We’re shooting a promo reel for the new Biker-Build-off series in our vast and unrelenting Bikernet Nerve Center Intergalactic Headquarters, Ivory Tower, this weekend. The executive producer is of course, the magnanimous Chopper King, Hugh King from the vast empire of Chili Rellenos with his loyal subjects, the Jalapenos. It should be interesting.

AMA Pro Flat Track Racing Returns to Phoenix Arizona With The Law Tigers — For the first time in 30 years, the AMA Pro Flat Track will return to Phoenix, Arizona. The Law Tigers, America’s Motorcycle Lawyers, are honored to be sponsoring round 4 – also known as the Law Tigers Arizona Mile on Saturday, May 14th.
This is the first AMA dirt track race in the area since Bubba Shobert completed the “Grand Slam” by winning the half-mile event in Phoenix in 1986. The race is being presented by Buddy-Stubs Harley-Davidson and will be a family-friendly event for all motorcycle enthusiasts in Arizona.

While AMA Pro Racing recognizes and sanctions many different kinds of racing, the most traditional form of motorcycle racing is dirt track racing. The series is still one of the longest running championships in the history of motorsports and regarded as the most competitive form of dirt track motorcycle racing in the world.
The 2016 season will kick off on March 10th with a quarter mile race at the Daytona International Speedway in Daytona Beach, FL during Bike Week. The season will end in early October in Northern California, but not before hitting 11 different states, including South Dakota during the Sturgis Motorcycle Rally.

LEGISLATIVE REPORT FROM THE MOTORCYCLE RIDERS FOUNDATION–Here is Texas Law. Got this from our Legislative officer– Skee
Effective September 1, 2015 SB 1918 passed to add TRC 547.306 LED GROUND EFFECT LIGHTING EQUIPMENT ON MOTORCYCLE.
In this section, “LED ground effect lighting equipment” means light emitting diode (LED) technology that is attached to the underbody of a motorcycle for the purpose of illuminating:
the body of the motorcycle; or
the ground below the motorcycle.
It is not the function of the Department of Public Safety to provide legal interpretations of the Texas Transportation Code, nor is it the role of anyone in the department to dispense legal advice even regarding the traffic laws of the state. The department enforces state traffic law as its members understand it, and if necessary, issue citations for violations, all which are subject to review by courts of law.
Section §547.004 of the Texas Transportation Code prohibits the operation of a vehicle that is unsafe, not equipped in compliance, with the law, or equipped in a prohibited manner by the Transportation Code. Some would take this to mean that if the lamp is not required under Texas law, nor fits an exception, then it is prohibited, particularly if it can be shown as a distraction to other drivers or a driving hazard.
Motorcycle lighting requirements can be found in §547.801 and the general statutory restriction on vehicle lighting is §547.305, but neither specifically addresses after-market lighting. Only DOT approved equipment properly installed is definitely compliant with state and federal regulations, and that much add-on equipment is sold for off-road or show use only and is not necessarily legal for highway use.
Section §547.3215 adopts the federal motor vehicle safety standard (FMVSS) for lighting (49 CFR 571.108) for all lighting and associated equipment, unless specifically prohibited by the code. FMVSS #108 prohibits anything that interferes with or obscures federal required lighting equipment. However it does not prohibit, nor regulate, after-market lighting equipment not meant to replace original equipment manufacturer (OEM) lighting.
After-market lighting that is not DOT approved and used to replace original lighting may be illegal under Texas law if the equipment violates any provision of Chapter 547, particularly Subchapters D and E.

