CONTROL FREAKS BIKERNET WEEKLY NEWS for September 15, 2016

Hey,

I just received a new C of O, or Certificate of Occupancy for the Bikernet Headquarters. For months I wondered whether armed officials would kick me out of my old building. Today, we wonder if our old motorcycles might be banned. We wonder if police will barge into our homes and search for guns. WTF.

“Don’t you just love dealing with these power crazed bureaucratic nut jobs at the City……They Tax, Restrict, Regulate, Confiscate or Exercise Seizure in their attempt to “be of service” It’s horribly pathetic how our cities have matured into these houses of regulation under some false sense of “public safety or public good.”

–Undercover Bikernet Agent

I don’t like it. Maybe I’ve been an outlaw all my life. Good or bad I will fight this bullshit and for our peeps’ Freedom until I’m gone. Watch out. Someone is banging on the door. It’s the Mandatory Health Insurance folks.

Don’t forget the Bikernet Weekly News is sponsored in Part by Cycle Source Magazine, Iron Trader News, ChopperTown, Las Vegas Bike Fest, Born to Ride and The Motorcycle Riders Foundation.

AUSTRALIAN BIKER TAKES DEPORTATION CASE TO THE HIGH COURT– Government authorities have failed to show how deporting high profile Tasmanian biker Aaron “AJ” Graham would serve the national interest, a High Court application says.

The former Rebels MC leader has been housed in arguably Australia’s toughest prison, since immigration officials arrested him in June last year and cancelled his visa.

In the latest twist of the long-running deportation saga, Graham has lodged a constitutional challenge in the High Court.

The 49-year-old is appealing Immigration Minister Peter Dutton’s decision to cancel his visa for a second time in June.

The second cancellation came just hours after Graham won a Federal Court challenge to quash Dutton’s initial decision to have him deported to his native New Zealand.

High Court documents show a constitutional aspect to the appeal, with Graham’s lawyers arguing Dutton’s decision went beyond the power of Parliament.

Another ground of the appeal relates to Dutton rescinding the visa on the basis that it would advance the national interest because of Graham’s links to the Rebels.

But the former president of the Rebels’ Kingston chapter argued through his lawyers that Dutton’s decision was misguided.

“[Mr Dutton] made no finding as to how removing the plaintiff from Australia would advance the national interest,” the High Court application says.

Graham has changed legal teams since his last court bout and is now represented by Melbourne firm Malkoun & Co Lawyers.

The firm’s principal Anthony Malkoun, who studied law at the University of Tasmania, is the nephew of former Victorian Comanchero president Amad “Jay” Malkoun.

The firm has brought in one of Australia’s top barristers, Brett Walker, SC, who represented big tobacco companies in the fight against plain packaging.

Graham was arrested in a crackdown on bikers and taken away to Goulburn Supermax. Although he was not charged with an offence, because of a prior conviction Dutton (a former QLD cop), cancelled his visa on character grounds, claiming it would “contribute to the national effort to disrupt, disable and dismantle the criminal activity of outlaw motorcycle gangs”.

Graham was jailed in 2009 over an assault of an insurance fraud investigator at Clarendon Vale.

Graham moved to Australia when he was 10 and has children born here.

SAME OLD SAME OLD–
Recent headlines screamed at us:

Traffic Fatalities Up Sharply in 2015

NHTSA: 2015 Sees Largest Increase in Traffic Fatalities in Half Century

Traffic Deaths in 2015 Climb by Largest Increase in Decades

Highway Fatalities Jumped 7.2% Last Year

Cheap Gas May Be Killing Us

No, we didn’t make that last one up.

The media reacted swiftly to the National Highway Traffic Safety Administration’s (NHTSA) announcement that 35,092 people died on U.S. roads in 2015, an increase of 7.2 percent over the previous year. In turn, NHTSA and the White House made a public plea for help in analyzing the raw data to determine the cause of the near-record increase in highway fatalities.

You know that the instant conclusion of many will be – already has been – that speed limits have to be lowered.

First it should be recognized that two data points – in this case traffic fatalities in 2014 and 2015 – do not constitute a pattern. The second equally important observation is that absolute numbers are misleading when trying to identify a trend. NHTSA, by virtue of its FARS (Fatality Analysis Reporting System) database, established the standard by factoring in distance traveled. The traffic fatality rate in terms of 100 million vehicle miles traveled provides a truer year-over-year comparison than looking at absolute totals.

