THE ANTIQUE MOTORCYCLE CLUB OF AMERICA IN COOPERATION WITH BIKERNET.COM WANTS NEW, YOUNGER MEMBERS, WIN A BIKE, LEARN AND JOIN– A Classic Harley-Davidson Motorcycle ?Give Away.?

If you or someone you know is between 18 and 25 years old, here is an opportunity to win and rebuild a 1940s era Harley-Davidson WLA motorcycle project! The youth program of the Antique Motorcycle Club of America is running a contest this year that will give away a 1942 Harley Davidson bobber project.

Matt Olsen of the Youth Program of The Antique Motorcycle Club of America is the young man behind this proposal. ?As classic motorcycles become more rare and expensive it is getting tougher for young people to afford them,? Olsen explained. ?Knowing how frustrating this can be, I decided to try something to help encourage young people like me to better understand, preserve and enjoy classic bikes and possibly to own one.? Olsen approached The AMCA Foundation, Inc. to fund this special program and has spent more than a year developing the project and finding members of the A.M.C.A. to donate the parts to build a Harley-Davidson WLA bobber.

The contest is limited to young Americans (guys and gals and they don?t have to be a member!) between the ages of 18 than 25. They simply have to write and submit a 1,000 word essay describing what they hope to learn about classic bikes, why they want the bike, what they plan to do with it once the build is completed, and any other reasons why they feel they should win this motorcycle. The entry must be received by Matt Olsen at amcayouthprogram@hotmail.com no later than August 15th 2009.

The one lucky winner will be selected at the Antique Motorcycle Super Meet in Davenport, Iowa in 2009 by a committee made up of the people that donated the parts and supporters. But wait, there?s more. In addition to the Harley-Davidson WLA motorcycle, the lucky winner will also win a grant from the AMCA Foundation of up to $5,000 for parts and travel and living expenses to spend up to two months shop time at Carl?s Cycle Supply in scenic Aberdeen, South Dakota. This will allow the winner to learn how to put his or her new motorcycle together under the watchful eye of trained professionals.

The title and paperwork for the motorcycle will be given to the winner after the motorcycle has been started and ridden a few miles. The builder will also have the opportunity for the bike?s restoration and assembly process to be featured in a series of tech articles in Iron Horse magazine. Once finished, the bike and new owner will be photographed and featured in various magazines, including American Iron Magazine as well as The Antique Motorcycle? so that others may share in the adventure of owning and restoring a classic motorcycle.

If you are interested in ?old iron?, or just want to check out how the contest is coming along, please check out the Antique Motorcycle Club of America www.antiquemotorcyle.org, Classic American Iron www.caimag.com, and Bikernet www.bikernet.com for regular updates. AMD shocks

Tricky Air & Billet refines shock lineTRICKY Air & Billet has reworked its stainless steel shocks used in its air-ride suspension systems– The company is now producing the shocks for Harley and custom application as two separate units instead of a single one-piece unit.

The change has been made in response to the company’s research into the variations in frame design around the shock mount area. Arnie Gonzalez, Owner and President of Tricky Air & Billet, said of the redesign: “Since we made this separation change to our shocks we have noticed a huge improvement in the wear factor between the shaft and bushing seals. Splitting of our once ‘tied together’ unit lets our shocks find their individual location more freely in the bike while still delivering true center hole to center hole precise measurements.”

Additionally, the company is beginning work on a line of triple trees to allow its Hayabusa front forks to be fitted to Road Kings and other Harleys.

BIKERNET CORRECTION–“Davidson shops won’t work on bikes older than 10years,” said a Bikernet Report.

He should have correctly said “some shops” We are currently rebuilding a 1950FL, before I sold them we routinely worked on my 1960FLH and my 1969FL.

We have never turned away any Panhead or Shovelhead for repairs or service. In the 12 years I have worked there to the best of my knowledge there has never been a Knuckle or a Flathead brought in for service.

We do stock some parts that will still work on Pan’s and Shovels, but we only have so much money for inventory and have to stock what we routinely sell, not what we might sell once every couple of years. Twists my chain to hear this kinda bullshit constantly being spread with no one ever checking the facts.

LEGENDARY RECORD-SETTING MOTORCYCLE TO BE SOLD: MARTY DICKERSON?S VINCENT RAPIDE ?BLUE BIKE,?HISTORIC MACHINE TO BE THE 2-WHEELED HIGHLIGHT OF THE PETERSEN AUTO MUSEUM SALE OCTOBER 25th– 15 September 2008 ? San Francisco ? Certain competitors, once in the saddle, put an indelible stamp on events and, similarly, there?s a select group of racers who create an affinity with a single brand. There is no finer example of this than the long-standing link between Marty Dickerson, Vincent and Bonneville.

In 1951 at Utah?s famous Bonneville Salt Flats, Marty and his ?Blue Bike? earned the second fastest speed of 129mph. The next year, the pair achieved the fastest time and the AMA Class C record with a speed of 141.72mph. (Class C rules restricted un-faired machines to pump fuel, an 8:1 compression ratio, and for riders to sit conventionally.) A year later, in 1953, he raised that speed and grabbed yet another Class C record at 147.56mph ? a record that remained unbroken for the next 20 years!

Why Men Don’t Write Advice Columns– (Walter is the male version of Anne Landers)

Dear Walter: I hope you can help me. Yesterday, I set off for work leaving my husband in the house watching the TV as usual. I had gone less than a mile when my car’s engine conked out and came to a halt. I walked home to get my husband’s help. When I got home, I couldn’t believe my eyes. He was in our bedroom with the neighbor lady. I am 32, my husband is 34, and we have been married for twelve years.

When I confronted him, he broke down and admitted that they’d been having an affair for the past six months. I told him to stop or I would leave him. He was let go from his job six months ago, and he says he has been feeling increasingly depressed and worthless. I love him very much, but ever since I gave him the ultimatum, he has become increasingly distant. He won’t go to counseling and I’m afraid I can’t get through to him anymore. Can you please help?

Sincerely,
Distraught in North Carolina

Dear Distraught: A car stalling after being driven a short distance can be caused by a variety of faults with the engine. Start by checking that there is no debris in the fuel line. If it is clear, check the vacuum pipes and hoses on the intake manifold and also check all grounding wires. If none of these approaches solves the problem, it could be that the fuel pump itself is faulty, causing low delivery pressure to the carburetor float chamber.

I hope this helps.
–Walter

hennchman

SAXON MOTORCYCLE COMPANY UNVEILS THE HENCHMAN IN THE US– CASA GRANDE, Ariz.–September 18, 2008–Saxon Motorcycle Company is proud to announce the release of its newest model, the Henchman. This new addition offers Saxon’s signature styling, a factory warranty and an impressive parts list all at a reasonable price point.

The Henchman upholds Saxon’s commitment to affordability, reliability and comfort while offering some customizable features to help buyers personalize their rides. With 35 degrees of rake and 1.5″ stretch, this 510 pound rigid is lightweight, but the four-piston front and two-piston rear Brembo brakes provide extra stopping power to complement the 1500 cc S&S 96 engine.

The bike features a Primo Rivera six-speed transmission with left-side chain drive and can be customized with either a telescopic or springer front end. Customers can choose from several paint colors, but the Henchman’s simple paint job, 200 mm rear tire, sculpted leather spring seat and custom handlebars work together to give this chopper/bobber a ride that is nimble and has a stripped down style.

“We’re excited to add the Henchman to Saxon’s motorcycle line-up,” said Dustin Petty, Saxon’s plant manager. “This bike has the lowest MSRP of all the Saxon models, but still features top-of-the-line parts and several option packages to give customers that custom look without the custom price tag.”

The Henchman starts at $18,900 with the telescopic front end and $19,500 with the springer front end. As with all Saxon models, the bike is backed by Saxon’s customer service pledge and comes with a one-year limited warranty.

LOUD PIPES SAVE LIVES!–Silent but deadly, a California lawmaker says electric and hybrid cars and motorcycles may be good for the environment, but they?re bad news for the blind.

State Sen. Alan Lowenthal, a Long Beach Democrat, has pushed a bill through the legislature to ensure that vehicles make enough noise to be heard by the blind and visually impaired when they’re about to cross a street.

The state Senate approved the bill on August 20 on a 23-12 vote and sent it to Gov. Arnold Schwarzenegger, who according to the San Francisco Chronicle has not taken a position.