Outgoing President Nakagawa To Retire
Kawasaki Motors Corp., U.S.A. (KMC) has announced that Yoshitaka “Yoshi” Tamura will succeed Masafumi “Masa” Nakagawa as president of the company, effective April 1. Nakagawa has been with KMC’s parent company for 39 years and will retire after recently reaching the company’s retirement age.
Mr. Tamura returns to KMC after serving in many roles for Kawasaki, including as Director of Kawasaki Motors Europe and most recently as Associate Officer, KD Office in the Marketing and Sales division of Kawasaki’s Motorcycle and Engine Company, where he worked with Kawasaki subsidiaries around the globe. Mr. Tamura will lead KMC in celebrating the company’s 50th anniversary in North America, as well as spearheading the company’s move to its new headquarters later this year.
“Yoshi brings a wealth of experience in the powersports industry to his new position. I am confident he will continue to lead KMC to greater heights as it celebrates its golden anniversary,” said Nakagawa.
During Nakagawa’s two-year tenure at KMC, the company introduced several new products that are revolutionary in the powersports industry, including the supercharged Ninja H2 R and Ninja H2 sportbikes, and the popular MULE PRO series side x sides.
BENNETT’S PERFORMANCE SPECIAL FXR BUILD— We are going to cover a new FXR build from Bennett’s Performance. “FXRs are going crazy,” said the boss Eric Bennitt. He’s starting with the last set of S&S twin cam cases designed for Evo mounting. I tried to get S&S to keep the Evo/Twin Cam configuration alive, but it’s a no-go, at least for now.
Eric has the last, rare, as hens’ teeth, set of these cases and he’s shaving twin cam cylinders, letting Branch handle the heads, and building a hot rod motor. We will cover the rare, and most grand process on Bikernet. Hang on.

KERSEY READY TO ROAR INTO BIKE WEEK– It would be hard to find someone more excited about the 75th anniversary edition of Bike Week than Janet Kersey, one of the event’s main organizers.
Kersey is executive director and chief operating officer of the Daytona Regional Chamber of Commerce, official sponsor of the rally that is again expected to draw hundreds of thousands of visitors to Daytona Beach during its 10-day run, March 4-13.
Along with the Sturgis Motorcycle Rally in South Dakota, Bike Week ranks among the biggest motorcycle events in the country.
Kersey’s interest in Volusia County biker events began long before she started her Chamber job two years ago. As director of tourism events for the Daytona Beach Area Convention & Visitors Bureau in 1993, Kersey was a force behind the creation of Biketoberfest, a four-day October counterpart to Bike Week.
The event was designed to boost area tourism during a traditionally slow month.
She continued to oversee Biketoberfest until her departure from the visitors bureau in 2011.

Any advice for visitors to this year’s event?
Anticipating that more riders will be in town it is most important that everyone takes extra time to get around. Be patient on the roadways and look twice for riders.
What is your favorite part of Bike Week?
I’m definitely a people watcher. I love just walking around in the bright sunshine looking at everyone, and listening to their thoughts as they visit. I pick up a lot of good ideas from just hanging out and talking with our visitors. That’s the most fun for me.

BIKE WEEK ALERTS– Here’s what law enforcement officers will be watching for—
The following is a news release from the Flagler Beach Police Department:
Bike Week begins Friday, March 4 and runs through Sunday, March 13.
The Flagler Beach Police Department will be enforcing both hazardous moving violations and non-moving violations. Hazardous moving violations include, but are not limited to:
• Careless driving
• Aggressive careless driving
• Reckless driving
• Excessive speed
• Racing on a highway (drag racing)
• Driving under the influence (DUI)
The following statutes, paraphrased below, are in effect in the state of Florida:
• 316.2095 – Footrests, handholds, and handlebars: Footrests must be provided for a passenger on a motorcycle, unless it is equipped with sidecar or enclosed cab. Handlebars or handgrips cannot be higher than the top of the shoulders of the person operating the motorcycle while properly seated upon the motorcycle.
• 316.211 – Equipment for motorcycles: An eye protective device must be worn by the operator of the motorcycle.
• 316.294 – Mirrors: Every vehicle and motorcycle, operated singly or when towing any other vehicle, must have a rear view mirror that allows the driver a rear view of the highway for a minimum distance of 200 feet.
• 316.304 – Wearing of headsets: No motorcycle operator can wear a headset, headphone, or other listening device. The exception is a hearing aid or instrument for the improvement of defective human hearing.
• 316.405 Motorcycle headlights to be turned on: Headlights must be on at all times while the motorcycle or motor-driven cycle is being driven on public streets or highways.
The goal for this year’s Bike Week event is the safety of our visitors and residents through compliance with the laws of the state of Florida.

An 1939 Indian Restoration Story
Great article, love them old Indians and the new ones too. As a disillusioned Harley owner, I recently purchased 2016 Scout 60, my 1st Indian. Makes this 69-yr-old feel like a kid again. I too love all motorcycles and would love to own a vintage Indian.
For now I go between a ‘99 Road King Classic, ‘82 Virago,’16 scout 60 and a Yamaha 50 moped. Have a friend & neighbor who owns and rides a ‘46 Chief and I believe it’s unrestored.