The reason is simple: As more total miles are driven, the risk exposure to accidents also increases. NHTSA noted that vehicle miles traveled were 3.5 percent higher in 2015 than in 2014. So while the agency estimates that total fatalities increased 7.2 percent in 2015, the fatality rate increase was actually 7.2 – 3.5 = 3.7 percent.

Check out this progression of numbers: 1.73, 1.69, 1.65, 1.58, 1.55, 1.53, 1.51, 1.51, 1.48, 1.44, 1.46, 1.42, 1.36, 1.26, 1.15, 1.11, 1.10, 1.14, 1.10, 1.08. Those are NHTSA-published fatalities per 100 million vehicle miles for 1995 (when the 55 mph national maximum speed limit was fully repealed) to 2014. The long-term trend is a steady decline in fatalities with the most meaningful year-to-year rate increase being 3.6 percent from 2011 (1.10) to 2012 (1.14).

That is similar to the increase between 2014 and 2015. Note that after 2012, the rate reverted back to the 20-year pattern of declining highway fatalities, 1.10 in 2013 and 1.08 in 2014. Let’s see what happens to the fatality rate in 2016, 2017 and 2018 before declaring a new upward trend based on a one-year increase.

That is not to say that efforts to reduce the absolute numbers of fatalities shouldn’t continue in earnest. It is commendable that the government is reaching out to tech companies for help in that regard. But when it comes to calls for blanket lowering of speed limits, consider this: From 1995 to 2014 speed limits rose from 55 mph to 70, 75 and even 80+ mph. During that same period, fatality rates dropped 37.6 percent in a relatively steady line. If anything, highway safety improvements across the nation should include speed limit reform where speed studies and the 85th percentile traffic engineering principle that can lead to a smoother, more consistent flow of traffic.

PRISON STRIKE PENDING– I have often referred to Prison Labor as Slave Labor and can through personal knowledge and experience.

A large portion of inmates are Bikers and some are there because they would not fall in line with what the Biggest Gang In The Country Said (Government).
The worst offenders are the Private Prisons.

Inmates strike in prisons nationwide over ‘slave labor’ working conditions
Organizing groups say coordinated strikes are under way in at least four states against poor sanitary conditions and jobs that amount to forced labor.

The Free Alabama Movement said a widespread strike at Holman correctional facility was launched a minute after midnight on Friday.

A nationwide prison strike over conditions and wages behind bars, which organizers tipped to be the biggest of its kind in US history, was under way in at least several correctional facilities across the country on Friday, according to prison rights advocates.
Inmates from several states, who had bound together with the help of activists and organizing groups, aimed the national strikes – which had been in the making for several months – against what they said amounted to slave labor conditions amid mass incarceration in the country.

The coordinated events, which organizers targeted in as many as 24 states, occurred on the 45th anniversary of the riots at Attica prison in New York – the largest prison uprising in American history – over grievances today’s protesters say are similar, including poor sanitary conditions and prison jobs that amount to forced labor.

In April, one of the main national groups organizing the campaign, the Incarcerated Workers Organizing Committee (IWOC), under the banner of the Industrial Workers of the World (IWW) union, announced its call to action.

“This is a call for a nation-wide prisoner work stoppage to end prison slavery,” it said. “They cannot run these facilities without us.”
“Work is good for anyone,” Melvin Ray, who is incarcerated at the WE Donaldson correctional facility in Bessemer, Alabama, told Mother Jones on Friday. “The problem is that our work is producing services that we’re being charged for, that we don’t get any compensation from.”

Ray is a member of the group called the Free Alabama Movement, which has been instrumental in leading the strike efforts, along with other groups formed with the help of incarcerated individuals such as the Free Ohio Movement, the Free Mississippi Movement and the End Prison Slavery in Texas movement.

According to the Federal Bureau of Prisons, prisoners at federal facilities can make between 12 and 40 cents an hour for their work, while state prison rates can be higher or lower. In several states, including Texas and Arkansas, inmates are paid no wage for their labor.

But the issue is not merely about earning meager amounts of money on the side. Inmates and outside organizers say that many US prisons simply would not run without the labor of inmates, including the work of building maintenance, cooking and cleaning.

“These strikes are our method for challenging mass incarceration,” Kinetik Justice, a founder of the Free Alabama Movement, who serves at the Holman correctional facility in Alabama, told Democracy Now in May, during a prior 10-day strike which mirrors what he and others planned for Friday.

