Hey,

We are in a building frenzy. Guys are building for Born Free, the Smoke Out, Sturgis, Bonneville, you name it. It feels good to be in a two-wheeled creative space.

There’s something interesting about the biker spirit. Building a bike is similar to painting on canvas, except it has additional function, like it runs, it meets legal requirements, almost, and it’s capable of taking you or me across the country, as long as we carry Commander Edge’s tool bag.

So, that grubby biker covered in grease is just as creative and talented, maybe more that the guy with paint under his nails. Of course there are lots of artistic endeavors from building a home, a boat, or tiling a kitchen. I’m currently working with James, our tile master on the kitchen area down front. I’ve been waiting to get my hands on this area for over a decade.

Fuck all that shit, we’ve got bikes to build and places to ride. Let’s hit it.

WEEKEND GUN NUT REPORT– California: Anti-Gun Language Amended into Budget Bill

Assembly Bill 103, a budget trailer bill, was recently amended to include substantial policy changes that could remove your Second Amendment rights without due process. AB 103 is scheduled to be heard on Tuesday, June 13. Please use our TAKE ACTION button below to contact the members of the Senate Budget and Fiscal Review Committee and also CALL the Committee Members and urge them to OPPOSE AB 103. Committee member phone numbers are listed below.

Current law prohibits a person from owning, purchasing, receiving, possessing, or having under his/her custody or control a firearm upon conviction of a felony or for ten years upon conviction of a specified misdemeanor (29085 pc).

AB 103 would make a substantial change to current law by significantly expanding the prohibiting categories to include persons who have a warrant for a felony or disqualifying misdemeanor. This drastic policy change will violate an individual’s right to due process as warrants can be issued without notice or hearing. Furthermore, this policy is not germane to the budget and would circumvent the normal legislative process for policy measures.

AB 103 also contains additional money and a time for the Department of Justice to implement and allow for the registration of newly classified “assault weapons.” To read more on the recently submitted “assault weapon” regulations click here.

NEWS FROM THE HILL –
Profiling Update, RPM Act Advancing

We have reached an important RPM Act milestone thanks to our recent work during Bikers Inside the Beltway. Sen. Bob Casey (D-PA) was officially added as a cosponsor of S. 203 recently, making him the 8th Democrat on the bill. This symbolically demonstrates that the bill has enough support to get 60 votes and overcome a filibuster and pass the Senate.

The RPM Act in the Senate (S. 203) currently has 34 cosponsors, while the companion measure in the House (H.R. 350) has 123 cosponsors. Given this information, now is the time to not just ask for additional co-sponsors but rather to push for a vote on the floor. Your MRF will carry this message in the halls of Congress this summer! We hope we can count on you to do the same back in the district.

Following our May 23rd event, the profiling resolution (S.Res.154 & H.Res.318) enjoyed an uptick in support with Reps. Rep. LaHood (Illinois), Grothman (Wisconsin), Nolan (Minnesota), Zeldin (New York) and Thompson (Pennsylvania) signing on in the House and Angus King (Maine) signing on in the Senate. This brings the total supports up to 9 in the house and 3 in the Senate.

While this is a good start, we have a long way to go. The more co-sponsors this bill has, the more likely it will be voted on and approved. If your Member of Congress or Senator has not yet signed on, please contact them! Look for an engagement from the MRF early next week to help you in contacting your elected official to ask for support.

EXECUTIVE & REGULATORY UPDATES –  
MAC Letter Response & Comey Hearing

In one of the most highly watched congressional hearings since the days of Watergate and the impeachment of President Bill Clinton, this week former FBI Director James B. Comey testified before the Senate Intelligence Committee about his conversations with President Donald Trump, who fired him in May, about the investigation into some of his associates’ ties to Russia.

The line to get one of the 80 seats was out the door and around the block in the Senate. Comey began his testimony by accusing President Donald Trump’s administration of slandering him with its explanations of his abrupt dismissal, but also saying he did not believe the president or his aides asked him to stop the Russia probe as it related to the 2016 elections. Though no new revelations were revealed, more details were provided and there were several instances in which Comey suggested that he couldn’t discuss in an open setting. These are likely the places where the investigating most likely has found evidence of wrongdoing, or enough suspicion to investigate.

