COMPUTER HELL THURSDAY NEWS for January 30,2014

Hey,

I have good news and bad news. The International Monetary Fund predicts the world economy will grow faster this year than in any of the last three years, said Don Lee in the Los Angeles Times. The IMF said this week that it expects a 3.7 percent increase in global output, up from 3 percent last year, “thanks largely to a strengthening U.S., economy.”

–The Week Magazine

Fuck it, I won’t go into the bad news. Life is too damn exciting to focus on any negative waves.

The Thursday News is sponsored in part by Cycle Source Magazine.

BIKERNET BAD JOKE LIBRARY– A wife says to her husband, “You’re always pushing me around and talking behind my back.” He says, “What do you expect? You’re in a wheel chair.”

• I was explaining to my wife last night that when you die you get reincarnated but must come back as a different creature. She said she would like to come back as a cow. I said, “You’re obviously not listening”.

• The wife has been missing a week now. Police said to prepare for the worst. So, I went to the thrift shop to get all of her clothes back.

• A new Muslim clothing shop opened in our shopping center, but I’ve been banned from it after asking to look at some of the new bomber jackets.

• You can say lots of bad things about pedophiles but at least they drive slowly past schools.

• Being a modest man, when I checked into my hotel on a recent trip, I said to the lady at the registration desk, “I hope the porn channel in my room is disabled.” To which she replied, “No! It’s normal people porn, you sick bastard!

• The Red Cross just knocked at our door and asked if we could help towards the floods in Pakistan. I said we would love to but our garden hose only reaches the driveway.

KESSTECH Harley Sound comes to the USA– Glendale, CA and Theres-Horhausen, Germany (January 27, 2014)—Finally, US Harley-Davidson riders have the opportunity to experience the unique KESSTECH sound.

The KESSTECH sound enables riders to enjoy a very special and true Harley experience. Harley-Davidson of Glendale / California is proud to be the first dealer in the United States to offer KESSTECH exhaust systems.

Now available at the Harley-Davidson of Glendale, the KESSTECH accessory exhaust systems impress because of their unmistakable, unique and completely legal sound, as well as because of the design that is influenced by the characteristics of the motorbike.

Christian Schütte, KESSTECH Managing Director, is delighted to be partnering with Harley-Davidson of Glendale. “We are very pleased that we have found for our U.S. launch such an established partner with Oliver Shokouh of Harley-Davidson of Glendale. Oliver is the founder of the annual motorcycle charity event, the Love Ride, and has shaped the U.S. Harley scene for decades. Over the last few months, Oliver was extremely valuable in helping us prepare for our U.S. launch, offering advice based on his extensive experience. We are proud to have him as our partner. We have long been preparing for this and now it can finally begin.”

With the Harley-Davidson of Glendale, KESSTECH brings to the U.S. its electronically adjustable sound management system, ESM2, the flagship of KESSTECH’s product family. The ESM2 generates an unmatched and beautiful rumbling sound. With the ESM2, riders can activate or deactivate the sound management system at the touch of a switch in a ¼ second at any speed and in any gear. The system conforms to EPA in all switch positions and is always legal. When the system is activated, the electronics control the sound and the volume completely automatically, so that all sound values and all performance values remain legal.

Harley-Davidson of Glendale and KESSTECH will offer the ESM2 system for Touring models, with availability for other models to follow.

KESSTECH sound systems are developed and designed in Germany. The systems are assembled and quality controlled at the German manufacturing plant. Only high-quality stainless steel is used for the systems, to ensure extreme robustness, a very long service life and functional duration.

ANTI-VLAD Act protests go global–Australia Day protests against the anti-biker laws in Queensland have gone global. Protests will be held in London, Dublin and San Francisco, California.

The British Bikers Protest starts at the Ecuadorian embassy, to highlight the plight of Wikileaks founder Julian Assange, then moves to Australia House to protest the Newman government’s Vicious Lawless Association Disestablishment (VLAD) Act.

In Dublin, riders will protest the rights to associate with a breakfast in Furry Park, followed by an assembly at the Australian Embassy at noon.

In California, the World Wide Australian Embassy/Consulate Protest Against VLAD Facebook page has organised a protest at the Australian Consulate in San Francisco on Sunday.

Social media has called for protests at “every Australian embassy and consulate” in every country.

Motorcycle USA online magazine says the San Francisco protest will have “no organized pack ride, no parade, no speeches, no amplified sound, avoiding the need for city permits”.

Bikers-Rally-at-California-Instead, people will “assemble in front of the building, hold signs, occupying half of the public sidewalk closest to the street and avoid blocking pedestrian traffic”.

Motorcycle USA blogger Bryan Harley says anti-association laws have also been passed in the US.
“Think things like this don’t happen in America? Think again. Look at what happened to the Mongols.

After a multi-state sweep by the ATF and Department of Justice called “Operation Black Rain” in 2008, “US District Court Judge Florence-Marie Cooper granted an injunction that prohibits club members, their family members and associates from wearing, licensing, selling, or distributing the logo, which typically depicts the profile of a Mongolian warrior wearing sunglasses, because according to the police, they use the logo and names as an identity and as a form of intimidation to fulfil their goals.”

“Let’s see if we can’t drum up similar support for Australian clubs because if the Queensland government is successful in its prosecution of bikers, there’s no telling who might adopt similar laws next.

“Did you know… that our own government assisted the Queensland government by providing intelligence on US based motorcycle clubs?
“The whole world is watching how things unfold in Queensland. As a global, unified motorcycle community of bikers, we cannot sit on the sidelines.”

