SUNDAY LEGAL QUESTION– I’m a lawyer from Arkansas who spent the entire day yesterday waiting to go to trial on a case for a client’s son (I’m doing this pro bono) who was charged with “failure to maintain control” of his motorcycle. The statute in question provides as follows:

27-51-104. Careless and prohibited driving.

(a) It shall be unlawful for any person to drive or operate any vehicle in such a careless manner as to evidence a failure to keep a proper lookout for other traffic, vehicular or otherwise, or in such a manner as to evidence a failure to maintain proper control on the public thoroughfares or private property in the State of Arkansas.

(b) It shall be unlawful for any person to operate or drive any vehicle on the public thoroughfares or private property in the State of Arkansas in violation of the following prohibited acts:

(1) Improper or unsafe lane changes on public roadways;

(2) Driving onto or across private property to avoid intersections, stop signs, traffic control devices, or traffic lights; (3) Driving in such a manner, or at such a speed, so as to cause a skidding, spinning, or sliding of tires or a sliding of the vehicle;

(4) Driving too close to, or colliding with, parked or stopped vehicles, fixtures, persons, or objects adjacent to the public thoroughfares;

(5) Driving a vehicle which has any part thereof, or any object, extended in such fashion as to endanger persons or property;

(6) To operate any vehicle in such a manner which would cause a failure to maintain control;

(7) To operate or drive a vehicle wherein or whereon passengers are located in such a manner as to be dangerous to the welfare of such passengers; or

(8) To operate a vehicle in any manner, when the driver is inattentive, and such inattention is not reasonable and prudent in maintaining vehicular control.

(c) A person who violates this section shall be subject to a fine not to exceed one hundred dollars ($100).

History. Acts 1995, No. 807, § 1.

There were no witnesses to the accident which according to my client occurred when he he missed the exit ramp from a parking lot (it was a dark night), and lost control going over the first curb, and then rammed into the curb across the street, causing him to fall off the bike and sustain various abrasions. The citing officer admitted that he did not see the accident and that he could not offer any evidence that the client was driving too fast. My argument to the Court was that it was just an accident, and that there was no evidence that the client was driving in a “careless” manner.

The judge inticated that it was a no brainer, that the operative language in the statute was “failure to maintain control” and that the mere fact that he had an accident was enough for her to conclude that he would not have had a wreck if he had maintained control.

There are no cases in Arkansas that have interpreted this statute, and I am hoping that you may have some information that will help me as I move this case up the appeal ladder.

BIKERNET ANIMAL CONTROL LESSON– A teacher is explaining biology to her 4th grade students. “Human beings are the only animals that stutter”, she says.

A little girl raises her hand. “I had a kitty-cat who stuttered”, she volunteered.

The teacher, knowing how precious some of these stories could become, asked the girl to describe the incident.

“Well”, she began, “I was in the back yard with my kitty and the rottweiler who lives next door got a running start and before we knew it, he jumped over the fence into our yard!

“That must’ve been scary”, said the teacher.

“It sure was”, said the little girl. “My kitty went ‘Fffff, Fffff, Fffff’… and before he could say “Fuck,” the rottweiler ate him!”

TWO MALIBU MEN ARRESTED FOR MOTORCYCLE THEFT– Wednesday, August 09, 2006, The two attempted to steal a motorcycle in broad daylight, in front of dealership customers and employees. Ventura Country Sheriff’s deputies arrested Malibu residents Zack Howard, 24, and Robert Krafft, 27, on suspicion of stealing a new motorcycle from a Thousand Oaks dealership on Saturday.

According to Sheriff’s officials, Krafft and Howard drove a sport utility vehicle to a Honda dealership on Thousand Oaks Boulevard on Saturday afternoon. They parked the SUV in front of the building, a few feet from the door. While looking at off-road motorcycles, Howard sat on one bike and then rolled it out the door, while Krafft held it open. Krafft and Howard then loaded the bike into the vehicle.

Employees saw what was happening and ran out to the car and grabbed a wheel of the motorcycle, pulling it out as the two men drove away. Witnesses wrote down the license plate of the SUV and contacted the Sheriff’s Department. Sheriff’s deputies later contacted Krafft and Howard at their home in Malibu, and the two turned themselves in separately on Monday and Tuesday.

Howard was released on his own recognizance on Tuesday, and Krafft was held several days and was released after posting bail, according to Sheriff’s officials. “What was unusual about this,” said Sheriff’s detective Eric Buschow, “is that it happened in broad daylight in front of employees and customers. It’s not the smartest crime I’ve seen.”

Also, Buschow said, the two, in an attempt to avoid getting into trouble, later called the dealership and offered to bring in beer and quesadillas if the owners didn’t pursue the case.