City of Denver Attacks Bikers

cops 1

As unbelievable as it may seem, Denver now has one of the harshest noise ordinances in the country. Clearly aimed at bikers, this little piece of government bull was sponsored by the aspiring fascist Rick Garcia.

The law is pretty simple, it only takes up two pages – but what it does is effectively takes away the rights of ANY biker who happens upon the now-biker-unfriendly burg of Denver. Here’s a rough outline of the provisions (now, I’m no lawyer here, so read the thing yourself):

1) Your bike must register under 82 db from 25 feet.

2) The measurement can be taken at ANY condition – idle, rev up, rev down – apparently this is at the officer’s discretion. Yes, they can make you rev the bike until you fail the test.

cop2

3) It’s illegal to install any muffler on a motorcycle made after 1982 that doesn’t bear an EPA stamp of approval.

4) It’s illegal to operate a motorcycle made after 1982 with a muffler that doesn’t have an EPA stamp of approval.

Wait, I hear your blood boiling and questions coming out like, “Where the hell do I get an EPA approved muffler for a 1986 bike?” “What about the $700 bucks I just spent on my custom system?” “Nobody can pass that noise test –my lawnmower is louder than that!” “Did I fall asleep in Denver and wake up in Nazi Germany?” Well, thanks to your friend Rick Garcia, the answer to the last question is simple, “Yes, you did.

It’s not about noise folks – it’s about the cops being able to pull over any bike, at any time for suspicion of violating this new noise ordinance. And guess what, if you happen to have the EPA approved horse crap stamped into your muffler – you’ll be requested to rev your engine until you fail the test.

But don’t worry, the fine isn’t that bad: you’ve got two weeks to show up with “the problem” fixed or pay a measly $500 fine.

Look folks, this is the biggest slap in the face Denver bikers have ever had to endure. They’re taking away our right as law-abiding citizens to ride a bike through Denver on a sunny day. To which I say, “Screw ‘Em!” – that’s the last you’ll see of me (and my money) in the City of Denver. No more Children’s Hospital Toy run, no more benefits for fallen cops and firemen, no more NOTHIN’ …if this is the way we get treated, then the only thing we can do as bikers is to take our cash, our goodwill and our community support and go someplace else.

Actually, this is what Denver’s new self-appointed guardian of Goodness seems to want, as he is quoted in all the newspapers as saying. “Hopefully they will stay out of Denver,” Garcia said about the motorcyclists with loud exhaust pipes. I guess Rick will go explain that to the kids at Children’s Hospital when they don’t get any Christmas presents.

I’m not buying gas in Denver; I’m not buying food in Denver; I’m not going to plays or movies in Denver; I’m not staying at hotels in Denver; I’m not going to the People’s Fair; Taste of Denver, or ANY of the other events in Denver because Rick Garcia and his crew of mis-informed do-gooders clearly didn’t think this one through. But I have – and I’m calling on all right-thinking bikers who read this to do the same thing. You don’t want us? We’re gone. BIKERS BOYCOTT DENVER!

It starts now, but who knows where it will end?

BIKERNET INVESTIGATES FORMER CHOPPER KING, HUGH KING–He missed three Bikernet Board meetings, so Renegade, the constant dismal Dan, brought him up for a vote. “He ain’t the King No Mo’!” Renegade snapped. It took a month but we found the god of Biker Build-offs in Maine, almost frozen to a stack of logs.

“I’m in second month of producing a series for Discovery tentatively titled “Log Drivers,” reported Mr. King. “It’s about a family of nine brothers who cut and haul timber in the deepest forests of Maine…. a risky and dangerous business. Since these guys work 24/7 under very rugged conditions. It’s been a challenge keeping up with them… but we’re doing it. The first of six shows airs in March of 2008.”

By the way most of the brothers are hardcore bikers….some have made the trek all the way from Maine to Sturgis twice. On weekends they?ve lent me their bikes to take scenic short hops… so I’m not out of the loop all together.”

You should make your Freedom film next year. Why don’t you buy a Sony Z7U which is HD broadcast quality for $6000, a tripod, a sound recording machine for $2,500 a couple of microphones and just film it yourself. Then edit the whole experience into 3 minute beats and put them up sequentially on Biker Net.”

I will be on the east coast till March which is lonely but when I return I’ll give you a hand.”

BOOZEFIGHTERS RAFFLE BIKE TO BENEFIT MILITARY FAMILIES SUPPORTED BY PAUGHCO–A couple of months back the Boozefighters M/C announced they would be building a real world chopper from the ground up with the sole purpose of raffling the bike off and donating the funds to the Nevada County Military Families. This recent photo shows the project is well on its way to completion. With the exception of a few finishing fitment details the bike is ready to be pulled down and painted.

The ?Real Chopper? style reflects the historical background of the club and was made possible in large part to the support of The Driveline Company (TDC), Paughco, Revenge Cycle, Carl Spotts Co, Fat Katz, Tech Alloy and others. Paughco provided one of their awesome Wide Drive Softail chassis, a 3? Wide Springer and wrap around oil bag while Mark Modonna heavily modified and recovered a LePera seat.

The engine, as you may have guessed by its distinctive ram air system, is a 125? TDC backed by a 2008 6-speed with kicker. Revenge Cycle provided adjustable rear suspension, bars, mirrors and lighting and the license mount is Fat Katz?. Assembly is being handled by Carl ?Big Daddy? Spotts and Jeff ?Trashcan? Wray.

Once complete the scooter will be making the rounds at various local venues, where tickets may be purchased. Tickets are also available at our website: www.bfmc6.com www.bfmc6.com ? click the store link to purchase via PayPal. THAT’S A 9-11 WRAP–We should all take a minute to reflect on that day and how it changed our lives. I know the president catches constant heat from our media for Iraq, but there’s another side to that story, and perhaps as history unfolds we will discover being proactive in Iraq will benefit us from a security prospective and all of the middle east. Remember, for the troops that on average 800 have died a year in Iraq while 44,000 people will die in this country this year in car accidents alone. The brothers and sisters in the military might be safer off the streets in Iraq.

I escaped to the mountains and went through every chapter of my first Chance Hogan book. I’m ready to have a copy editor review it then hunt for a publisher. I may already have one in Europe. So I apologize if we missed new content for a couple of days, but that means there’s a pallet of content coming. Sin Wu is about to launch my Sturgis and the Bikernet Brouhaha report, I’m about to launch our first of two Victory Vision Road Tests. A new Roland Sands feature just landed on my desk and I’m about to launch the coolest BMW feature in the Bikernet Metric Area. We’re looking for a replacement, parttime BikernetMetric Editor, but next week we’ll have a new News feature headed that way. I’ll also bring you a tech on Chica’s Wheels and the German Viking just turned in a new Girl of Bikernet for the Cantina, plus I’ll try to edit another world run feature and see if we can’t scrap together a Bandit’s Cantina Soap opera chapter. Another Plus, Bonneville reports are rolling in including a cool on the salt report from Gina Woods and I have another report on the H-D 105th from a little known motojournalist, Sarge the Scribe. Hang on, next week will be full of action. In the meantime, let’s ride.

COOLBETH WINS TO CLINCH THIRD AMA GRAND NATIONAL TITLE– Coolbeth Passes Smith for Sixth Win; Kopp Fails to Qualify for Main.

MONTICELLO N.Y.. (Sept. 7, 2008) ? Harley-Davidson Screamin’ Eagle factory rider Kenny Coolbeth clinched his third consecutive AMA Grand National Twins championship with a win on the half-mile track at Monticello Raceway. Coolbeth passed Moroney’s Harley-Davidson/Screamin’ Eagle rider Bryan Smith on lap 17 of the 25-lap main and led by 2.054-seconds at the finish line to win his sixth race of the season. Because his closest rival for the series title, Latus Harley-Davidson/Screamin? Eagle rider Joe Kopp, failed to qualify for the main, Coolbeth?s win gives him an insurmountable points lead with two races left on the schedule.

?We certainly didn?t come to Monticello expecting to win the championship,? said Coolbeth. ?Winning the title was our goal when we opened the season in May and it feels great to be able to wrap it up early. I?m really happy for the Screamin? Eagle Harley-Davidson factory team. They really work hard for me, listen to me and are great people to race with. I could not have won these championships without that support.?

Coolbeth joins a list of legendary flat-track racers who have won three consecutive AMA Grand National championships that includes Carroll Resweber, Jay Springsteen, Bubba Shobert, Scott Parker, and Chris Carr.

