This news is packed with controversy and the fight for Freedom. I do my best to avoid politics, but I’m looking hard for a solution. Just after I wrote my Brief Manifesto, the EPA and SEMA had a meeting about new regulations. They will basically ban all car, truck, and motorcycle performance products.

If I’m not mistaken, the EPA was formed by the federal government as an advisory committee, but became a regulatory body that doesn’t answer to the government. In fact they could ban the Federal government and the government couldn’t stop them. So, of course they ignored SEMA and just announced new regulations are coming.

You’ll see the report below. I think it’s time for a change.

BONNEVILLE ALERT–
Replacing Alienation with Cooperation on Track for Bonneville Salt Flats Restoration

Back-to-back years of wet weather, coupled with years of federal mismanagement, has created unsafe surface conditions and ramped up frustrations among the land speed racing community. Save the Salt Coalition and the Utah Alliance recognized that adversarial postures would contribute nothing to the restoration of the Bonneville Salt Flats, an Area of Critical Environmental Concern, and instead spent the past six months cultivating new, productive relationships with the Bureau of Land Management (BLM), Intrepid Potash- Wendover, and elected representatives on city, state and federal levels.

The result was an unprecedented improvement in communication and cooperation between the BLM and the land speed racing community. Numerous substantive conversations percolated a vigorous exchange of information, ideas and documents. Chief among them is the possibility of withdrawing all 10 mineral leases located north of Interstate 80 from future mining.

The racing community contends that Bonneville lost millions of tons of salt over many decades due to the leases. However, only three percent of Intrepid-Potash’s current annual production is derived from all 10 leases combined. The mining company is willing to abandon the leases altogether so long as no other competitor is allowed to take them over.

We have asked the BLM to investigate the appropriate process to withdraw the 10 leases from all future mining. Normally it is a cumbersome federal process that can take years, but we are working with both BLM staff and elected officials to speed the effort.

Additionally, we are patiently waiting for the delivery of the Bingham Report, a comprehensive engineering document commissioned by the Save the Salt Coalition and Utah Alliance with short- and long-term recommendations for restoring Bonneville. This document forms the basis of the land speed racing community’s position statement.

Among the action items will be: a plan to maximize the brine return program volume as well as control the brine return by creating a containment area; protect the already fragile salt surface from additional mud drift; closing the I-80 culverts to retain laydown brine flow; shift from voluntary to mandatory salt return; require measurement, monitoring, reporting, and analysis of the salt return amounts as well as salt extracted from areas that could impact the international speedway; actively evaluate alternative mechanisms and processes for salt return.

The Save the Salt Foundation (StS) is a nonprofit organization whose mission is to restore the world-famous Bonneville Salt Flats. The Utah Alliance (UA) is a volunteer Utah-based advocacy group using its expertise and contacts at the local level to protect this Historic Place listed on the National Register.

The Save the Salt Coalition (StSc) is an umbrella group comprised of automotive and motorsports companies and organizations with a vested interest in this national treasure. All three organizations are collaborating to keep the Bonneville Salt Flats available for future generations.

Not surprisingly, this concoction made him ill, and he vomited into the fireplace in his house. The resulting explosion and fire burned his house down, killing both him and his sister.

Three Brazilian men were flying in a light aircraft at low altitude when another plane approached. It appears that they decided to moon the occupants of the other plane, but lost control of their own aircraft and crashed. They were all found dead in the wreckage with their pants around their ankles.

More Xarelto Lawsuits Filed in New Year
LawyersandSettlements.com – January 29, 2016

Since the start of the new year, more than 400 additional lawsuits relating to the medication Xarelto have been filed. The lawsuits allege that patients weren’t warned of the increased risk of bleeding associated with the medication.

Next generation anticoagulants like Xarelto have been marketed as easier to use than traditional anticoagulants because, unlike the older medications, they don’t require blood monitoring. However, many of these medications do not have an antidote, and a number of patients suffered hemorrhages and other serious bleeding events that could have been detected with regular blood monitoring.

