Hey,

Here’s the deal. Just returned from our ride to Half Moon Bay on a peninsula just south of San Francisco for the Legend of the Motorcycle Concourse. I thought it was located at the same austere venue as the car Concourse D’ Elegance in Pebble Beach. Half Moon Bay/Pebble Beach, what’s the difference? Just another 100 miles.

The Ride with Jeremiah, Billy Lane, Tattoo John and Christian, the boss of Sucker Punch was cool, hot and winding. We all rode kicker old bikes, except John’s rusting Evo, so we moseyed along the jagged coast at 60 mph. I’ll bring you a report in a couple of days. In the meantime let’s hit the news. Rumor has it that this Ritz Carlton event is being moved way south next year. We’ll bring you reports:

Brass Balls Bobbers and IronWorks Magazine Collaborate on a Unique Giveaway Bike– Montgomery, Alabama — April 30, 2008 — Dar Holdsworth from Brass Balls Bobbers & Choppers of Oklahoma City, Oklahoma and IronWorks magazine announce the building of a one-of-a-kind bobber to be influenced by the readers of the magazine. New subscribers and current subscribers that renew to IronWorks for a year will be automatically signed up to win the bike they helped to design.

The IronWorks readers can visit Brass Balls Bobbers website or click through IronWorks website to access the design page. Twenty-one aspects of the bike will be voted on and the parts with the highest number of votes will be installed on the bike. The magazine will update the winning parts in each issue until all the components are voted on. The build will also be covered on Bikernet.com.

The winner will be randomly selected on January 31, 2008 and will be presented with the bike at Bike Week in Daytona, Florida in March of 2009.

PANEL OKS REPEAL OF LA HELMET LAW– BATON ROUGE, La. (AP) — Louisiana should stop forcing adult motorcyclists to wear helmets, but begin requiring that new bikers undergo safety training before getting a license, a House committee voted on Tuesday.

Rep. Mert Smiley’s bill, which has Gov. Bobby Jindal’s support, would require bikers under age 18 to wear helmets, but not adults. The bill would create a mandatory training course for anyone applying for a license to operate a motorcycle.

The House Transportation committee voted 10-5 to send the bill to the House floor.

Among other things, the safety course will teach future bikers of the importance of wearing a proper helmet, instead of plastic “novelty” helmets that offer far less skull protection than authorized helmets, Smiley said. Combined with the training course, he said passage of his bill would mean the state will produce better trained and better equipped bikers.

“More people will start wearing helmets and they’ll be better educated than they are now,” said Smiley, R-Port Vincent, who is a motorcyclist.

Louisiana is one of 20 states that require all motorcyclists to wear a helmet, a statute that safety activists say saves lives in accidents.

Smiley’s bill moved forward despite opposition from James Champagne, former head of the Louisiana Highway Safety Commission, who mocked Smiley’s position as “tantamount to believing in the tooth fairy.”

Louisiana had a mandatory helmet law until Gov. Mike Foster, a motorcyclist, backed its repeal. The helmet law was reinstated under Gov. Kathleen Blanco.

Jindal, a Foster protege, included in his campaign for governor last year a pledge to support the law’s repeal, saying bikers should be able to decide for themselves whether to wear a helmet.

The instructional course on motorcycling would go into effect after July 1, 2009, to be taught by the Department of Public Safety.

I always find these report to be so slanted. It’s not just about freedom. Helmets cause accidents, break necks, etc. I wore a full helmet to Half Moon Bay, and twice almost pulled in front of a cars because the helmet blocked my peripheral vision and was in my mirror’s blind spot. –Bandit

HINES AND SCREAMIN? EAGLE V-ROD WIN AGAIN AT GATEWAY–It?s Two NHRA Wins in a Row for Hines; Krawiec Makes Semi-Finals.

MADISON, Ill.. (May 4, 2008) ? Screamin? Eagle/Vance & Hines rider Andrew Hines rode a Harley-Davidson V-Rod to his second Pro Stock Motorcycle win of the season at the 12th Annual O?Reilly NHRA Midwest Nationals presented by Castrol at Gateway International Raceway. Hines defeated NitroFish/Torco Buell rider Matt Smith in the final round to take his second consecutive win of the season and the 15th of his career. Four races into the 2008 NHRA Pro Stock Motorcycle season, Hines has appeared in three final rounds, has two wins, and leads the series by 56 points.