In timing of what could only be described as highly coincidental, the Department of Transportation sent a letter of response to the Senate in regard to a sign-on letter sent back in February citing concerns over adequate representation of motorcyclists on the Motorcyclist Advisory Council or ‘MAC.’

Though dated May 11, the letter was transmitted to the Senate on May 24. One day AFTER the Bikers Inside the Beltway event. The letter was signed by Finch Fulton, the Deputy Assistant Secretary for Transportation and indicated that the objective behind the MAC was to attract “motorcyclist practitioners” to serve on the Council. In other words, they want motorcyclists, but only ones that are also experts in roadway design, engineering, construction and maintenance.

To date, DoT has claimed that the majority of applicants fulfill both of these criteria. The letter also states that they (Federal Highway Administration) will ensure that participants have the necessary expertise and diversity to serve.

So far, the nominees have not been identified but when announced the MRF will circulate the list, closely scrutinizing to see how ‘diverse’ the Council is. We already have commitments from our champions in the House and Senate to help us in this process. This fight is not over…we won’t stop until we are satisfied! STATE NEWS –
New Mexico

The New Mexico Motorcyclist Rights Organization Board is working diligently behind the scene to protect your rights and fight for justice. Recently, one of their members was killed while at a local carwash while washing his motorcycle after a day of riding. Members of the NMMRO board were notified of the shooting and arrived on the scene that afternoon to provide support for the family, friends and brothers of the victim and to ensure the rights of the motorcycle community were upheld.

The NMMRO recently reported that no arrests have occurred in connection with the shooting but they have opened a dialogue between the local police department and their organization to ensure a proper investigation will be held into what is a senseless shooting.

The MRF is saddened to hear of the NMMRO’s loss and is in support of their efforts in the state.

We’re coming fresh off another successful Bikers Inside the Beltway Event that was held in the days leading up to Rolling Thunder in our nation’s Capital. Though this was only my 2nd ‘BITB’ I am told it was the largest to date with participants from across the U.S. representing the club world, NCOM, and of course the MROs…the backbone of this great organization.

I’ve heard from many of you saying that you enjoyed your time in Washington and are already looking forward to next year’s event. It was definitely a success, thanks in part to MRF A&E who helped to spearhead a unique event in the Capitol, bringing a SMARTrainer in to let staff and elected officials experience a taste of what it’s like to ride. And legislatively we made headway, too, with an influx of sponsors for the RPM Act as well as the Anti-Profiling Resolution. We also advanced conversations as they relate to motorcyclists’ concerns over autonomous vehicles and expressed our frustration with the MAC and lack of motorcyclists.

I want to take just a moment to express my gratitude for everyone that joined us in D.C. spending your time and money to advance our cause. If you participated in BITB congratulate yourself because you are supporting and moving the needle in the world of motorcycle rights. And for those that didn’t come to D.C., thank your brother or sister that did and get your ass to D.C. next year!

It a nice start-up bike for it to be customized. The one thing I didn’t see the final build.

On the other hand, a Baker transmission XL6 was used, even though it’s for a 1991-2003. Did they do that first or what other mods did you do.

U.S. Sen. Deb Fischer (R-Neb.) and U.S. Rep. Adrian Smith (R-Neb.) have introduced legislation, the Consumer and Fuel Retailer Choice Act (S. 517 & H.R. 1311) that would amend the Clean Air Act with respect to the ethanol waiver for Reid Vapor Pressure (a measure of gasoline’s propensity to evaporate) limitations.

If passed and signed into law, the legislation would allow the sale of E15 during the summer months (June 1 – Sept. 15).

The American Motorcyclist Association opposes E15 fuel because using E15 in motorcycles and all-terrain vehicles may cause engine and fuel system damage and void the manufacturer’s warranty.

None of the estimated 22 million motorcycles and all-terrain vehicles in use in the United States is approved by the U.S. Environmental Protection Agency to use E15 or higher ethanol blends. Using E15 in motorcycles and ATVs violates federal law.