The race at Monticello was delayed from its scheduled Saturday start until Sunday due to rains caused by the remnants of tropical storm Hanna. Smith was on the pole for the start after posting the fastest time in qualifying heats, and took the lead on the first lap with Coolbeth in second and Glassman/LZ Racing rider Sammy Halbert and Nick Cummings fighting for third. Smith opened a comfortable lead on Coolbeth, but as the race passed the half-way point, the factory Harley-Davidson rider picked up the pace and closed in on Smith. Coolbeth passed Smith low in turn one on lap 17, and Smith made one attempt to re-pass before Coolbeth pulled away and then rode uncontested to the finish.

?I was just biding my time, not letting Smith get away,? said Coolbeth. ?I knew he?d be fast at first when the track was loose. But I figured it would dry as the race went on and work better for my set-up, which is exactly what happened.?

Halbert dropped out of the race on lap 19, leaving third position to Cummings. Blue Springs Harley-Davidson/Screamin’ Eagle rider Jared Mees finished ninth.

After 11 of 13 events on the 2008 AMA Grand National Twins schedule, Coolbeth has a lock on first place with 214 points. Smith has 162 points and moves past Kopp for second place. Kopp is third with 155 points, followed by Chris Carr, who finished seventh at Monticello, with 154. Mees moves up from ninth to seventh with 102 points.

Smith, Kopp and Carr have two races remaining on the schedule to battle for second and third place in the season standings. The 2008 AMA Grand National Twins Championship will next race on September 13 on the Indiana State Fairground mile in Indianapolis, Ind.

?We tested at Indianapolis after the Springfield race,? said Coolbeth. ?It has been a few years since we raced there. The track is not as fast as the Springfield Mile, but it?s more technical and more of a cushion track with lots of lines and passing opportunities. There will be a lot of fans in Indy for the MotoGP race that weekend, so we hope they come out to watch what I think will be an exciting race.?

The season closes on Oct. 4 with a race at Heartland Park Topeka in Topeka, Kansas.

BANDS ROCK MILWAUKEE DURING H-D 105TH–There was music everywhere during Harley?s 105th anniversary in Milwaukee Labor Day weekend.Names like Joan Jett and Kid Rock were at the Hog event held at Miller Park.

Bruce Springsteen, ZZ Top, Foghat, Black Crows and Blue Oyster Cult were just a few playing at Summerfest grounds. Though the music was good at the larger events the crowds were large and cumbersome.

The various dealers, bars and everywhere you can think of had performers. Some of the smaller events had some really good bands that you could either lay back and listen to or get up and dance.

Charlie Brechtel with DR. Snake Oil for a back up rocked them at Hal?s HD. The crowd really got into Charlie?s style and songs as they usually do with many getting up and moving their feet. All in all no matter what kind of music you like it was there.

DISGRACED FBI AGENT–Fla. murder trial nears for disgraced ex-FBI agent MIAMI — John J. Connolly was hundreds of miles away in 1982 when gambling executive John Callahan’s bullet-riddled body was discovered in the trunk of his Cadillac at Miami’s airport. The admitted shooter says he never met Connolly, the disgraced ex-FBI man at the heart of the agency’s sordid dealings with Boston’s Winter Hill Gang.

Yet Connolly will stand trial on murder and conspiracy charges this month as if he had pulled the trigger himself, because prosecutors say he secretly gave information that was crucial in setting up the hit. Jury selection is to begin Monday in a trial that figures to rehash some of the ugliest episodes in the Boston FBI’s handling of the gang, once led by James “Whitey” Bulger and convicted killer Stephen “The Rifleman” Flemmi.

For years, both were top FBI informants on rival Italian mobsters. Connolly was their handler – and Connolly made sure they were shielded from prosecution for murder and many other crimes, a service for which he was eventually sent to federal prison on a racketeering conviction.

A congressional investigation concluded in 2003 that the FBI’s relationship with Bulger and his cohorts “must be considered one of the greatest failures in the history of federal law enforcement.” The scandal spawned several books and was the template for the 2006 Martin Scorcese film “The Departed,” with Matt Damon playing a crooked Connolly-like law enforcement officer and Jack Nicholson as the Bulger-esque Irish-American mobster. And it led former Attorney General Janet Reno in 2001 – one of her last acts in office – to install reforms on FBI use of criminals as informants, including better monitoring and accountability.

The Callahan slaying is part of that history, detailed in numerous court documents, interviews and investigative reports.Callahan was president of World Jai-Alai, a Miami fronton, or facility, for the sport in which gamblers bet on players who sling a small ball against a wall using wicker baskets. World Jai-Alai was purchased in the late 1970s by Roger Wheeler, a businessman from Tulsa, Okla., who liked the fact that former Boston FBI agent Paul Rico was part of the security team.

Soon, however, Wheeler suspected that Callahan was skimming profits from World Jai-Alai for the Winter Hill Gang. He fired Callahan and ordered an audit. On May 27, 1981, Wheeler was shot between the eyes at a Tulsa country club by hit man John V. Martorano, who has admitted in court to 20 murders.

Callahan was targeted next because Bulger and Flemmi feared he would finger them for Wheeler’s killing. Martorano pleaded guilty in 2001 to shooting Callahan and, with the help of an associate, stuffing his body into the trunk of Callahan’s silver Cadillac.

Authorities found the car at Miami International Airport, with a dime placed on Callahan’s body as a warning against potential informants not to “drop a dime” or rat out associates.

Rico, Connolly’s former FBI colleague, was eventually charged in Wheeler’s murder, but he died in 2004 before going to trial. A little over a year later, Connolly was indicted by a Miami-Dade County grand jury in Callahan’s killing. A conviction means a life prison sentence.Connolly, 68, is already serving a 10-year federal prison stretch for racketeering and other charges from his associations with Bulger and his gang, including tipping his former informant off about an impending 1995 indictment.Bulger – the brother of William Bulger, the former state Senate president who resigned as president of the University of Massachusetts in 2003 – fled before he could be arrested and remains a fugitive, a fixture on the FBI’s “Ten Most Wanted” list.

The FBI has checked out hundreds of tips regarding his whereabouts, including Spain, Italy, Portugal, Mexico, Great Britain and Germany. Last week, the agency marked his 79th birthday by doubling the reward for a tip leading to his capture to $2 million.

The federal jury that convicted Connolly in 2002 rejected evidence of his involvement in the Callahan killing, although the charge then was obstruction of justice. And Connolly’s lawyer, Manuel Casabielle, said little new has surfaced in the years since.

“The reason you haven’t seen much connecting John to the Callahan murder is because there isn’t much. It isn’t there,” Casabielle said. “Most of what they have comes from two people who have admitted at least 40 murders between them.”

BIKERNET NEWS UPDATE CONTINUES–BONNEVILLE BOOK REVIEWED IN THUNDER PRESS, NOT BAD

LOTS MORE THAN A SIMPLE HOW-TO BOOK, BONNEVILLE BY KEITH R. BALL–
How to Build a Bonneville Salt Flats Motorcycle
Keith R. Ball
Wolfgang Publications, Inc., 144pp, $24.95
www.wolfpub.com
www.bikernet.com
Reviewed by Bill Hayes

It?s generally a safe bet that any book that begins its title with ?How to?? is probably indeed a ?how-to? book. Keith Ball?s introduction to his newest book reiterates this incredibly perceptive logic: ?On the surface, this book is nearly a how-to. It covers dramatically how we built a bike, hauled it to the historic Bonneville Salt Flats, and attempted to set an AMA World Land Speed Record. Done deal. Let?s get started.?

But he quickly adds a caveat.?Ah, but not so fast? This book is about an adventure, a dream and the desire to see the vision to fruition.?And he is so right. The book accelerates rapidly into the ?adventure? side of things as the nuts and bolts and measured tolerances and fork angles?while still vital to the work as a whole?become secondary to the non-stop emotion of Keith ?Bandit? Ball?s Bonneville epic. This ?adventure? story and the passion that goes with it create a perfect portrait of the soul of this lifestyle?a portrait that goes miles beyond the hands-on building and racing of a motorcycle.

Right off the bat, the book?s adventure component centers on two legends: one living (Keith) and one (sort of) dead (the dry remnant of the ancient Lake Bonneville of glacial times, now known worldwide as Bonneville Speedway near Wendover, Utah).

Keith Ball was the editor of Easyriders magazine for two decades. He is a member of the prestigious Sturgis Motorcycle Hall of Fame. Everything Keith has ever done, currently does, or will do in the future is steeped in ?adventure, dreams and the desire to see vision come to fruition.? The words that he has written, the bikes that he has built, and the odysseys he has enjoyed over the years have proven this again and again.