Meanwhile Freedom Australia rides and rallies will be held in several Australian cities on Sunday with Eureka Rising rides from several cities heading to Federal Parliament in Canberra to demand an Australian Bill of Rights.

AUSTRALIA DAY FREEDOM RALLY– Queensland independent politician Peter Wellington will tell an anti-VLAD law (anti-association/anti-biker laws) Freedom Rally in Brisbane today to use the upcoming by-elections in the state seat of Redcliffe and Griffith federally to send a clear message to the Newman Government.

Mr Wellington urged voters not to waste their ballot papers out of anger but to get smart, number every box and put the LNP last.

He said yesterday that a campaign had never been run in Queensland urging voters to put one party last.

“The Newman Government isn’t listening to the opinions of eminent Australians who are all critical of the legislation,” Mr Wellington said.

“The Premier and Jarrod Bleijie aren’t listening to the thousands of Queenslanders. They need to be given the biggest wake-up call possible.”

He said there had been an increasingly significant protest vote at recent state and federal elections with people writing protest messages on ballot papers rendering them worthless.

“The Government doesn’t care about anyone else’s opinion on this issue,” Mr Wellington said.

“It’s not listening.

“It needs to be hit hard in the two by-elections.

I like the look of the REV tech 110…I never put a bike together before..although I have always wanted to. I am not even a good mechanic. Will I have trouble with this?

If it were up to me, I think I would rather a springer front end. What’s the cost? I have looked at a bunch now….my budget is limited. I look forward to your reply. Do you ship much to Canada?

THE ONE MOTORCYCLE SHOW 2014 & “21 HELMETS” EXHIBIT– Free Three-Day Collision of Custom Motorcycles To Showcase Portland’s Finest Artisans & Artists, Plus Bands and Beers. A motorcycle show for motorcyclists by motorcyclists, the event originated five years ago in Portland, Oregon with the intention to unite the ever-growing motorcycle community and to celebrate the “one” bike that defines its owner and builder.

We’re particularly excited about this years show. It has been our simple and always challenging goal to make each show twice as good as the year before. With that in mind, we listened to the comments and suggestions from last year. The overwhelming consideration was that we had outgrown the space.

Over 120 custom motorcycles + 6-8,000 attendees a day….we need a bigger space. We’re very excited to announce that we have a new location about 1/2 mile away with twice the amount of space. It’s the building of One Show Dreams. This show is the culmination of the hard work volunteered from everyone involved, and sponsorship from brands and companies who see the value in an event like this.

MOTORCYCLE SURVIVOR PLANS TO CHANGE STATE HELMET — St. Petersburg, Florida — A motorcycle crash survivor has exceeded doctors’ expectations and wants to re-write state helmet laws.

“That helmet saved my life. There are no ifs, ends, or buts about it,” said Albert Grella.

Last March, Grella swerved to miss his brother, who was riding in front of him while they were riding through Miami with their friend to the Florida Keys.

“I quickly swerved around him and looked over my shoulder, but I didn’t see the telephone pole in front of me,” said Grella. “I was thrown 65 feet they told me.”

He broke his neck, both collar bones, both arms, both legs, and many other bones.

“They flew me to Jackson Memorial Hospital to put me back together,” said Grella.

He was in surgery for 30 hours.

“He should have been paralyzed, or worse,” said his physical therapist, Kenneth Olan at Southern Pines Health Care Center.

After his surgery, Grella’s brother and friend drove him in their car to Southern Pines Health Care Center in New Port Richey to be closer to home for his therapies.

“We worried when they got here about his transportation here, but his friends wanted to do [it] because no one could afford the hospital to do it, because it costs thousands of dollars to transfer someone,” said Olan.

Olan and his partners at Southern Pines worked with Grella endlessly.

“Some days were challenging, because he thought he would be stuck in his horrible condition forever, but we started seeing incredible improvements,” said Olan. “First, he accomplished moving from his bed to his wheelchair, and then would be in the chair for an hour, and that seemed impossible initially.”

Grella did the impossible and continued to baffle doctors with his healing process.

“I say good friends, good therapists, and prayers got me through this,” said Grella.

After ten months, he is ready to leave and live independently.

“I am not only walking and driving, but I am ready to get back on a motorcycle and ride up to Tallahassee and get them to change the helmet law,” said Grella. “I will never ride again without a helmet, and no one else should either.”

Grella has been riding his bike since he was 17 years old. He is now 67.

“In 50 years, I only wore my helmet on long trips,” said Grella.

He knows that convincing his friends to sign a petition to change the law so they all have to wear their helmets will be tough.

“It’s your life, though!” said Grella. “I know it’s freedom, I know the wind in your hair, the macho look, but it’s not worth it. They have not experienced what I went through.”

Florida law states you must wear a helmet if you are under 21 years old, but you are not required to wear it if you are over 21 and you have medical insurance of $10,000 that covers motorcycle related injuries.

If he hadn’t been wearing the helmet, he would have seen the telephone pole, avoided it, and saved thousands in medical bills.–Bandit

UNCLE MONKEY ON REBUILDING A BIKE– Rebuilding a bike can be a balancing act. I wish I could say money is no object or that I have a buyer in wait throwing money at my latest bike build. Unfortunately writing is not the high paying, glamorous job some would think.

Building from scratch gives you the freedom to order and manufacture the perfect part from the get-go. Rebuilding, however, means I have lots of good original parts but they may not all fit with my overall goal and look of the bike.