Yet the rush to force more E15 fuel into the marketplace by the ethanol industry greatly increases the chances of inadvertent misfueling by motorcyclists and ATV owners — as well as owners of boats, small engines and other machines that are not warrantied for E15 use — due to blender pumps, confusing pump labeling and the lack of any significant consumer education by the ethanol industry or the federal government.

Concealed Carry Reciprocity Effort Gains Steam in Congress

In March, we reported on the details of NRA-backed concealed carry reciprocity legislation pending in Congress. The momentum behind those bills continues to build, with each attracting dozens of co-sponsors.

Sen. John Cornyn’s Constitutional Concealed Carry Reciprocity Act now boasts 37 co-sponsors. And 194 of his House colleagues have signed onto Rep. Richard Hudson’s Concealed Carry Reciprocity Act of 2017.

Concealed carry reciprocity legislation recognizes that Americans’ Second Amendment right to bear arms doesn’t end at their states’ borders. While most states already recognize this and have provisions allowing for reciprocity for concealed carry permits from other jurisdiction, a minority of antigun states have made a point of arresting out-of-state residents who carry or transport otherwise lawfully owned firearms in their jurisdictions.

This sort of “zero tolerance” enforcement has nothing to do with public safety and everything to do with punishing people who believe in the Second Amendment. There is nothing legitimate about a state using its police powers to suppress the constitutional rights of fellow Americans.

That’s why your NRA has for years supported legislation to ensure that people who are federally eligible to possess firearms and who have state-sanctioned ability to carry concealed don’t lose their eligibility to do so simply because they cross state lines. This legislation would ensure that states would have to treat lawful concealed carriers from other states the same as lawful in-state concealed carriers. States would maintain their prerogatives over their own licensing regimes and the rules of behavior that govern concealed carry within their borders.

Gun control proponents have weakly argued that this legislation makes the most lenient concealed carry standards the de facto national standard. What that argument fails to account for, however, is that criminals who carry unlawfully with evil intent have no standards whatsoever. These bills are not for them. They are for law-abiding and self-regulating Americans who take pains to carry lawfully. And lawful concealed carriers have proven themselves to behave responsibly year after year in every U.S. jurisdiction.

Every expansion of concealed carry rights over the last 30 years has been met with the same tired rhetoric from gun control proponents about how it will result in a return to the Wild West and “blood in the streets.” But with some 15 million concealed carry permittees in the U.S. and untold thousands more lawfully carrying in the 12 states that no longer require a permit for concealed carry, those predictions simply have not materialized. And the handful of cases gun control proponents desperately point to simply prove the rule.

If your senators or representative have not co-sponsored the bills introduced by Sen. Cornyn and Rep. Hudson, please contact them today and respectfully ask that they do so.

MOTORCYCLE PROFILING PROJECT REPORT–
State Farm Responds to Outrage After Denying Coverage to Motorcycle Clubs
The MPP recently reported that the National Council of Clubs (NCOC), a national rights organization representing the interests of motorcyclists and motorcycle clubs nationwide, recently obtained a copy of a letter from the State Farm Insurance Operations Center notifying a chapter of a Veterans motorcycle club that the insurance coverage on their property was being cancelled.

The stated explanation for the policy cancellation was “we don’t provide coverage for businesses engaged in motorcycle clubs.”

Although the NCOC received no direct response, the Arizona State Representative for the Motorcycle Riders Foundation, Dale “Animal” Dedrick, took initiative and contacted State Farm Insurance requesting an explanation. “What is the State Farm Insurance company policy relating to motorcycle clubs and their property?” Dedrick received the following response from State Farm on May 25th:

State Farm’s response is vague and never directly responds to the clearly stated policy made clear by State Farm’s original cancellation letter.

On May 25th the NCOC responded to the above letter, which included the following:

“The May 25th response does not directly address the original question and core issues sufficiently.

The May 25th response says coverage for clubs is considered on an individual basis, but it is not clear if the statement of policy in the original letter dated February 27, 2017 is now being rejected by State Farm. Does State Farm have a policy “that denies coverage to businesses engaged with motorcycle clubs”?

If the blanket denial of coverage to businesses engaged with motorcycle clubs is no longer State Farm policy, what activities would disqualify an individual motorcycle club or motorcycle organization from receiving coverage from State Farm?”