EPA AND DRIVING POLITICS–
Not only do the Feds want to limit all vehicle modifications, but good old California is at it again. Assembly Member Jim Frazer (San Jose) plans introduce Assembly Bill 1591 to raise license fees $38 per car and add a fuel tax $.22 per gallon. The purpose is to fix our roads. Gov. Brown and his buddies will slowly move the monies into the General Fund and the roads won’t see a dime. This tax would increase each individual’s tax up $3,500 a year.
Haven’t verified if it’s true, but if it is, this is bad! What else is this @#$% administration going to do to screw this country, ban baseball next??? Forward this on to all your car buddies.
EPA Rule To Ban Car Modification
The Obama administration is looking to close down the automotive aftermarket. Tucked deep within a proposed rule making governing diesel truck engines, the Environmental Protection Agency (EPA) and National Highway Traffic Safety Administration (NHTSA) introduced language that would prohibit any changes to an automobile’s engine or exhaust after it leaves the factory. The Specialty Equipment Market Association (SEMA) raised the alarm Monday after discovering the hidden provision.
“Certified motor vehicles and motor vehicle engines and their emission control devices must remain in their certified configuration even if they are used solely for competition or if they become non-road vehicles or engines,” the proposed regulation states. “Anyone modifying a certified motor vehicle or motor vehicle engine for any reason is subject to the tampering and defeat device prohibitions of this section and 42 USC 7522(a)(3).”
The public comment period on the rule change closed last October. After the final rule is published in the Federal Register, it will have the force of law. The new regulation clarifies that road vehicles that are certified for sale in the United States can still be raced — as long as the catalytic converters and other equipment remain untouched.
“If a motor vehicle is covered by a certificate of conformity at any point, there is no exemption from the tampering and defeat-device prohibitions that would allow for converting the engine or vehicle for competition use,” the proposed rule states. “There is no prohibition against actual use of certified motor vehicles or motor vehicle engines for competition purposes; however, it is not permissible to remove a motor vehicle or motor vehicle engine from its certified configuration regardless of the purpose for doing so.”
Under existing regulations, engines produced for racing do not need to meet any emissions standards, and a road car’s engine may be modified for use in racing and offered for commercial sale without specific EPA approval (40 CFR 1068.235). Many automotive tuner shops sell parts designed for the race track to individuals interested in boosting the performance of their street vehicles. The EPA intends to close that market permanently by prohibiting the sale of high-performance engine and exhaust parts.
SEMA, which represents the $36 billion aftermarket industry, is furious and intends to battle the proposal in court. The group argues that the federal agencies violated public notice requirements by hiding the controversial proposal in a proceeding that has nothing to do with automobiles.
“This proposed regulation represents overreaching by the agency, runs contrary to the law and defies decades of racing activity where EPA has acknowledged and allowed conversion of vehicles,” SEMA President Chris Kersting said in a statement. “Congress did not intend the original Clean Air Act to extend to vehicles modified for racing and has re-enforced that intent on more than one occasion.”
The administration’s hostility to performance cars is not new. It denied long-standing regulatory exemptions to low-volume manufacturers like Lotus, forcing the British automaker out of the US market. The administration has also sought to downplay the use of internal combustion engines in auto-racing in favor of battery-powered vehicles through its “Green Racing Initiative,” claiming the change of focus will prevent global warming.

THE SLIP AND FALL CASE OF THE YEAR– Attorney Michael Hupy’s Case Selected as 2015 Litigator Award Winner– Hupy and Abraham, S.C. has received a 2015 Litigator Award, a prestigious legal accolade given to less than one percent of trial attorneys across the nation.
Given in each firm’s practice areas, Hupy and Abraham, S.C. received the award for outstanding legal representation in the “Dangerous Conditions: Slip and Fall” category.
Spearheaded by firm president, Attorney Michael Hupy, the selected case was a tragic accident involving an immigrant family from Southeast Asia. ARIZONA HELMET LAW FIGHT–
Congressman Stewart McKinney was the Congressman I talked to about introducing the amendment bill to the NHTSA and it eventually led to the hearing in Washington that led to the removal of the Blackmail Threat of Withholding Highway Funds.
Once that was done Connecticut and other states Repealed Their Mandatory Helmet Laws.
It is important for people in Arizona to contact their elected officials and let them know how they feel on this issue.