?Four races and three finals and two wins, it’s just a tribute to how good my team is,? said Hines. ?They like being on top and they’re giving me a motorcycle underneath me to be there a lot this year. It’s so fun right now. There’s a lot of work back at the shop for the guys and they’re just trying to dig and scrape and find anything they can to help us out. This is a perfect way to go into a month-off swing. It’s going to be fun once we get to Chicago. Everybody else in the class is going to go home and do their homework. At this point last year we went out and made 40 test runs and went out and won Chicago. We plan on doing the same thing. We’re not going to slack off any bit, we’re just going to enjoy this win right now.?

Hines qualified third for the event with a pass of 6.943 seconds, behind Chip Ellis (6.907) and Smith, who lead the field with a pass of 6.901. Screamin? Eagle/Vance & Hines rider Eddie Krawiec was right behind Hines, qualifying fourth at 6.945.

Hines opened Sunday?s elimination rounds with an event-best 6.875 pass to beat Joe DeSantis, and then defeated Karen Stoffer and Ellis to reach the final. Krawiec beat Mike Berry and Angelle Sampey before losing to Smith on the starting line in the semi-final round, as both riders posted 6.965 runs down the track. In the final, Smith and Hines left the line together but Smith?s bike faltered down the track and Hines collected the win, 6.882 to 8.098. Hines has now posted 16 consecutive six-second runs.

The win by Hines and a first-round loss by Matt Guidera shuffled the points standings after four rounds in the 2008 NHRA POWERade Drag Racing Series. Hines leads with 405 points, followed by Smith with 349, and Chip Ellis with 325. Guidera, who was second coming into Gateway, drops to fourth with 296 points. Krawiec is sixth with 220 points. NHRA Pro Stock Motorcycles will race next at the Torco Racing Fuels Route 66 NHRA Nationals, June 5-8 at Route 66 Raceway, Joliet, Ill.

DOUGZ CUSTOM PAINT HAS A REQUEST– The last couple of weeks we’ve had a noticeable increase in traffic here at the shop which – if they were profitable visits – I’d be saying ‘Praise God’! The problem is 90% of the increase is for no other reason than to just stop by to say Hi and to check out our progress on the 50th Anniversary bike.

We’ve been tracking this and in the last week alone we’ve had 49 separate visits and at least as many phone calls. If you consider each one of these a 10 minute interruption (which many can be well over that) it is really slowing down this build which we ALL know must be completed in 7 weeks.

Here’s what I’m asking for….

If you must stop in PLEASE make sure the reason you’re here is business related NOT simply to visit or ask questions about the build. We appreciate your interest, friendship and patronage more than you’ll ever know, and as good friends we know you’ll understand that we need to devote as much time as possible to this project – as we do with your’s when it is in our shop.

We’ll all have time to catch up during and after the 50th Anniversary celebration and I look forward to seeing you all at that event!

Apparently the City of East Selkirk and the gentleman who was supposed to be running the show have had some sort of fall out and we will not be able to host the show there. So in light of this rather startling last minute change of events I am announcing that the winner of Regina ? the Western Canadian Championships, to be held this weekend May 10-11, will be representing Canada at Sturgis. Basically, the “Veterans Rock & Roll Ride, Inc” a non-profit company owns and operates the motorcycle rally known as “Branson Rock Ride Remember. The “Veterans” provide the builders $10,000.00 to build a bike with a military theme. The bike can has to be delivered to the “Veterans” rally by May 15th for the rally which is the 15-18th. The Veterans own the bike.

Winner is judged on “peoples choice” and judging goes on each day. The winner is announced Saturday evening, May 17th.

DAMN, I HATE SENIOR CITIZEN JOKES–A Florida senior citizen drove his brand new Corvette convertible out of the dealership. Taking off down the road, he floored it to 80 mph, enjoying the wind blowing through what little hair he had left.