The MPP will continue to follow and report on any information relating to State Farm’s policies related to motorcycle clubs.

NEWS FROM THE FAST LANE–

While the NMA has been increasingly promoting left lane courtesy for years, I can compare several states in which I have lived or worked. California is far worse than Maryland, DC, or Virginia, Pennsylvania, New Jersey, and most other Eastern states in left and right lane courtesy (not that any of them are anywhere close to perfect).

However, I have found in the NMA’s coverage of the subject of left-lane courtesy, there is hardly any mention of the relationship between that lack of left lane courtesy and the culture that seems to have been established regarding right lane rules. The two issues affect each other.

I think that a large part of the left-lane courtesy issue is the nearly complete lack of emphasis on what was taught in the East: Keep right except to pass. It seems to be ignored or glossed over in Driver Education courses. Indeed, the DMV booklet covering the topics for the driver license test seems to go too lightly on this and another issue: Right of Way when entering a freeway.

On the left lane courtesy issue, there are the random signs in the (ever-smaller) median strips about slower cars moving to the right, but they do not address the circumstance of someone feeling “righteous” about driving slightly slower than the speed limit, and feeling that they shouldn’t let any faster car pass.

However this problem seems to be related to the absence of yield signs at the end of oncoming ramps, resulting in increasing confusion about extending courtesy to oncoming traffic and the actual law. Rather than truly understanding that ramp traffic must yield to the existing freeway traffic, some seem to believe (erroneously) that the law provides that oncoming ramp traffic holds the right of way!

It seems to be true that California’s generally longer ramps (than in the East) permit an easier merging, but that easier merge may have been more valid when the total volume of traffic was less than it is today. Even worse, most drivers’ experience with Yield signs is at the increasingly (traffic engineer) popular Roundabouts. Even there, few drivers truly understand their purpose. (At roundabouts, traffic at incoming “spokes” must yield to pedestrians and traffic already in the roundabout, but not for traffic in the other feeder lanes.)

What happens is that there has developed a culture that lane courtesy is mandated for the right lane only, a point emphasized by the DVM booklet suggesting that continuing traffic use the center lane(s) or left lane instead of the right lane.

In short, the attitude is set to reinforce illegal behavior in the right lane, always yielding to oncoming traffic, to avoid driving in the right lane, and almost no mention of leaving the left lane(s) for allowing passing traffic (of any speed) to use that passing lane. (That is even true of the behavior of many trucks in 3-lane configurations. The trucks routinely occupy the center lane.)

The changes for these bad, if not outright dangerous, conditions will only occur when the DMV booklet stops emphasizing right-lane vacancy, when CalTrans adds Yield signs to the end of every on-ramp (and indeed) at any intersections that do not have a defined traffic signal or Stop sign. Additionally, the Eastern mantra of Keep Right Except to Pass needs to be added to the DMV booklet, and more importantly emphasized in both New Driver Education as well as Remedial Driver Education courses.

These two issues seem to be linked, both in their encouragement of unsafe driving practices, but also in the widespread popular culture of California drivers.

Recommendations:

Add Yield signs near the end of every on-ramp, and not just at roundabouts. (Indeed most people don’t know what they mean, even there.)
 
Emphasize in the DMV booklet the issues of Right-of-Way for existing freeway traffic at on-ramps.
 
Emphasize the use of the left lane for any faster vehicles, driving at the speed limit or not.
 

Work both of these concepts into both the First-time and Remedial Drivers’ Education courses.

While I applaud the NMA focusing on left-lane courtesy, the subject (at least for California) should not be taken out of the context of related driver culture, seemingly encouraged by the California DMV, its publications, and the many new and remedial driver education courses.

But motorcycles are my creative outlet. Next week we will start to put Frankie’s Dyna back together.

We are starting by installing the Custom Cycle Engineering rubber mounts and then aligning the chassis.

We will cover Eric Bennett’s Born Free FXR assembly scramble. Bennett’s Performance plans to have seven FXRs in the FXR portion of the show. Jason’s sharp FXR will be one of them (below).

I’ll cover my Panhead build again. Barnett’s has the best selection of cables in the industry and they saved me with this drum brake cable. There’s a bunch more coming, but I need to haul ass to Bennett’s and take more shots.
