Memorial Day Sunday Post for May 28, 2017



Hey,

Happy Memorial Day. Take a minute or an hour to respect what soldiers and freedom fighters have done for this country. Commemorate the lives lost in Military service. This holiday began even before the Civil War as a tradition to decorate cemeteries on the last Monday in May. It is also kicks off of the summer season.

It’s a day of celebration and one of remembrance. I wish every government official would step back and think about Freedom and not more regulation. That’s what the founding fathers came to America for and fought for…

I’m scrambling and wondering why. Let me see if I can explain. I’ve buried myself in projects and I’m trying to complete a couple of bike projects for Sturgis. I’ll try like hell to bring you a report on my Panhead build this coming week.

Next week we hit June and half the year is over. Is that incredible or what? We just got started. But we’re having a blast and will share every element with you.

NEWS FROM NEW MEXICO–

As we go into our riding season, the NMMRO Board is working diligently behind the scene to protect your rights and fight for justice.

As many of you know one of our members, Earl Royal, “Payaso” of the Onagers MC was mercilessly gunned down on March 26th while at a local carwash while washing his motorcycle after a day of riding. Members of the NMMRO board were notified of the shooting and arrived on the scene that afternoon to provide support for the family, friends and brothers of Mr. Royal and to ensure the rights of our community were upheld.

Acting as a spokesperson for the community, we conducted several interviews with the media to ensure the Mr. Royal received a fair and unbiased description of the events. Several news stories have aired since this tragedy occurred and for the most part, they have all been reporting fairly, the facts and information, as we currently understand them.

Here is what we know as of May 19th 2017. No arrests have occurred in connection with this shooting and the Bernalillo County District Attorney’s Office is currently reviewing the case. The Albuquerque Police Dept. investigated this case for approximately three weeks and then an additional one-week was taken to review all the reports and evidence.

I immediately began contacting both the Albuquerque Police Department as well as the Bernalillo County District Attorney’s Office on May 27th to begin an open dialog with our organization. This was to ensure that there would be no discrimination, and that the rights of both Mr. Royal and his family would be respected and that he receives a proper investigation into this senseless shooting.

Surprisingly, The Bernalillo County District Attorney’s Office has been very cooperative and continues to listen to our concerns, as well as keeping us updated on where the process is currently. I meet weekly with the ADA in charge of the case and will continue to do so until charges are filed and we find justice for our fallen brother.

Recently the news Media has released the identity of the shooting suspect as well as videos from the day of the incident. I understand that these images are hard to see and that there are many within our own community who are frustrated and feel like they need to do something to right this wrong. All I can ask for is your patience and trust.

As an organization and as a community we are doing our very best to push the authorities in this case to do the right thing and to not simply brush this under the carpet. I have spoken one on one with many who have been directly impacted by this tragedy. I understand your frustration, and I can appreciate the pain you must be going through. I talk weekly with Mr. Royal’s family via his aunt, who is also suffering, yet has the faith and strength see this through until her nephew receive the justice he deserves.

After reviewing the 180 or so documents and reports filed by the investigation, I feel that the DA’s office will also come to a logical conclusion that charges be filed and the shooter stand trial for his actions. Until that time, I am asking that as a community, as a family, we maintain the higher moral ground and not allow ourselves to be baited into actions that could jeopardize the case or put yourself or anyone else in harm’s way.

The National Highway Traffic Safety Administration (NHTSA) has posted its annual reminder that May is Motorcycle Safety Awareness Month. Governor Susana Martinez signed a proclamation put together by Richard Sturgeon Los Alamos National Lab Motorcycle Committee Chair proclaiming May as safe-ty awareness month in New Mexico. The Department of transportation responded to the NMMRO re-quest to help promote safety awareness in our state by utilizing the electronic road signs displaying Look Out for Motorcycle throughout our state freeways. We ae hoping these messages will help make those who share the road with us more aware of motorcyclist on our roads

To date we have 102 motorcycle crashes with 14 of those resulting in fatality for 2017; at this time last year 73 crashes with 19 fatalities for 2016 were reported to the NMMRO. According to the Motorcycle Safety Foundation, motorcycle fatalities have been on the rise on an average of 10-percent per year over the last 20 years.