‘Amazing,’ he thought as he flew down I-75, pushing the pedal even more.

Looking in his rear view mirror, he saw a state trooper behind him, blue lights flashing and siren blaring. He floored it to 100 mph…then 110… then 120. Suddenly he thought, ‘What am I doing? I’m too old for this,’ and pulled over to await the trooper’s arrival.

Designed by Pininfarina, with coachwork by Scaglietti, this magnificent example, chassis no. 5845GT, was the fourth of only thirty-two 250 LMs built. The highlight of its extensive racing history occurred in 1965 when, capably driven by Jochen Rindt, s/n 5845GT claimed one of the most interesting victories for the 250 LM, taking first place at the esteemed Austrian Grand Prix.

The 1965 Austrian Grand Prix was a 200 mile race that was widely expected to be won by Mike Parkes in the Maranello Concessionaires 365 P2. With its exceptional balance and handling, Jochen Rindt was able to make the tyres (and fuel) last the full race, and without a pit stop he had a 31 second lead over Parkes when the chequered flag fell.

In September 1969, the car was shipped to Boston, Massachusetts in the US and later converted for road use. The dashboard was covered with leather, sliding windows replaced with wind-up windows, and seat belts and carpets were added. During the ensuing years, the car changed hands numerous times, during which it was, at one stage, a common sight on New York freeways, being used by its then owner for regular commutes into the city.

The car was purchased by its current owner in 2002, at which time it underwent a comprehensive restoration.

?The 250 LM is one of the most highly sought after of all Ferraris, and the example offered here is one of the best examples of the 250 LM and the first to be offered by RM Auctions since 2002,? says Max Girardo, Managing Director of RM?s European Operations in referring to s/n 5845GT.

THAT’S THE NEWS THAT’S FIT TO PRINT–I’m biting my tongue avoiding the jinx jerk. I’ve got a couple of hot items to discuss, but the demons of desire are holding me back. When the news breaks you’ll here it on Bikernet first.

I watched the Chopper Challenge last night and was disappointed. It’s not a build-off at all. They cover one competitor an episode, no competitive edge, there’s no ride challenge and each builder is given a box of parts and I imagine most of the contestants will receive a similar mixture of parts so all the bikes will be similar. What’s up with that?

Kirk and Greg built a cool bike, but it was an all promotional Geico bike. And, as usual with these shows, there were tremendous opportunities to study tech thinking, design and fabrication, and they glazed over most aspects. Too bad.

I don’t get it, why use an actor when you have real guys looking for something to do. I think it would be pretty easy acting for some of us, LOL. It’s very sacred ground on which they thread. It’s the last piece of the biker world that hasn’t been commercialized and made into a joke. I think it would be safe to say, “beware and do it right.”

THE BAKER DRIVETRAIN CREW RELEASES THE SYNCHRONOUS BELT DRIVE FOR SOFTAILS– From the original makers of the first Big Dog SBD finally comes an Evo Softail compatible belt drive that is built to last.

BAKER designs premium innovations only to be purchased only once by their customers, so a belt drive will be no different. BAKER R&D found that teeth easily wear down on typical aluminum pulleys. This is due to the strength modern belts have now. They reek havoc on mere aluminum pulley teeth. When the teeth wear down, the diameter wains, and belts sag. Saggy belts not only look sloppy, but can cause clearance problems, or unwanted friction issues. In extreme cases, they could fall off.

Steel is also the material of choice for the clutch basket. When a bike is launched hard, the clutch plates aggressively spank the reciprocal flanks on the clutch basket. EASYRIDERS LEGEND WINO JOE PASSES ON– Not sure if you knew or not, but Wino Joe died a few days ago. Got a note from his son-in-law Bobby. Apparently Joe banged his head falling out of his mobility chair and died a couple of days later in the hospital of a brain hematoma.

I knew Joe from the neighborhood (Half Moon Bay)and was a part of his short-lived website, “The Roadhouse Gang”.