Helmet Culture War Continues
The helmet culture war – the front in the culture wars that requires motorcyclists to wear special plastic hats – just entered its fiftieth year.
Forty-three years ago a Congressman named Stewart McKinney successfully sponsored an amendment to the National Highway Safety Act of 1966 that repealed the provision that compelled states enact helmet laws. McKinney convinced his fellow Congressmen by telling them, “My philosophy concerning helmets can be summed up in three words. It’s my head.”
That was then. This is now. Now it takes a village to protect your head.
Earlier this year, an Arizona State Representative named Randall Friese – he’s a Democrat from Tucson – introduced HB 2052 which would amend Arizona’s current helmet law, which requires persons “under eighteen years of age” to wear a helmet.
Friese’s revision would read: “An operator or passenger of a motorcycle, all-terrain vehicle or motor driven cycle shall wear at all times a protective helmet on the operator’s or passenger’s head in an appropriate manner. The protective helmet shall be safely secured while the operator or passenger is operating or riding on the motorcycle, all-terrain vehicle or motor driven cycle.”
New Fee
Arizona motorcycle enthusiasts can avoid wearing a helmet while they ride if they pay an as yet undetermined fee when they register their bikes. If the law passes the amount of that fee will be determined by the Director of the Arizona Department of Transportation.
Those fees will be deposited in the Arizona Highway User Revenue Fund.
Under the proposed law, a policeman can’t stop a motorcyclist simply because he is not wearing a helmet. He has to find another reason to stop a motorcyclist. But if he does stop a motorcyclist pursuant to, say a courtesy motorcycle safety inspection, or for an unsafe lane change, or because he observes the biker’s front tire touching a white stop line, he can cite any motorcyclist who hasn’t paid the proposed fee to ride helmet free down to the nearest convenience store.
Privilege
Friese, a “trauma surgeon,” proposes “a civil penalty of five hundred dollars” for not paying the requisite fee before getting stopped by the police without a helmet. And, “two hundred dollars of each civil penalty collected shall be deposited…in the Arizona Highway User Revenue Fund and three hundred dollars of each civil penalty collected shall be deposited” in a “spinal and head injuries trust fund.”
The law hasn’t attracted much public scrutiny so far. Last month Friese told Cronkite News, “I believe, and I listen to the motorcycle riders saying ‘we want to choose,’ I don’t believe it is a right to not wear your helmet. I believe it is a privilege, just as driving is a privilege.”
Since Arizona seems to be among the most libertarian of all the states, Friese’s bill wouldn’t seem to have a much of a chance. But it is probably less likely to pass if you know about it in advance.

AMA ROOKIE CLASS NAMED– AMA Pro Racing has named The Rookie Class of ’79 as the designated charity for the 2016 AMA Pro Flat Track season. The Rookie Class of ’79 is a non-profit organization with a mission of raising funds to help injured flat track riders and their families.
“We are proud to support The Rookie Class of ’79,” said Michael Lock, CEO of AMA Pro Racing. “There are few virtues in life more admirable than helping a person in a time of need, and we are glad to assist in bringing a wider awareness to the group’s tireless efforts in that regard.”

Former Tonight Show host Jay Leno is known for his vast collection of rare automobiles. Leno is no longer on late-night television but his new show, Jay Leno’s Garage, gives the long-time comedian the opportunity to test out some of the fastest muscle cars in the world, including a 1970 Dodge Charger nicknamed “Tantrum” from Wisconsin based Speedkore Performance equipped with a twin-turbo, 9.0 L, 1350hp Mercury Racing crate engine. The engine platform is capable of 1650+hp.

