant within 30 days of the crash.

Fatal crash data for motorcyclists and passengers from the years 2010 to 2019 is included on this website.

Users of the website can sort the information on fatalities by a variety of categories, including:

  • State where the crash took place
  • Crash Characteristics
  • Environmental Characteristics
  • Month of Crash
  • Time of Crash
  • Helmet Usage
  • Alcohol Usage
  • Age and Sex of Victims
  • Weather Conditions
  • Single Vehicle v Multi Vehicle

While this information can be useful in understanding when, why and where crashes are taking place, it’s important to note that this data includes not just traditional motorcycles but also mopeds, scooters, minibikes, and pocket bikes.

The Motorcycle Riders Foundation believes crash avoidance is key component of rider safety. There are zero fatalities in crashes that never happen.

Chainsaws, Golf Carts, Lawn Mowers… What’s Next?

Over the weekend, California Governor Gavin Newson signed a bill into law banning the sale of all off-road, gas-powered engines, including generators, lawn equipment, pressure washers, chainsaws, weed trimmers, and even golf carts. Under the new law, these machines must be zero-emissions, meaning they will have to be either battery-powered or plug-in.

This law is particularly concerning because of the status California holds within the national economy. The population and market size that California commands often forces manufacturers to react by changing products nationwide, to conform to California standards. Additionally, states with like-minded legislatures often follow with similar laws and regulations of their own.

The Motorcycle Riders Foundation (MRF) is concerned that this action by California, will begin a cascading effect that will eventually result in the demise of the internal combustion engine and the fuel supply tied to it. During the legislative agenda setting meeting, held at the 2021 Meeting of the Minds, in Atlanta, Georgia this very issue was debated. Working with our state partners, the MRF is currently evaluating how best to address these concerns.

The final 2022 MRF Legislative Agenda will be made public in an upcoming American Biker Journal.

House introduces Motorcycle Advisory Council Reauthorization Act

WASHINGTON, D.C. – Today, Congressmen Mike Gallagher (R-WI) along with Reps. Chris Pappas (D-NH), Harley Rouda (D-CA), and Troy Balderson (R-OH) introduced bipartisan legislation, Motorcycle Advisory Council Reauthorization Act.  The bill reauthorizes the Motorcycle Advisory Council (MAC) for six years and ensures national motorcycle organizations regain seats on the council.

The Motorcycle Riders Foundation (MRF), along with our partners ABATE of Wisconsin, ABATE of Ohio, Harley-Davidson, and American Motorcyclist Association, have been hard at work over the past month ensuring the future MAC membership is representative of the riding community.  This legislation clarifies the membership of MAC which now will include five highway engineering experts from state or local governments, one state or local traffic safety engineer who is a motorcyclist, one roadway safety data expert on crash testing and analysis, and one representative from each of the following groups: a national association of state transportation officials, a national motorcyclist foundation, a national motorcyclist association, a national motorcycle manufacturing association, and a national safety organization.

“As the feds address the vast roadway infrastructure issues and emerging technologies surrounding vehicles and roads, there isn’t a more appropriate time to re-establish the Motorcycle Advisory Council,” said Kirk “Hardtail” Willard, President of the Motorcycle Riders Foundation.  “It was originally and effectively designed to give motorcyclists a voice with regards to the unique challenges we face on two and three wheels when it comes to roadway design.”

The MRF is encouraged that this legislation will ensure that motorcyclists will continue to have an open dialogue with government officials about the unique characteristics and challenges that motorcyclists face when they are not adequately considered or accounted for as infrastructure programs are being discussed and implemented. We want to acknowledge and commend the relationships that our state motorcyclist rights organizations (SMROs), specifically ABATE of Wisconsin and ABATE of Ohio, established with their elected officials through attending events such as our annual lobby day, Bikers Inside the Beltway.  This event, along with active engagement with members of Congress in their home districts,  helps the MRF identify the champions of motorcycle issues and achieve our goals.

“We are pleased that our elected representatives from the state of Wisconsin continue to lead the charge in advocating on behalf of the motorcyclists in the country,” said Steve Panten, Legislative Director for ABATE of Wisconsin, Inc. “I am encouraged that years of building relationships, both in our State and by coming to Washington, D.C., every year, continues to elevate our issues on Capitol Hill. We urge other SMRO’s to take the opportunity to do the same.”

The MAC, initially authorized in the SAFETEA-LU in 2005, allotted four of the ten members to consist of representatives from the motorcycling community from various state and federal motorcycle associations. In the FAST Act of 2015, Congress re-established the Motorcyclist Advisory Council in the Highway Bill to advise the Federal Highway Administration on “issues of concern to motorcyclists.” However, the MRF was disappointed the re-established MAC only included one seat for a representative of a national motorcycle organization.

The Motorcycle Advisory Council provides the Secretary of the Department of Transportation (DOT), the Administrator of the National Highway Traffic Safety Administration (NHTSA), and the Administrator of the Federal Highway Administration (FHWA) with expert first-hand knowledge of motorcycle issues. “Motorcycle registration is at an all-time high, but this increasing popularity has brought with it increasing risks, such as fatal accidents,” said Rep. Gallagher. “Motorcycles require specific – and in some cases different – requirements of roads, and we need an open dialogue between the motorcycle community, infrastructure experts, and the federal government to discuss these challenges.”  The MAC serves as the only official forum for the motorcycle community to have an open dialogue with the federal government to discuss concerns with infrastructure design, issues with intelligent transportation systems, and other areas of safety affecting motorcycles on the road.

“With the number of motorcycles currently on the road, it is critical that the road designers and transportation engineers understand the way that motorcycles and motorcyclists interact with the roadways as well as other vehicles using those same roads,” said Ed Schetter, Executive Director for ABATE of Ohio, Inc.  “Motorcyclists need to be present to help recognize those needs and ensure that motorcycles maintain their place on the road and can be safely operated into a future where technology is creating more and more challenges.”