NEWS FROM THE KING ARCHIVES–I ran into my first glitch Sunday evening with the new King. Fortunately, it happened in my garage instead of on the road, and it turned out to be an easy fix. It had rained most of the day, but the weather broke for awhile, so I decided to go for a short putt. Bike cranked but wouldn’t fire..

I know you’re thinking, what was the last thing I fucked with before this happened, because I was, too. That’s part of the Code, right? But all I did was ride for about 100 miles Saturday, stop off for a brew at a local watering hole, filled the tank, rode home and parked her in the garage. That’s it. I did change all the fluids earlier in the week, but no way could that have caused the problem.

Plenty of juice, just wouldn’t fire. Checked all the usual stuff. Run switch on, clutch disengaged. Cables OK. Plugs OK, got spark, but installed a new pair anyhow. No trouble codes. All electrics functioning normally. Fuel system fuses and ECM connection OK. CKP connection OK. I can hear the fuel pump come on. But no fuel was making it to the combustion chamber; the plugs were bone-dry. That kinda narrowed it down, I thought, to the fuel filter, bad gas (but no symptoms during the 30-mile ride home after I topped off), bad coil, bad CKP or MAP sensor, or bad ECM. Which put me right back at square one, scratching my head, and resigned to having to haul the bike into the dealer and somehow survive bikeless for awhile.

I emailed the selling dealer’s service department, describing the problem and what troubleshooting I’d done. Randy, a tech at Ray Price H-D, called me Monday morning and pointed me in the right direction. There’s a QC fitting (chrome sleeve) that seats and houses the check valve on the fuel supply line (where the petcock would be on a carbed bike). I re-seated it and she fired right up. Naturally, though, this tip isn’t included in the factory service manual’s troubleshooting guide. It’s only mentioned in the fuel tank removal/installation section.

I’ve gotta tip my hat to Randy for taking the time to call me on my cell and helping me solve the problem. His five-minute call saved me more gray hair, a tow, and possibly an hour’s shop time labor. Well, they probably wouldn’t have hit me for shop time since the bike’s still under warranty, but the tow would’ve cost me. I have a single-rail Kendon trailer, but there’s no way in hell I can manhandle an 800-lb bike onto it by myself.

And that’s one of only two positive experiences I’ve had with a H-D service department.

ANOTHER BROTHER DOWN– Thomas ‘Criminal’ Cavanaugh passed away on Monday morning, May 12, 2008. Criminal was born in Philadelphia, Pennsylvania on a Friday the 13th in 1943. He was 64.

Criminal lived in West Palm Beach, Florida for over forty years. Years ago, he owned a motorcycle shop, and later, usually worked out of his garage, continuously wrenching and helping bikers in his South Florida community when he wasn’t on the road.

He met Samantha Morgan when she was just a teenager and their lives were spent sharing the thrill and experiences that only the Wall of Death motordromes could bring. He was deeply loved by his family and enormous amounts of close friends and associates all over the world.

He would give you the shirt off his back. He may have died suddenly of a massive heart attack while planning memorial celebrations for his beloved Samantha, (as Sam Morgan passed away a week prior),he really died of a broken heart.

So lift your eyes to Heaven and give a wink, as he and Samantha look over us now, riding their motorcycles across the twilight sun’s cloud canyons. They are free at last.

RIDERS, PATRONS REACT TO ATLANTIC STATION MOTORCYCLE BAN– (FOX 5) ? Metro Atlanta motorcyclists have been banned from Atlantic Station. The popular dining and retail district no longer allows riders to drive through or park there.Motorcycles are now an unwelcome sight. The heart of the retail and dining district is off limits to motorcyclist Jarid Ison and other riders.

Video: Riders, Patrons React to Atlantic Station Motorcycle Ban — FOX 5’s Deidra Dukes reports. “We just don’t understand why, why not let a bike park there?” asked Ison.

Atlantic Station officials say they took action after facing ongoing problems.”They continually don’t abide by the code of conduct down here, continually rev their engines really loud,” said Brian Leary of Atlantic Station.

Atlantic Station started telling motorcyclists about the change last month and will soon post signs and start ticketing violators.

