This has been a fascinating and challenging week. Hell, the year followed the same code. I’m running to Vegas in a couple of weeks for Bikefest, and my mission this week is to rewrite our Bikernet Media Kit with all new bikernet advertising benefits.
We have made so many strides this year and our numbers might be exploding. That’s the pure business aspect. Business is interesting. It’s sorta like building a bike and selling it to make a slight profit. In the process of building it you use resources, like a pinstripper, the powder coating guys, Primo-Rivera to rebuild you S.U. carb, or BDL for a belt drive and the list goes one.
If you stop building bikes it impacts lots of folks. Bikernet is our project bike. We love what we do, even when we are challenged. Hell, the challenges keep it interesting, keep us on our toes, and keep our minds working for the best experience we can provide and still pay the bills.

UNIQUE NORWEGIAN COOPERATION ON MOTORCYCLE SAFETY– The Norwegian Public Roads Administration and FEMA member organization NMCU did a joint presentation at a key road safety conference in Sweden.
The Norwegian Public Roads Administration (NPRA) had invited Morten Hansen from riders’ rights organization NMCU to do a joint presentation about the cooperation on the national motorcycle strategy in Norway. In his part of the presentation Karsten Nikolaisen from NPRA said that the cooperation was based on trust and respect, built over many years.
Among other things he said that NMCU’s initiative to organize a round-table conference on rider training in 1999 was the start of the new model for rider training, and that the NMCU’s ‘Full Control‘ book was used as a basis for the new motorcycle training that was introduced in 2005. He continued by saying that NMCU was invited by NPRA to be part of the organizing committee of the OECD workshop on motorcycle safety in Lillehammer in 2008, and that NMCU was a member of the reference group for the new rider training in 2005. NMCU was also part of the group that did the in-depth analysis of fatal accidents on motorcycle 2005-2014.
Karsten Nikolaisen said that it was the Ministry of Transport that demanded that NMCU should be part of the mission to create the national strategy for mopeds and motorcycles, but that it would have been natural for NPRA to make use of NMCU in that work anyway. Mr. Nikolaisen used two examples from the motorcycle strategy to explain that cooperation is built on trust and generosity: NPRA will examine the negative and positive consequences of raising the minimum license age for light motorcycles from 16 to 18 years. This is not at the top of NMCU’s wish list, but NMCU accepts and supports that the case must be investigated and NMCU trusts the NPRA to make an unbiased decision based on facts.
NMCU in turn wanted to encourage motorcyclists to “choose the right time and right place” when training riding technique. This is hardly an action that the NPRA would choose, but they support it because they trust NMCU’s professionalism. “We have benefited greatly from NMCU’s expertise when working with analyses, guidelines and strategies. NMCU is always willing to cooperate and is a positive partner, says Mr. Karsten Nikolaisen in his presentation.
Part of the future agenda is to revise the measures in the motorcycle strategy. In this work, the new in-depth analysis of fatal accidents is an important tool to adjust the direction of the safety work. Guro Ranes, road safety director in the Norwegian Public Roads Administration said: “Mutual trust and respect, understanding for each other’s roles and responsibilities is the key to good results.”

I think it’s important to know where motorcycles have come from and how they’ve evolved over the years.”
After ten years of visualizing, and nearly three more of hard work and painstaking dedication to detail, Lee completed the 14” x 11” landscape-style collectible edition of Timeless American – A Selection of Pre-1916 Motorcycles, which was produced and printed in the United States.
The hard cover case bound book has 264 pages, each filled with beautiful imagery of the classic craftsmanship of mostly cruiser bikes, circa 1900 to 1915 – single, V-Twin and four cylinder engines. Lee showcases 26 manufacturers, with 46 motorcycles, displayed in chronological and alphabetical order, including Indian, Harley-Davidson, Excelsior, Thor, Henderson, Flying Merkel, Marsh Metz, Hudson, Pope, Marvel, Reading Standard, Emblem, Cyclone, and more.
For Lee, one of the more important features of this book was that everything was American made, honoring the history of the collection. >From the bikes themselves, to the process of creating it, to the printing – everything was done on American soil. Lee shot an average of two bikes per day. The entire shoot took about eight months and post production took another six months.

