This is going to be a quirky news, and I’m going to begin to discuss prospects and projects for next year. It’s almost mystical, but I’ll try to stay centered on the vast custom motorcycling empire and turkey day.

The folks behind the Sturgis Museum are trying to expand it into a magnificent building devoted to the history of motorcycling through Sturgis. Michael Lichter should have a wing devoted to him. I sent him to Sturgis for his first Easyriders Magazine assignment.

A notion recently surfaced to draw a higher education facility or trade campus into Sturgis as a draw with a considerable link to the new museum. We discovered some serious state restrictions, but there may be guiding light at the end of the tunnel. Let us know if you have some thoughts or suggestions for success.

As we begin the gift of today let us think about all the things we are grateful for.

We so often get caught up in the prophets of doom and gloom and don’t pause to take the time to say thank you. Not only do we get stuck in that stinkin thinkin mode but it escalates as the day goes on because we set up the path of negativity early in the morning.

We might start our day with worry, resentment, mad thoughts of negativity, lack or limitation. Why do we set ourselves up so early to have a shitty day and how often do we repeat the insanity. Remember the old definition of insanity, “keep doing what you are doing and expect a change”. Life is so full of choices.

I love the words of Zig Ziglar “Gratitude is the healthiest of all human emotions. The more you express gratitude for what you have, the more likely you will have even more to express gratitude for.”

Today is an opportunity to Pause and think about all the things that you are Grateful for.

Today Know: As I begin the gift of today I Pause to say Thank You. I am Grateful for every experience in my Life good and bad for they have all been opportunities to learn, to grow, to be and to have more. I would not be the person I am today if I had not grown from my past. I am Grateful for winning the birth lottery, there is no better place on this planet to live. I am grateful for the many things I don’t think about like running water, toilet paper, electricity, my home and roads to drive on. I am Grateful for my Family and Family of Choice. I think about all of the people, friends, teachers and mentors who have touched MY Life and say Thank You to them.

OFFICIAL GUN NUT REPORT–Israeli Officials Recognize Protective Benefits of Good Guys with Guns– This week, Israeli Public Security Minister Yitzhak Aharonovitch announced a decision to relax the rules governing the carrying of firearms and the issuance of licenses to carry. The move came shortly after the reprehensible slaughter of four Orthodox Jewish men and a police officer in a West Jerusalem Temple by terrorists armed with knives, axes and a gun.

The assailants in the attack had been shot and killed at the scene by police. Aharonovitch was quoted in an article in the Israeli newspaper Haaretz as stating, “The decision to ease [approving gun permits] is a result of the present need to strengthen the feeling of security for the population, in light of the recent terrorist incidents befalling us.”

As the Haaretz article explains, the decision temporarily allows licensed security personnel to take firearms home with them. Further, the criteria for granting firearm licenses has been changed, allowing for people in sufficiently dangerous communities to acquire firearms licenses. Requirements for ex-military personnel and current military reservists have also been eased.

In late 2012, following the tragic murders in Newtown, Conn., NRA Executive Vice President Wayne LaPierre uttered the now famous words, “The only thing that stops a bad guy with a gun is a good guy with a gun.” The common sense statement received harsh criticism at the time in some corners of the media. Nonetheless, the Israeli Minister of Public Security, undeniably tasked with some of the most challenging internal security conditions on Earth, echoed that sentiment by relaxing Israel’s normally strict firearms rules in the face of this latest atrocity. While a departure from the typical reaction of Western officials confronted with the ugly reality of wanton violence, denial and wishful thinking are not viable options for a nation whose very existence neighboring powers have sworn to destroy.

Notably, Aharonovitch isn’t the only high-ranking security official to endorse this view after a tragedy. In 2013, following an attack in a shopping mall in Nairobi, Kenya, Interpol Secretary Robert K. Noble suggested that an armed citizenry could be used to counter terrorist violence. Noble told ABC, “Societies have to think about how they’re going to approach the problem…. One is to say we want an armed citizenry; you can see the reason for that.” Noble added, “You have to ask yourself, ‘Is an armed citizenry more necessary now than it was in the past with an evolving threat of terrorism?’ This is something that has to be discussed.”