The wild 159 square miles of Bonneville?s dead sea bed has been its own version of a hall of fame since the 1930s; immortalizing?by making or breaking?the great and the not-so-great drivers, riders, and racing machines.

How to Build a Bonneville Salt Flats Motorcycle chronicles the mix of this duo; two forces in this lifestyle meeting in a frenzy of fast fun?combining for another attempt at a hard line in the record books.

Bonneville?s historic legacy is laid out in Steve Thomas? foreword to the book. It sets one of the physical ?stages? for this adventure/production. In Chapter One, the curtain rises on another stage?the garages and the shops?when Ball introduces one of the main ?stars? of this show: the monster bike affectionately called the ?Assalt Weapan.? This bike is fittingly billed as ?the world?s fastest Panhead.? The hoped-for ability of this beast to break some speed records is the outward focus of the adventure?the quest. The stretched and silver big-inch bomb was given life in a couple of famous ?laboratories,? including Berry Wardlaw?s Accurate Engineering factory in Alabama and Ball?s own magnificent compound beneath the shadow of the Vincent Thomas Bridge.

Another star of this extravaganza is the pilot of the monster ride: the lovely, talented, and bad-to-the-bone Valerie Thompson. Gender is a non-issue when you can roll at 150 mph-plus on a Panhead.

There are many other stars. Keith?s entire 5-Ball Racing Team is a serious bunch of talented badasses who are bulletproof and blessed with high-tech brains and skill. The reader gets to know them all. The reader also gets to know members of this lifestyle outside of Keith?s hands-on racing team?s inner circle. Comments from bikernet.com?s audience, other builders, and a variety of additional sources add color throughout.

The third setting that is so important in this open-throttle drama is ?The Road??and it is here where the meat of this adventure becomes so savory. After the idea has been conceived, the bike has been designed, the team has been assembled, the machine has been built, and the millions of details have been attended to, the journey from So Cal to Utah is logistically arranged and undertaken?all the while looking at the clock, sweating the myriad deadlines that are part of the daily schedules. This is great stuff. It?s truly a hoot.

In the chapter titled ?The Deadline Approaches,? Keith notes: ?Facing the grim reality that only eight days remain before we roll toward the historic Bonneville Salt Flats, we feel like high school kids facing the potentially bad report card.?

You will lose yourself in this book. You?ll become a member of the team. You?ll be right there along with the 5-Ball bunch. You?ll be sweating, too, and looking at that damn clock:

?But we aren?t out of town yet. Instead, we sit in this rented fun mover in downtown Long Beach and count the minutes. We are burnin? daylight?we are screwed. Nyla, [Keith?s better and more rational half], and her daughter Karley, are inside the 100 year old bank, negotiating. Jeremiah [Keith?s buddy whom he describes as ?a local biker?a talented construction worker with a swarm of exes who harass him constantly.?] and I are parked illegally outside the plate glass windows with ski masks pulled over our sweaty faces. Nyla is attempting to have funds released into our account, but the bank staff isn?t budging. I tap the steering wheel while Jeremiah tells nervous jokes, and whistles.?

Too much fun!

The complete building process and the whole pressure-cooker of an adventure is captured in a mass of incredible photos taken by a battery of photographers from the ?inside? of our special culture?artists who obviously understand what this way of life is all about.

And Keith ?Bandit? Ball? knows this lifestyle better than anyone. Sure, this book is a how-to in many ways?how-to build a screamer of a bike, how-to undertake a giant project in the spirit of fun and brotherhood?but most importantly, it shows the reader ?how to? enjoy an adventure, a dream, a desire to see a vision to fruition, and a look at life in general through the eyes of a true biker legend.

OLD RACER

MOTORCYCLING UNDER ATTACK HIT WITH FRAUD–I do not know the answer to it so I am sending it out to see if someone does.

For a long time, I have wondered about the frauds that have been perpetrated upon the motorcyclist and motorcycling.

Helmets are fraudulent. They are a device that are neither capable of preventing crashes (crash helmet) nor are they capable of providing safety (safety helmet).

The Motorcycle Safety Foundation has failed dismally at education and failed miserably at lowering the death toll of motorcyclists upon our highways and byways.

Can the government on a state or federal level be sued for fraud or participation in fraudulent schemes?

FOUR LADIES AND FIVE RECORDS FOR TEAM KLOCK WERKS– MITCHELL, S.D.? Four ladies were riding for Team Klock Werks at the Motorcycle Speed Trials by Bub on the Bonneville Salt Flats this year. After a week of racing, Team Klock Werks came back with FIVE new National Land Speed Records! As a bonus, Laura Klock defended the ?World?s Fastest Bagger? record, and her daughters Erika (17 ? senior at Hanson High School) and Karlee (14 ? freshman at Mitchell High School) joined her as record holders on their own bikes, making the trio the first mother-daughter-daughter in history to set land speed records in the same year at the same event. At age 14, Karlee was the youngest female participant, and she set two of the five records in her rookie attempt.

Laura Klock faced the tough challenge of being a supportive and encouraging mother while trying to set a land speed record of her own. She was successful at both roles. Laura has piloted the WFB (World?s Fastest Bagger) to multiple records since her first attempt in 2006, and this year she reached a new personal best, and a new record. The WFB, #3338 in MPS-PF 3000, reached a top speed of 153.906 mph, with a new record on the books of 153.592.

The WFB utilizes many of Klock Werks signature series parts including the patent pending Flare Windshield. Erika Cobb returned this year after setting a land speed record on a 500 cc Buell Blast in 2007. Erika rode a 1995 Buell S2 for this year?s speed trials. She set a new land speed record on the Buell #455 in P-PP 1350 of 130.392, and her personal best for the week was 132.206.

While both Erika and Karlee have traveled to the salt with the team since 2006, Karlee was unable to participate simply because she wasn?t old enough. This year she was able to get a valid driver?s license from the state of South Dakota, where it is allowed to be licensed at the age of 14, and participate. Karlee rode the Buell Blast that Erika piloted in 2007, which means that she went after her older sister?s record.

Karlee not only broke the old record on the Buell Blast #3333 (110.724 mph in class MPS-PG500), she also set an additional record by running the bike in another class by removing the fairing (107.391 in class M-PG 500). Her personal best is 111.580 mph.

klock facing

With Karlee?s land speed records, she will join her mother and older sister in the Sturgis Motorcycle Museum?s ?First Ladies of Motorcycling? exhibit as the first mother-daughter-daughter trio in history to hold Bonneville National Land Speed Records in the same year.

Also new to the Klock Werks team was Michelle Mielke, who is the wife of Klock Werks service manager, Joe Mielke. Michelle was riding her 2000 Yamaha V-Star 650 bike #415 in M-P 650 and set a land speed record of 102.1. Her personal best was 102.389.

All of these land speed records are under AMA (American Motorcycle Association) sanctioning and are subject to final verification. Records on the Bonneville Salt Flats are an average of two passes ? one being a qualifying down run and then a return run. A rider must be at or above the existing record speed to qualify for a return pass. The Bub Speed Trials are sponsored by AMA so the return pass is made in the opposite direction on the course. The speed is an average of how fast you pass through a measured mile (which is the middle mile of the course). There is no separation between male and female or by age. Bikes are placed in classes based on their frame, fuel and motor size.

Team Klock Werks came home with more than just land speed records. The Team also won an award sponsored by www.landracing.com given to the team who has the cleanest and most organized area in the pits.

Team Klock Werks mentions that they feel so blessed to have the team that they have which includes all who were out on the salt with them and everyone taking care of things back home. Some teams travel to the salt for years and years and don?t come away with the number of successful passes and records that Team Klock Werks has. The salt was in great condition this year and the weather was amazing. The team did face mechanical challenges and some humbling experiences as most teams do, but is ALWAYS an event to remember.

Team Klock Werks would like to extend congratulations to High Country Harley Davidson of Frederick, Colorado and rider Kevin Edgmon for their true efforts with their Road Glide at the Bub Speed Trials this week. They got a record in their own class, MPS-PG 2000 if 143.409, and they were rockin the Klock Werks Flare Windshield, a product designed for downforce and born on the salt.

BAD COP REPORT, Ex-deputy charged with stealing tiny dog–PALATKA ? Authorities say a former Putnam County Sheriff?s deputy stole a teacup Chihuahua named Princess from a San Mateo pet store.

