BIKERNET BLACK HILLS RALLY LEGAL ADVICE, WHAT TO DO IF YOUR STOPPED BY POLICE– Be polite and respectful. Never badmouth a police officer. Stay calm and in control of your words, body language and emotions.
Don’t get into an argument with the police.
Remember, anything you say or do can be used against you.
Keep your hands where the police can see them.
Don’t run. Don’t touch any police officer.
Don’t resist, even if you believe you are innocent.
Don’t complain on the scene or tell the police they’re wrong or that you’re going to file a complaint.
Do not make any statements regarding the incident.
Ask for a lawyer immediately upon your arrest.
Remember officers’ badge and patrol car numbers.
Write down everything you remember ASAP.
Try to find witnesses and their names and phone numbers.
If you are injured, take photographs of the injuries as soon as possible, but make sure you seek medical attention first.
If you feel your rights have been violated, file a written complaint with the police department’s internal affairs division of civilian complaint board.

1. What you say to the police is always important. What you say can be used against you, and it can give the police an excuse to arrest you, especially if you badmouth a police officer.
2. You don’t have to answer a police officer’s questions, but you must show your driver’s license and registration when stopped in a car. In other situations, you can’t legally be arrested for refusing to identify yourself to a police officer.
3. You don’t have to consent to any search of yourself, your car or your house. If you DO consent to a search, if can affect your rights later in court. If the police say they have a search warrant, ASK TO SEE IT.
4. Do not interfere with, or obstruct the police – you can be arrested for it.

IF YOU ARE STOPPED FOR QUESTIONING:
1. It’s not a crime to refuse to answer questions, but refusing to answer can make the police suspicious about you. You can’t be arrested for merely refusing to identify yourself on the street. 2. Police may “pat-down” your clothing if they suspect a concealed weapon. Don’t physically resist, but make it clear that you don’t consent to any further search.
3. Ask if you are under arrest. If you are, you have a right to know why.
4. Don’t badmouth the police officer or run away, even if you believe what is happening is unreasonable. That could lead to your arrest.

IF YOU ARE STOPPED IN YOUR CAR:
1. Upon request, show them your driver’s license, registration and proof of insurance. In certain cases, your car can be searched without a warrant as long as the police have probable cause. To protect yourself later, you should make it clear that you do not consent to a search. It is not lawful for police to arrest you simply for refusing to consent to a search.
2. If you’re given a ticket, you should sign it. Otherwise, you can be arrested. You can always fight the case in court later.
3. If you’re suspected of drunk driving (DWI), and refuse to take a blood, urine or breath test, your driver’s license may be suspended.

IF YOU’RE ARRESTED OR TAKEN TO A POLICE STATION:
1. You have the right to remain silent and to talk to a lawyer before you talk to the police. Tell the police nothing except your name and address. Don’t give any explanations, excuses or stories. You can make your defense later, in court, based on what you and your lawyer decide is best.
2. Ask to see a lawyer immediately. If you can’t pay for a lawyer, you have a right to a free one and should ask the police how the lawyer can be contacted. Don’t say anything without a lawyer.
3. Within a reasonable time after your arrest, or booking, you have the right to make a local phone call: to a lawyer, bail bondsman, a relative or any other person. The police may not listen to the call to the lawyer. 4. Sometimes you can be released without bail, or have bail lowered. Have your lawyer ask the judge about this possibility. You must be taken before the judge on the next court day after arrest.
5. Do not make any decision in your case until you have talked with a lawyer. IN YOUR HOME:
1. If the police knock and ask to enter your home, you don’t have to admit them, unless they have a warrant signed by a judge.
2. However, in some emergency situations (like when a person is screaming for help inside, or when the police are chasing someone) officers are allowed to enter and search your home without a warrant.
3. If you are arrested, the police can search you and the area close by. If you are in a building, “close by” usually means just the room you are in. We all recognize the need for effective law enforcement, but we should also understand our own rights and responsibilities – especially in our relationships with the police. Everyone, including minors, has the right to courteous and respectful police treatment. If your rights are violated, don’t try to deal with the situation at the scene. You can discuss the matter with an attorney afterwards, or file a complaint with the Internal Affairs or Civilian Complaint Board.

WISCONSIN COURT WON’T REOPEN H-D LAWSUIT– The Wisconsin Supreme Court refused on Thursday to reopen a class-action lawsuit that accuses Harley-Davidson Inc. of failing to disclose a defect in two engine types sold in 1999 and 2000.

