D.C. GUN BAN PROPONENTS IGNORE THE FACTSFor gun control proponents and opponents a lot is riding on a former security guard for the Supreme Court Annex. Next Tuesday, the Supreme Court will hear arguments over whether the District of Columbia’s ban on handguns and its requirement that any rifles or shotguns remain locked violates the plaintiff, Dick Heller’s, constitutional rights.
Whatever the court decides, no one expects them to end gun control any more than the First Amendment’s “congress shall make no laws” has prevented the passage of campaign finance regulations. The decision is likely to be limited to just whether a ban “infringed” on “the right of the people to keep and bear arms.”
If the D.C. ban is accepted by the court, it is hard to believe that any gun regulation will ever be struck down. If the court strikes it down, where the courts draw the line on what laws are considered “reasonable”regulations will take years to sort out.
Thus far the District of Columbia has spent a lot of time making a public policy case. Their argument in their brief to the court is pretty simple : “banning handguns saves lives.”
Yet, while it may seem obvious to many people that banning guns will save lives, that has not been D.C.’s experience.
The ban went into effect in early 1977, but since it started there is only one year (1985) when D.C.’s murder rate fell below what it was in 1976. But the murder rate also rose dramatically relative to other cities. In the 29 years we have data after the ban, D.C.’s murder rate ranked first or second among the largest 50 cities for 15 years. In another four years, it ranked fourth.
For Instance, D.C.’s murder rate fell 3.5 to 3 times more than Maryland and Virginia’s during the five years before the handgun ban went into effect in 1977, but rose 3.8 times more in the five years after it.
Was there something special about D.C. that kept the ban from working?Probably not, since bans have been causing crime to increase in other cities as well. D.C. cites the Chicago ban to support its own. Yet, before Chicago’s ban in 1982, its murder rate, which was falling from 27 to 22 per 100,000 in the five years, suddenly stopped falling and rose slightly to 23 per 100,000 in the five years afterwards.
Neither have bans worked in other countries. Gun crime in England and Wales increased 340 percent in the seven years since their 1998 ban.Ireland banned handguns and center fire rifles in 1972 and murder rates soared – the post-ban murder rate average has been 144 percent higher than pre-ban.
How could this be? D.C. officials say that the ban will disarm criminals. But who follows a ban and turns their guns in? Criminals who would be facing long prison sentences anyway if they were caught in a crime, or typically law-abiding citizens? By disarming normal people, a gun ban actually makes crime easier to commit.
Unfortunately, the Department of Justice has actually sided with D.C. in important parts of the case, and the court has granted Solicitor General Paul Clement 15 minutes to make his argument. While largely paying lip service to the Second Amendment being an “individual right,” the Department of Justice brief argues that an “unquestionable threat to public safety” from unregulated guns requires a lower standard must be adopted in defending it than is used to defend the rest of the Bill of Rights. But if they really believed that their evidence showed this, just as with the classic exception for the First Amendment of “falsely shouting fire in a theater,” it wouldn’t be necessary to treat the Second Amendment differently .
But what has not gotten much attention is that for the first time in U.S. history an administration has provided conflicting briefs to the Supreme Court. Vice President Dick Cheney has put forward his own brief arguing that the Second Amendment guarantees an individual right that is no different than freedom of speech.
The DOJ constitutional argument is similar to that of D.C. It argues that since the government bans machine guns, it should also be able to ban handguns. And they claim that D.C. residents still retain a right to self-defense because the city doesn’t ban locked shotguns and rifles.Locks, they claim , “can properly be interpreted” as not interfering with using guns for self-protection.
Factual errors underlie the rest of the argument – for in D.C., rifles and shotguns become illegal as soon as they are unlocked. That means the city can prosecute anyone who uses one in self-defense, even if it was locked before the incident. Is that a “reasonable” restriction on self-defense? Gunlock requirements are also associated with more deaths and more violent crime as they make defensive gun uses more difficult.Machine guns are also not banned .
It makes sense that the DOJ is backing the ban, given that it would lose regulatory power if it were struck down. As the DOJ lawyers note in the brief, striking down this ban could “cast doubt on the constitutionality of existing federal legislation.”