Bellweather trials have been scheduled for early 2017, but it’s not too late for affected individuals to file suit. Currently, more than 3,000 lawsuits related to the medication are pending. The Xarelto manufacturers aren’t the only ones facing legal challenges; lawsuits have been filed against a number of newer-generation anticoagulant manufacturers for the same reason.

The GARAGE BREWED MOTO SHOW
highlights midwest bikes and builders. Held in Cincinnati on Feb 6th inside of the Rhinegeist brewery. This free to the public show lets you see what builders from midwest towns and cities are building or collecting.

The curated invitational event showcases custom, rare, antique, collectible and just plain odd bikes that are hidden away in garages and basements.

The event is hosted by an all volunteer group, the Cincinnati Cafe Racer club, which is a social club of motorcycle enthusiasts with a broad range of interests and styles (not just cafe racer style).

Our first year was 2015 where we showcased fifty motorcycles out of about 75 nominated bikes. Styles ranging from custom cafe racers, choppers, antique board track bikes, restored Indian motorcycles, rat bikes and collectable restored classics.

In 2016 we had over 110 nominations and have also narrowed it down to 50 motorcycles (not an easy task). And we added a new category for trophies: Race Bikes. The show will surely have many bikes that will surprise and delight. Each with it’s own unique story.

FREEDOM UPDATE—
I wrote the following a couple of weeks ago and challenged some organizations to pick up the fight.

You’ll see responses from a couple of prominent editors in our industry. Then, just this week I received a release from SEMA, the hot rod association regarding the EPA. A few months ago we published a letter from Drag Specialties after they were forced by the Air Resources Board in California to discontinue 280 part numbers.

This is all exploding right now and no one wants to stand up to this mess. We keep trying. Let me know, if you run across a resource or an organization willing to stand up for Freedom.

WHEN YOU CAN’T GIVE UP, WRITE–

A Brief Manifesto.
 
I have a bitch and a project that could save the custom motorcycle aftermarket and place freedom at the forefront of our nation once more.
 
Sounds ominous but it’s not, then again it is a tough alteration to current government thinking. And I believe our industry could be at the forefront.
 
Why can’t we prove that Freedom always needs to be a consideration. Why can’t we prove that all the custom motorcycles in the country will never have any significant impact on the environment and agencies need to leave us alone.
 
If we were successful, this could place Freedom at the forefront in many applications from hot rods, to go carts, to speed boats.
 
Could this become a priority in 2016?

Great! I would also consider adding that the inherent freedom in people that work with their hands is at risk at the same time since 65% or the motorcycle industry is the mom and pop shop.
 
Many of the manufacturers who serve it are from the small manufacturing segment and need the support of those who would discourage government agencies from marginalizing their ability to make and offering  the custom market and make a living to boot.

Yet we out-strip larger concerns in creativity, artistic sensibilities, hand-crafting and the kinds of grassroots skill sets that build and foster community and cultural progress. Still, government has made custom motorcycling the test bed for every onerous regulation, with environmental concerns as the excuse for this un-due attention.
 
Listen, I’m an environmentalist. I believe in appropriate stewardship of precious resources. That’s why I’m in favor of placing emphasis on the major producers of pollution and carbon emissions, the giants with coal-burning facilities and those millions of vehicles on the road whose combined emissions far outweigh the entire motorcycle market. Innovation in these segments would have massive impact.
 
Let the renegade run free! Give creative capabilities free reign to lead and innovate. As small as we are in terms of environmental impact, motorcycling is rife with authentic ideas, ability and the brilliant spark that could ignite the next big idea. If government must place restrictions, go to the volume segments, the ones doing the most damage every day we debate the issue. Our organizations: the MIC, the MRF, the AMA need to promote custom biking’s contributions and defend us as the innovators. It’s the freedom to discover, the hands-on mindset to figure out solutions, that made America what it is. Those qualities still exist in the custom motorcycle world and they absolutely must have the freedom to persist.