Atlantic Station officials said motorcyclists are welcome to park in the Target parking lot just behind the main retail district or on any of the side streets.

“It’s a nuisance, it’s a loud nuisance and a lot of time they don’t come to spend money in the area, they come to hang out,” said Atlanta resident Kenneth Johns.

Many Atlanta Station visitors said they welcomed the change.

“It’s nice to have people in a place you can walk and not worry about being run over,” said Steve Lytle of Johns Creek.

Ison said he thought motorcyclists were being unfairly targeted.

“We’re paying patrons just like somebody in a car,” said Ison.

“I know it’s tough. We do definitely apologize to the motorcycle owners and riders but in the meantime we are making the change,” said Leary.

After four strong, growing years in the domestic motorcycle market building six successful models, we recognized the country’s economic downturn and tightened our belts. We continue to build our dealer network and work with Gard Hollinger on new products and models. We’ve reached across the pond and hooked up distributors in Europe and Australia. We are refining all elements of our product from chassis to electronics.

We are just working hard to streamline our operation for the lower domestic volume. As well our R&D department is going nuts working on new ’09 models. Personally, I am extremely excited about working with my son Dustin who just graduated from the ASU engineering school with top honors and is running our production now. He?s kicking ass everyday making production sing and solving any problems rapidly. We’re preparing for a stronger economy.

Several of the executives of the three casino hotels are bikers and recently a new president came on board and said, “Let’s have a motorcycle friendly facility.” Joe Zanelli, a biker VP, immediately reached for the phone and called his secretary, “Get Bandit on the phone.”

We’ve been working ever since to help Whiskey Pete’s, Buffalo Bills and Primm Valley Resort become motorcycle friendly and a place that’s perfect as a weekend run, stop-over or perhaps an event destination. We’ll bring you more reports when I return from the desert.

BIKERNET ALERT FOR NEW H-D RIDERS–BEWARE MOBIL GAS STATIONS WITH FAST PASS TECHNOLOGY– My son just rode to Santa Maria north of LA this weekend. He was ridingwith 25 guys and several on new bikes. When they pulled into Mobil servicestations with Fast Pass technology, it shut their security systems down andthey couldn’t start their bikes. Crazy.

Here’s the response I got from H-D engineering. The H-D Security system has been verified to operate in proximity of most Speed Pass fuel pumps – no problems there. Besides, interference like that would affect the LF (125kHz) only, and that one is very short ranged, can not affect a whole group of riders at the same time.

Unfortunately, the electromagnetic environment is something we have no control over. It is always feasible, that in some locations the level of EMI may be so high as to prevent proper reception. This is why we have the back up – the PIN disarming. Cases like this only elevate the importance of PIN disarming, and our dealers should always remind our customers about this.

We operate on the by FCC specified RF band, and with the maximum power allowed. Our receiver is super heterodyne receiver, with excellent sensitivity.

More testing is taking place but the best bet is to fill up, then push your bike 20 feet from these pumps before trying to start your bike again. That way your fob signal is not interfered with.

It would be easy to assume motorcycling’s bona fide heroes have established their bravado on the tracks of the world. A safe notion, further validated by attending a race or perusing any related publications. Popular media has historically depicted the go fast sect as conquerors of all things two wheeled. The truth is, motorcycling heroics are everywhere and sometimes right next to you on your way to work.

Sure it takes serious guts to run WFO on the banks at Daytona, but let’s see any of racing’s superstars do it surrounded by giant SUVs piloted by coffee slurping, cell phone yakking commuters.

Yes, my friends we are speaking of the much maligned and in many states illegal lane splitters. These are men and women with an unpretentious goal, to get to work quickly and inexpensively. Why, you ask would they be elevated to the lofty ranks of two wheeled heroes?? If you have ever run through the tail light tunnel, you already know what it takes and the dangers that await. For those who have not, it can oddly enough, be summed up with a movie analogy. Although, I’m not a Star Wars Zealot, the second episode showcased some very useful imagery. Access your movie scene archive and pull up the land speeder scenes with Luke zipping through the heavily forested Ewok planet.