The pet shop owner told deputies that 39-year-old John Lee May had been wearing a heavy jacket in the store on Saturday and that another customer?s son saw May put the dog into his pocket. He was arrested Monday and charged with grand theft. He was later released on $1,004 bail.

A spokesman for the sheriff?s office says May had already been fired last week following an investigation into a domestic violence complaint involving his former girlfriend.

Before resigning, May had been a K-9 officer in the school resource unit.

The demand for these bars has been so overwhelming that Paul set out to find a way to make them for half the cost while maintaining all the quality that PYO products are known for. Well, we did it, and we are passing our fantastic new pricing on to you!

Each bar measures 7″ in rise from the center of the riser bar to the center of the grip area…. 9″ in total height. They are 11.5″ wide at the base and 32″ wide from tip to tip with a 6″ pullback. DOUGZ Pro-Tour ?X? featured on Torque TV– During the S&S Cycle 50th Anniversary the good folks at Torque TV were on hand interviewing various builders about the bikes they built for the competition. Saturday afternoon they spent a half-hour with Mark Platt and I going over the finer points of the Pro-Tour ?X?. While you?re surfing the net follow this link to Torque TV. http://www.torque.tv/?player=TorqueTV_27_copy&ct=1&ids=231136 You?ll find a video of the interview and a short segment of Mark and I collecting the ?People?s Choice? award. What an honor for the Pro-Tour ?X? to be chosen as the favorite bike of thousands of people who came to La Crosse in June and to be picked by Torque TV as one of their Top 20 bikes of the event!

I see a Pro-Tour ?S? in the future? As many of our ?regular? visitors know, we are in the early stages of another build dubbed the Pro-Tour ?S?. What we?re doing is creating a bike that will have many of the same characteristics of the Pro-Tour ?X? but we?re basing it on a Genuine Sportster chassis as our platform. We?ve dropped the seat area 3 ? inches to put you in a nice pocket (only 24.5 inches off the pavement!), stretched the swingarm 6 inches to give the bike ? inch MORE wheelbase than a full size dresser, added StreetGlide air shocks, built an oil tank that?s cradled between the swingarm horizontals and set the battery just above the oil tank.

What you end up with is a Lightweight, long-wheelbase, low center-of-gravity, drop seat Hot Rod with many attributes of a purebred Drag bike and it includes the racy yet functional fairing, the side covers that double as storage compartments, and of course our exclusive ?clamshell? rear fender/storage area that is found on the Pro-Tour ?X?. With a seat height 2 inches LOWER than a Standard Softail or Sportster ?Low? and a full 3 inches lower than a StreetGlide even a person with the shortest of inseams will sit comfortably flat-footed on this scoot. Plus the added benefit of being roughly 200 lbs. LIGHTER than a StreetGlide!

Keep checking the DOUGZ website as we?ll begin adding progress images real soon in the ?Custom Built Bikes? gallery.

BEMISDERFER WINS ASRA PRO THUNDERBIKE AT SUMMIT POINT– Buell Riders Win Eight CCS Sprint Races.

SUMMIT POINT, W.V. (September 7, 2008) ? Harley-Davidson/Buell of Frederick rider Bryan Bemisderfer rode a Buell XB12R to win the ASRA Pro Thunderbike National at the Summer?s End Cyclefest at Summit Point Motorsports Park. Deeley H-D/Buell Canada/Ruthless Racing rider David Estok finished second. BMW rider Nate Kern, who finished third, clinched the 2008 ASRA Pro Thunderbike championship with one race remaining on the schedule. Kern is the first rider to win the Pro Thunderbike title on a brand other than Buell.

It was the first Pro Thunderbike win since 2006 for Bemisderfer, who was the Pro Thunderbike champion in 2004.

?We turned our focus away from Thunderbike last season, and it?s taken a little while to get back up to speed in this series,? said Bemisderfer. ?We?ve also had a real string of bad luck, but the H-D/Buell of Frederick team never gave up and has put a lot of time and resources into this effort, so it?s really great to finally have it pay off with a win.?

Heavy rains from tropical storm Hanna on Saturday caused ASRA to compress the entire weekend racing schedule on Sunday, and riders were gridded for the start of the eight-lap Pro Thunderbike national on the basis of season points. Deeley H-D/Buell Canada/Ruthless Racing rider David Estok, the defending Pro Thunderbike champion, and Kern, the series points leader, started on the front row and jumped off to an early lead with Estok on the point. Bemisderfer caught and passed first Kern and then Estok on lap four, and then pulled away to take the win.

?At the last minute I decided we should race our long-stroke bike, so the team switched the set-up to that motorcycle,? said Bemisderfer. ?I got behind a few other bikes in the first few turns and Kern and Estok took off on a clear track, but I put my head down and caught them on lap two. Once I got by I thought they would be right behind me, but I was faster and able to pull away.?

On the final lap, Bemisderfer set a new Summit Point Thunderbike lap record of 1:16.507. Sound Waves/Hal?s Speed Shop team rider Joe Rozynski was fourth on a Buell XB12R, followed by Ray Price Harley-Davidson/Buell rider Carl Reid, also on a Buell. After seven of eight events on the 2008 ASRA Thunderbike schedule, Kern has clinched the title with 223 points. Estok is second with 162 points, Bison Racing/Eagle H-D/Buell rider Walt Sipp is third with 115 points, and Hal?s H-D/Buell/Hal?s Speed Shop rider Dan Bilansky is fourth with 110 points.

The final stop on the ASRA Pro Thunderbike schedule is the 25th Annual Race of Champions, Oct. 16-19, at Daytona International Speedway in Daytona Beach, Fla.

Buell Riders Win Eight CCS Sprint RacesBuell riders won eight MotoSport.com Championship Cup Series (CCS) sprint races at Summit Point Motorsports Park. Ray Price Harley-Davidson/Buell rider Carl Reid rode a Buell XB12R to win Amateur Lightweight Superbike, Amateur Lightweight Grand Prix, and Amateur Thunderbike. Classic Harley-Davidson/Buell rider Arthur Diaz won Expert Lightweight Grand Prix and Expert Lightweight F40. Bemisderfer won Expert Lightweight Superbike and Expert F40, and Estok won Expert Thunderbike.

MYRTLE BEACH CITY COUNCIL PASSES 15 ORDINANCE TO LIMIT BIKERS– MYRTLE BEACH, SC (WMBF) – Myrtle Beach City Council passed 15 city-wide ordinances that they hope will limit bike rallies. These ordinances will apply year-round, but are aimed to limit May’s bike rallies. The ordinances that were passed ranged from a 1 a.m. curfew for underage teenagers to requiring photo identification for anyone checking into a hotel or motel. Officials went as far as implementing a mandatory helmet law for anyone riding a motorcycle within city limits.

All of the ordinances passed unanimously with the exception of the helmet ordinances. It passed 5-1. Critics say forcing bikers to wear a helmet goes against state law, which allows any adult to decide whether or not to wear one.

The city, however, says it’s only an administrative infraction meant to improve the safety of people living in the city. Therefore, they say there’s no conflict with state law.

Myrtle beach

Today, business owners were worried about the new ordinances. They say that the ordinances could cripple their business.

“If the bike rallies go away, it could be the equivalent of a category five hurricane hitting Myrtle Beach for the month of May,” says Don Cauthen, who owns two restaurants in Myrtle Beach.

With the new ordinances, business that have to call the police more than twice in a six month period could face a maximum fine of up to 50 thousand dollars. They could even be forced to close by two a.m.

By Greg Argos

–from Rogue

What bullshit. Pull the rally completely. Bikernet is looking for a small town to buy. “I remember when Leon had a line on a town for only motorcycles,” Bandit said of a man who once ran Easyriders events. We need Motoville for motorcycles only. “I’d pass a law that all folks in cars had to wear helmets in our town,” Bandit said. “Sixty six percent of all transportation related head injuries are in cars, just 6 percent on bikes and 13 percent are pedestrian related.” We’re in search of Motoville.–Renegade

Chica is a strong family man who works long hours, currently by himself, building bikes, rebuilding engines and making his own line of wheels. He had 40 on order when we stumbled into his shop yesterday. Watch for the tech on Bikernet next week. He works from 9 in the morning until 10-11 at night.

“I have three girls in two schools apiece,” Chica said, “Then there’s piano lessons, sports, you name it.” But he’s already looking forward to the Badlands ride next year.