THE AUSTRALIAN FIGHT FOR FREEDOM–South Australian council stops clubhouse.

A metropolitan council in Adelaide – the Tea Tree Gully council – has moved to a stop members of the Rebels MC using a property in it’s area (Ridgehaven) as their clubrooms.

A council committee supported a staff report which denies a retrospective request to run the club at 16 Dewer Ave because it does not comply with zoning rules and may cause noise and traffic problems.

The report does not name the Rebels, but it’s accepted the club has used the venue as clubrooms for several years.

The club’s flag flies from a flagpole at the address, which features a 1.8m fence surrounding a building adorned with security blinds and multiple surveillance cameras.

The applicant for the clubrooms is Old Southern Investments, the president of which is Gino Petruzzella, who has held a senior position in the Rebels club.

The report says motorcycle enthusiasts have been operating at the address “for some time” but the site only has approval for a motorcycle assembly and repairs workshop, which was granted in 1986.

The council report states the application is for “the operation of a motorcycle clubrooms with members sharing a common interest in Harley-Davidson motorcycles”.

It would hold a maximum of two weekday meetings per week between 6pm and 10pm for members only.

It would also hold larger meetings no more than monthly on Friday or Saturday nights between 8pm and 2am, involving amplified music by live bands or a DJ.

The weekend events would be invite-only events for members, including interstate members, family and friends.

Acoustic engineers hired by the council found that the clubrooms would likely produce too much noise for the area from music, talking and motorcycles and other vehicles leaving the property.

The property is in an area zoned for light industry but is adjacent to a residential zone and there are residential houses directly across the road.

The development would “likely result in sleep disturbance for adjacent residential properties,” the report said.

Council staff also referred the application to police on the grounds that “the development may involve the creation of fortifications” due to its 1.8m fence, closer roller shutters, security cameras and more.

But police told the council the site was not a form of fortification.

The council report said council staff notified neighbours of the application in line with policy but did not receive any responses.

But it noted several property occupiers around the site wanted to know more about the application.

“Given their informality, no regard has been given to such inquiries in the assessment of this application,” the report said.

The TTG development assessment panel unanimously agreed to refuse the club’s application, citing traffic and noise concerns.

MOTORCYCLE RIDERS FOUNDATION WEEKLY LEGISLATIVE REPORT–
This was the first real week of work for the Congress in this already puzzling lame duck session. The House had some fireworks on the Democratic side, as did the Senate.

First the House: The Energy and Commerce committee has vast jurisdiction over several seemingly odd issues, such as health care, telecommunication, food safety, etc. According to the website for the committee, they are “the oldest standing committee, with the broadest jurisdiction” and that “the history of the committee is the story of American prosperity and opportunity.”

Energy and Commerce, or E&C, is a powerful, maybe the most powerful committee, in the House. So it makes sense that two high-ranking Democratic members were both fighting for the top Democratic seat on the committee, known as ranking member.

The back and forth started in August when it was clear that the Republicans would indeed keep the majority in the House. Two contenders emerged: In one corner we have Frank Pallone, a New Jerseyan who is finishing his 14th term, and in the other, Anna Eshoo, an 11-termer from California.

Pallone is the more centrist of the two, but not by much. However, Pallone is a behind-the-scenes supporter of motorcycling. He won’t ever be the poster child for us, but he will not come at us. I can’t say the same for Eshoo. The fight rose to Pelosi level, with the former speaker backing longtime friend and fellow California woman Eshoo. Victory was Pallone’s, so we should enjoy a friendly E&C committee this next Congress.

The Senate showdown took place on the Senate floor. Backstory: Senator Mary Landrieu (D-LA), who is serving out her third term, is in the political race of her life. She is from a family who has been serving in Louisiana politics since 1960. Her return to the Senate was imminent, and a fourth term seemed all but hers – a true legacy.