Lane splitting is much like that, only the trees are moving around and have big mirrors hanging off of them. Just picture yourself riding through a narrow corridor surrounded by undulating walls, sharp objects and the occasional, slammed in your face door. Maybe that makes the lane splitter more chump then champion, but then again, he just got to where he was going in half the time, with a third of the fuel and hasn’t a notion of what a parking problem is.

Similar to their trophy-seeking brethren, the splitters are not just people on bikes going fast; they tend to have unique personalities and machines. If you are a regular commuter, take a break from your mocha, half cafe, latte and observe the cast of characters streaming by. Like most of us, you see a lot of the same nameless faces five days a week without taking note of the real person behind those handlebars. Each one of these brave commuters is the proud member of a unique sect of the motorcycling community.

At the bottom of the lane splitter hierarchy is the new guy. Easily identified by his fresh from the dealership paper plate and crispy clean riding gear. Smart new guys ride cautiously and are apt to have a terrified, hanging-on-for-dear-life style. The careless new guys tend not to last much more than their first bike payment. Keep an eye on the bikes flowing past. The new guy will be there and each day he will improve and each new guy means one less car on the freeway.

Next rung up on the splitter pecking order is the young sportbike guy.

Attrition is pretty high with this group, as they are burdened by the unfortunate combination of youthful daring, and a bike capable of 160 miles per hour.

Look for them to be hunched over their racer replicas in full leathers toting a backpack of street clothes or quite possibly lying on the ground looking forlornly at the aforementioned machine. From here, we leap up a few steps to the rat bike commuter. Here’s a guy who has little regard for fashion, modern machinery or even routine maintenance. Generally seen on a sullied ‘80s era cruiser, with a lunch box precariously strapped to the back. He is considered by many to be the bravest of the brave and usually has the most seat time of any faction. Imagine, at one point he was the new guy, or maybe survived being sport bike guy, but these days riding is just a means to an end. He is also one of the very few riders willing to don rubber based riding gear and brave adverse weather conditions.

Then there are the big twin riders. The man’s man of lane splitters. An assemblage of riders comfortably commuting on $20,000 chrome plated tractors. For them, the hindrance of a lumbering 800lb bike is overcome by the exhaust note warning that can part traffic like Moses parted the Red Sea. Although, the slightest hint of bad weather, and most of this group tends to abandon their two-wheeled steed. As of late, this clique of bikers often coincides with the new guys. Nothing like watching an inexperienced motorcyclist on a 36-inch wide bike plowing down a 40-inch wide undulating channel.

They typically develop their skill at a fast pace or return to the safe haven of a warm Lexus.

After the big twin enthusiast, the group tends to splinter into much smaller factions. There’s giant touring bike guy, occasionally seen wedging his leviathan of a bike through the mystery lane like unchewed food through a resistant esophagus. Then there is enduro guy who has the line of sight advantage of a tall bike coupled with drawback of skittish knobby tires.

The rarely seen vintage bike guy is replete in period correct gear and a bike that is better suited for display then the rigors of commuting. Also a rarity is wild custom bike guy. This sect is actually a derivative of big twin guy but warrants his own category by the shear brazenness of riding a $40,000+ motorcycle in such hostile conditions. On the other end of the cc scale is the seldom-spotted small bike guy. Here’s a rider who eschews the bigger is better thinking of many splitters and instead straddles a bike that barely meets the minimum cc rating for freeway travel. The lightweight and quick handling of this machine is soon forgotten as its motor is forced to live on the very edge of self-destruction. Let us not forget the often-disparaged elephantine scooter enthusiast. Talk about brave, this guy not only rides the motorcycle equivalent of an over inflated lawn chair, but does so taunted by the jeers of his fellow splitters.

Now we come to the top of the heap. These are the very best of the best of the lane splitting clique. The riders who are using the right tool for the job and have the experience and presence of mind to use it well. They are the journeyman of the splitters and most often seen on a late model Dyna or sport-touring bike bedecked with side bags and wearing a knowing grin. Lacking the flash of the leather clad groups and rarely taking the risks like the younger ones, this elite band of commuters gets the job done without any vacillation or concession. The motor cop also falls into this category as many of them commute to and from their daily riding duties on the company bike. Quite a few of them spending upwards of 200 miles a day on a bike.