It would be nice to sell off the unneeded but sadly locally motorcycle swap meets are going the way of the Dodo bird. The Regina Motorcycle Association Inc. has cancelled their annual meet replacing it with a steak night. One would have to think that the Moose Jaw Cycle Associations meet might fall to the same fate. While both events brought in large crowds very little swapping was going on and the sellers seemed to only bring out the same tired and unsold parts years after year.

Keeping the part means updating the design and look of the bike. It is not a perfect world as time and cost always help to keep the world spinning. Right now I’m wrestling with the seat on the King. Big and comfortable I look forward to rolling on the miles in it with Mrs. Monkey at my back. I can easily fix the couple of small tears in it and call it a day but it doesn’t flow into my new tank design the way I want it too.

Now I’m spinning the roulette wheel to see where I will land. I can throw it away, sell it online to the next guy, or try to rework it. Each option has its pros and cons. Each its risk and reward. At the end of the day the biker gods will win. Like any addict we will find a way to justify our decisions. We will find the money somehow somewhere. Mrs. Monkey may need to get use to mac&cheese for awhile.

Product Review By Tail Gunner

Well it’s getting that time again, warm weather and beautiful riding, long trips to freedom! Aaaah, Summer! My buddy Andy and I were talking about our annual upcoming ride to Laughlin and he decided he needed to change his riding position for the trip (old guys ya know). So, what to do? Change the seat, lower the bike, change the bars?? We decided to change the bars so his hands and arms are at a more comfy position.

HELMET BILL WARRANTS SUPPORT–South Carolina legislators are being given an opportunity to save lives and money by making mandatory the use of motorcycle helmets. But then, they’ve been given the same opportunity before and passed it by. And Gov. Nikki Haley follows their flawed line of reasoning on the issue.

It’s time for a change.

.Three state representatives, Reps. Wendell Gilliard, D-Charleston, Seth Whipper, D-North Charleston, and Carl Anderson, D-Georgetown, pre-filed a bill that would require all motorcycle riders to wear helmets.

They note that the number of motorcycle deaths is growing. Mr. Gilliard said, “This is about saving lives.”

But they also know it will not be popular with motorcycle groups who say it is their right to decide whether to wear a helmet or not.

ABATE of South Carolina, a bikers’ rights group, already is calling for people to speak out against the bill.

ABATE spokesman Chad Fuller said, “We don’t believe that helmets save lives. Education saves lives.”

Well, a person who is educated on motorcycle safety issues would know that helmets reduce by 37 percent the likelihood of death in a motorcycle crash. The Centers for Disease Control did extensive statistical research to arrive at that conclusion.

The independent FairWarning.org reported that in 1997, one of every 20 traffic deaths was a motorcyclist. By 2010, that surged to one in seven.

Even the S.C. Legislature conceded that helmets improve safety for motorcycle riders when it passed legislation requiring motorcycle riders under the age of 21 to wear a helmet.

Mr. Gilliard says it is his duty as a legislator to save lives if possible. “It’s better to be safe, to be proactive, than to be sorry.” But even those people who discount motorcycle death statistics can’t discount the financial cost of motorcycle accidents.

The CDC found that hospital charges for those suffering traumatic brain injuries were 13 times higher than for motorcyclists with other injuries. Helmets are designed to prevent traumatic brain injuries.

And about 63 percent of the cost of caring for such traumas is borne by the public.
Despite common sense, it is assured that the motorcycle lobby will talk about its freedom to choose not to wear a helmet as if it is somehow different from requiring motorists to wear seat belts.

And it will say that requiring helmets for people’s safety is the act of a Nanny State, while enforcing speed limits for people’s safety is fine.

Reps. Gilliard, Whipper and Anderson are advocating for safer streets, fewer deaths and fewer patients with expensive traumatic head injuries.

The Legislature and the governor should recognize the value of the legislation and and support it.

I just don’t get it. We pride ourselves in being a free country, but folks want to constantly throw freedoms away. I especially don’t get it, when it comes to the press. SAFETY NAZI’S ATTACKING PENNSYLVANIA–Report flags traffic safety law gaps in Pa.

By Natasha Lindstrom Calkins

HARRISBURG — Pennsylvania needs stronger seat belt laws, more stringent restrictions on teen drivers and to reinstate a law requiring motorcyclists to wear helmets, a traffic safety advocacy group concluded in a new national report.

The 2014 Roadmap of State Highway Safety Laws grades states based on 15 traffic safety laws, and it identifies legal gaps that advocates argue put drivers and the public in danger.

“The Roadmap Report provides practical and proven solutions to reduce the highway death and injury toll,” Jackie Gillan, president of the Washington, D.C.-based Highway and Auto Safety Advocates, said in a statement.

After six years of declining, U.S. deaths from motor vehicle crashes climbed in 2012, the analysis shows. Of some 2.4 million people injured in car crashes in 2012, nearly 34,000 people died – up 3.3 percent from 2011. It’s the leading cause of death for Americans between the ages of 5 and 24, the report states.

Washington, D.C., Illinois, Oregon, Delaware and California earned some of the highest Roadmap ratings, while South Dakota, Arizona, Missouri, Iowa and Florida had some of the worst.

Pennsylvania received an overall yellow “caution” rating, which means the state needs improvement because it doesn’t have enough traffic safety laws, but isn’t bad enough to reach the red “danger” rating.

The state earned higher marks for its no-texting while driving law and booster seat rules, and a mixed grade on its teen driving restrictions.