That is, until a pesky reporter started sniffing around this summer and found rock solid evidence that Landrieu did not live in Louisiana, exactly. She was part owner of an estate that was split amongst her eight siblings, and all enjoy the same share of the modest bungalow in New Orleans.

In reality, she lives in D.C. in a $2.5 million mansion on Capitol Hill, and stays in hotels when campaigning back in Louisiana. Her race was not decided on election night because the three way split caused none of the candidates to garner the needed fifty percent plus. So, the top two candidates, Landrieu and Republican opponent Representative Bill Cassidy will face each other on December 6th. Cassidy is the favorite by a large margin.

Harry Reid also did something he has refused to do for years – hold a vote on the Keystone XL pipeline approval. Why, you ask? To give Landrieu some political cover with a big win for the energy industry, a dominating force in Louisiana. It did not work, the vote failed by one vote.

Dick Durbin (D-IL) refused to vote yes after telling leadership that he would; Durbin coasted to reelection earlier this month, so his flip-flop was a head scratcher. His reason? He was late. Durbin agreed to support the measure in order to help Landrieu. His mind changed when he was the very last senator to make it to the floor. Ninety-nine other senators had already voted with the bill set to pass 59-40. Durbin would have been the 60th yea vote. He didn’t want to be the guy that tipped Keystone pipeline over the edge. So he voted no, thus resulting in a messy defeat for team Reid-Landrieu, and certain guarantee that this will be up early in the 114th Congress.

Another troubling move came from our president last night. His sweeping immigration actions are seen by some as usurp in congress. I’ll leave that to the constitutional lawyers. But if it was legal for him to do, why now? Why not six years ago? If it’s so broken, why leave it on the to do list for so long?

This action raises more questions than it answers. Be prepared for a knock-down drag out fight between Congress and the White House on this one, and probably every one for the next two years.

THE HUPY WEEKLY SEMINAR–Is it Profiling or Discrimination?

A traffic stop of a biker, based on the mode of transportation, or the style of dress, or membership in a club, is considered by many to be profiling. Most are familiar with the illegal practice of racial profiling. To base a traffic stop simply on a person’s race is discriminatory and illegal. Race is a protected class.

Considering the biker example above, the stop is discriminatory in nature, but is it discrimination under the law?

Profiling is a means of using set criterion to identify members of a certain group. Although used extensively to identify members of street gangs through clothing color, manner of dress, etc., more and more law enforcement agencies appear to be profiling motorcycle clubs in an attempt to gather information for intelligence databases.

The Washington State Patrol went so far as to publish a pamphlet entitled “Basic Biker 101” which troopers used as a reference in identifying possible criminal biker organizations. That pamphlet was banned in 2002, but it continued to be read and utilized by troopers even after the ban. In fact, one club member was detained and subsequently arrested in 2008 and the trooper admitted using Basic Biker 101 information as a pretext for the stop. Two years later, in a civil rights action against that trooper, the biker was awarded $90,000 in damages.

Although his club colors were the reason the biker was detained on the roadside, it wasn’t discrimination or even profiling that determined the violation of his civil rights. It was the fact that he was detained in violation of the Fourth Amendment, with the court ruling he was illegally stopped without probable cause or reasonable suspicion. Membership in a club is not a permissive reason to stop and detain a person, unless there is suspicion or cause to believe the person has committed a crime or is about to commit a crime.

There is a lot of misunderstanding surrounding the use of the word “discrimination” regarding traffic stops. Bikers are not a protected class. Race, religion, color of skin, national origin and sex are protected classes under the Civil Rights Act.

Nowhere will you find a class for biker in the act.
Profiling a person using any of the above protected classes is illegal discrimination.