EPA SEEKS TO PROHIBIT CONVERSION OF VEHICLES TO RACE–
SEMA To Oppose Action As Threat to Modified Racecars and Parts Suppliers

Washington, DC (February 8, 2016) – The U.S. Environmental Protection Agency (EPA) has proposed a regulation to prohibit conversion of vehicles originally designed for on-road use into racecars. The regulation would also make the sale of certain products for use on such vehicles illegal. The proposed regulation was contained within a non-related proposed regulation entitled “Greenhouse Gas Emissions and Fuel Efficiency Standards for Medium- and Heavy-Duty Engines and Vehicles—Phase 2.”

The regulation would impact all vehicle types, including the sports cars, sedans and hatch-backs commonly converted strictly for use at the track (including motorcycles). While the Clean Air Act prohibits certain modifications to motor vehicles, it is clear that vehicles built or modified for racing, and not used on the streets, are not the “motor vehicles” that Congress intended to regulate.

“This proposed regulation represents overreaching by the agency, runs contrary to the law and defies decades of racing activity where EPA has acknowledged and allowed conversion of vehicles,” said SEMA President and CEO Chris Kersting. “Congress did not intend the original Clean Air Act to extend to vehicles modified for racing and has re-enforced that intent on more than one occasion.”

SEMA submitted comments in opposition to the regulation and met with the EPA to confirm the agency’s intentions. The EPA indicated that the regulation would prohibit conversion of vehicles into racecars and make the sale of certain emissions-related parts for use on converted vehicles illegal.

Working with other affected organizations, including those representing legions of professional and hobbyist racers and fans, SEMA will continue to oppose the regulation through the administrative process and will seek congressional support and judicial intervention as necessary.

The EPA has indicated it expects to publish final regulations by July 2016.

PEREWITZ PAINT EXTRAVAGANZA IN DAYTONA, BE THERE, BE THERE, BE THERE– Hearing the words “Daytona Bike Week” can bring on many thoughts. Warm weather, palm trees along the ocean and of course several bike shows.

Most of you who have been to Bike Week are familiar with all of the great bike shows that happen during the week. This year, bike week hosted a new show that is sure to be a success, alongside other shows such as Willie’s Chopper Show and the Cycle Source Shows.

Dave Perewitz along with his daughter Jody, launched the first “Perewitz Paint Show” held at the J&P Pavilion. Being the first of many to come, the show was a huge success and not only attracted several people, but the number of bikes to register for judging was overwhelming.

Being a part of this show and helping judge it, was personally a highlight in my career. Regardless of anything you have to say about bike styles, shapes and sizes, Dave Perewitz is one of the greatest motorbike painters of all time. He is literally responsible for paving the way for what we see painted on bikes today.

The amount of bikes entered in the show and the amazing amount of talent that went into each and every paint job, made me want to throw away my brushes. The task of judging these bikes was literally monumental.

It was an honor to be critiquing the art alongside very talented and genuinely good artists such as Chad Chambers, Bones, Tony Laramie and Mark Brodie. The opportunity was wonderful and I was able to leave the show with new knowledge and greater appreciation of the art of motorbike painting.

FLORIDA NEWS, Man accused of tossing gator into drive-thru window–

WEST PALM BEACH – Alligators have been used as shoes, briefcases, university mascots, lunch and now, authorities say, a deadly weapon.

Joshua James, 24, was arrested Monday and charged with assault with a deadly weapon without intent to kill after Florida Fish and Wildlife Conservation officials say he threw a 3.5-foot alligator through a Palm Beach County Wendy’s drive-thru window in October.

He’s also charged with illegally possessing an alligator and petty theft. Bail was set Tuesday at $6,000, and he was ordered to have no contact with animals.