Justice said that effort to push for a coordinated strikes came after “we understood that our incarceration was pretty much about our labor and the money that was being generated through the prison system”. He added that the prisoners, as a result, “began organizing around our labor and used it as a means and a method in order to bring about reform in the Alabama prison system”.

The full scope of Friday’s planned protests, however, has not yet emerged.
Strikes have happened at many prisons across the country over wages and conditions in the past several years.
In 2013, one of the largest coordinated inmate resistance actions to date occurred when some 30,000 inmates across California went on hunger strike to protest at penal conditions, including a heavy reliance upon solitary confinement.

ATF STING IN MILWAUKEE FLAWED—from the start

From the outset, an undercover gun-buying sting by federal agents in Milwaukee was plagued by confusion.

Local ATF agents wanted to target their longtime nemesis, the Outlaws. They had been going after the aging motorcycle gang with what they dubbed “Operation Smokin’ Piston,” breaking up untaxed cigarette operations on the south side, but were having little success nailing the gang.

It was 2011. Fellow agents with the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives familiar with the Outlaws elsewhere in the country came to Milwaukee to offer some advice: Ditch the tobacco operation. The Outlaws were savvy to that type of sting. Instead try a fake storefront, a “surplus shop” and sell T-shirts, motorcycle parts and other goods as a front. Situate the store in the gang’s prime territory: Police District 2.

That’s how to get the Outlaws, the experienced agents advised.
But higher-ups in the agency wanted a broader focus to the operation. With a violent crime rate double the national average, Milwaukee had more pressing problems.

An ATF supervisor wanted the operation to target all gun violence in the city. The sting should be located on the north side, closer to a majority of the firearms violence in Milwaukee, they said.

After the plan had been approved and without permission from headquarters, the location of the storefront was changed and Operation Fearless Distributing was hatched — not in District 2 but in a former sign factory north of downtown on a quiet street in Riverwest.

It was just the beginning of an operation marred by mismanagement and mistakes that would ultimately spark major reforms in how the federal agency conducts undercover storefront stings.

Those details and others were released in a report issued by the Justice Department’s Office of the Inspector General last week, three years after a Milwaukee Journal Sentinel investigation exposed major problems with the Fearless sting and other similar undercover operations nationwide.

The inspector general’s 112-page reportconfirmed the depth of the problems, calling them “avoidable,” and said significant reform was needed for such operations to be done correctly.

Investigators with the office also found the ATF and other federal law enforcement agencies were in violation of a 43-year-old disabilities law. Although they said they found no evidence that agents targeted people with disabilities, they found that operations in “Pensacola, Wichita, Milwaukee, and Portland storefronts each had one or two persons who regularly frequented the storefront, provided assistance to the undercover agents at times, and who were later alleged to have an I/DD (intellectual or developmental disabilities).”

Once traffic in the store picked up, problems mounted. An armed felon with armor-piercing bullets in a loaded revolver who was threatening to shoot someone was allowed to leave the store. He refused to sell his gun, saying he needed it to retaliate against those who shot his cousin. And he left.

‘An obvious flaw’

The agents had no cover team outside to stop him. Officials don’t know if he ever shot anyone. The man was arrested and charged eventually.

Agents also overpaid for guns, leading people to bring in firearms they had bought hours earlier in stores, enticed by the opportunity to turn a quick profit.

The operation was shut down after nine months when an agent’s guns, including a machine gun, were stolen from his vehicle parked at a coffee shop and the store itself was burglarized of $40,000 in merchandise, a ballistic shield and a Drug Enforcement Administration cash-counting machine, the report says.

The machine gun and a handgun have not been recovered. After the theft, a witness told an ATF supervisor that he knew of people who were selling guns to some “white, undercover, ATF person.”

After the burglary, the agents left a messy building with damaged walls and doors and then refused to pay landlord Dave Salkin, who did not know they were agents. They also were behind in rent and utility payments. The agents also left behind sensitive operations plans that included undercover officers’ names, vehicle information and cell phone numbers.

When Salkin pressed to be paid, ATF officials threatened him…

The St. Louis storefront cost $260,000 and yielded 129 guns along with heroin, cocaine and other drugs. Thirty-two people were arrested with two dozen going to the federal system.

The operation was shut down when agents learned of a pending robbery by suspects. The St. Louis sting did not lead to any other major cases, the report said.

–byJohn Diedrich and Raquel Rutledge, Milwaukee Journal Sentinel

It is a well-known fact that the ATF has targeted Motorcycle Clubs first by calling them Gangs.