NRA ALERT, Stranger Than Fiction: Gun Control Debate Leads to Discovery of New Species– Researchers have found a variety of new species on the planet in recent years. Bugs and slugs, bats and rats, mini-dragons with tails, fish that walk, pigs that live in the sea, monkeys that sneeze, translucent frogs and, well, the list of previously unknown critters goes on and on.
We think we’ve found another. This will have to be validated according to scientific protocols before we can be certain, but we think we have found . . . an honest anti-gunner.
On Tuesday, the New York Times published an opinion by Abner Mikva, previously a federal judge placed on the bench by anti-gun president Jimmy Carter, White House counsel to anti-gun president Bill Clinton, admirer of anti-gun president Barack Obama, and mentor-of-sorts to Supreme Court Justice Elena Kagan, who previously advised Clinton on gun control issues.
Like other gun control supporters, Mikva advocates requiring background checks on private sales of firearms. Following their usual script, he says, “[t]he Brady Bill’s background-check requirement applies only to sales by licensed firearms dealers. Virtually all resales of guns by private individuals are left unregulated.” Though the nation’s murder rate fell to an all-time low in 2014, Mikva insists, “The consequences of this gap are dire.”
However, unlike other anti-gunners, Mikva also makes clear where gun control supporters hope their background check expansion efforts will lead. “A more effective system would require everyone who owns or acquires a gun to register it,” he says. “Gun owners would also need a license that could be obtained by demonstrating they can use a gun responsibly, and passing a background check. Registration records would create a comprehensive database of all guns and their owners. . . . Registration could include recording the unique characteristics of a firearm’s barrel [and] stamping ammunition with identifiers.”
As we have elsewhere noted, in addition to demanding background checks on private sales of firearms, gun control supporters have introduced legislation to allow the FBI to indefinitely retain records on people who pass firearm background checks. If they completed those two goals, all that would remain to achieve the gun registration system they have long desired would be to require each background check record to include the make, model and serial number of every gun acquired as a result of the check.
It’s no coincidence that gun control supporters’ priority, which used to be getting handguns registered as a precursor to getting them banned and confiscated, is now getting all firearms sales subjected to a background check and having the FBI retain records of such checks indefinitely. Just as birds chirp, squirrels bury nuts, and dogs bark, gun control supporters are always trying to set the stage for banning guns.
LIGHTING LAWS REVISITED– A law concerning auxiliary/accent lighting for motorcycles passed this
legislative session in Wisconsin. These are the stipulations of said law.
347.07 (3) A motorcycle may be equipped with a lighting device that
illuminates the ground directly beneath the motorcycle if all of the
following apply:
(a) The lighting device is not visible to approaching vehicles.
(b) The lighting device does not display a red, blue, or amber light.
(c) The lighting device does not display a flashing, oscillating, or
rotating light.

HARLEY-DAVIDSON FACTORY FLAT TRACK TEAM TO FIELD RIDERS BRAD BAKER AND DAVIS FISHER IN AMA PRO GNC1 SERIES– The Harley-Davidson Screamin’ Eagle Factory Team will deliver a new one-two punch to the competition behind riders Brad Baker and Davis Fisher on the 2016 AMA Pro Harley-Davidson GNC1 presented by Vance & Hines flat track series. Baker and Davis, both young, hard-charging and hungry for victory, will compete in all GNC1 Twins races, beginning with the Circuit of the Americas half-mile in Austin, Texas, on April 9.
“This will be the first season since 2006 that the Harley-Davidson Factory Team has fielded two riders,” said Harley-Davidson Racing Manager Kris Schoonover. “We are excited to have the opportunity to bring an emerging talent like Davis Fisher up to the GNC1 series to ride alongside a proven champion in Brad Baker.”
Brad “The Bullet” Baker, the 2013 AMA Pro Grand National Champion, returns for his third full season with the Harley-Davidson Factory Team. The 23-year-old rider from Dryad, Wash., finished eighth in GNC1 points in 2015 while missing four races due to injury. Baker won the AMA Pro Singles Championship in 2009 before moving up to the Expert Twins class and winning the 2011 AMA Pro Flat Track Expert Rookie of the Year Award.
Davis Fisher advances to the 2016 GNC1 series following two impressive seasons racing in the AMA Pro GNC2 class. Riding for Parkinson Brothers Racing, Fisher won the 2015 GNC2 championship, dominating the series with four event wins and five second-place results to clinch his first national title with two races left on the schedule.
In 2014, Fisher finished second in GNC2, missing that championship by a single point. Fisher is 18 years old and began racing in 2005. Davis Fisher is the son of flat track racer Rex Fisher, former AMA national No. 12 and 2006 AMA Vet/Senior Dirt Tracker of the Year. Davis Fisher lives in Warren, Ore.
Veteran tuner Craig Lager returns for a 10th season as crew chief for the Harley Factory Team, assisted by rider coach and set-up expert Mike Hacker.