Jenny Robinson, spokeswoman for AAA Mid-Atlantic, credits the passage of the Junior Driver Law by state Rep. Kathy Watson of Bucks County with improving local safety. The law required more hours of behind-the-wheel training and limited the number of non-family passengers who can travel with young drivers.

In 2012 – the first full year the law was in place — teen car crash fatalities dropped, with 44 fatalities involving 16- and 17-year-old drivers in 2012, down from 66 in 2011, PennDOT data shows.

“We’re glad to see positive results for the teen driver law and the no-texting law,” Robinson by email. “However, we need to share the road safely, whether in a vehicle, on foot, or on a bike or motorcycle. And the increase in senior driver deaths is concerning. Pennsylvania has more than 1.7 million drivers who are 65 and older, and the number grows larger each year as our population ages. It’s more important than ever for senior drivers to assess and improve their own skills so they can keep driving safer and longer.”

Robinson pointed to at least one traffic safety-related bill introduced this legislative session: House Bill 109 by state Rep. Chris Ross of Chester County, which would fine drivers $50 if convicted of careless driving by engaging in one of several types of distractions, from eating to grooming to using electronic devices. The bill cleared the House last session on a 184-12 vote but died in the Senate.

Here are the laws the Highway and Auto Safety Advocates group says would make Pennsylvania’s roads safer:

-Primary enforcement of seat belt law.
Currently Pennsylvania police only ticket drivers for seat belt violations as a secondary enforcement offense, which means the driver must already have been pulled over for another offense. State law also requires seat belts on passengers under 18, and on front-seat passenger drivers ages 18 and older. Seventeen states don’t have primary enforcement laws for all drivers and front-seat passengers, and 33 don’t have it for rear-seat passengers.

-All-rider motorcycle helmet law.
Pennsylvania repealed its motorcycle helmet law in 2003, in response to riders clamoring for their individual rights, and over objections by groups like AAA Mid-Atlantic. Riders can choose not to wear a helmet as long as they are age 21 or older and have two years of riding experience or have passed the state’s Motorcycle Safety Program. Motorcycle crashes account for 15 percent of all U.S. motor vehicle fatalities, the report states. Nearly 5,000 Americans died from motorcycle accidents in 2012, including 210 in Pennsylvania. Thirty-one states don’t have an all-rider motorcycle helmet law.

-More restrictive teen driving requirements.

The Roadmap report argues Pennsylvania should tighten restrictions on young drivers, including stronger nighttime restriction, stronger cell phone restrictions and awarding a graduated driver’s license only to those ages 18 and older. Existing state law requires that new drivers do 65 hours of supervised driving, at least 10 of which must be at night; and doesn’t allow driving from 11 p.m. to 5 a.m. for a driver’s first six months. No states meet the advocacy group’s full list of criteria restricting teen drivers.

-Ignition interlock law for all offenders.
Pennsylvania’s existing law requires those convicted two or more times of driving under the influence to install an ignition interlock on their vehicles for one year after their suspension. Thirty-nine states still need stronger laws to for impaired drivers, the report states.

HUGE TURNOUT EMPTIES SOUP SUPPLY– Rob Domen of Rolling Thunder NC-5 stirs the chili to perfection during the Screamin’ Eagle High Performance Chili Challenge at New River Harley Davidson in Jacksonville Saturday afternoon.

John Sudbrink / The Daily News By Daily News staff

About 700 people gathered at the 7th annual Screamin’ Eagle High Performance Chili Challenge at New River Harley Davidson Saturday afternoon.

Many attendees shared the same goal: to create and vote for the best chili. Capturing first place was team Lighthouse Keepers; second place went to team Old Timers; and the People’s Choice award unanimously went to team Rolling Thunder for their immersive Vietnam jungle display.

The turnout was so great that the event ran out of chili and had to rely on community donations to continue serving hungry patrons. Other than a small amount of money set aside for administration costs, $3,300 in proceeds will benefit Semper Fi Fund and Wounded Warriors.

‘CRYUZUN’ for Crime Stoppers’ motorcycle ride raises funds for organization–

By: Christina Noce

Hundreds of motorcycles cruised through Palm Beach County on Sunday in an effort to fight crime.

Every year, Crime Stoppers holds a fundraiser so they can continue to offer cash rewards to anonymous callers who report crimes in their community.

They are the eyes that keep watch of the roads and keep your neighborhoods safe.

But today, Palm Beach County law enforcement agencies were on the road for a different reason.

“It’s our road for an hour and a half, it’s a beautiful ride for a 100 mile ride,” said Sergeant Jim Defago with the Palm Beach County Sheriff’s Office.

Crime Stoppers’ annual motorcycle ride gives officers and community members the chance to ride together for a great cause.

The money raised will pay for reward donations given to anonymous callers who call the Crime Stopper’s tip line.

Police say even traffic complaints like speeding or reckless driving can help them get a dangerous person off the road.

“We might be out there looking for something different or in the wrong corner or in the wrong area,” said Jim Theel with the Palm Beach County Sheriff’s Office.

Tips that were called in to the hotline this month alone led to 251 arrests and closed 359 unsolved cases.

YEAR END FINANCIAL REPORT FROM THE MOTOR COMPANY– Harley-Davidson has released its end of years figures and is reporting that earnings and new motorcycle sales have continued to grow in the fourth quarter of 2013 and for the full year, compared to the year-ago periods.

For the fourth-quarter, diluted earnings per share increased 9.7 percent to $0.34, primarily on strong operating results in the Motorcycles segment, including higher revenue and lower operating expense, compared to the year-ago period. Fourth-quarter net income was $75.4 million on consolidated revenue of $1.19 billion, compared to net income of $70.6 million on consolidated revenue of $1.17 billion in the year-ago period.