This is just another bullshit sting in a long list of flawed investigations and mishandling of cases involving motorcyclist.

If the ATF has so many people that they have time to target motorcyclist just to keep them busy then it indicates they have too many agents on the payroll.

This does not even get into the court cases and the time and money to try and get convictions to justify the time and money they had already spent on bogus investigations.

AMERICAN LEGION THROWS WEIGHT BEHIND MARIJUANA RESEARCH–
The American Legion has called on Congress to remove marijuana from the list of drugs that are classified as having no potential medical use.

The Legion, the country’s largest veterans organization with 2.4 million members, passed a resolution at its annual convention last week to promote research on marijuana’s potential use for treating post-traumatic stress disorder and traumatic brain injury.

The resolution noted that with thousands of veterans from Iraq and Afghanistan diagnosed with PTSD or TBI, and the Drug Enforcement Agency’s recent approval of a study on the effectiveness of cannabis for PTSD, Congress should remove marijuana from its Schedule I designation, where it shares space with heroin, Ecstasy, LSD, Quaaludes and peyote.

“Amend legislation to remove marijuana from Schedule I and reclassify it in a category that, at a minimum, will recognize cannabis as a drug with potential medical value,” the Legion wrote in its resolution, first reported by marijuana.com.

The Drug Enforcement Agency in April approved the first randomized, controlled research in the U.S. that will use inhaled marijuana to treat PTSD.

During the convention, Dr. Sue Sisley, a lead researcher on that project and a former Veterans Affairs psychiatrist, described veterans as “exhausted and [feeling] like guinea pigs” when it comes to treatment for PTSD.

MilitaryTimes
VA docs to be able to recommend marijuana in some states

“They’re getting desperate. I could never reach that level of relief with traditional medications, so I knew I had to keep going,” she said of her efforts to pursue cannabis research for mental health conditions.

The DEA last month elected to leave marijuana on the list of Schedule I drugs. But it also ended its monopoly on growing marijuana for medical research, a move seen by advocates as a loosening of restrictions that could pave the way for more research on cannabis.

Legion leaders said their resolution was an effort for the organization to “step forward and help veterans who are suffering from PTSD.”

“There are a lot of tools that are not being utilized. Big pharma does not want them used,” former American Legion National Commander Bill Detweiler said.

Sisley called the organization’s decision to support marijuana research a “bold statement for a conservative veterans group.”

MilitaryTimes
Judge orders Illinois to add PTSD to medical marijuana list

“It’s a big breakthrough. While I can’t say definitively that medical marijuana works for PTSD — we are three years away from published data — we owe it to veterans to study this plant,” Sisley said.

Earlier this year, the House passed an amendment to a Veterans Affairs funding bill that would have allowed veterans to discuss medical marijuana with their VA doctors and VA doctors to fill out the required paperwork in states where medical marijuana is legal.

The Senate Appropriations Committee also approved a similar measure.

But during negotiations on the final version the fiscal 2017 Military Construction and Veterans Affairs appropriations bill, the provision was stripped from the legislation.

The bill has stalled in the Senate over an unrelated Zika funding provision. If the medical marijuana provision is not returned to the legislation or fails to pass as a stand-alone bill, veterans wanting to use medical marijuana must continue to go through a private doctor for a recommendation.

FROM THE AMA– Vote Like A Motorcyclist!
Important issues hinge on this election

On Nov. 8, voters will determine who will reside in the White House for the next four years, who will occupy 435 seats in the U.S. House of Representatives, who will win 34 spots in the U.S. Senate and who will occupy the governor’s mansion in 12 states.

Some of the issues these politicians are likely to address in office include increasing amounts of ethanol in our fuel supply, motorized access to public land, distracted driving, lane splitting, federal exhaust regulations for competition-only bikes, vehicle-to-vehicle communication technology and many others.

The AMA is providing this Vote Like A Motorcyclist section on its website to help riders better understand the issues and where the various candidates stand on them.

You also can learn how incumbent candidates have voted on issues important to motorcyclists and whether they have cosponsored bills favorable or unfavorable to motorcycling interests.

We encourage every motorcyclist and all-terrain-vehicle rider to become informed about the issues and the candidates and carry that knowledge into the voting booth on Nov. 8.

On this page, you’ll find a map that will link you to your state’s page, where we have listed the candidates who will appear on your ballot.