The Department of Justice and D.C. politicians can talk all they want about how necessary handgun bans are to ensure public safety and the “reasonableness” of the restrictions. But hopefully the Supreme Court will see past that. At some point, hard facts must matter. This is one point where public safety and individual rights coincide.

BIKERNET ALWAYS IN DOUBT–Charles, the Frenchman, was leaving his Parisian home for two weeks and confided in his friend, Pierre, “I always hate leaving my wife for so long like this. When I’m away, I just don’t know what she is doing. There’s always the doubt, always the doubt.”
Pierre said, “Charles, I’ll tell you what. Because we’re such close friends, I’ll keep an eye on her every evening that you’re gone.”
“You would do that for me, Pierre?” Charles said, relieved.”Oh thank you so very much. I know I really should trust my wife, but it’s just that there’s always the doubt, always the doubt.”
So Charles went off on his business trip and returned to Paris two weeks later. The two men met again.
“Charles, I’m afraid I have bad news for you,” Pierre said.”The very first night you were gone, I watched this man go to your house. Your wife opened the door naked and kissed and hugged him. He fondled her breasts. He rubbed her need I say more…? They then closed the door to go upstairs. Never daunted, I climbed up the tree outside your house and watched them in the bedroom.”
“And so…?” inquired Charles.
“Well, first they took off all his clothes.”
“What happened then?” asked Charles.”Then,” Pierre shook his head sorrowfully, “then they closed the curtains. I could see nothing. I could learn nothing more.”
Charles sighed a deep sigh. “So you see how it is, my friend? Always the doubt, always the doubt.”

RIDER’S EDGE, THE HARLEY-DAVIDSON ACADEMY OF MOTORCYCLING, MOVES INTO CALIFORNIA– Three Dealerships Set To Offer Rider Training Course.
MILWAUKEE (March 11, 2008) – In a continuing effort to teach the fundamentals of and instill a greater appreciation for motorcycle riding, Harley-Davidson is expanding its successful rider training program into California. Select California Harley-Davidson dealerships are now offering the Rider’s Edge New Rider Course premier motorcycle training program where students have opportunities to interact with dealership staff and draw from a network of experienced motorcyclists. Additional dealerships are preparing to launch their program within the month.
The Rider’s Edge New Rider Course California premier program is based on the proven curriculum of the Motorcycle Safety Foundation’s (MSF) Basic RiderCourseSM, while offering additions that provide longer classroom and range time.
“With Harley-Davidson, becoming a rider is first and foremost about motorcycle safety, but it’s also about a rite of passage; an experience you’ll never forget,” said Julie Chichlowski, director of Rider Services. “That’s exactly what we bring to our Rider’s Edge New Rider Course and what we’re excited to bring to the state of California. Rider’s Edge is about learning, discovering and bonding – everything a new riding experience should be.”
The first Harley-Davidson dealerships in California to offer the Rider’s Edge New Rider Course premier program are Orange County Harley-Davidson in Irvine and Antelope Valley Harley-Davidson in Lancaster. Harley-Davidson anticipates more California dealerships will add the Rider’s Edge New Rider Course program to their dealer services by year’s end. Beyond additional classroom activities over the MSF course, The Rider’s Edge New Rider Course California program includes a group riding component and a Riding Straight module that focuses on the impact of alcohol and riding where students can experience simulations using Fatal Vision Goggles.
According to Chichlowski, an essential component of the Harley-Davidson Rider’s Edge programs is the expert instructors. “Our Rider’s Edge Instructors are passionate about riding and passionate about teaching people the safety skills needed to do so.”
Classroom and skills training are held onsite at participating Harley-Davison dealers. The cost and course schedule vary by dealership, but the New Rider Course program typically can be completed in an extended weekend and outside of standard work hours. To be eligible, students must have a valid driver’s license, learners permit or certificate showing completion of the classroom portion of driver’s education. For those under 18, a waiver must be signed by a parent or guardian.
Upon successful completion of the course, graduates receive a California motorcycle license waiver, relinquishing the riding test given by the Department of Motor Vehicles (DMV) and qualifying riders for insurance premium discounts with some motorcycle insurers.
