STAYING FOCUSED SUNDAY POST for 10-11-15

Hey,

I’m trying to shift my focus. Focus is the key. I’m trying to teach a couple of kids about focus. One is five and the other is 25. One is just starting school and the other only focuses on getting high.

I’m trying to get them to understand how important focus is. I remember as a kid and all the opportunities I had to focus and learn. It’s not to say you can’t party or you can’t play. But it’s critical to your future when you learn when to focus, relax and learn.

Someday you may wake up and wish you focused on the opportunities you had to learn. Could mean welding a frame, or getting a better job.

ABOUT DRIVER’S LICENSE POINTS–
One of the most common questions we get from members is how many points will a given violation add to their driving record. It’s an important question, but it’s not the only one to ask after you get a traffic ticket. You also need to know how many points it takes to trigger a license suspension.

The answers to both questions depend on what state you’re in. This is because different states use different systems for assessing points against your license, and some don’t use points at all.

Traffic violation points systems assign a certain number of points for each traffic citation based on the severity of the offense. If you’re convicted of that offense, the points go on your driving record. Accumulate enough points, and you will lose your license.

The number of points assigned per violation varies considerably from state to state, as does the threshold for suspension. In California, most violations only cost you one or two points, but you can lose your license if you accumulate four or more points over 12 months. In Wisconsin, speeding up to 10 mph over the speed limit will add three points to your record, and you will lose your license if you accumulate 12 points over a 12 month period. In Utah a speeding violation can run up to 75 points, but you won’t lose your license until you hit 300 points.

To make matters even more complicated, nine states (HI, KS, LA, MN, MS, OR, RI, WA, WY) don’t track points, but that doesn’t mean you’re off the hook if you get a ticket. They still monitor your driving behavior to determine if any action against your license is warranted. In the state of Washington, for example, if you’re ticketed for six moving violations over 12 months, you’ll lose your driver’s license for 60 days.

Keep in mind that the points aren’t automatic; you have to be convicted of the offense before they apply. All the more reason to fight every ticket you get, especially if you’re driving record isn’t spotless to begin with. Points usually stay on your record for around three years, but some, like those assessed for a DUI conviction, can stay on for 10 years or more. Check your driving record routinely to see what’s on it. You can order a copy online with your state DMV for a nominal fee.

Points on your driving record can affect your insurance rates, but the relationship may not be as direct as you think. This is because insurance companies don’t necessarily pay close attention to DMV points. They instead use their own points/ratings systems to calculate rates and surcharges using data compiled from third-party sources. This explains why violations that don’t show up on your driving record, like photo-based tickets in most states, can still raise your insurance rates.

This last fact contradicts the frequently repeated statement from politicians, “safety” advocates and camera vendors that camera tickets won’t increase your insurance rates. The NMA refuted this in a prior newsletter, but it’s insightful to consider this chart from the Insurance Institute for Highway Safety which lays out camera ticket penalties by state.

In states like California and Arizona where red-light camera citations carry points, there will be insurance consequences. But in states like Maryland or New York the chart notes that red-light camera tickets “may not be used by insurers.” This implies that they are used by insurers in other states. Look at Rhode Island, for example, where it states that red-light camera tickets are “not to be used by insurers until there is a final adjudication of the violation.”

So, what can you do to minimize the impact of points on your driving record and your insurance rates?

Here are a few tips:
Learn how the point system in your state works. You can track that down on your state’s DMV website or start here.

Request a copy of your driving record from your DMV and from your insurance company.

Fight every ticket to the best of your ability.

If you don’t win a dismissal, try to negotiate down to a non-moving violation or see if you’re eligible to take a traffic safety course as a way to remove points from your record.

Check the language in your auto insurance policy which may spell out your carrier’s underwriting standards.

Call your insurance provider if you have questions about the impact a specific traffic citation will have on your rates.

Producer Don Cusic presented the song he had written to Noone, which had resided on a shelf since 1980. It seemed a perfect fit to have a fellow musician of the British Invasion perform the song. Noone jumped at the opportunity.

With Noone on vocals, John Hobbs on piano, Andy Reiss and Chris Shruggs on guitar, Byron House on bass, Marco Giovano on drums, and Glen Duncan providing strings and other instrumentation, “I Can’t Imagine” was brought to life.