Limited time and resources don’t allow the AMA to track the positions of candidates outside the two dominant parties. So, we are asking our members to contact the candidates on their ballots to ask them about motorcycling issues. Send any candidate responses to grassroots@ama-cycle.org, and we will post them on the appropriate webpage.

You also can find a link on this page where you can register to vote, if you have not already done so.

And we have provided convenient links to all of our press releases and alerts related to the Vote Like A Motorcyclist campaign.

If you have any questions or comments about these pages or the Vote Like A Motorcyclist campaign, please contact us at grassroots@ama-cycle.org or call (202) 220-1390.

A MESSAGE FROM THE LOVE RIDE FOUNDER–
Dear friends and riders,

While we have officially ended the Love Ride’s 30+ year motorcycle charity ride and huge concert, the LOVE RIDE FOUNDATION itself will continue to forward charitable causes for underprivileged children and US veterans in the near future.

I came to this decision after an endless stream of personal letters and emails asking me to at least keep the pilot light on, if not the full blaze of the Love Ride. So I thank you for reminding me of the importance of why we started this all 32 years ago- To help those less fortunate.

We plan to take 2016 off and regroup in 2017 for a yet to be announced activity of some sort. So stay tuned for further announcements. Again, it won’t be the Love Ride charity ride and huge concert. It will be a LOVE RIDE FOUNDATION sponsored event of some sort to help those in need, which is the true spirit and camaraderie that brought me to the motorcycle community in the first place.

In closing, I am deeply grateful for your friendship and support to date. You can find me at Glendale Harley-Davidson or spending time with my many Grandchildren. Feel free to reach out with any suggestions or ideas to oliver@loveride.org

Safe travels,

–Oliver Shokouh
Chairman and Founder, the Love Ride Foundation

BIKERNET SPECIAL REPORT COMING–
Motorcycle safety and accidents in Europe.

This is a major accident study from Europe for FEMA, the European motorcycle rights foundation. They take a very different slant on accident. In many respects it’s refreshing to see someone study accidents from more directions than just helmets.

http://www.fema-online.eu/website/index.php/2016/08/05/motorcycle-safety-and-accidents/

This summary report was written by Harold de Bock, member of the board of MAG Netherlands, an FEMA member organization.

We will launch the entire article on Bikernet in the next couple of weeks. If you’re in a hurry to check it out go to the FEMA website.

INSURANCE ALERT FROM LAW TIGERS–
If You Are In A Motorcycle Accident Are You ‘Fully Insured’?

If you are in a motorcycle accident, even though it is NOT your fault, you can end up footing a lot of the medical bills.

Are You Fully Insured?

Watch this great PSA from Scootin America on what happened to him personally after he was injured in a motorcycle accident. The accident was NOT his fault. But he is still left with the ‘bill’.

If you are a motorcyclist, you are probably well aware of how quickly your life could change in the blink of an eye if you are involved in a motorcycle accident. In an instant, you may be left with debilitating injuries and in chronic pain. You may also erroneously believe that all of your medical expenses and long-term care expenses will be covered by the at-fault driver.

After all, isn’t that what insurance is for? And it wasn’t your fault! This is far from the truth. While the state of Arizona, for example, does require all individuals to carry liability insurance on their vehicles- both two-wheeled and four-wheeled, this insurance is often painfully inadequate after a serious motorcycle accident.

Even worse, many auto drivers are underinsured or not insured at all. When this happens – who pays for your expenses? Who takes care of your injuries? Who takes care of your family?

You are in a motorcycle accident and it is not your fault. Are you protected?

You are in a motorcycle accident and it is not your fault. Are you protected?

Just how much insurance is enough?

Using Arizona as an example, the minimum amounts of liability coverage required to legally operate your motorcycle in the Grand Canyon State are as follows:

$15,000 bodily injury per person
$30,000 bodily injury per accident
$10,000 property damage per accident

Yet after a catastrophic motorcycle accident, medical bills and rehabilitation expenses can quickly exceed your insurance limits. Remember, even a relatively small accident can rack up some substantial damages. Recent statistics show that a fatal motorcycle accident can cost around $1.2 million in damages and the average cost of an injury motorcycle accident can range from $2500 to over $1.4 million.

Unfortunately, if your injuries and medical expenses exceed your insurance limits or the insurance limits of the negligent driver, you may be forced to pay for your medical expenses on your own. This can result in crippling financial debt and even bankruptcy for many families.