Heartland STEAM 2016. This is an annual seminar that brings together freedom fighters from South Dakota, North Dakota, Nebraska, Illinois, Wisconsin, and Minnesota.
This year it will be in Sioux Falls South Dakota. All proceeds go to support the MRF’s mission in DC. This is a major revenue source for the MRF and all freedom fighters from all states are welcome.

Did 25 birthdays in a row at Daytona, with Hamsters, Victory, and even the Excelsior Henderson Experiment as guests.
This year also is the 40-year anniversary of visiting my favorite country US of A. Eighty visits so far and more to come.
Lots of logistic planning to make it happen, as my day job was with the Swedish Armed Forces.

UNCLE MONKEY ON THE CRIMINAL ELEMENT– I know there are many of you who are true bad asses. Petty crimes, assaults, curb stomping, drug deals and BnE’s are just a normal day of life. You spend your life at odds against the police bewildered why the cops keep hassling you.
That is your life. You are a criminal who does crimes who should realize you are in a cat and mouse game with police who are policing to keep society on even keel. But for many more of us we are just good old boys.
We are out tearing up the back country with jacked 4×4’s. We head into town for a Friday night, carrying it through to Saturday night but come Sunday we are in a pew with blood shot eyes and pounding headaches.
We patch together makeshift vehicles to bomb around in, cut the top off the next for a lake beach cruiser. We aren’t out to harm anyone. It is when we run afoul of the police that life gets ugly. Sure there are the usual stops to tell us to settle down, maybe get out of town for a while to let the dust settle.
It is when they perceive that you are making their lives and the community`s a living hell that they will come down on you. Eyewitness accounts putting you at the scene of the crime when the rest of the town seen you on the jumbo-tron kiss cam at the game.
How about detailed reports of your bike tearing up the town, when your motor is scattered in a thousand greasy parts across the garage floor waiting weeks for a new component to arrive. If there is a disturbance in the area the police search starts and ends with you.
I’ve actually had a good relationship with the police. I know they spent half the night dealing with a belligerent drunk in his boxers and tank top on a front lawn. They babysat a junkie who overdosed for the umpteenth time until an ambulance arrived. So when they do arrive, I keep my answers polite and short. It has gotten me out of more trouble than any rant has gotten anyone.
But as good as that relationship is I would find myself accused of more serious crimes by other officers, other “community leaders”.
You see when you find yourself on the outside of a community it is very hard if not impossible to get back in. Mention of your family names explains everything, justifying their judgment of the carnage. You are the short list of suspects regardless of the crime.
You are the only one who would have done donuts on Main Street; you are the only one tearing through town at 2 am with open exhaust pipes. You are the only one who robbed the liquor store. Even when you stop kicking up dust your reputation follows to your children, and your grandchildren.

LET’S HIT THE ROAD, BUT NO—
I’m scrambling in several directions. We’re very excited about the site make-over, which should be completed in the next two months. It will be amazing!
I’m excited about working with Paughco and their team as they build our Salt Torpedo frame and we get that puppy on wheels.
I’ve run through my book. Writing books is much like building a custom bike. There’s always more to be done, but I’m feeling strong about this effort. I found another copy editor/proof reader and I may just run it through her for any final errors.
I want to start to write a piece of fiction around my building issues, but then I ran into a friend, who owns a business. His landlord offered to install a new roof coating, but used water based materials, which don’t go well with rain. It rained and he was up against five or six government agencies. Any one of them could have shut him down. A nightmare. Another friend’s dad owned an apartment house. He had a problem with a tenant who got busted for drugs. The owner was attacked by the City of Los Angeles, the renter’s board, gay rights, and ended up in court. He did nothing, but they all wanted to bury him.
It’s going to be a tough story to write and you won’t believe it, but it’s all true, I swear. On the other hand, the Redhead of Redheads is one helluva cook. She doesn’t mess around.
Received parts today from Indian, so I can install the Motherwell rack on my Indian. Hang on for the tech.
In the meantime have some fun goddammit.