Detaining one of the protected classes based on profile is illegal. So what happens when a trooper stops you for membership in a club or just because he doesn’t like the way you look? That’s an illegal violation of your Fourth and 14th Amendment rights. If during the stop your club colors are confiscated, that is a violation of your First Amendment right of free speech and right of association. Certain clubs have been listed as “criminal enterprises” and are currently engaged in legal battles to secure their rights to wear and keep club colors.

Going back to Washington State, an organized coalition of motorcyclists were successful in 2012 in amending the state statutes regarding racial profiling. ESB 5241-2011-12 statutorily provides training for law enforcement and clarifies the definition of motorcycle profiling. This Bill was worked very hard by ABATE of Washington, Washington State Confederation of Clubs, Washington State US Defenders Program, BOLT of Washington and the Washington Road Riders Association.

Will it completely alleviate the problem of discriminatory stops of bikers by law enforcement? It’s certainly a step in the right direction.
The continued misuse of the word “discrimination” is adding to the confusion over the problems of illegal traffic stops on our roadways. The unpopular “no colors” signs on business establishments add to the confusion.

As bikers, it’s to our benefit to use proper terminology and to learn the proper application of the law regarding our rights, especially as declared in the First, Fourth, Fifth and 14th Amendments.

UNCLE MONKEY ON OLD SHIT–
Everything has a story. Old parts, old tools, old motorcycles, old gear it is very rare for them to still belong to original owner. Some get used and abused before getting put up on a shelf or packed away in a box to be forgotten about until one day they eventually make it to a swap meet, make it into some one else’s hands.

Some things have lived a good life – days at the track, nights down at the local water hole. They have criss-crossed this nation and the next. A million miles and million stories, if they could only talk. You see the age, the patina that only comes with years of use. Some things we press back into service with only the bare minimum of repair to get them useable again. People stop and ask us about the story behind it, whether it is an old scoot or an old racing helmet or jersey. Some find their ways to our walls and shelves, into collections. Their life now is a lesson, a story, and a reminder of the way things use to be. They are cherished, something to be passed from one generation to the next.

Then there are those other things. Prides and joys bought with hard earned money. They were to be like the others but life wasn’t the same. Sometimes the owner shipped away to a distant land to never come home. It was pushed to the side to await a return that would never come. Some were only used once or twice. Children or life came along. Barely touched they were slid under beds, leaned into corners of closets, hid under tarps in musky corners. They would follow along ever hopeful that maybe this time, this time would be the time that they would finally be used, but that rarely would be the case. They would get strummed a few times, maybe cleaned up with some fresh oil and few kicks to make sure there was still life. One day they are relinquished to a new home a new buyer.

Pristine, prime, perfect they end up in collections, in displays. We ooh and awe. We forget that there was a reason why it was never used, why it wasn’t used.

There are young soldiers who died in war, young men who died in their prime, people who lost use of their hand, lost use of their legs. People who had their hearts broken. People who loved so much they held tight to the one thing that would remind them of those no longer with them. So the next time you spot a tattered woolen sweater at a swap meet, an old Indian motorcycle sitting in someone’s office take a moment to think of the lives it touched, how it touched yours.

The JP Cycle’s Ultimate Builder rolls up to Seattle for a Killer Show in the Cathedral of Cool–

The 2014 edition of the J&P Cycles Ultimate Builder Custom Bike Show in Seattle is a feature of the Progressive International Motorcycle Show with custom bikes positioned on oval pads located on the glass and steel arch that connects the two halls in the downtown Seattle convention center.

Enthusiasts are able to walk around the customs and get a full 360 degree view. The glass arch is lit by spots and twinkle lights that deliver a museum-like venue to view some of the most amazing motorcycles from the Northwest. The facility has been dubbed the Cathedral of Cool.

Special guest to the show was Bryan Harley, Motorcycle USA Editor. He provided an Editor’s Choice Award and selected Brad Hall and his 2013 Sportster named Psycho Addiction. He brought along a kinetic trophy and a $100 gift certificate from Motorcycle Superstore.