It is not only revenue that has increased for the Motor Company as it is also reporting that worldwide retail sales of new Harley-Davidson motorcycles grew 5.7 percent in the quarter and 4.4 percent for the full year, compared to the year-ago periods.

For the full year 2013, Harley-Davidson net income was $734.0 million on consolidated revenue of $5.90 billion, compared to full-year 2012 net income of $623.9 million on consolidated revenue of $5.58 billion. Full-year 2013 diluted earnings per share were $3.28, up 20.6 percent from EPS of $2.72 in 2012.

“Without question 2013 was an outstanding year for Harley-Davidson. We unveiled game-changing motorcycles like Project Rushmore and Street, launched surge manufacturing, celebrated our 110th anniversary with customers around the globe and delivered continued financial growth,” said Keith Wandell, Chairman, President and CEO of Harley-Davidson.

“Harley-Davidson has been relentless at driving improvements throughout the organization that enable us to design, build and deliver motorcycles with unprecedented speed, efficiency, safety and quality. Together with our dealers, we continue to broaden our customer base and inspire riders to experience our brand. In 2013, retail sales of new Harley-Davidson motorcycles to outreach customers in the US grew at more than twice the rate of sales growth to core customers, and we continued to expand the reach of our brand in international markets.

“None of these results would be possible without the great efforts of our employees, dealers and suppliers, working as one team and moving in one direction to fulfill customers’ dreams,” said Wandell. “Moving forward, we believe we are well positioned to leverage our momentum, expand our reach among new and existing customers, and further strengthen Harley-Davidson’s position as one of the world’s leading brands.”

Dealers worldwide sold 45,875 new Harley-Davidson motorcycles in the fourth quarter of 2013, compared to 43,405 motorcycles in the year-ago quarter. California City Weighs Keeping RED LIGHT Cameras Despite Accidents–Independent analysis finds red light cameras increased accidents in Walnut, California.

Walnut, California’s city council decided earlier this month to keep red light cameras clicking beyond the automated ticketing contract’s February 27 expiration date. In the face of renewed questions over the program’s effectiveness, the council renewed the contract with scandal-plagued Redflex Traffic Systems for just three months as councilmen weigh the evidence. The Australian firm has been mailing tickets, now $500 each, since 2007.

“Photo enforcement programs will typically cause an increase in rear-end type collisions and cause a decrease in broadside type collisions,” city management analyst Rosalea Layman admitted in a memo to the city council.

According to the city’s analysis, rear end collisions increased 53 percent from 5.7 to 8.7 accidents per year and broadsides dropped 21 percent from 1.4 to 1.1. By the city’s own figures, one non-injury broadside collision was traded for 21 rear end collisions, several of which involved injuries. After the cameras were activated, the city installed dedicated right and left turn lanes to improve traffic flow. The city blamed the rear end collision increase on the traffic improvements, but credited the cameras alone with the broadside collision result.

Not so fast says Jay Beeber, Executive Director of Safer Streets LA. Beeber decided to double-check the city’s analysis against ten years’ data from the California Highway Patrol’s Statewide Integrated Traffic Records System database of traffic collisions (five years before and five years after). The numbers show broadside collisions did not decrease, they doubled.

“No argument can be made that photo enforcement has improved safety at this intersection or within the city of Walnut,” Beeber wrote. “In fact, the use of red light cameras appears to have decreased safety and put roadway users at increased risk.”

Beeber faulted the city for relying on inaccurate measures of the camera’s performance.

“Since not all broadside collisions are caused by a red light violation and not all red light violations result in a broadside collision, using the general category of broadside collisions rather than the more specific category of collisions caused by red light running will provide erroneous results,” Beeber wrote. “However, since the staff report provided for the city council meeting on January 8th evaluated broadside collisions, data on those types of crashes were also evaluated.”

The state data show red light-running collisions increased 400 percent at the photo enforced intersection. Over the same ten-year period, there was no red-light related accident increase at the other intersections in Walnut. Contrary to the city’s assertion that broadside accidents are more serious, the lone red-light related collision that happened at the monitored location prior to camera activation was minor and involved no visible injuries.

Redflex issued 5053 tickets worth $2.4 million last year, about 70 percent of which were given to vehicles photographed turning right on red.

ASK A COP: Damn Those Deafeningly Loud Motorcycles–What’s it take to give a ticket to unmuffled cycles that rattle the earth and destroy any chance of enjoying nature?

by Brad Kava (Editor)

Every week Patch passes on your questions to law enforcement officers. Email yours to brad.kava@patch.com

Patch Reader: Hi I would like to know why CHP and local law enforcement agencies do not enforce muffler violations on those motorcyclists on Harley- Davidson bikes seem to always ignore. Was behind one the other day in the fast lane doing 65 plus and he passed me like I was standing still! The noise almost broke the windows, He had no mufflers whatsoever, just straight pipes! Why is this allowed??

Answer from CHP officer Bradley Sadek: Often we will observe a mechanical violation (ie: Illegal lighting, loud exhaust, tinted windows) and issue a “Fix-It ticket.” The unfortunate fact is, often those violators will correct the deficiency, get the citation signed off and paid for, then reinstall the equipment that got them the ticket in the first place.
It is also important to remember, just because a law exists, doesn’t mean it isn’t violated. We get this question often relating to window tint. Just because motorists observe a lot of tinted windows doesn’t mean we aren’t enforcing that law, and the same is true for loud motorcycles and speeders.