But what happens when you are involved in an accident with an uninsured or underinsured driver? If you do not own Uninsured Motorist and Underinsured Motorist Insurance coverage, then you won’t have enough money to cover your expenses.

UM and UIM coverage will protect you, and your passenger, for any bodily injury that you may sustain in an accident involving a driver with no liability insurance, or a driver with insufficient insurance to cover your injuries, respectively. With UM and UIM, the insurance company will reimburse you compensatory damages for bodily injury caused by the uninsured driver. These damages include your medical bills, lost wages, pain and suffering, in addition to other personal injury damages.

Even though states like Arizona allow motorcyclists to opt out of UIM/UM coverage, all motorcyclists should purchase this insurance to protect themselves. In many situations, the only recovery to be made in a serious Arizona motorcycle accident will come from the UM and UIM coverage.

The Law Tigers see it happen all the time and it can be devastating. A motorcyclist feels its all going to be ok because, after all, it was not your fault. Make sure you speak to your insurance broker about as much UM/UIM as you can get. A few additional dollars now can be the best money you have ever spent protecting yourself.

Ride Safe!

Metzeler Tires and Indian Larry Motorcycles Raffling Off Famous Metzeler Custom Bike to Benefit Aidan Jack Seeger Foundation–
Metzeler Tires and Indian Larry Motorcycles will be holding a raffle to benefit the Aidan Jack Seeger Foundation, a charity established to help fight Adrenoleukodystrophy (ALD).

One lucky winner will receive an incredible prize: the world-famous Indian Larry custom METZELER custom bike that is used in METZELER’S “follow your dream” contest. The bike will be fitted with ME 888 Marathon Ultra front and rear tires that are specifically designed for mileage, performance and handling.

“In the last few years, METZELER has been an amazing partner in donating towards the battle against ALD. The Aidan Jack Seeger Foundation is honored and grateful for the support we have received from METZELER,” said Aidan’s mother and founder of the foundation, Elisa Seeger. “The donation of this motorcycle and the proceeds from it will not only help so many affected families, but raise awareness and get us closer to our mission of National ALD Newborn Screening.”

Raffle tickets will go on sale at the Indian Larry Block Party on September 17, 2016. Once the tickets are on sale, the custom METZELER motorcycle will go on the road for several events, selling raffle tickets at each one.

The events include Aidan’s Ride California October 8; Biketoberfest October 14–16; Aidan’s Ride Virginia October 23rd; and The New York Motorcycle Show December 9–11. More events are in the works for 2017, and tickets will also be available to purchase online. METZELER and Indian Larry Motorcycles will announce the winner at the 2017 Sturgis Motorcycle Rally.

“It took us four months to build it.” Said co-owner of Indian Larry Motorcycles, Bobby Seeger Jr. “It’s a bike we’re really proud of and to see it used to contribute to a worthy cause is really special.”

In total, 2,000 tickets at $50 apiece will be available. METZELER hopes to raise $100,000 and is donating 100% of the proceeds to the Aidan Jack Seeger Foundation to help in the fight against ALD.

Currently, New York is the only one of the United States to screen for ALD, thanks to Aidan’s Law, passed by the state legislature in the wake of Aidan’s tragic and untimely death. As of July 26, 2016, over 650,000 babies have been tested and 53 babies diagnosed with the disease. Thanks to early detection, these children will undergo monitoring and treatment that will allow them to live full lives.

AUSTRALIA CLUB NEWS–
Aussie Government’s proposed new anti-biker laws introduced to parliament
Wednesday, 14 September 2016

In the Australian state of Queensland, the Premier introduced new organised crime laws in Parliament yesterday with a goal to make Australia a ‘outlaw motorcycle club-free’ zone.

The laws will make it illegal to wear club colors in any public space and introduce a two-strikes-and-you’re-out approach to contact between any two convicted criminals who have committed “serious indictable offences”.

“I want to see organized crime gangs driven out of Queensland, but I don’t want to see them pop up in another state,” the Premier said.

“I want to see organised crime gangs driven out of the country altogether.”

CURRENT LAWS

No club colours in licensed venues.

¦ Club members cannot associate in groups of three or more.

¦ Mandatory sentences of 15 to 25 years for club members and office bearers.

¦ Ban on clubhouses.

¦ Crime and Corruption Commission does not have to hand over evidence potentially favourable to defendant.

¦ Mandatory minimum jail sentences for contempt of the CCC.

¦ Fear of retribution cannot be used as an excuse for not complying with CCC coercive powers.