Wildlife officer Nicholas Guerin said in his report that James drove his pickup truck to the window at about 1:20 a.m. Oct. 11. After an employee handed James his drink, he threw the alligator through the window and drove off. No one was hurt.

Guerin captured the alligator and released it into the wild. Guerin said James was tracked down through video surveillance and a purchase at a neighboring convenience store. Guerin wrote that James admitted throwing the alligator in a December interview. He said James told him he had found the alligator on the side of the road and put it in his truck.

James mother, Linda James, told WPTV that her son’s actions were a “stupid prank.”
“He does stuff like this because he thinks it’s funny,” she said. She said he meant no harm and had “no problem turning himself in.”

No one answered the door at homes listed to the James family. Phones listed to the family were disconnected.

CORRUPTION BILL CLEARS SENATE COMMITTEE–
An anti-public corruption bill cleared its final committee hurdle Wednesday and now will head for debate on the Senate floor. SB 582, sponsored by Sen. Don Gaetz, R-Niceville, and promoted by the USA TODAY NETWORK-Florida sites, including this site, would make it easier to prosecute misconduct by public officials.

“Literally hundreds of millions of dollars a year in extra sales taxes, school taxes, court fees, even highway tolls are caused by bid rigging, bribery, fraud and other abuses of public office,” Gaetz said when he presented the bill to the Senate Rules Committee.

The proposal implements two recommendations by a statewide grand jury convened six years ago by then-Gov. Charlie Crist to investigate corruption in Florida governments. Grand jurors advised that changing the definition of “public servant” and “corruptly” in Florida statutes would make it easier to punish bad behavior by public officials.

Current Florida law requires prosecutors to prove that defendants in corruption cases acted with corrupt intent or acted corruptly. A nearly impossible standard without a confession, according to Brevard State Attorney Phil Archer.

“It requires you to go into the mind of the defendant to prove the motivation,”
said Archer, who helped write the bill.
Gaetz’s bill makes prosecution easier by requiring only proof that defendants acted “knowingly and intentionally.”

The measure has been endorsed by Florida’s 20 state attorneys.

“It has had input from all the stakeholders, not only the prosecutors but also private businesses, they had some concerns early on. Those concerns were relieved once the bill was amended,” Archer said on Wednesday.

FINAL Southern California Stop for PIRELLI’S Monster Energy Supercross Athletes– 
The Monster Energy AMA Supercross, an FIM World Championship, returns to Petco Park in San Diego, California this Saturday, February 13, for round 6 of 17. This weekend is the final stop on the 2016 schedule for Southern California as the series prepares to head east.

BTO Sports/WPS/KTM teammate Justin Brayton has had a strong start to the 2016 season, which he has finished inside of the top-10 at the first five rounds. Last weekend he recorded his best finish of the season with a seventh place. THAT’S A WRAP—
Next week, I will try to install a new Indian performance upgrade from NightRider. Watch out, I may go to jail.

I’m still struggling with my building. I had a meeting with one of the bosses of LA City Building and Safety. He explained that he gave us an extension and that as long as I was working with them, the clock stopped ticking. Out of concern, I passed this info onto my inspector in an e-mail, but he never responded, but he did send me another threatening letter.

I ended up contacting his supervisor who returned my call. He told me e-mails don’t count from petty tax-paying citizens, and he will only accept a communication written in gold lettering from the guy I’m working with. And he cannot reach out to him on his own, but must follow chain of command, which he didn’t until I called.

Is life nuts or what? I still don’t know if they are going to throw me out or not. How would you feel?

I’ve been thinking about a Cantina Episode and a couple of wild scenarios come to mind. Actually, a lot of the Cantina Episodes are based on true stories around the harbor.

And finally I can start on the Carducci Dual Sport Sportster feature. This will be a good one for next week.

And I’m praying for an Salt Torpedo update. We need to get a move on. If they fix the salt, I want to be there.