With motorcycle exhaust, it can be a bit more tricky. Unfortunately our hands are tied up, just a bit.

(Info from AAA’s website)

California Vehicle Code sections 27201 and 27202 established the following:

A noise limit of 92 decibels applies to any motorcycle manufactured before 1970. A noise limit of 88 decibels applies to motorcycles manufactured after 1969 and before 1973; 86 decibels applies to motorcycles manufactured after 1972 and before 1975; 83 decibels applies to motorcycles manufactured after 1974 and before 1986; 80 decibels applies to motorcycles manufactured after 1985.

Motorcycles registered in the state that are manufactured on or after 2013 or have an aftermarket exhaust system manufactured on or after 2013 must have the federal EPA noise emission label affixed to it in order to be operated, used, or parked in the state.

However, in order for us to enforce these regulations we are required to have a calibrated decibel meter! Psss….. we don’t have calibrated decibel meters.

What we do have is section 27150 (a) which requires every motor vehicle to be equipped with “An adequate muffler in constant operation and properly maintained to prevent any excessive or unusual noise.”

So what is excessive and unusual noise? If we can hear it from a distance of 50 feet, at freeway speeds, with our windows rolled up, and it is still uncomfortably loud, that is enough for us to stop that motorcycle for excessive exhaust noise.

Philippines: Protest Against License-Plates-On-Vest Law – Crazy

By Mike Werner

From all the crazy laws politicians come up with to satisfy their own enormous egos, this one has got to be the biggest, most stupidest, law every. This goes into the history books.

The politicians in Manila, Philippines are planning to 1) ban pillions from riding (in other words, you are not allowed to bring anyone on your motorcycle) and 2) make it mandatory to wear your motorcycle’s license plate on the back of you jacket/vest.

On what planet do these politicians live? Imagine having two or more motorcycles? And in a poor country, where motorcycles are often the only affordable means of transportation, where whole families are to be found on the bike … this means that can’t go to work.

What a crazy world we live in.

IDAHO NATIONAL GUARD EXPANDS POWERS–House committee advances bill giving domestic police powers to National Guard– The House Transportation and Defense Committee, on a voice vote, has approved legislation that would significantly broaden the role of the Idaho National Guard. House Bill 367 seeks to amend existing law to allow for circumstances when the Idaho National Guard and the Idaho Military Division could be utilized as a state law enforcement agency.

“There seemed to be no major opposition to this bill,” commented Rep. Linden Bateman, R-Idaho Falls. “It seems like a good idea to me and I supported it.”

The bill also seeks to formalize what is known as the Idaho National Guard Counter Drug Support Program by declaring that it may “assist federal and state law enforcement agencies in interdicting the importation of controlled substances into this state.”

Additionally, the bill declares that the military unit will be “deemed a state law enforcement agency for the purpose of participating in the sharing of property seized or forfeited and receive property and revenues.”

When reached for comment about the new legislation, Monica Hopkins of the Idaho chapter of the American Civil Liberties Union noted that “I think there should be growing concern among citizens at the militarization of our police forces. We have seen communities where federal dollars are going toward the use of tanks and other military weaponry. American citizens should be concerned at the growing militarization of local government power.”

Similarly, Wayne Hoffman of the Idaho Freedom Foundation added that “every Idahoan should be alarmed by the continued use of the military for law enforcement purposes. That is not what the military is for, that is not what the National Guard is for. Yet we’re continuing to see our military deployed for law enforcement purposes or military equipment used for everyday law enforcement purposes. It is a very frightening trend.”

Rep. Brandon Hixon, R-Caldwell, a member of the committee, told IdahoReporter.com that “there are certain parameters set with this bill that make sense for the National Guard’s collaboration with law enforcement.” Hixon said that under the provisions of the bill, the National Guard would be used only in drug crimes and what he referred to as “related lawful property seizures.”

The distinctions between military power and domestic law enforcement power have a long and varied history. The Posse Comitatus Act, passed by the U.S. Congress and signed into law by President Rutherford B. Hayes in 1878, sought to limit the power of the federal government to use military personnel for domestic purposes although state National Guard units are generally regarded as exempt from the law.

Rep. Joe Palmer, R-Meridian, chair of the committee, told IdahoReporter.com that the new legislation will be beneficial to the Idaho National Guard’s budget. He added that Gov. Butch Otter has read the proposal and approves of it.

GUN NUTS RISE UP–APPS: Protect Yourself if the Government Comes for Your Guns–Attention residents of the City of Los Angeles and Orange County:

We recently learned that local law enforcement entities are conducting firearm confiscation raids in your area on behalf of the California Department of Justice, as part of its Armed Prohibited Persons System (?APPS?) program. These raids are typically conducted without search warrants.

Be prepared! Whilethese raids are promoted by politicians as intended to disarm dangerous criminals, they actually more often target unsuspecting citizens who present no danger and have no idea that they are prohibited from possessing firearms and ammunition.

Watch this video for background on APPS?s shortcomings and injustices, and this revealing video in review of a former DOJ Special Agent who formerly conducted APPS raids.

For an overview of how these confiscations are conducted, and information about your rights when subjected to one, read this memorandum.

If you are uncertain if you are prohibited from possessing a firearm or ammunition, check your eligibility by submitting a Personal Firearms Eligibility Check application to the California Department of Justice.

If you are prohibited from possessing firearms, contact an attorney to discuss how best to restore your rights and comply with the law.