The J&P Cycles Ultimate Builder is a platform for builders to showcase their work. It is also defined by an eclectic mix of motorcycles. In Seattle we had not one but two Kenny Roberts dirt-track replica motorcycles, two big-wheel baggers and numerous ground-up bike builds. It was a true celebration of creativity and innovation.

The Show Dog award is provided to the builder that engages the audience and builds a connection with the enthusiast. Our 2014 recipient was Bill Shawley. He brought in his own model and really worked the show. So he cruised home with a Leatherworks Solo Bag.

People’s Choice awards is always entertaining. Builders are filling out ballots and “helping” the attendees make their decision. Mike Hempstead from Voodoo Bikeworks took home a 5-Ball Racing Leathers Special Ops vest and a Bell Helmets’ Custom 500 lid for his efforts.

Quality Aerosols cleaners and polishers provided a can of polish to all the builders when they entered the show and their entire product line to the six winning builders that made their appearance on the podium.

The competition was close in all classes. A vote one way or another would have changed up the results. Judging is peer-to-peer which means the builders evaluate the work completed by their fellow builders.

You could tell hours and hours of polishing went into the drivetrain because the chrome gleamed. The 750cc mil was punched out to 800cc. The bike featured a custom frame, ACME Springer, NOS 1960’s Wassell tank & fender, Akront shouldered rims and custom seat. The bike rolled in with a light blue paint and gold stripes applied by Aaron.

purchased used, and they’ve all had 13″ tires. They’ve all also had
the fender mounts break eventually.

We spoke to Frank Esposito, the President of Kendon Trailers, and he would like to research your trailers. If you contact him with the VIN numbers, he will research your units to confirm if they are actually Kendon’s or not. There are a couple of knock-offs out there.

Some trailers have funky fenders mounted to the chassis with less than strong fender rails. Kendon fenders are mounted to the suspension and stay closer to the tire.

Folks don’t take care of their trailer tires like they do car tire. If bias-ply tires are not removed from the ground during storage, they can develop flat spots. Bias-ply tires are substandard tires and not prone to accurate balancing. It is critical to replace old bias-ply tires every 7-8 years, even low mileage units. The air pressure must be checked on a regular basis. And wheel bearings need to be lubed.

Kendon is now mounting all quality radial tires on their trailers. Their fender brackets are now cast with rolled edges for a stronger beam.

THIS JUST IN FROM THE BIKERNET PRISON BLUES FILES–JPay Inc., the biggest provider of money services for prisoners, has eliminated fees for sending money orders to inmates in three states, creating a free deposit option for families of more than 100,000 people incarcerated in Indiana, Ohio and Oklahoma.

The move comes after a Center for Public Integrity report showed that the families of hundreds of thousands of U.S. inmates had no way to send money to their incarcerated loved ones without incurring high fees. Several of the prison systems that had no free option for money transfers contracted with JPay for their inmates’ financial services.

JPay is one of the largest prison bankers, companies that provide financial services to inmates and their families, sometimes charging high fees and sharing their profits with the agencies that contract with them. The company handled nearly 7 million transactions last year and expects to transfer more than $1 billion this year.

JPay and other prison bankers have become central players in a multi-billion dollar economy that shifts the costs of incarceration onto families of prison inmates, according to the Center’s report. Families must send money to help pay for necessities like toilet paper and winter clothes that used to be provided by the government. JPay says it handles money transfers for 1.7 million offenders, or nearly 70 percent of the inmates in U.S. prisons.

JPay did not respond to several emails and phone calls requesting comment about the decision to eliminate some fees. The company’s founder and CEO Ryan Shapiro earlier said The Center’s questions about money order deposit fees forced him to consider the impact of policies that affect the company’s poorest customers. He said he would seek to convince states to provide families with a free deposit option.

