TRIAL UPDATE–Bryan Joseph ?B.J.? Mough was shot in the back Feb. 25, 2008 WATKINSVILLE – Jurors watched a video this morning of Richard Harold “Ricky” Gear, the Bogart man accused of gunning down a motorcyclist at the foot of his driveway, as Gear demonstrated that he stood back from the road when he fired the fatal shot.

Oconee County investigators secretly made the video the evening of Feb. 25, as they questioned Gear soon after he shot and killed Brian Joseph “B.J.” Mough of Winder.

In the video, Gear told deputies that a motorcyclist had followed his daughters home after he collided with their car, and that Mough drove past soon after his daughters car pulled into the driveway

“He whipped around and came right at me, like he was going to take me out,” Gear said in the video.

But when deputies asked Gear to return to the place where he fired at Mough, he positioned himself back from the roadway, with a culvert and mailbox between himself and the biker?s path.

“He was right there, like where the mail-lady comes through,” Gear said in the video.

In testimony Wednesday, Oconee County Sheriff Scott Berry told jurors that Gear told investigators he acted in self-defense, but the sheriff ordered Gear arrested after he saw that Mough was shot in the back.

Gear told Berry at the schooting scene that he fired only once at Mough as the biker came toward him while he stood on his own property, the sheriff said.

But when Berry examined the victim at Athens Regional Medical Center, he and a coroner concluded that Mough was shot from behind.

“As I looked at the body of Bryan Mough in the hospital, I didn’t see how that was possible” that Mough was shot as he drove at Gear, the sheriff told jurors.

“We were satisfied the (bullet) came from the right rear,” he said.

Berry took the stand at the end of a full day of testimony from law enforcement officers and emergency medical workers.

Earlier, Deputy William “Ken” Elrod told jurors he was the first to arrive at the shooting scene, and he knew from his experience as a combat medic that Mough would not survive.

“He took two deep breaths and that was pretty much it,” Elrod told jurors.

Authorities allege Gear shot Mough as he drove past Gear’s home outside of Bogart, but Gear has claimed he acted in self-defense after Mough harassed his daughters as they drove along Atlanta Highway, then followed them home and tried to run him down.

A grand jury indicted Gear on charges of malice murder, felony murder, aggravated assault and three counts of possession of a firearm in the commission of a crime. Jurors watched video footage Wednesday that sheriff’s investigators taped with a camera disguised as a flashlight as Berry questioned sisters Chelsea and Samantha Gear about events that led to Mough’s death. Chelsea Gear was animated and called Mough a “jackass” and “douche bag” because of the way he drove. The 21-year-old told Berry in the video that as she and her sister left Target in Athens, Mough’s motorcycle passed close to her car in the same turn lane while traffic pulled onto Atlanta Highway. “He was in my lane,” she said. Mough was in front of the Gear sisters’ car most of the way as they traveled west, but at some point, the car got ahead of the motorcycle. Chelsea Gear complained in the video that Mough followed closely behind her, and as the two westbound lanes of Atlanta Highway narrowed to a single lane at the junction of Monroe Highway near the Pepsi plant, Mough passed her on the left side, in the turn lane. When she reached Burson Avenue, where Mough was stopped for a red light, she made an obscene hand gesture as she turned right into downtown Bogart, Chelsea Gear said in the taped interview.

Instead of continuing on Atlanta Highway toward his home in Winder, Mough followed the sisters’ car and at a stop sign “slammed into the side of (the) car and knocked the sideview mirror out of whack,” Chelsea Gear said in the interview.

About that time, 18-year-old Samantha Gear called her mother to say a man was following them, and Dianna Gear said to her husband, “Rick, get your gun and c’mon,” prosecutor Ken Mauldin told jurors Tuesday, the first day of testimony.

The sisters already had returned home, and Chelsea Gear was inside when Mough drove by, Mauldin told jurors. Richard Gear walked about halfway down his driveway and fired twice at the passing motorcyclist, Mauldin said.

Mough turned around and made a second pass, and Gear fired the third and fatal shot from his .40-caliber semiautomatic pistol, said Mauldin, district attorney for the Western Judicial Circuit.

Gear told Berry that he heard the crunching of gravel between the road and his yard as Mough drove at him, the sheriff said, but investigators found no tire tracks in the gravel to back up Gear’s recollection.