If law enforcement shows up at your home asking about firearms:
Don’t talk! Officers are trained to get people to make statements that provide “probable cause” to search and seize. Try not to even open the door.
Instead, provide the officers with this flyer, or tell the officers that you assert your right to remain silent and want to have an attorney present (actually say those words).

Do NOT consent to a search of your person, possessions, or home. Insist on a search warrant. If they don’t have a warrant, refuse the search entirely and close the door. Consult a lawyer immediately.

Confirm whether you may legally possess firearms and learn your rights! Don’t take the rap for APPS!

WOW it’s January 27, 2014 already. Where has the month gone? I don’t know about you, but I had so many things that I said that was going to do this month and now it is almost over.

Although it was a fairly productive month I had hoped to get a lot a more done.

Over the weekend I Paused and took inventory of what I accomplished and what I needed to do. Sometimes we confuse activity with productivity and end up spinning our wheels.

It seems that the procrastination of doing the things I don’t like to do has put me into a little bit of a jackpot.

Today I am making a list of priorities that I must complete today. Sometimes I get so busy with little tasks that I don’t get the important ones done. Today, I commit to complete everything on my list. I think about the saying “if you fail to plan you plan to fail” today I choose to have a plan that I will follow with benchmarks that I can tick off when completed.

Today Know: This morning I am going to review my master goal list of what I planned for 2014 and make sure I am on track. As I go through my day I am going to take a few moments to Pause and make sure that I doing what needs to be done. I am going to hold the Consciousness that I am Divinely Guided and Supplied on this journey and am Grateful for the gifts of this day.

I Know that there may be some adjustments made to the plan occasionally and that is OK. Today is going to be a productive joyful day.

Windermere’s disgraced former police chief, Daniel Saylor, was found guilty of perjury by a jury on Wednesday for lying on the witness stand during the child-rape trial of a friend.
It was the culmination of a fall from grace that began when the then-chief was arrested in January 2011, accused of covering up the allegations against that friend, Scott Frederick Bush.

By January 2013, while on probation after a year in work release on a plea deal, Saylor testified defiantly in Bush’s trial, denying that he had impeded the case.

A year later, he was led from his own trial in handcuffs Wednesday, after his fifth felony conviction: perjury in an official capital proceeding. Saylor, 47, was sentenced to eight years in state prison.

Before trial, Saylor rejected a plea offer carrying a five-year sentence.

He was accused of falsely claiming that two outside agencies recommended against charging Bush after sexual abuse allegations against the Windermere man first surfaced in 2003.

In reality, prosecutor Ryan Williams said in the state’s closing argument, Saylor “took the stand and told a statement that was not true — a lie — to undercut [Bush’s victims’] credibility,” Williams said.

On Wednesday, Saylor took the stand again, in his own defense.

He claimed his officers told him the State Attorney’s Office and Orange County Sheriff’s Office had reviewed the case in 2003 and recommended against charging Bush: “That’s what I was told.”

However, on cross examination, he acknowledged telling Bush’s jury that the case had been investigated “thoroughly” in 2003. Witnesses who testified this week said otherwise.

Sgt. Fred Westerberg, who ran the OCSO sex-crimes unit at the time, testified that one of his detectives sat in on an interview of Bush’s victims in 2003, but only as a courtesy.

“There was no recommendation, because there was no investigation,” Williams told jurors in the state’s closing.

Defense attorney William McClellan argued that Saylor was no different than any police agency head: “They get their information from … what their people are telling them,” he said.

However, Williams noted that Saylor didn’t tell Bush’s jury that the information he had was secondhand, or solely an opinion.

“When he took the stand on the behalf of Scott Bush, there was no uncertainty whatsoever,” Williams said.

Saylor was arrested in 2011 after a Florida Department of Law Enforcement probe. He later pleaded to official misconduct and other charges.
Bush was convicted of rape and sentenced to life in prison.

Saylor’s six-member jury deliberated just more than an hour Wednesday before returning their verdict. Before sentencing, Saylor asked for mercy, but continued to deny wrongdoing: “I still believe what I said was the truth,” he said.

We have all seen the articles about prosecutors Not Prosecuting members of Law Enforcement Committing Perjury during trials But in this case they are and that is Because he Lied In A Case They Were Prosecuting To Help The Defense.
Lying by Law Enforcement While Under Oath Should Be Punished No Matter What Side They Are Testifying For.

MUCH NEEDED BAD JOKE LIBRARY STILL OPEN–Ever since Bubba was a child, he always had a fear of someone under my bed at night. So he went to a shrink and told him, ‘I’ve got problems. Every time I go to bed I think there’s somebody under it. I’m scared. I think I’m going crazy.’

The shrink replied, ‘Just put yourself in my hands. Come talk to me three times a week for one year, and we should be able to get rid of those fears.’

Bubba asked, ‘How much do you charge?’

The shrink replied, ‘Eighty dollars per visit.’

Bubba said, ‘I’ll think about it.’

Six months later, Bubba met the shrink on the street. The shrink asked, ‘Why didn’t you come to see me about those fears you were having?’

Bubba explained, ‘Well, eighty bucks a visit three times a week for a year is an awful lot of money. A bartender cured me for $10. I was so happy to have saved all that money that I bought me a new pickup.’

With a bit of attitude, the shrink asked, ‘And how, may I ask, did a bartender cure you?’

I replied, ‘He told me to cut the legs off the bed. Ain’t nobody under there now.’

Stay away from shrinks. Talk to a bartender and have a drink.