Even though motorcycles account for less than five percent of registered vehicles in the US, they are traveling some 21-million miles each year. NHTSA reports that per vehicle traveled, motorcyclists were more than 26 times more likely than passenger car occupants to die in a traffic crash.

On Mothers Day weekend motorcyclist throughout the state came together at NCOM (National Coalition of Bikers) in Reno Nevada to discuss motorcycle rights. Big D Dennis Watson who served on the NCOM Board for 20 years was honored this year. Big D had stepped away due to illness 5 years ago. Big D passed away due to illness in March of Cancer. Condolences to his family and friends.

Did the Queensland ‘anti-bikie’ laws really work?

The tough, so-called anti-bikie VLAD laws in Queensland have not been the success the police claim they are, according to a crime expert.

Queensland Police formed the anti-bikie unit, Task Force Maxima, after the VLAD laws were introduced, giving them greater powers. The Task Force has so far seized $13 million in drugs.

That sounds like a lot, but former detective and now Bond Uni criminology lecturer Terry Goldsworthy says it is a drop in the ocean.

“Given that the Australian Criminal Intelligence Commission estimate the drug market annually was $4.4 billion nationally in 2013-14, seizing $13 million over more than three years does not make for a big impact on organised crime,” he says.

“Rough sum suggests that $13 million would amount to less that 1% of the value of the drug market over the same time period.”

While the VLAD laws have since been slightly watered down, there is still a “fashion police” rule that bans “bikie colours” in public because they create fear.

No one has explained how such a ban will help fight organised crime!

Task Force changes

Meanwhile, Task Force Maxima continues, although it is now one of five units inside the new Organised Crime Gangs Group.

The changes follow the findings of a 2015 Commission of Inquiry that found the force was too bikies-focused under the Newman Government.

Terry has said all along that the fixation on bikies would be at the detriment of other crime groups and has now been proved correct.

So while “bikies” and some other motorcycle riders have been harassed by police and vilified by the public, the real kingpins of the drug trade have been ignored.

If you believe the VLAD laws didn’t affect innocent people, tell that to the librarian looked up for having drinks with a restive who was club member, or the Mt Isa man wrongfully arrested for wearing a Sons of Anarchy t-shirt, or the motorcycle mechanic strip-searched at the side of the road in front of a school.

These are just some of the abuses of police power that occurred after sloppy and discriminatory legislation was rushed through Parliament.

Voice your opposition to the Bikes for Beef tariff

Take Action

Urge U.S. Trade Representative Robert Lighthizer to oppose the proposed 100 percent tariff on motorcycles imported from the European Union.

The proposal-which would affect bikes with an engine size between 51cc and 500cc-is part of the ongoing E.U.-U.S. beef hormone trade dispute.

Now is the time to make your voices heard!

Use the American Motorcyclist Association’s convenient tools to urge the U.S. Trade Representative to withdraw this ill-conceived proposal. Motorcyclists should not be penalized with exorbitant tariffs because of a dispute over beef.

If enacted, this tariff will cause serious and irreversible harm to American small- and medium-sized business owners who sell motorcycles and scooters with an engine size between 51cc and 500cc. Additionally, consumers will be denied access to affected models of competition and recreational motorcycles that contribute to the lifestyle and wellbeing of millions of American families.

The AMA opposes the proposed tariff because trade disputes residing within the boundaries of the agricultural industry should not be solved with trade sanctions levied against non-agricultural products.

In February, a USTR official admitted that motorcycles were included in the proposal as leverage to achieve relief for the beef industry. The AMA finds this approach to trade policy to be cynical at best.

In reality, this agency is playing with peoples’ lives and livelihoods. The proposed trade sanctions, if implemented, will cause dramatic and irreparable harm to the motorcycle industry.

In a news article, the then Acting Trade Representative said he and Lighthizer want to represent all of the United States’ commercial interests. He added, “I don’t want a situation where anybody is saying: ‘Well, our voices weren’t heard or we weren’t listened to.'”