The trial is expected to last at least through Friday, and possibly into early next week.

Gear, his wife and both daughters are slated to testify.

BIKERNET READER SPOTS EAGLE–A couple of weeks ago I was going to Winchester, VA and saw a huge eagle sitting on a fence post along the side of the road. This weekend I had to go back, so I took the backroads and decided to take my camera along in case I got lucky and saw him again. Well, I got lucky. As I was cruising up a gravel road I saw an eagle sitting on a deer carcass about 100 yds off in a field. I stopped the truck and took a few pictures using my telephoto lens. I took this shot through the passenger window of my truck. I tried to get a little closer, but as soon as I got out of the truck and crunched through some dried leaves, he looked up at me and took off. Another eagle joined him in flight.

The only bad thing about it is whoever shot the deer obviously took the head for a trophy and left the carcass. That seems like a real waste, but I couldn’t get over how big this bird was. Take a look at how the eagle’s body size compares to the deer’s body size and that’ll give you an idea.

PRICE FIXING FINES– Japan-based Sharp Corp., South Korean-based LG Display Co, Ltd., and Taiwan-based Chunghwa Picture Tubes Ltd. were recently found guilty of ?conspiring to drive up the price of LCD panels? forcing consumers ?to pay more for these products? according to the Justice Department. LG Display agreed to pay a $400 million fine, Sharp agree to fork over $120 million and Chunhwa consented to a $65 million fine for fixing prices to gain prominence in the $70 billion worldwide LCD screen market.

But how does buying American enter into the picture since most of the electronic devices that use LCD screens are made outside of the United States anyway? The answer is that we can still buy American by supporting U.S.-based companies even when their products are sourced from overseas.

WHO IS MORE DESERVING OF BIKER CHARITY THAN OUR OWN?–Fellow Riders and Freedom Fighters: Across our nation and throughout the year, “bikers” are called upon to ride for this cause and donate to that charity. And now that the holidays are upon us, requests that we “open our hearts and wallets” will be pervasive.

That’s all well and good. Those of us with something extra should be willing to help those who are truly needy and deserving. But being “needy and deserving” should not be the only test a charity has to pass to get a bucket of biker bucks. We must also consider where the money will actually go, and how it will ultimately be used. Before we let those eagles fly, we need to know whether the net result will be complementary … or counterproductive.

What I Mean By “Counterproductive” Let’s say, for example, your SMRO is asked to sponsor a poker run to raise money to fight some nasty-sounding disease or disorder. Who gets the money? The afflicted patients’ families, their doctors, the hospitals, or some physicians’ research institute? If the answer is “the families”, will it not then be applied to medical bills and insurance premiums? One way or the other, will not most or all of the money end up in the hands of doctors, healthcare firms or insurance companies? And will they not in turn spend at least some of what was OUR money to lobby against freedom of choice and other motorcyclists’ rights?

Everyday and everywhere motorcyclists–our brothers and sisters–are being injured, maimed, crippled and killed in accidents resulting from right-of-way violations (ROWVs) by care-less, negligent, distracted and impaired cagers:

And everyday and everywhere safetycrats … paid with OUR tax dollars and appointed by politicians elected with OUR contributions … ally themselves with healthcare and insurance lobbyists bankrolled by OUR premium payments and OUR charitable donations to condemn motorcyclists for the “social costs” of all this carnage … unjustly and unacceptably blaming the victims for the crimes. Must we continue to donate the dollars directed to deride and defeat us?!?

What I Mean By “Complementary”

Bikers may like breasts, but we are NOT breasts. We do not have to feed the mouths that bite us. And we do not have to look outside of our tribe to find potential beneficiaries who are needy and deserving. According to NHTSA, nationwide last year 103,000 motorcyclists were injured and 5,154 were killed in traffic accidents:

That’s more than 108,000 biker households who suffered loss of income, limb or life, incurring catastrophic medical costs and other expenses to boot. And I ask you:

WHO IS MORE DESERVING OF BIKER CHARITY THAN OUR OWN?

This holiday season, please remember the brothers and sisters in your area who went down, and do what you can to make sure their families have something under the tree. Even a small gift from you could mean the world to them.

Pharmaceutical Commercials–I’m tired of Prescription ads that are forced to list all the downsides. The law or regulation is discriminatory. Why aren’t there warnings with car ads, like SUVs tip over if braking in a severe turns.