INDIAN MOTORCYCLE REV UP POLARIS– It turns out six decades of collecting dust may have been just what the Indian motorcycle brand needed.

Polaris (PII), which resurrected the nameplate in August with three new bikes, said this morning that “pent-up demand” has fueled a slew of orders for the first models rolling out of factories. The long-defunct brand may put a dent in Harley-Davidson (HOG) after all.

“The shipment ramp-up was a little slower than we would’ve liked, but the initial quality is over the moon,” Polaris Chief Operating Officer Bennett Morgan said on a conference call this morning. Customers, he added, “love the styling, they love the future refinements, and it’s really kind of a lovefest.”

In the fourth quarter, traditionally a slow period for motorcycle purchases, Polaris bike sales almost doubled, to $68.8 million. That growth was driven almost entirely by the new Indians, not by Victory, the company’s other motorcycle brand.

The Indians, meanwhile, may just be getting tuned up as Polaris expands production and builds out its dealership network. Only 60 of the 140 North American dealers signed on to sell the bikes actually have them in stock, according to Chief Executive Officer Scott Wine. “The launch has been spectacular, but starting this spring we will begin to see the full potential … as consumers around the world begin to make the choice,” Wine said.

In truth, though, this was the quarter when Indian sales should have been huge—needed to be huge. It was the first period when bikes hit the market en masse and potential buyers were primed by an extensive marketing blitz and a flurry of commendable, hard-won reviews. The people scrambling to buy a new Indian in November were most likely those excited about the burnishing of a storied brand, not necessarily old-school Hog riders switching to the new bike on its merits. In the months and years to come, Indian is going to have to capture a good share of that tough, leather-chapped market if it wants to keep cruising at its current pace.

Of course, unlike Harley, Polaris doesn’t need to sell motorcycles. More than 90 percent of its business comes from dirt bikes, ATVs, and snow machines. It sprang for Indian because it seemed cool; anyone who has ever bought a motorcycle can respect that.

DIY Motorcycle-Sled Race In Russia–Here is a shot from Samara, Russia of the 10th annual international winter motor-sled “Snowdogs” competition that we’ve never heard off. The motorized sleds vary from from what is basically a motorcycle minus one wheel plus some soldered-on metal ski appendages to retro-futuristic, minimal racing bikes to… is that guy riding an airplane engine?

It’s like Bike Kill, but with motorcycles and Russians. Some weird shit. Where are the dashcams?

THE DEFINITION OF THE WEEK–A “Liberal Paradise” would be a place where everybody has guaranteed employment, free comprehensive healthcare, free education, free food, free housing, free clothing, free utilities, and only Law Enforcement has guns.

And believe it or not, such a place does indeed exist …… It’s called prison.

MANY GUN NUT REPORTS THIS WEEK–Anti-gun legislation, Senate Bill 808, is moving extremely fast. SB 808 has been scheduled to be considered in the state Senate tomorrow. It is CRUCIAL that you, your family, friends, fellow gun owners and sportsmen in California call AND e-mail your state Senator TODAY and TOMORROW urging him or her to OPPOSE SB 808. For contact information on your state Senator, please click here.

SB 808 would impose heavy restrictions and costly fees on the ability to make, or even assemble, a personal firearm, along with requiring serialization and registration of that personal firearm. If this bill is in enacted into law, it would even require all firearms made and assembled prior to enactment to have serial numbers and be registered.

Federal law allows firearms to be made and assembled for legal personal use and SB 808 is just another back-door anti-gun scheme to register firearms. There are already hundreds of superfluous gun laws on the books in California that do nothing to reduce the crime rate. Please, call AND e-mail your state Senator and let them know that California does not need any more unless gun laws and to OPPOSE SB 808. Instead, urge your state Senator to concentrate on meaningful legislation relating to school safety, mental health issues, marketing of violence as entertainment for our children and the collapse of federal prosecutions of violent criminals.

Forward this alert to your family, friends, fellow gun owners and sportsmen in California and urge them to call AND e-mail their state Senator urging them to OPPOSE this needless bill.

I’M A NUT—I think I have notions worth expanding on. I let the board members of the MRF know, when conjure up something startling. Most of the time no one responds, so I must be a nut.

For instance: You know about the McCarthy era, where the government ruined lives, jailed folks, destroyed careers, because they were paranoid about communism. I sorta think we are living through some similar times, because our government and even the press doesn’t believe in the principles the country was founded on, and freedom.

The most recent has been legalizing Marijuana. How many folks have suffered over the last four decades, and are still in prison because of bullshit Marijuana laws.

What about this terrorism stuff. Look at how many Americans are jacked up everyday because of terrorism paranoia. Hell, more government agencies are popping up daily. We pay for every intrusion in our lives with our taxes.

How about Gun Laws. It’s okay that they torture folks, beat them, jail them, break into their homes, all around the fear of guns. Why don’t we create more training programs. They want to create any excuse to jail folks over their paranoia about guns.

Finally, how about the EPA? It was designed to help deal with emissions, then someone decided that it would be cool to give them powers, because of the global warming paranoia. Then the agency had to justify their growing staff and budget with more reasons why they need to control everything that smells of fuel or oil. So, now they can put you out of business, fine the living shit out of you, and restrict you from ever tampering with anything. Hell, you can’t whittle a piece of wood with your pocket knife without a government agency telling you where to put the chips.

So, am I nuts? Maybe so, but I like the notion of freedom, and I want to fight for it. Need to find a new redhead and ride into a quiet valley in the desert and hide out.

Ride Forever,

–Bandit