Let’s hit the news:

REMEMBERING, LESSONS, AND TIME SEVEN YEARS LATER– Smoke bellowed in the empty sky where the buildings once stood, as the gaspsand screams of those watching filled the 34th floor of this midtown officebuilding. Terror filled my heart and confusion erupted like searing moltenlava in my mind. Even though I knew what had happened, the idea was not aneasy one to wrap my head around. Radio’s came out of desks and the need tohear what was going on surpassed all other emotions. For me it was just tooincomprehensible. Never in my protected and sheltered life had I experiencedsuch terror, confusion and doubt.

The Pentagon, the World Trade Centers, another plane, flights grounded, jetsover the city; and sobs, sirens, and silence filled the streets of New YorkCity. Unthinkable?

We wandered around the office for hours seeking each others’ comfort. I cried silently at my desk and called home to San Diego to let family know that I was ok. Friends and co-workers from one of the now fallen buildings filed in little by little as the marooned hours passed. They had escaped because they ignored the security order to stay put. Traumatized and confused they sought comfort here. Other co-workers perished in the fall. No comfort was to be found that day. All bridges, tunnels, trains, busses, and roads leading to and from Manhattan Island were closed. Those of us wholived outside the city were stranded. News came that the Ferries wererunning to take us off the island. Emotional zombies filed their way to theboats. We waited hours for our turn to cross the river to New Jersey. HazMat doctors screened us as we disembarked. Still dazed we walked several miles to where my Middle Eastern co-worker’s wife and kids picked us up.They took me home?

Alone at home, I called local friends. Although there was some semblance of comfort we found in each other, nothing could ease the indescribable emotional state that we shared. To those who knew people in the city, it was a frantic role call of friends and family.

I don’t remember how many days I stayed home, a couple I guess. That time is a blur of confusion and realizations. The city was silent; taxi filled streets that customarily honked at theslightest traffic infractions, were quiet. For two-weeks after, when I hearda siren, I hoped it was because they found somebody alive underneath the steal and concrete tomb that was the World Trade Centers. Even though I knew that was a futile hope.

New York parks soon sprang up with memorials, candles, healing gardens of love, support, and throngs of people; brought together to somehow make sense of it all. There was a strong call to peace as the terror soon turned to rage and revenge for many across the country.

I was lost in my own ignorance?

One night as I was making my way through Union Square Park, a healing labyrinth of remembrances, messages, grief and pleas to find missing loved ones. I came upon a scene that planted something deep in my psyche. With no judgment (as this is not a time to judge) I will share my experience.

I was ending my walk through the memorial web and ready to exit the park. There, standing a few inches higher than those of us on the ground, stood a man with a sign. The sign just read “Peace”. Inches from his face was a very angry citizen, appalled that in the face of such a devastating and disastrous attack this man could call for peace. The angry man screamed into the face of the man with the sign. I watched as the chasm between me and the scene grew smaller. I saw two Americans. One man, screaming in the face of another; directing his indignation of such a ludicrous and dangerous ideal such as peace, the other man, non-reactive, silent, motionless, and with a soft expression on his face. I watched in amazement as I went by. Then as I was looking back at the scene the man with the sign, smiled at me and winked. I was moved to tears. Here, in the wake of such confusion and pain were two America loving citizens expressing their belief. One, justifiably angry, expressing his deep felt sentiments and frustration with the loss.

The other stood practicing his conviction of peace, allowing the verbalassault without moving to stop the onslaught. Neither man yielding to thestubborn position of the other. In turn, perhaps without realizing it, eachman giving the other the opportunity to convey and practice in their ownmeaningful way his own belief and contributing somehow to each others’healing.I must quote a song by JohnMellencamp “Now ain’t that America?”

Who am I but an insignificant ripple in this placid lake of life? I cannotjudge those around me, as my own internal truth is often in question and in reality merely my own interpretation of a moment in time. The best I can do for myself and perhaps those I meet along the way, is possibly to stay true to my own convictions, my own heart’s direction, my own truth, as insignificant as these may be in a bigger picture. Maybe this is the best I can give humanity along with a tangible helping hand in a timely manner.Just don’t forget 9-11

Most Critical Court Case In Motorcycle History

19ga

There is important constitutional helmet law litigation, originally brought by Richard Quigley that requires your support for it to succeed. It is set for trial in May 2008 in the same California courthouse where Quigley obtained the judicial opinion that the California helmet law was unconstitutionally vague as applied. The present litigation, if successful, will build on that victory now to defeat the California helmet law on the same constitutional due process grounds. We anticipate, furthermore, that the appellate decision resulting from the case will also assist freedom fighters across the nation to defeat their helmet laws.

The purpose of this correspondence is to request your help to properly fund the trial. We urge you to pass the hat, dig deep, and send your checks to: “Judicial Fund” c/o Abate of California, 10240 Seventh Avenue, Hesperia, CA 92345.

True to the tradition of the small but great state of Delaware, the first state to ratify the United States Constitution, the three Delaware ABATE Chapters have announced that they will be the first to stand to defend the constitution, specifically by doing their part to assure that this important constitutional litigation prevails. These three small Delaware ABATE Chapters have made an $8,000 contribution to this Judicial Fund set up as the war chest for the Quigley litigation. The contribution represents $8.00 from each Delaware ABATE member. In announcing the donation, Delaware ABATE State Legislative Coordinator, Gary K. (Hildy) Hilderbrand stated:

“We are releasing this announcement as a challenge to all SMROs in every state in the nation to match what our little State has done. ABATE of Delaware is proud to represent the State that started this nation, and first on board with the desperately needed funds to maintain our freedom.”

12a

We are writing to urge all SMROs across this nation to come together, and follow Delaware's lead, to assure that this important constitutional litigation prevails. We also want you to know that the success we achieve will not just free California bikers from the shackles of our oppressive helmet law; it will set the precedent that we hope will assure that every other state can obtain or preserve freedom.

The legislative helmet wars have entered an entirely new battlefield on which SMROs now face not only the insurance industry and medical lobbyists but the federal government now wearing the face of the National Transportation Safety Board. The September 2007 NTSB recommendations and the reinvigorated helmet law proponent activity nationwide should cause rights advocates in every state to consider whether it will be realistic to expect with any certainty that freedom can be achieved against these even greater powers lining up against us, and indeed, whether the SMROs in the free and semi-free states will be able to hold on to their freedom.

The NTSB has made a specific recommendation to every state, and that is to adopt or amend the state helmet laws to require that ALL riders wear helmets conforming to the federal motorcycle helmet performance standard set forth in FMVSS 218. This already has happened in Nebraska and North Carolina.

The importance of the Quigley California litigation is in part derived from the fact that the California helmet law is precisely the law that the NTSB has recommended. It is a law requiring all California motorcyclists and their passengers to wear helmets compliant with FMVSS 218.

The present litigation is the culmination of 17 years of concerted work by Richard Quigley and California freedom fighters like Steve Bianco, the truck driver responsible for the constitutional appellate law which has set the CHP up for this fall. Steve Bianco is also one of the four remaining plaintiffs in the Quigley litigation who will carry this litigation forward now following Quig's passing.

If successful, our victory will hammer the final constitutional nail into the coffin of the California helmet law. It is 17 years of work which we also hope may be able to shortcut the road to freedom for those who will fight for it in the courts of our sister states. Indeed, it is our greatest hope that our victory will serve as important constitutional precedent for freedom fighters to obtain the same result in every state in which a helmet law presently requires use of FMVSS 218 compliant helmets, and every other state in which such a law is subsequently enacted pursuant to the NTSB's recommendations.

Thank you for your consideration in the above regard.

In freedom and brotherhood,

History of the California Litigation

For you to have a satisfactory explanation as to why this California litigation will benefit your efforts to obtain or preserve freedom in your state requires a discussion of the constitutional principles we are working to vindicate, as well as a few highlights from the history of the California litigation. With that foundation we hope that you will appreciate that this is the same long road that the freedom fighters would be required to ride out in other states if we fail to achieve the landmark victory here.

First the overview: We would hope that after our present case is decided in the California Court of Appeals that freedom fighters in other states will be able to use our result as precedent to persuade your courts to find your helmet laws unconstitutionally vague “as written.” That is the quickest way to knock out a helmet law. In the absence of our victory in the California litigation, however, your Courts might determine to “reinterpret” the law to conform to constitutional requisites, just as the California courts did 17 years ago. What our present litigation will establish is that the law can't be reinterpreted to meet constitutional principles without rendering the law as a practical matter incapable of being constitutionally enforced.