The change was confirmed by John Witherow, director of Nevada CURE, an inmates’-rights group. Witherow said he received an email announcing the change from JPay’s public relations manager sometime in the past two weeks. A spokesman for the Indiana Department of Corrections also confirmed the change. Spokesmen for the Ohio and Oklahoma departments did not respond to requests for comment.

The fees families pay to send money to an inmate vary from state to state. Electronic transfers almost always incur a steep fee charged by JPay or another private vendor. Some states let vendors charge a fee to deposit funds sent by mail but most offer money order deposits as a free option. Florida, an outlier, charges its own processing fee for money order deposits.

BANKS IS TROUBLE AGAIN—This time they may go to jail. According to the WEEK magazine regulators in the U.S., the U.K., and Switzerland have slapped six of the world’s biggest banks with a combined $4.3 billion fine over allegations of widespread rate rigging in the foreign exchange markets, said Daniel Schafer in the Financial Times. JPMorgan Chase, HSBC, the Royal Band of Scotland, Citigroup, Bank of America, and UBS agreed that “they did not have the necessary controls in place to prevent manipulation of what is the largest financial market in the world, with $5.3 trillion a day in trades.” The banks could face criminal charges.

SPLITTING LANES IN CALIFORNIA—The AMA’s support of lane splitting in California and its disappointment in the state’s removal of safety guidelines, published in 2013, from the websites of state agencies has been the topic of discussions between the AMA and the California State Transportation Agency (CalSTA).

Someone who hates lane splitting came down on the agency for the guidelines, so hard they pulled them. The AMA and I’m sure ABATE has gone after them to put them back.

FROM AMA IN ILLINOIS—Senate Bill 3130, sponsored by Don Harmon (D-Oak Park), defines an autocycle as “a three-wheel motor vehicle that has a steering wheel and seating that does not require the operator to straddle or sit astride it.” It also provides that the operation of an autocycle requires a Class D driver’s license—with no motorcycle endorsement—and makes certain provisions for titling vehicles with challenged titles.

The bill was signed into law by the governor on July 21.

Florida corrections secretary to resign–

TALLAHASSEE — Florida Department of Corrections Secretary Michael Crews is resigning at the end of the month. Crews notified Gov. Rick Scott on Monday of his plans to step down. He said he has taken another position in the criminal justice field. The department has been under scrutiny for prison deaths, abuse and allegations of cover-ups.

Scott immediately appointed deputy secretary Tim Cannon to serve as interim secretary. Cannon has worked at the department for more than two decades, including as assistant secretary of institutions and as a prison warden.

Never Should Have Threatened To Shoot The Dog–Police: Man shoots himself in face

PINELLAS PARK — Authorities say a man accidentally shot himself in the face while arguing with his wife in their Pinellas Park home.

According to police, Dennis Eugene Emery, 57, grabbed a revolver while fighting with his wife early Tuesday and threatened to shoot one of their dogs. He pulled the hammer back on the revolver as if he planned to carry through with his threat. At some point, he tried to release the hammer and the gun fired, striking him in the face. He died at the scene.

Police say they’ve have 34 contacts with Emery since 2012, including three arrests in the past five days for domestic battery, aggravated assault, resisting arrest and leaving the scene of a crash.

HAPPY THANKSGIVING—I scrambled out of the sack at 5:00 to meet the deadline, and the Mistress and her husband Krash Kranzler peeled to relatives for the holiday, so I was on my own.

If there are terrible mistakes, stumbles, misspelled words, don’t hesitate to blame me. I’m guilty.

The plan is to hook up with our Certified Welder and philosopher Dr. Feng and ride over to Long Beach and wish my 93-year-old ma Happy Thanksgiving, besides the good doctor will scare the shit outta her.

Then we thought about hitting the local Veterans outpost and check it out. They are serving meals to the homeless.

And finally we plan to ride to the rat bike of boat marinas at Leeward Bay, for dinner at the Chowder Barge. It should be interesting. Sinwu owns it now.

I’ll report on Sunday. Have a helluva Holiday and stay out of trouble, no drinking and driving or riding.