¦ Club members cannot obtain tattoo licences or work in industries such as electrical, towing, plumbing and security.

PROPOSED LAWS

¦ No colours in any public space, with possible jail time, but penalties for wearing colors in licensed venues would be reduced.

¦ Anti-consorting laws to apply after warnings.

¦ Shorter mandatory sentences attached to new serious organized crime aggravating circumstance.

¦ Clubhouses to stay closed with new organized crime control order and public safety orders to be introduced.

¦ Bikers would not be barred from becoming electricians or plumbers but organized crime offences would be taken into account.

¦ Tattoo license bans to apply to those with organized crime convictions.

¦ A new fortification removal order to stop criminals reinforcing doors or setting up security measures.

¦ Tougher maximum penalties for drug traffickers and those dealing in child exploitation.

¦ A transitional period of two years would be in place.

UNCLE MONKEY ON THE ART OF GETTING FROM POINT A TO POINT B IN STYLE–
Since before man was man we have constantly tried different ways to get from point A to B. From swinging on branches and vines, to horses, bicycles, cars, motorcycles and spaceships, man has away found a way to go farther faster. Driving is an intimate part of that.

For many of us hitting a well worn road with our bike and closest friends is the shit, miles of asphalt and memories. For others it is a dusty pickup with a couple shotgun shells sliding across the dash as we tear up a country road. Maybe it is only the focus on the quarter directly in front of you and flashing light from the corner of your eye. Before we get there we first have to learn to drive.

Driving isn’t an innate process but rather something that we must learn, something we need to master if we don’t want the metal machines to chew us up and spit us out. It means learning the rules, learning the machine, learning the roads, learning the weather and learning the time. It is through practice we get better or at least capable.

Driving at night is just part of it. Anyone who has been caught in tornado alley as storm clouds roll in, can tell you it can become dark as night in the middle of the day. Anyone who has screamed across the open prairie under a harvest moon can tell you that you can see for miles around you in the dead of the night.

Driving on ice and snow prepares you for rain soaked roads when the water wants to carry you away. It is the reason why self-driving vehicles are still a long way away. It is the reason why we shouldn’t throw all our trust behind a mechanical machine. The safest self driving car is one that travels on rails and in the two hundred years since we mastered that, we still rely on someone behind the controls and still have train collisions.

Driving is a skill, and a skill that should be learned when our reflexes are quick enough to get us out of any trouble we stumble into.

SPITFIRE, BIKERNET CUB REPORTER FOLLOWING THE CANNONBALL DAILY ON THE BIKERNET BLOG–
Every time I see a gas station I look to see if there are old bikes. There are certain stations that seem to attract larger crowds.

Gas stops are some of my favorites. It’s fun to see the reactions of the locals as they realize something is going on. In small rural towns the news spreads like wild fire.

In one little town I saw a local police officer who just couldn’t get enough. Taking picture, chatting with the riders and I kept hearing him say, ”I ride a motorcycle”!

At the next larger stop in Mt. Carmel, I was greeted by local press, Haley, as I got off my bike. We were at Jumpin’ Jimmy’s. One of the locals went home to get some saddle bags and was trying to sell them to the riders.

“Where do you find this many old bikes?” one person exclaimed both bewildered and amazed.

Watch for the next daily chapter on the Bikernet Blog.

TAKE THE ROAD–
The Short Film Created by METZELER is Going to the Motorcycle Film Festival in New York.

From Milan to the Big Apple Via Wheels and Waves: A Tire, Three Photographers and a Special Motorcycle are Among the Protagonists

A trip that lasted a year, which had no fear of sudden climate changes: from its debut at Deus Ex Machina store in Milan, across the official launch at Breuberg, in Germany, until the experience of Wheels and Waves, painted by three photographers-guests until the arrival in New York.

The history of ROADTEC 01, the latest sport-touring tire branded METZELER, is the protagonist of the short film that will be presented at Motorcycle Film Festival in Brooklyn, which will run until September 17th. It marks the end of the TAKE THE ROAD with ROADTEC 01 campaign, the initiative organized by the German-founded tire manufacturer to celebrate this product, which was able to win the comparative tests promoted by both newspapers, Motorcycle News in Great Britain and Motorrad in Germany and considered “the best sport touring tire” by the prestigious German magazine.

The movie, which lasts 10 minutes, is the adventure of a special bike, the Project X, created by Deus Ex Machina and based on a Yamaha XJR1300 enriched by Aryk Old Paint artist, who painted the tank.