Yes, the result in this case will be California case law, not the case law of your state. But wherever a trial court or appellate court in any state considers an “issue of first impression,” meaning an issue which has not yet been decided by the higher courts of the state, the courts will consider the case law of the other states which have faced and decided the issues. And on this pivotal issue whether an FMVSS 218 based helmet law can be successfully reinterpreted to meet constitutional requisites, the result in the present California case will be a resounding “No,” and it will be the only case providing precedent.

38

For those who would like to understand more fully why this California litigation is important for the freedom cause in every state in our Union, we will provide the briefest possible discussion below, while still attempting to do justice to the constitutional principles and just the few main cases which have led us now to rise above our helmet law's coffin with our hammer and the last nail poised to put the law where it belongs – firmly planted six feet under. At the same time we would hope to provide you some appreciation for our long battle that we would hope will shortcut yours.

In California, we started, as you will, with the attempt to void our helmet law on the grounds that the legislation was unconstitutionally vague “as written.” The appellate courts chose instead to reinterpret the helmet law to cure the facial constitutional defect. What our work of the past 17 years has successfully accomplished is to lay the legal and evidentiary framework now to demonstrate that it is not an option to reinterpret the law, because it can only yield a law which cannot be “enforced” constitutionally.

The initial case brought to challenge the constitutionality of the California helmet law was Buhl v. Hannigan. The main premise of the argument made in Buhl would be the same that would apply in any state in which a helmet statute incorporating FVMSS 218 was enacted. Stated simply, the argument was that neither the bikers nor the cops can possibly understand or apply the technical helmet performance protocol set forth in FMVSS 218; the bikers are thus deprived of the opportunity to conform to this law that they can't understand; and the cops are left to make entirely subjective decisions whether any particular helmets would comply, lending to law enforcement which is entirely arbitrary and potentially discriminatory. This is the definition of an unconstitutionally vague law, prohibited by the due process clause of the United States Constitution.

38-1

As set forth by the United States Supreme Court:

“It is a basic principle of due process that an enactment is void for vagueness if its prohibitions are not clearly defined. Vague laws offend several important values. First, because we assume that man is free to steer between lawful and unlawful conduct, we insist that laws give the person of ordinary intelligence a reasonable opportunity to know what is prohibited, so that he may act accordingly. Vague laws may trap the innocent by not providing fair warning. Second, if arbitrary and discriminatory enforcement is to be prevented, laws must provide explicit standards for those who apply them. A vague law impermissibly delegates basic policy matters to policemen, judges, and juries for resolution on an ad hoc and subjective basis with the attendant dangers of arbitrary and discriminatory application.” Grayned v. City of Rockford, 408 U.S. 104, 108 (1971).

In Buhl, our California Court of Appeals immediately recognized that it would be “absurd” to posit that the consumer, meaning the biker, or the law enforcement officer, would be able to understand or apply FMVSS 218. It was specifically the holding of the Buhl court that neither the bikers nor the cops could possibly assess whether a helmet meets the federal performance standard based upon examination of a helmet's “fabrication.” However, the Buhl Court took it upon itself to “reinterpret” the California helmet law so as not to be facially vague by redefining the legislature's reference to FMVSS 218 to mean only that the helmet bear the manufacturer's “DOT” certification of compliance.

With the CHP's hands first tied in Buhl to preclude officer assessment of helmet fabrication as a basis for issuing a ticket, the hands of law enforcement were next tied with even greater restrictions in Bianco v. CHP, again on the same constitutional due process grounds. The Court in Bianco held that the presence of a manufacturer's “DOT” certification will create the “presumption” that the helmet meets FMVSS 218 specifications, a presumption which can be rebutted only if: (1) the helmet model was recalled by the manufacturer for the helmet's failure to comply with FMVSS 218 or if NHTSA or one of its contracting independent laboratories has determined that the helmet is noncompliant with FMVSS 218; AND (2) the biker has “actual knowledge” of the recall or determination of noncompliance.

It is important to recognize that these decisions reinterpreting the California helmet law to meet due process requisites were not arbitrary. They were the only means available to the California courts or any other court to attempt to reconcile a legislature's adoption of a helmet law incorporating FMVSS 218 to avoid the conclusion that the law is incapable of being understood, and hence unconstitutionally vague as written. This is because the only ones with the equipment and the engineers to test motorcycle helmets are the manufacturers, NHTSA and NHTSA's contracting independent laboratories.

What is equally important to recognize is that once reinterpreted – in the only way that an FMVSS 218 based law could be reinterpreted – the law was rendered so impossible to apply that the CHP could not enforce the law legally. Quigley was fond of wearing a fabric trucker's cap with the manufacturer's “DOT” certification of compliance embroidered on the back. This was clearly legal under the California law set forth in Bianco, the manufacturer never having recalled the helmet and NHTSA having never tested it to determine if it complied with FMVSS 218. Others manufactured and certified their own helmets. Still others wore teeny weenie beanie helmets. One of the Plaintiffs in the current litigation wore sunglasses with the letters DOT scratched into the frame. Recall that Buhl holds that helmet “fabrication” cannot be considered by the law enforcement officer in determining to cite a biker, and the “DOT” label gives rise to the presumption that the helmet complies with FMVSS 218.

Instead of recognizing the fact that the California appellate courts reinterpretation of the helmet law rendered the law's enforcement impossible, the CHP chose to violate the law set forth in Buhl and Bianco. The CHP did not alter its policy or the practice of its officers, who just kept on writing helmet tickets based upon their unqualified fabrication conclusions.

The evidence of the CHP's unaltered and now illegal helmet law enforcement practices was first brought to the attention of the United States District Court in Easyriders v. Hannigan: consultation by Richard Quigley and Steve Bianco with attorney of record, Skip Raring. The District Court wrote scathing factual findings indicting the CHP's helmet law enforcement practices, which were adopted by the United States Court of Appeals for the Ninth Circuit as the basis for its affirming that portion of the District Court's decision to issue an injunction against further illegal CHP helmet law enforcement.

Based now on the 4th and 14th Amendments to the United States Constitution, the United States Court of Appeals affirmed the District Court's injunction requiring the CHP to cease and desist issuing helmet citations unless the CHP officer has “probable cause” to believe that the biker has “actual knowledge” that his helmet has been “recalled” by the manufacturer or “determined by NHTSA to be noncompliant with FMVSS 218.”

But again, instead of laying down their citation books, the CHP once more chose continue with their illegal enforcement practices, now not only in violation of the California law of Buhl and Bianco, but now also in violation of the Easyriders federal injunction.

Ten years to the day following the decision in Easyriders Richard Quigley obtained his decision from the California Superior Court that the California helmet law was unconstitutionally vague “as applied.” And that is the application of the due process clause, recognizing the unconstitutionality of our CHP's circumvention of the essential constitutional limits on its authority to enforce the law that we expect will finally lay our helmet law to rest.

Unfortunately, the California Attorney General was less concerned with upholding the United States and California Constitutions than he was with preserving the CHP's ability to continue to illegally enforce our helmet law. The Attorney General declined to appeal the Quigley decision. The effect was that it was left intact, but only as it applied to Quig. It was thus deprived of its deserved force of precedent both here in California and nationally. The reason for that is that attorneys are prohibited to cite to opinions of trial courts; indeed, they are permitted only to cite to the published appellate court opinions.

The present injunction/declaratory relief action awaiting trial in the Santa Cruz Superior Court seeks to vindicate the same constitutional principles urged by Richard Quigley, and which resulted in the previous judicial determination that the helmet law is unconstitutionally vague “as applied.”

It will be based upon the same evidence that Quigley presented in his case. The evidence will be that the CHP has a policy and practice to cite bikers based upon the officer's incompetent assessments of qualities of helmet fabrication, most of the tickets also issued on the legally indefensible grounds that the helmets were “not DOT approved.”

Quig will testify by video deposition, obtained prior to his death. The case will involve, in addition, the testimony of the other four plaintiffs, Steve Bianco, Steve “Red” Barron, Don Blanscet and Pat Holmes, who will carry the litigation forward in Quig's absence, as well as the testimony of many other bikers who have been issued illegal helmet tickets.

The case will be bolstered by CHP internal documents evidencing the CHP's policies contravening the clear dictates of Buhl, Bianco and Easyriders. It is our intention to demonstrate again that the CHP's policy and practice is to illegally enforce the law. This time, however, the Attorney General will not be able to avoid the result simply by failing to appeal it.