BAD COP REPORT–
A bill in the New York City Council would force the NYPD to release annual reports on its asset forfeiture program, but the NYPD says it’s impossible.
NYPD brass testified before the New York City Council Thursday that it has no idea how much money it seizes from citizens each year using civil asset forfeiture, and an attempt to collect the data would crash its computer systems, The Village Voice reported.
Concerned by the lack of transparency surrounding the NYPD’s civil forfeiture program, NYC councilmember Ritchie Torres introduced legislation this year that would require annual reports from the police department about how much money it seizes, but at Thursday’s hearing, the NYPD said it has no technologically feasible way to track seized money that was ultimately not pursued through asset forfeiture.

“Attempts to perform the types of searches envisioned in the bill will lead to system crashes and significant delays during the intake and release process,” said Assistant Deputy Commissioner Robert Messner, while testifying in front of the council’s Public Safety Committee. “The only way the department could possibly comply with the bill would be a manual count of over half a million invoices each year.”
When asked by councilmember Dan Garodnick whether the NYPD had come to the hearing with any sort of accounting for how much money it has seized from New Yorkers this past year, the NYPD higher-ups testifying simply answered “no.”
According to the Voice, the NYPD “claimed that it only legally forfeited $11,653 in currency last year — that is, gone to court and actually made a case as to why the NYPD should be taking this money.”
As I reported last month, Bronx Defenders, a legal aid group, is suing the NYPD for public records on its asset forfeiture program, which rakes in millions in seized cash and property from arrests every year. According to the scant records Bronx Defenders did manage to get back, the NYPD reported more than $6 million in revenue in 2013 from seized cash, forfeitures, and property sold at auction, and it had a balance of more than $68 million in seized currency in any given month of that year. Bronx Defenders say the records indicate that the vast majority of seized assets are simply forfeited by default after the deadline passes for the property owner fails to go through the burdensome and Byzantine process of trying to retrieve them by the deadline.
The NYPD’s “unclaimed cash and property” sales totaled $6.5 million in 2014 and more than $7 million in 2015, according to the Bronx Defender lawsuit.

Testifying in front of committee members, lawyers and advocates from the Bronx Defenders, Brooklyn Defender Services, and Legal Aid Society relayed a litany of horrors experienced by clients who had become trapped by the NYPD’s unjust civil forfeiture process. Anca Grigore, a staff attorney at Brooklyn Defender Services, told the story of one client who was arrested while a passenger in another person’s car. The NYPD then went to the BDS client’s home, told their brother that they needed to move the client’s own car because it was blocking a driveway, and then seized the car. The BDS client eventually paid $500 to get the car back from the NYPD six months later. In another case, a BDS client had hundreds of dollars vouchered under the name of a co-defendant, whose criminal case was ongoing — the process took months to play out, and the client had to jump through several hoops just to prove the money was hers.

Facts Instead of Fiction on Michigan’s Helmet Law Modification
In recent months many advocates of mandatory helmet laws have attacked Michigan’s ADULT CHOICE motorcycle helmet law passed in 2012. In these “reports” the claim is that 40% of riders who died in fatal crashes were un-helmeted which means 60% of riders were wearing helmets. More riders died wearing a helmet than without.
The real problems are UNENDORSED MOTORCYCLE RIDERS and car drivers violating a motorcyclist’s right of way, by making a left turn in front of the rider.
Ever year since 1989 (a total of 27 years) when Michigan started keeping track of this data, 40% OR MORE of the motorcycle riders did not have a motorcycle endorsement and, were thus, riding illegally. In 2013 and 2015 that number reached 57% or nearly 3 out of 5 riders involved in fatal accidents, according to Michigan’s Office of Highway Safety Planning.
Additional claims are taken out of context and show a lack of integrity in their reporting. The claim that there was a 23% increase in motorcycle fatalities from 2014 to 2015 is misleading since they do not state that 2014 had the lowest number of motorcycle fatalities in ten years while 2015 had the highest number. The helmet law faction claims “The very low figure in 2014 appears to be an anomaly.” Thus the truth, buried in their report is that 2015 was normal.
ABATE Statistician, Vince Piacenti, finds this “cherry-picking” of data to falsely represent motorcycle safety records to be unprofessional. He added, “Comparing a high year with a low year is not statistically valid.”
“The reality is that deaths fluctuate with miles driven, which is affected by weather,” wrote Jarrett Skorup of the Mackinac Center. “At the end of the day, the fatalities this year are well within the range of what is normal.
The recent fatality of State Representative Peter Pettalia from a right of way violation, shows the need for a state funded motorcycle awareness program. Pete was an experienced rider. He rode with a defensive riding mindset. Our thoughts and prayers go out to his wife and kids. Left turns in front of a motorcycle rider are one of the leading causes of motorcyclist’s fatalities.