The bike, equipped with METZELER ROADTEC 01, is the protagonist of this journey that is narrated from the lens of the three photographers who wanted to spread the typical emotions of a challenge using the famous Leica cameras.

It is a journey made from the heart of Milan to Wheels and Waves event in Biarritz, along a 1,400 kilometers trail made with METZELER tires through sun, rain, wind and fog. The beautiful photographs taken along the journey will create a photo book that’s presentation is scheduled during next autumn.

In this short film there is everything: the various forms of art, as decorations and photography, up to drawings, for example on the tread pattern, which are portrayed by photographers through different shots and places which have become a symbol of this adventure.

These different styles are able to create a complementary work which tells a use of METZELER ROADTEC 01 from an unconventional point of view, unpublished and created with the aim of narrating both emotions and feelings experienced during the journey, while looking for intense fieldworks.

The movie will be screened in its world premiere at Motorcycle Film Festival in New York, crowning a project that lasted a year. It will then be exclusively available at Deus Leica Theatre in 3, Thaon di Revel street in Milan during the initiative TAKE THE ROADTM – 48 Hours of Movies branded METZELER from November 8th to 10th, during which will be aired for the Italian audience all the leading films of this Motorcycle Film Festival edition.

LONGANIMITY: long-guh-NIM-i-tee, lawng-

noun

1. patient endurance of hardship, injuries, or offense; forbearance.

Quotes
If your beauteousness scorns me, if your worth does not favour me, if your disdain is my humiliation, I shall ill be able, albeit I am well furnished with longanimity, to suffer a grief that is not merely intense but protracted.
— Miguel de Cervantes, Don Quixote, translated by John Rutherford, 2000

Origin of longanimity

Longanimity finds its roots in the Latin terms longus meaning “long” and animus meaning “spirit.” It entered English in the 1400s.

British FEMA members unite to fight for motorcyclists’ safety–
The Motorcycle Action Group (MAG UK) and the British Motorcyclists Federation (BMF) are against the use of ‘light segregation’ devices on British roads (devices in cycle lanes as a means of deterring drivers of cars and vans from entering the cycle lane). The organizations have issued a joint statement.

“The use of light segregation devices, including ‘Armadillos’, ‘Orcas’ and ‘Mini Orcas’, on our roads raises serious safety concerns in respect to riders of Powered Two Wheelers (PTWs). Inadvertent contact with the devices can quickly destabilize any two-wheeled vehicle with the potential to throw the rider into the path of other road users.

Evidence has emerged from CCTV monitoring of a Mini-Orca scheme in the City of London that clearly shows the devices to be trip hazards; 55 pedestrians having tripped on them within the first 24 hours of installation. This scheme has now been removed.

These devices are easily damaged and broken by heavy vehicles, leaving fixing bolts exposed and protruding from the road surface, thus creating a further hazard to riders and pedestrians alike. Visibility is easily compromised by scuff marks from contact with tyres, poor light and weather conditions, a build-up of general road grime and the presence of other road users.

Neither the BMF nor MAG wishes these devices to be fitted to our roads due to safety concerns for all vulnerable road users, not just motorcyclists. Both organizations call for an urgent review of all current and pending light segregation schemes in light of the evidence demonstrating their hazardous nature.”

logo_uknews_260816The BMF and MAG are the United Kingdom’s longest-running riders’ rights organizations. Over many years, both organizations have worked to fight on behalf of riders’ rights both here in the UK and abroad through FEMA.

Recognizing that both MAG and the BMF want what is best for our motorcycling community, BMF Chair Jim Freeman and MAG Chair Selina Lavender met recently. They will be in regular contact regarding shared concerns in respect to motorcycling matters.

I’M WORKING ON MY RIDE BACK FROM STURGIS STORY— I can’t wait for my Bikernet State of the Union address at the end of the year.

It will be fuckin’ amazing the accomplishments we’ve made this year. Hell, I’m about to have registration papers for my Indian. Another click off the list.

I have two exciting goals for next year. Actually, there’s three, but one started several years ago. We kicked off the Salt Torpedo a few years back. It adds a tough element when you’re not made of money, but fuck it. Anything can be accomplished with the right mindset and team. Next year we will start to make passes with that puppy, probably at El Mirage, then at the Bonneville Motorcycle Speed Trials.

There’s so much more to come. Hang on for the next installment.