The lyrics say it all… “I know there’s a reason why you’re not here, maybe it’s to show us that dreams live on, and the songs are still sung though the singer is gone.” Each verse is a loving send-up to John Lennon’s memory.

WACO, TEXAS CASE UPDATE–
Cossacks, Bandidos, law enforcement and district attorney all to blame for Twin Peaks gunfire, lockups.

As a veteran, community member and sworn defender of the U.S. Constitution, I’ve been too quiet. I’ve waited to see how facts emerged from this Twin Peaks incident in Waco. Apparently they are not going to be released in a timely manner.
I call this an incident, not a tragedy, because it came about through various groups of people with their own decision-making abilities.

I will say this to every group involved: How dare you bring your issues into a busy shopping center when it endangered people who don’t share your priorities, beliefs or values? None of you — Cossacks, Bandidos, law enforcement or support units of each group — have the right to endanger others.

And that’s exactly what all of you did.

The Cossacks: Honestly, I have heard so many stories about why you were dying for a showdown with the Bandidos. I really don’t care what it was about. You as a group came to cause a problem, to fight or whatever, and this is the result. Whether you’re a so-called “good Cossack” or “bad Cossack” in the eyes of the dead makes no difference. They’re still dead.

The Bandidos: I don’t know your issues with the Cossacks, but again it makes no difference to the dead on the ground. All of you as a club were aware the Cossacks were looking for a fight so I suspect you travelled in a state of readiness. I don’t know if you knew this would be the day, but knowing this was nonetheless a big problem. Thus, going to a shopping center in the middle of Waco was not a smart decision.

Law enforcement agencies: It’s said you had solid evidence something might go down that day from credible sources inside the Cossacks. Apparently you had evidence because you showed up with automatic weapons and placed them discreetly and tactically in a shopping center on a Sunday morning between restaurants where many churchgoers eat after religious services. Community safety should have been more efficiently addressed.

The job of law enforcement is to prevent this — not to kill perpetrators who may start a rumble, riot or fight. How about a show of force? Enough visible police vehicles and personnel in the immediate area would have likely caused the Cossacks to go home and save any clash for another day, preferably in a less populated area. That really was the job of law enforcement.

Someone not well versed with the Texas Code of Criminal Procedure or under stress possibly gave the OK to arrest everyone with a vest or colors, as some call them. With advance knowledge of this event, police were confident enough to identify warring factions. With that same information, police should have then let the obvious non-warring individuals go.

Yes, police had reasonable suspicion to detain and identify most of the folks there. But before police arrest and charge someone with a crime, they are required to have probable cause and they clearly did not in all cases on May 17. See under Police Academy 101.

Many police officers and community leaders know me. I’m sure my comments will anger them, but I say what many in our community are feeling. Most of us have tremendous regard for law enforcement and all they do on a daily basis. But this incident was mishandled. Bad decisions were made at many levels, including most recently by the district attorney.

This country has historically let a guilty man go free before punishing an innocent one. Some of those arrested must now spend money they don’t have. They might lose jobs, vehicles, food on their table, just to make a ridiculous bond. And that outrages, especially when the charge levelled is so vague.

I challenge the district attorney and our district judges to review these cases promptly and dismiss. Expunge records of the innocent. On your orders these charges can be dismissed. If you need a reason, how about lack of evidence? When you have evidence on individuals, then and only then refile.

Am I a biker? Yes, I have ridden 45 years. Will I take my vest off? No. My freedom of speech allows me to wear it. If you take time to read it before you cuff me, you’ll see it honors those killed in our nation’s wars. It shows respect for the fallen, prisoners of war and those missing in action. As a veteran I belong to a club that is unique. I speak here today as a veteran and motorcycle rider who has the same constitutional rights as those who choose not to ride.

It will take real men to straighten all this out without further persecuting and penalizing the innocent.

Bill Mahon, a local Vietnam veteran, also served as McLennan County veterans service officer. He also led efforts to keep the then-Waco Veterans Affairs Medical Center from closing.

Hiya, read with interest latest rumor of Deans Spyder.