Garth Brooks performed his first full-length show at the Ryman Auditorium in Nashville. The concert launched Brook’s new SiriusXM station, “The Garth Channel,” and was broadcasted live on the station. The concert also featured Brooks’ wife, Trisha Yearwood.
Crystal Gayle, Peggy Sue and their family member’s performed at Loretta Lynn’s Ranch. Lynn was unable to attend due to injuries sustained from a recent fall. However, two of Lynn’s daughters and her son Ernest did perform. Sending well wishes and a speedy recovery to Ms. Lynn.

THE FUTURE OF LAW ENFORCEMENT–
Nexar, a fast-growing U.S.-Israeli startup, is marketing a smartphone-turned-dashcam app that records the habits of nearby drivers. If any get out of line – a few mph over the posted speed limit, making a sudden lane change, or any other maneuver the app deems as questionable – it records the license plate of the offending vehicle and uploads it to the Nexar database. If one of those flagged vehicles approaches the car of another Nexar user, a dangerous-driver-in-the-vicinity warning goes off.
So the next logical step for the for-profit Nexar is what, providing information to law enforcement, selling it to insurance companies and other bidders who can leverage the information for their own benefit? “Orwellian” is an adjective too often overused, but considering that the Nexar app has the potential of turning every car on the road into a mobile snitch, it is appropriately applied here.
A veteran NMA member weighs in:
This one will take some thought regarding the implications. Once again I’m blindsided by the potential of technology. I’m used to thinking of automated plate readers that cost thousands of dollars. No more.
This can be summed up as an automated “scarlet-letter” license plate, that tells the world, “I’m a dangerous screwup, and you are expected to grant me less-than-usual courtesy and rights, if not actually abuse me,” except without any process of law. Who pays if you are libeled by an algorithm and a cell-phone app? Obviously this is aimed at insurers. Instead of an accelerometer in your car, it may be a motion-reading algorithm in any other car.
One of my co-workers points out that this will have a huge rate of false alerts, like bad radar detectors or the early seat-belt buzzers. Similar observations:
· Some of the screw-ups caught by the app may be by the driver using Nexar. You could be ratting yourself out if you use this. All of your miles traveled will be recorded, along with momentary exposure to other cars.
· Some of the reported behavior may be legal, such as motorcycle lane splitting in California.
· Some bad behavior will be by pedestrians who don’t have license plates. Others are by semis, whose trailer plates don’t identify them.
How long before all cars are mandated to carry what amounts to an aftermarket event recorder, uploading everything to the cloud? You no longer physically control the data once that happens, as you do now.
In a few months, every truck will be required to carry an automated log. This will utterly change the behavior of truckers relative to rest stops, and change the balance between corporate truck lines and owner operators. Every truck MUST be parked when the mandatory rest stop is due to begin, or a violation will be logged. No more fudging the logbook while looking for a parking place. Truck schedules will slow to provide the necessary cushion.

MOVING RIGHT ALONG— Life is so nuts. I came face to face with family treachery this week. I’ll never forget my mother’s family treachery, which was bullshit. It’s so interesting how someone will throw a eight decade family relationship in the gutter for $5000.
A buddy of mine, Dr. Nuttboy, who is a psychologist says constantly, “family’s are toxic.”
I got a kick out of it for years, and heard horror stories. Then came face to face with my own bullshit, but there’s always another angle, slant, positive outcome. Hell, that’s a few less gifts I need to concern myself with each Christmas…