001
Let's ride free once more.

The previous Quigley v. CHP was a case involving a number of helmet citations which were consolidated for the trial contesting their constitutional validity. The result, while accompanied by the wonderful judicial opinion that the helmet law was unconstitutionally vague, resulted only in the dismissal of the Quigley citations. This was a decision that the Attorney General could afford to let stand as a trial court ruling.

The present case, however, was conceived by Quig to preclude the Attorney General from avoiding its implications simply by choosing not to appeal it. It is a case which we hope will result in both a declaration from the trial court that the California helmet law is unconstitutionally vague as applied, and an injunction that would finally require the CHP either to entirely revamp its enforcement policies or cease and desist further enforcing the law altogether.

Whether the Court rules in our favor or against us in the trial court, one thing is certain this time, and that is that we will be able to present our record of the CHP's illegal enforcement policies and practices to the California Court of Appeals, where we are confident that the Judges will uphold the constitutional principles upon which our case is based. And we are also confident that the appellate courts will have no option but to void our helmet law, once and for all, based upon the recognition that it cannot be interpreted to conform to constitutional requisites and, as a practical matter, remain capable of being applied by law enforcement in a manner consistent with the constitutionally essential guarantees of due process.

With this result established, now to make full circle, we would hope that as the courts of other states consider the first constitutional challenges by your freedom fighters, asserting that helmet laws such as those proposed by NTSB are unconstitutional “as written,” that you may also cite to the new Quigley v. CHP decision for the proposition that these helmet laws cannot be reinterpreted with the expectation that they will be capable of constitutional enforcement. This is also why we would urge to you that our success in this litigation will aid you, specifically to save you the 17 years of hard work it has taken our freedom fighters to lay the constitutional and evidentiary foundation to place the “as applied” nail in our helmet law's coffin.

We ask you to stand with us at this historic moment at which our long fought efforts to advance the constitutional indictment of FMVSS 218 based helmet laws will be tested. This landmark case deserves to receive the most forceful trial presentation, and that can only be accomplished if we have a well funded war chest.

We ask you to consider the challenge of the three tiny Delaware ABATE Chapters to dig deep to help fund this litigation which they hope, as we do, will benefit all freedom fighters across the United States.

In Freedom,
–Ray Henke, Esq.

An Iowa woodpecker and an Arizona woodpecker were arguing about which state had the toughest trees– The Iowa woodpecker said Iowa had a tree that no woodpecker could peck. The Arizona woodpecker accepted his challenge and promptly pecked a hole in the tree with no problem. The Iowa woodpecker was amazed.

The Arizona woodpecker then challenged the Iowa woodpecker to peck a tree in Arizona that was absolutely im-peckable (a term woodpeckers like to use). The Iowa woodpecker expressed confidence, said he could do it and accepted the challenge. So the two flew to Arizona where the Iowa woodpecker successfully pecked the so-called impeckable tree with no problem.

Both woodpeckers were terribly confused. How is it that the Arizona woodpecker was able to peck the Iowa tree and the Iowa woodpecker was able to peck the Arizona tree, yet neither was able to peck the tree in their own state? Huh?

After much woodpecker pondering, they both came to the same conclusion: Apparently your pecker gets harder when you’re away from home

This unique testing team has journeyed to the Last Frontier, demonstrating the motivation to test the new Night Dragon on Canadian and American roads, further perfecting the product for the V-Twin market in North America.

Ice, the Rocky Mountains, the Great Lakes, deserts, cities; a demanding test of 17 stages will push the tires – the radial version – to the limit in all kinds of climates and road conditions of the United States and Canada, in line with the development philosophy of Pirelli’s Moto Business Unit. This run will conclude the testing process, releasing the product into the market for which it is designed and destined. The Night Dragon is the tire that Pirelli intends to conquer the North American V-twin market, by far the biggest street market and one that demands grip, style and performance.

Special equipment aboard these Harley-Davidson motorcycles will measure all the values of the tires? dynamics, gathering indispensable data for making the final touches to the product.

Accompanying the Pirelli team will be Alfredo Speranzoni, a doctor by profession, who has already been a fellow traveler with Pirelli Motorcycle Tire testers in the 2005 North Cape – Dakar event. It is his job to gather clinical data on the riders in relation to research already begun with the Faculty of Medicine of the University of Siena for the study of the relationship between hormones and positive stress.

On several motorcycle blogs and Internet websites, the most significant stages of this undertaking will be highlighted with photographs and feedback from the test riders during each period. In Canada, the Night Dragon Performance Tour will stop at Parts Canada, one of Pirelli’s Canadian distributors, and at Calgary Harley-Davidson, the largest Harley-Davidson store in western Canada. In the States, the tour will stop by the aftermath of Sturgis Bike Week by visiting Black Hills Harley-Davidson, then on to Hal’s Harley Davidson, who has participated in Moto-ST and Buell racing for years on Pirelli product.

The next two stops bring Salvo and his testing team to Janesville, WI, the home of Drag Specialties, Pirelli’s largest replacement customer in the United States. Harley-Davidson Motor Company in Milwaukee, WI follows, barely minutes after celebrating its 105th birthday party. Before the trip comes to an end, the test riders will arrive at Pirelli Tire’s headquarters in Rome, GA, where the company has an MIRS production line for automobile tires. And no transcontinental motorcycle tour is complete without a visit to Bruce Rossmeyer’s Destination Daytona, the largest Harley-Davidson dealership in North America.

Pirelli thanks and congratulates those who helped make the Performance Tour possible, including Barry Matteson, Frank Earwood and Mike Rink of Anchorage Harley-Davidson for selling and servicing the motorcycles. The test riders are using three 2008 Harley-Davidson Fat Boys for complete testing of the radial version of Night Dragon tires, and one 2008 Ultra Classic Electra Glide for feedback regarding the use of bias-ply tires with the Brembo ABS system featured on this model.

Sucker Punch Sally’s Takes Sturgis by Storm–SCOTTSDALE, ARIZ – September 3, 2008 – With two locations and almost their entire staff dispatched to Sturgis, Sucker Punch Sally’s showed that the motorcycle industry is anything but dead. The SPS crew had booths at both the Legendary Buffalo Chip and Thunder Road and was host to some of the hottest events in Sturgis.

SPS kicked off bike week with the launch of their newest venture – a beverage line. During the Kid Rock concert at the Legendary Buffalo Chip, SPS hosted a launch party to debut their Original Octane energy drink and Sucker Punch Shine, a refined version of moonshine that packs a punch at 120 proof. All the industry notables were present to get the first taste of the new drinks, and everyone had a great time.

By the end of the week, SPS had given away over 450 cases of Original Octane and over 20,000 people gave the drink their mark of approval. And to give fans another reason to stop by the SPS booth for free samples, the crew did what they do best – built a custom motorcycle. Fans registered to win the Original Octane bobber throughout bike week, and on Thursday, Arthur James, a huge SPS fan from Arizona, was randomly selected and announced live on stage as the proud owner of this signature custom.

At Thunder Road, Progressive Insurance teamed up with SPS to give away t-shirts and registered people to win a Progressive Insurance custom Sucker Punch Sally’s motorcycle. “This was the most successful motorcycle promotion that we have had to date and we look forward to doing a lot more with Sucker Punch Sally’s.” Said Amanda Jones of Progressive Insurance.

Sucker Punch Sally’s sold bikes alongside Destination Daytona at Thunder Road and unveiled another one of their latest customs, the SPS Hard Rock Bike hand painted by notable hot rod artist Sara Ray. SPS also posted record t-shirt sales at both of their booths, proving that fans just can’t get enough of SPS’s old-school style.

“Sturgis was a huge success for us this year,” said SPS President Christian Clayton. “The positive response to Original Octane and Sucker Punch Shine at the Legendary Buffalo Chip was great, and we’re excited to know that our fans will stand behind us as Sucker Punch branches out. Of course, our priority is still building old-school bikes people love to ride, but by adding new products to the SPS mix, we’ll be able to continue on our upward trend.”

In addition to getting the word out about their newest bikes and beverages, SPS also did some behind-the-scenes work. SPS sponsored the Legends Ride, and SPS front men Christian Clayton and Jeff Cochran joined in on the action cruising with other motorcyclists on the 50-mile ride through the “Hills of Dakota.” The SPS crew also built the Destination Duo bike, which was auctioned off for charity.

Sucker Punch Sally’s made their presence know at Sturgis 2008, and you can bet the crew is already working on more exciting things for next year’s rally. You can catch SPS in Dayton at The Doghouse Saloon on Mainstreet, out at Bruce Rossmeyer’s Destination Daytona and at Willie’s Tropical Tattoo.