Now is the time to voice our strong opposition to the 100 percent tariff proposal. We aren’t pawns in a game of international chess. Take action now to protect against significant hardships this tariff will cause to hardworking, everyday tax-paying Americans.

This week, Rep. Blaine Luetkemeyer (R-MO) reintroduced the Financial Institution Customer Protection Act, a bill aimed at permanently dismantling Operation Choke Point (OCP).

This Obama era “enforcement” program billed itself as an effort to shut down fraudulent businesses by choking off their access to financial services. But the “high risk” business sectors targeted by the program were not only those that are illegal or exploitative; they also included categories the Obama administration simply found distasteful or immoral. These included businesses within the firearm and ammunition industry. As a result, many lawful businesses operating in good standing suddenly found themselves scrambling to find or keep the banking relationships they need to survive.

Rep. Luetkemeyer’s legislation would institute numerous reforms to bring more transparency and accountability to federal oversight of banks, all aimed at preventing the sort of unchecked enforcement discretion and twisting of legislative language at the heart of OCP.

For example, the bill would require regulators that suggest or order a bank to terminate a customer’s account to have a “material reason” for doing so and to put the directive in writing, with reference to any specific laws or regulations the enforcement agency believes are being violated. Moreover, no such reason could be based solely on “reputational risk,” the supposed basis for including firearm and ammunition businesses within the scope of OCP’s “high risk” target list.

Regulating agencies would also have to submit annual reports to Congress documenting any such requests or orders.

The Act would additionally make important amendments to the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 – which agencies have cited as authorization for OCP – to clarify the law’s scope so as to conclusively preempt this dubious justification.

An identical bill was passed by the U.S. House of Representatives in 2016, before stalling in the Senate.

BIKE PATH COLLISIONS—CITY PLANNERS AND BUSINESS OWNERS AT ODDS IN MINNEAPOLIS–
Let’s focus for a moment on the opening statement of the NMA’s Streets That Work initiative:
Motorists deserve roads that not only work, but can also be put to work. That means allowing people the freedom to travel to the destination of their choice when they want with the least amount of interference. That is a fundamental principle of the American way of life. It also means keeping roads open for the movement of goods and services that is essential for society as a whole.

The last sentence resonates when learning about plans by Minneapolis, Minnesota officials to add protected bicycle lanes along two one-way streets lined with small businesses, plans that have many of those business owners unhappy.

Let’s start with daily traffic numbers provided by the city for the affected sections of 26th and 28th streets between I-35W and Hennepin Avenue:

26th Street

Motorized traffic: 3800 to 6100
Pedestrians: 630
Bicyclists: 220

28th Street

Motorized traffic: 4300 to 7000
Pedestrians: 750
Bicyclists: 340

On any given day, cars and other motorized traffic make up 80 to 88 percent of the road users, pedestrians 9 to 14 percent, and bicyclists 3 to 5 percent. Minneapolis transportation planner Rebecca Hughes says that the bike lanes will help keep bicyclists safe while noting the benefit of slowing down traffic as a whole. About 100 parking spots along the streets will be eliminated.

Larry Ludeman, a board member of the local business association, questions the need for bike paths when a greenway with riding paths runs parallel to both streets and is just a block away from 28th Street. “Yes, I believe bicycles are an integral part of our transportation system,” Ludeman said, “however, there is one group that the bike lanes discussion has left out, and that’s people who drive cars.

We are still in the majority, yet we have no say in this. I think the whole thing has been rigged.”

Local resident Dick Rueter’s response to the tug of war between city planners and bicyclists on one hand and small business owners on the other sums it up nicely:

I was happy to read Jon Tevlin’s April 30 column [in the Star Tribune] about bike lanes. I have been perplexed by their proliferation in my south Minneapolis neighborhoods.

I think biking is an important step we can take in lessening our dependence on fossil fuels. For three decades, I commuted by bike to my job at Abbott Northwestern, though not in winter. Those were years when there were no bike lanes. For safety, and in avoidance of inhaling exhaust fumes, I mostly used side streets. Now, in my late 60s, I am a fair weather biker at best, and I still use side streets.