This is what I know after reading many articles in “Excellence” magazine, that is solely devoted to Porsche. The engine was sold to racer who died in a crash. Same with the trans-axle, new owner killed. Both engine & trans-axle are lost.

Bad luck follows the parts of this car that Dean was driving to Salinas when he hit a Mr. Pumpkinseed, a student at Cal poly SLO, at the junction of hwy 41 & 46, in Monterey co.(the roads have been realigned but it’s still a dangerous junction) the car was in an enclosed trailer when it disappeared, in transit from Cal. To Florida, not the other way around, not to be seen again.

Deans last words according to his mechanic who was in the car and survived the crash were “He’s got to see us” just before he broadsided Pumpinkseeds’ Ford. The Pumpkinseed family are still land holders near Parkfield ,Cal. And I have met relatives of Mr. Pumpkinseed at the only restaurant in Parkfield.

This is a story that I will follow, it’ll be interesting to really see what happened to the “Lil Bastard”, the name Dean gave his car.

THE AUSTRALIAN CLUB ACTION REPORT– Inked-up protest slams South Australian anti-biker/anti-association laws.

A vocal, inked-up group of protesters have taken to the steps of parliament house in Adelaide, slamming proposed laws to ban bikers from owning tattoo parlors.

More than 400 protesters, including many well known tattoo artists, held signs reading “art is not a crime” as they shouted “wake up Australia” and “save our tattoos”, gathered on the steps of Parliament House to fight against the proposed Tattoo Industry Control Bill.

The new legislation introduced into the South Australian parliament in September, seeks to ban members of motorcycle clubs, their family and relatives along with close associates from owning or operating tattoo parlors.

“Goodness gracious, this is the worst legislation I’ve seen,” said Mark Aldridge, a former independent election candidate and speaker at the protest.

“We are not criminals here today. The tattooists of this state have every right to tattoo.”

Mr Aldridge said the laws would cost jobs in the tattooing industry.

“There’s not a lot of money in art these days but in this particular art form people can make a living – there’s no valid reason to take this away.”

SA Attorney-General John Rau said the legislation would only affect people who the minister has decreed to have a direct link to organized crime, or were closely associated with someone who did.

Rau said the move was the first time tattoo parlor ownership had been regulated.

He said it would “stamp out dodgy characters” who use such businesses “as a front for illegal activity and organized crime”.

This followed the July introduction of SA’s draconian anti-association laws that overnight declared (without any judicial input) 10 motorcycle clubs as criminal organizations.

“Those people in this particular industry who have no connection with organized crime are going to be left completely untouched by it,” Rau said.

Rau said the state police commissioner also had the power to lift a ban on so called club-associated people owning a tattoo parlor if they could demonstrate good reason.

“It’s interesting that all of the people complaining about it so far appear to either be current or past members of these declared criminal groups,” he said.

Robert Cameron, also known as “Bear”, is a member of Gypsy Jokers, one of 10 motorcycle clubs declared criminal organizations in the state under new anti-biker/anti-association laws.

He owns two tattoo studios in Adelaide’s northern suburbs.

“For me, my business will be closed down, I will never be able to tattoo again,” he said.

“I’ve been doing this for 28 years, I’ve been paying my taxes, I’ve owned my own business for 15 years.

“I think it’s just unjust that I can be declared a criminal when I’ve done nothing wrong and if I was a criminal they would have evidence and they’d put me in jail, wouldn’t they?”

“This concerns innocent people … we have done nothing wrong but I would end up losing my business,” he said.

Mr. Cameron said about 30 tattoo parlors would face closure if the laws took effect.

“One minister had declared us as illegal not a judge, if that is the case, we would all be in jail by now,” he said.

“We are not a criminal organization.

“It’s a blatant disrespect towards taxpayers and their money.”

Tattoo artist Dylan Glacken is not involved in any club, but the studio he works for is. He said he would be out of a job if the laws were passed.

“I don’t have any involvement in any other groups, I’m not involved in anything,” he said.

“I’ve got a couple of kids at home, this is the way I provide for my kids and my family and I think it’s unfair that they tell me I’m not allowed to do that.”

Tattoo parlor owner Moose Elliott said his shop in Modbury was raided twice last week but the police and health department had found nothing on both occasions.

“It’s like we’re up in Russia in the 1960s,” he said.