“One distinct advantage of the Rider’s Edge New Rider Course is that feeling of being part of something bigger,” said Chichlowski. “Rider’s Edge teaches the skills necessary to ride a motorcycle but in an environment that is pure Harley-Davidson.”
Harley-Davidson established the Rider’s Edge New Rider Course in 2000. Since then, the program has grown to include 41 states and 176 dealerships. In 2007, Rider’s Edge celebrated the training of its 100,000th student. He was 68. Buttera died March 2 of complications from brain cancer at Los Alamitos Medical Center, said his friend Kevin Bell.Don Prudhomme, a drag-racing legend who won several national events in a Buttera-built car, told The Times, “You couldn’t help but admire him. He was the best. Not only was he an innovator, he just did things that other chassis builders didn’t do.” Prudhomme recalled how “this guy from Wisconsin” showed up in California — the hotbed of racing — with a car he built for Mickey Thompson that was “the coolest thing I’d ever seen.” The engineering and craftsmanship were unmatched, said Prudhomme, who still owns one of the Buttera cars he drove — a 1972 Mattel Hot Wheels Plymouth Barracuda. “Everybody we raced wanted to see the Buttera car,” he said. “Guys lined up at his door to get one.” Buttera is credited with being the first to carve customized racing car parts out of aluminum blocks known as billets, an engineering leap that helped him create sleeker, lighter hot rods. A craze for billet parts took off in the 1980s and is still evident in racing today. The first billet part Buttera fabricated was a rearview mirror he made for a friend, influential hot rod designer Boyd Coddington, who died Feb. 27, four days before Buttera. Buttera said the most exciting thing he ever did was build a car that raced in 1982 at the Indianapolis 500. “The first time I saw my car come out of Turn Four at Indianapolis . . . I had goose bumps all over me. I couldn’t talk; I was crying,” Buttera told the Orange County Register in 1995. Dennis Firestone drove it to a 27th-place finish. Buttera, born in 1939 in Kenosha, Wis., began building dragsters there. A chance meeting with racing’s Thompson led to his 1968 move to California. More recently, Buttera did extensive development work for Harley-Davidson motorcycles. In 2004, he returned to building hot rods out of his Los Alamitos garage. “He had a gruff exterior but a very kind demeanor once you got to know him,” Fanshaw said. “You just had to get through that outer wall.” Buttera is survived by his son, Chris, daughter, Leigh, and two grandchildren. –Valerie Nelson, LA Times. THE BIKERNET SEX EDUCATION SEMINAR– There was this little boy about 12 years old walking down the sidewalk, dragging a flattened frog on a string behind him. He came up to the doorstep of a house of ill repute and knocked on the door. When the Madam answered it, she saw the little boy and asked what he wanted. He said, “I want to have sex with one of the women inside. I have the money to buy it, and I’m not leaving until I get it.” The Madam figured, why not, so she told him to come in. Once in, she told him to pick any of the girls he liked. He asked, “Do any of the girls have any diseases?” Of course the Madam said no. He said, “I heard all the men talking about having to get shots after making love with Amber. THAT’S the girl I want.” Since the little boy was so adamant and had the money to pay for it, the Madam told him to go to the first room on the right. He headed down the hall, dragging the squashed frog behind him. Ten minutes later he came back, still dragging the frog, paid the Madam, and headed out the door. The Madam stopped him and asked, “Why did you pick the only girl in the place with a disease?” He said, “Well, if you must know, tonight when I get home, my parents are going out to a restaurant to eat, leaving me at home with a baby-sitter. After they leave, my baby-sitter will have sex with me because she just happens to be very fond of cute little boys. She will then get the disease that I just caught. When Mom and Dad get back, Dad will take the baby-sitter home. On the way, he’ll jump the baby-sitter’s bones, and he’ll catch the disease. Then when Dad gets home from the baby-sitter’s, he and Mom will go to bed and have sex, and Mom will catch it. In the morning when Dad goes to work, the Milkman will deliver the milk, have a quickie with Mom and catch the disease, and HE’S the son-o f-a-bitch who ran over my FROG.” –from Chris T.