I have heard that up toward 16 percent of our populace commutes by bike. It’s hard for me to believe that number when I travel down Park, Portland or Blaisdell avenues in bumper-to-bumper traffic, seeing one to two bikes at best. At the recent precinct caucus, my City Council person promised me a link to the “Bike Master Plan,” which I have yet to see. I can’t imagine what that plan will look like, and how it will choke even more car traffic.

I think it would be wise to pause and look at the entire city’s transportation plan before proceeding further with bike lanes. From a clean-air perspective, cars idling on our streets waiting at traffic lights harm our air quality. We live here.

I ask for some common sense as we move forward. Citizen input would be a good thing. We don’t need to prove how groovy we are by reaching for designation as the No. 1 bike-friendly city in the nation. We are already groovy.

The tail will continue trying to wag the dog if we let it.

This is so interesting. It’s basically an attack on cars, and we need to stand up. I’ll bet if you went to a city meeting and asked for motorcycles to be able to use these lanes, they would never pass. This is us against them, nothing more. As a kid I rode a bike wherever I wanted. I can still do that. Nothing changed in that regard.

THE LOSS OF A HERO: NICKY HAYDEN DEAD AT 35–
Former MotoGP champion and current World Superbike racer Nicky Hayden died today, five days after a car collided with his bicycle while training. The Maurizio Bufalini Hospital released a statement stating the racer had died of multiple traumatic injuries, including serious cerebral damage.

Hayden was respected not just for his raw talent, but also for his drive, success and charisma. Nicky’s race career began on the dirt track at age 5, and he improved himself relentlessly, eventually moving to to road racing, ascending to the very top of the sport. Nicky Hayden became the youngest AMA Superbike champion in 2002, and won the MotoGP world championship in 2006, beating rival Valentino Rossi. “After the race, we shook hands and hugged,” Rossi recalled.

That sentiment poignantly encapsulates Hayden instantly. In a sport so known for its fierce competition, both on and off the track, Nicky was not only respected but incredibly well liked. This was no doubt due to the high level of sportsmanship he displayed throughout his career.

Hayden’s engaging personality was part of why he was so popular with so many fans. No death is an easy one to cope with, but to have such a talented and personable member of our community gone so suddenly makes his death acutely tragic.

If you’re interested in learning more about Hayden’s life and impact on motorcycling, author Chris Jonnum, who was close with Nicky, authored a book chronicling Hayden’s life. Jonnum intimately explains some of the roots that helped forge Nicky Hayden into the legendary racer Common Tread will fondly remember.

WEEKEND GUN NUT REPORT, LEGAL & LEGISLATION NEWS– Rep. Rob Bishop Introduces the “Lawful Purpose and Self Defense Act”

On Wednesday, May 24, 2017, Chairman of the House Committee on Natural Resources Rob Bishop (R-UT) introduced H.R. 2620, the “Lawful Purpose and Self Defense Act.” This bill would remove ATF’s authority to use the “sporting purposes” clauses in federal law in ways that could undermine the core purpose of the Second Amendment.

Under Chairman Bishop’s legislation, all lawful purposes – including self-defense – would have to be given due consideration and respect in the administration of federal firearms law.

There’s no time for fucking around. We have a batch of content headed your way, from my Panhead report, to a new Cantina Episode, Frank’s Dyna, James’ Dyna, even a book report.

We will bring you a Scott Jacob’s art retreat report in the next couple of weeks, as soon as my Grandson, Frankie, heals up from his eye infection.

We have several reports from Love Jugs coming. Some of these report involve the Jugs and a motorcycle manufacturer and a oil producer. These things work, if you’re a long run touring rider, they need to be considered.

We are bringing back this 5-Ball Racing Logo for the Panhead build. I’m looking for an old automatic-advance distributor. This bike will be too quirky. Maybe that’s my problem. I’m too excited over new projects.

I’m going to include this trophy bike which is a rendition of a K-Model. Too cool.

I bought this glide front end from a guy who supposedly rebuilds glides, but it’s been nothing but problems. These bearing are jammed into the hub. They won’t move. I’ll try to fix today.

How’s this for a Paughco Part patina. Hang on for reports.