The Uber commuter does not ride for the glory or the fame or even to impress the opposite sex, they do it to get from point A to point B in the most efficient manner possible and they do it in the tail light tunnel. For that, they and anyone else willing to consistently ride the mystery lane are indeed the unsung heroes of motorcycling.

CALIFORNIA HELMET CASE WILL BRING DOWN THE LAW– Richard Quigley, et al. vs. California Highway Patrol, the Constitutional Case Poised to Bring Down the California Helmet Law.

As Don Blancet, the Executive Director of ABATE of California, has correctly observed in a press release graciously disseminated by our friends at the Motorcycle Riders Federation, the instant Quigley et al. v. California Highway Patrol case will pound the final nail in the coffin of the California helmet law. But in order to appreciate why this case is the undertaker that will place the helmet law 6 feet under, you will need to understand the constitutional defect that this helmet law was born with – the same defect present at the heart of the helmet law recommended to all states by the NTSB – and how our California freedom fighters have constructed the law’s coffin, a labor of 17 years, in the state and federal courts, to lay the constitutional predicate to finally put the helmet law in its grave.

The constitutional defect in both the California helmet law and that proposed by NTSB is that these laws require motorcyclists to wear helmets compliant with the federal motorcycle helmet performance standard set forth at FMVSS 218. The defect is that neither the ordinarily intelligent biker nor the law enforcement officer could possibly have any clue what FMVSS 218 requires. The rider can’t read the law and know how to comply with it; and the law enforcement officer likewise cannot possibly apply it, except arbitrarily. Section 218 states nothing about helmet fabrication or what a helmet should look like. It merely describes some laboratory procedures and some arbitrary impact criteria. Indeed, to determine whether a particular helmet complies with FMVSS 218 requires the essential laboratory equipment and appropriately trained engineers to operate it, and in the process of testing the helmet you also destroy it.

The constitutional defect is the law’s “vagueness” and the legal challenge derives from the due process clause of the United States Constitution. As explained by the United States Supreme Court:

“It is a basic principle of due process that an enactment is void for vagueness if its prohibitions are not clearly defined. Vague laws offend several important values. First, because we assume that man is free to steer between lawful and unlawful conduct, we insist that laws give the person of ordinary intelligence a reasonable opportunity to know what is prohibited, so that he may act accordingly. Vague laws may trap the innocent by not providing fair warning. Second, if arbitrary and discriminatory enforcement is to be prevented, laws must provide explicit standards for those who apply them. A vague law impermissibly delegates basic policy matters to policemen, judges, and juries for resolution on an ad hoc and subjective basis with the attendant dangers of arbitrary and discriminatory application.” Grayned v. City of Rockford, 408 U.S. 104, 108 (1971).

The road to demonstrate that the California helmet law is unconstitutional has been a tortuous one, beginning with a challenge that the law was unconstitutional as written. In Buhl v. Hannigan, the California Court of Appeals agreed that it was “absurd” to posit that the ordinary biker or law enforcement officer could examine a helmet’s fabrication and apply FMVSS 218 to determine if it complied with the California helmet law.

The Buhl case was followed by Bianco v. California Highway Patrol in which the California Court of Appeals held that where a helmet bears a “DOT” label it creates a presumption that the helmet complies with FMVSS 218, and that the presumption can be rebutted only if (1) the helmet was recalled by the manufacturer for failure to comply with FMVSS 218 or determined by NHTSA to be noncompliant with FMVSS 218, AND (2) the biker as “actual knowledge” of a recall or determination of noncompliance.

At this point California law enforcement should have recognized that the constitutional restraints on application of the law had rendered it unenforceable. The California Highway Patrol’s response to the foregoing Court of Appeals decisions, however, was to ignore them and to continue to enforce the law arbitrarily based upon the law enforcement officer’s incompetent assessment of the fabrication qualities of the helmet.