“They should not be taking trade away from us.”

Clinton Says That the Second Amendment DOES NOT Protect an Individual Right to Keep and Bear Arms– A recent CNN/ORC International Poll found that 57-percent of Americans do not find Hillary Clinton “honest or trustworthy.” If there are figures in American public life with a stronger disregard for the rights of the American people, they have yet to come to our attention.

Obviously, Clinton is referring to the U.S. Supreme Court’s landmark decisions in District of Columbia v. Heller and McDonald v. Chicago. The central conclusion in Heller was that the Second Amendment protects an individual right to keep and bear arms for self-defense. The McDonald decision made clear that this right is fundamental and applies to all Americans.

When Clinton said, “the Supreme Court is wrong on the Second Amendment,” she was making clear her opposition to our individual right to keep and bear arms for self-defense; to her, governments at every level can strip us of this right without restriction.

It is hard to overstate the extremism of Clinton’s position on the Second Amendment. A February 2008 USA Today/Gallup poll conducted prior to the Heller decision, asked those surveyed, “Do you believe the Second Amendment to the U.S. Constitution guarantees the rights of Americans to own guns, or do you believe it only guarantees members of state militias such as National Guard units the right to own guns?” The response was unambiguous; 73-percent responded that the Second Amendment guarantees the rights of Americans to own guns, while a mere 20-percent limited that right to state militia members.

A Quinnipiac University poll conducted shortly after the Heller decision, in July 2008, mirrored these results. This poll asked respondents, “Would you support or oppose amending the United States Constitution to ban individual gun ownership?” 78-percent opposed such a measure, while only 17-percent were found to be in favor.

And in May 2009, CNN and ORC conducted a similar poll that asked “Which of the following comes closer to your interpretation of the Second Amendment to the U.S. Constitution? In addition to addressing the need for citizen-militias, it was intended to give individual Americans the right to keep and bear arms for their own defense. It was only intended to preserve the existence of citizen-militias, and does not give individual Americans the right to keep and bear arms for their own defense.” Once again, the American public made their position clear; with 77-percent choosing “individual gun ownership” to 21-percent answering “only citizen-militias.”

A professional politician like Clinton is almost certainly aware of the public’s views on this matter, which is likely the reason she’s gone to great lengths to hide her most extreme positions on the subject. To be sure, Clinton has publicly advocated for all manner of gun control; including gun owner licensing, taxation, and bans on popular firearms. However, with Clinton’s latest comments, the discussion has moved degrees of legally permissible controls. Clinton has made clear that she does not recognize that the Second Amendment protects your individual right to have a firearm at all.

During her previous run for president, at the April 16, 2008 Democratic debate held in Philadelphia, Clinton made sure to feign some respect for the Second Amendment. Clinton stated, “I respect the Second Amendment. I respect the rights of lawful gun owners to own guns, to use their guns,” adding, “we will strike the right balance to protect the constitutional right…” When later asked whether she supported D.C.’s total ban on handguns, she staked out a similar position, noting, “What I support is sensible regulation that is consistent with the constitutional right to own and bear arms.” Moreover, Clinton’s 2008 campaign broke new ground in hypocrisy when they attempted to paint her opponent, Barack Obama, as the more radical anti-gun candidate. A Clinton campaign mailer criticized Obama for telling people “he was for the 2nd Amendment, in order to get votes.” Sounds familiar.

More recently, at an August appearance in Iowa, Clinton called to “balance the legitimate Second Amendment rights with preventive measures and control measures.” Of course, there can no balancing of a right with an individual that does not even recognize that right’s existence.

The importance of Clinton’s extreme views cannot be overstated. The next president could be responsible for nominating one or more justices to the U.S. Supreme Court. In addition to the dissents issued in the Heller and McDonald decisions, we know that not all of the current justices view the correct interpretation of the Second Amendment as a matter of settled law. According to an item published in the Wall Street Journal, Associate Justice Ruth Bader Ginsburg has noted that a “future, wiser Court” could overturn Heller. If Clinton were president, there can be little doubt that she would choose to nominate those who share her false interpretation of the Second Amendment.

America deserves a president that holds a genuine respect for the individual right to keep and bear arms protected by the Second Amendment.