In a 4-3 vote, the court upheld a circuit court decision refusing to reopen and amend a 2001 case brought by Steven Tietsworth, of California. Tietsworth claimed the Milwaukee-based motorcycle maker knew or should have known the engine design for some motorcycles made in 1999 and early 2000 was inherently defective. The flaw, he claimed, diminished the value of his motorcycle. A court of appeals had overruled the circuit court in December 2005, saying Tietsworth’s case could be amended to include warranty and contract claims. The state Supreme Court ruled Thursday that the circuit court has no authority to reopen the amended case.

Harley-Davidson (nyse: HOG – news – people ) spokesman Bob Klein said the company would not comment until it had reviewed the decision. Tietsworth’s lawyer, Ted Warshafsky, also declined to comment before reading the decision.

Harley-Davidson sent letters in January 2001 to Tietsworth and 140,000 other owners of 1999 and early 2000 models built with the Twin Cam 88 and Twin Cam 88B engines. The company told owners the rear cam bearing in some bikes had failed but would probably not cause engine failure. Harley extended its warranty for the part and made cam repair kits available for $495.

Tietsworth’s complaint, which later involved four other owners, said the problem increased riders’ safety risks and decreased the value of their Harleys. A circuit court judge threw out the original case, saying Tietsworth and others failed to show actual damages or economic loss, and its decision was eventually upheld by the state Supreme Court. In 2004, Tietsworth asked a court to amend his original complaint to include contract and warranty claims. Thursday’s Supreme Court decision ended that effort.

RETIRED POLICE OFFICER ARRESTED DURING CHARITY RIDE– A former police officer says he was grossly mistreated by authorities over the weekend after they stopped him and the motorcycle group he was riding with. Steve Cobb says he and about 130 other motorcyclists were on a charity run near St. Joseph, Minnesota Saturday afternoon when they were stopped for alleged traffic violations on County Road 133.

Cobb says authorities forced everyone to sit on their bikes on the side of the road, without shade, in 95+ temperatures, for about 45 minutes.

Cobb says it was especially tough for him to sit so long in the heat because he is disabled. Cobb says he was hit by drunk drivers three times during his career as a police officer with departments in Greenwood and Tonka Bay. Cobb says he admits that he lost his temper during the traffic stop, but he still can’t believe that police treated him so harshly.

“I looked to my left and there’s a guy pointing a machine gun at me and a guy pointing a taser gun at me,” Cobb said. “They said put your hands on your head. I said, ‘I’m not putting my hands on my head. What are you doing?'” The situation escalated further when officers noticed Cobb had a knife on his belt. Cobb says it was a small pocket knife.

Cobb was eventually arrested, charged with obstructing justice and spent two hours in the Stearns County Jail. Authorities say they didn’t notice that Cobb has a disability. They say Cobb was belligerent from the beginning, swearing at officers at refusing to follow orders.

“He was one that immediately became uncooperative. He started using profanity and vulgarities toward the officers and refused to comply with directions to identify himself with his driver’s license,” Lt. Jon Lentz of the Stearns County Sheriff’s Department said.

About 70 people were cited for stop sign violations. The Stearns County Sheriff says motorcyclists on charity rides usually coordinate traffic control with law enforcement, but this group did not.

Officers from the Minnesota Drug and Gang Task Force were also involved in the traffic stop. Lt. Lentz says they believed members of outlaw motorcycle groups might have been riding in the group. Cobb says it’s was mostly middle-aged men and women who were riding to raise money for charity. Cobb’s first court date is July 26.

THE SUNDAY BLUES RETURN–Interesting times, we’re living in. Denver journalists attack bikers because of loud pipes, but it’s okay to disable a rider permanently while talking on a cell phone and driving a gas guzzling car. Yeah.

They want us all to wear helmets, yet the most deadly injury in a car accident is to the head. Head injuries are third on the list for motorcycles. (44,000 folks die in car accidents annually.) I just received a report that American Iron magazine won’t publish anymore shots of helmetless riders because of advertising pressure.

On the other hand I heard that Tattoo magazine won’t show tattoo art nipples. They cover ’em up. Can’t show nipples but violence on television and in movies is commonplace.

And since the last school shooting the anti-gun activists are at it again. We need a whole lot more education, training and soul in this country. Life is not all about safety. Like the poster says, “Two Wheels Have Soul.” If it’s all about safety, bolt seat belts to your couch and stay home.