Howard is a local surfer, who has competed in prestigious surf championships around the world. He has been a Los Angeles County lifeguard for nine years, and has surfed professionally for 10.

Krafft is scheduled to appear at the Ventura County Courthouse Aug. 21, and Howard is scheduled to appear Aug. 29. They are being charged with one count each of vehicle theft.

EPA LETTER OF GUIDANCE RELEASED– The Environmental Protection Agency (EPA) has released their long awaited Letter of Guidance (LOG) for aftermarket motorcycle engine emissions certification. This LOG will allow aftermarket motorcycle engine manufacturers to sell EPA compliant engine packages to individuals and small volume builders and manufacturers.

“I would like to thank the SMROs who assisted the Motorcycle Riders Foundation (MRF), American Iron Magazine, and key members of the Motorcycle Industry Council, V-Twin Aftermarket Committee: Brett Smith from S&S Cycle and Ted Sands from Performance Machine”, said Dave Dwyer, MRF Board of Directors. “With their commitment and assistance this LOG retained the exemptions currently in place and increased the choices available to builders of custom V-Twin motorcycles.”

Individuals and small volume motorcycle builders and manufacturers will be able to use these engines to build EPA compliant motorcycles without having to go through the emissions testing process themselves. By using these approved engine packages an individual may build and ride as many custom motorcycles as they want, as long as the engine package is not altered in a way that will increase exhaust emissions for any pollutant.

There is no EPA restriction on time of ownership, or restrictions on the sale of these compliant motorcycles like there is on the one per lifetime EPA exempt kit bikes.

To be EPA compliant the builder must keep the total weight of the motorcycle and the ratio of the engine speed to vehicle speed in high gear within the limits for the engine package they choose to use. If the engine was certified using a catalytic converter, that must also be included in the exhaust system. No engine modifications are allowed, similar to the anti-tampering rule for all other motorcycles, for the engine to remain EPA compliant.

The MRF will continue to inform the nation’s riders of any action by the EPA which impacts motorcycling.

RACE RESULTS FROM PALMYRA BIKE MEET– Raced at the Palmyra All Bike Meeting on my old jockey shifted pan yesterday. Made 10 passes all up in qualifying and Chicago shoutout. Engine needs a freshen up as it’s been progressively slowing down. Best ET was only 13.556, best mph 93.27 which is nearly 1/2 a second slower and 10 mph down, best light was .027 (.427).

Dialed in at 13.70 and ran 13.75 .067 RT 1st round, 13.73 3rd round. Lost to a cheeky blonde on a sportster in the 2nd round when I spun off the start line. I cut a .086 light to her .135 light but ran 3 tenths off my dial in 14.066. We had a deal going before the start of the race, if I let her win she’d show me her tits. If she let me win, I’d show her my tool. She ended up winning the 13.0 seconds or slower bracket. On the last 13.73 / 93.27 mph pass the pan threw the 1 1/2″ primo belt in the traps and I had to get towed back down the return road.

There was a classic match up during the meeting of my bike and a beautiful 1928 Indian in the first round. The Indian dialled in at 16.5 and broke out with a 16.092 / 80.15 mph pass. Wouldn’t be too many places in the world where you get a 1928 Indian and a 1951 panhead lined up beside each other on a dragstrip. James Lambert, the owner of the Indian was rapt, the 16 flat / 80 mph pass was the fastest he’s ever gone on with the home made 5″ crank, 3.25″ bore engine. I’ll try and get a photo to send to you. He rides this Indian all the way to Melbourne, 1800 miles, competes in vintage bike racing and rides it home. 3600 mile round trip.

IT’S A WRAP–I know the gang is just returning from Sturgis and we’ve got a short couple of weeks before we roll out to Bonneville. We’re against the wall with projects to prepare. I’ve learned a lesson about timing this year. I packed way too many items on my plate, but what-the-hell. Ya only go around once right.

Here’s our 5-Ball Racing short list of projects. Today I need to realign my rear fender on the Salt Shaker. I will mount the neck plate that Jeff gave me from SPS and start on my struts to drop the bike on the salt. Next week the Accurate engine is due to arrive on the same day as the paint, Tuesday. I also need to think about a full BDL primary cover, and another set of D&D pipes for the salt. I have the parts but can’t make the pipes until the engine is in place. I also need to find sprocket blanks. I’ll order them next week.

FLAT OUT FLIPPED

I made some connections for 45 parts in Sturgis with Hamsters. I’ll follow up next week. We won’t take the 1940, 45 with a K-model top end this time. Departure bike works is still working on the engine mods. Next year. But we’ll bring you reports as we proceed.