Richard Quigley and Steve Bianco then initiated litigation which would later be funded by Easyrider magazine. The bikers established in the federal district court that the California Highway Patrol had a policy and practice of illegally enforcing the law, in violation of the Court of Appeals decision in Bianco v. CHP. The federal district court issued a scathing opinion condemning the CHP for its illegal helmet law enforcement polices and the United States Court of Appeals affirmed an injunction ordering the CHP to cease and desist issuing helmet tickets unless the officer has “probable cause” to believe that the rider has “actual knowledge” that his headgear has been recalled or determined by NHTSA to be noncompliant with FMVSS 218.

Again, the CHP should have just laid down their ticket books, but again, the CHP determined instead to continue on with its illegal enforcement policy. Riders with Bikers of Lesser Tolerance in California like Richard Quigley and Steve Bianco tested the resolve of the California Highway Patrol, accumulating hundreds of helmet tickets, some for wearing the B.O.L.T. “Ill Eagle” helmet, with the Chinese manufacturer’s “DOT” label embroidered on the back, others wore sunglasses with DOT labels, or itsy bitsy teenie weenie helmets, beanie helmets, helmets looking similar to what some refer to as “novelty helmets,” and many manufactured their own smaller-than-watermelon-sized hard-shell helmets, as specifically authorized in a legal opinion authored by CHP legal counsel, appending their own DOT labels.

Quigley challenged his last dozen helmet tickets, this time urging that the California helmet law was unconstitutionally vague “as applied” by the California Highway Patrol. He interrogated the highway patrol officers and introduced the internal CHP policy memoranda and bulletins making plain the CHP’s intent to skirt the Court of Appeals decisions that defined the California helmet law; documents he’d accumulated over a dozen years fighting the CHP in court.

Ten years to the day after the United States Court of Appeals for the Ninth Circuit had upheld the injunction against the CHP’s illegal helmet law enforcement policies, Judge Barton, for the California Superior Court for the County of Santa Cruz found that the California Highway Patrol had engaged in a policy and practice of illegal helmet law enforcement, now not only in violation of the California Court of Appeals decision in Bianco, but also in violation of the Easyriders federal court injunction. The Court issued a several page, highly reasoned constitutional opinion holding that the California helmet law was unconstitutionally vague as applied.

As the Court transcripts reflect, the Court’s purpose in setting forth its reasoning in the opinion was to permit the case to be taken up to the Court of Appeals, and the California helmet law might have been laid to rest in that case. However, the California Attorney General, less concerned with upholding the California and United States Constitution than with preserving the ability of the CHP to continue to enforce the helmet law illegally, declined to appeal the case. Parenthetically, in another Quigley case which resulted in a decision by the California Court of Appeals that helmet law violations come within the California fix it ticket statute, the Court in “dicta,” meaning without either the AG or Quigley having briefed it, stated that law enforcement can conclude that a fabric helmet violates the law, but agreed again with the previous court decisions that it is well beyond the qualifications of the ordinary biker or law enforcement officers to determine if helmets manufactured out of hard materials comply with FMVSS 218 and the California helmet law. And it is the Plaintiff’s evidence that the California Highway Patrol has had the policy and practice to illegally ticket California bikers, including the Plaintiffs, arbitrarily and discriminatorily, for the entire spectrum of fabric and hard-shell helmets despite that every court has agreed that CHP officers plainly lack the ability to discern whether a helmet meets FMVSS 218 standards, the sole standard set forth in the California helmet law.

The instant litigation was initiated by Richard Quigley and several other members of Bikers of Lesser Tolerance, California, including Quig’s good friend Steve Bianco, with the intent this time to put on at trial not only the same evidence of illegal highway patrol helmet law enforcement practices as previously adduced by Quig, but the hundreds of illegal citations issued to the other B.O.L.T. Plaintiffs involving an entire spectrum of different types and construction of headgear illegally issued by the California Highway Patrol in violation of the Bianco and Easyriders constitutional decisions. Prior to his death Quig’s video deposition was taken and his testimony preserved for the trial. The other members of Bikers of Lesser Tolerance including Steve Bianco will also testify in the case, describing their several hundred citations illegally issued by the California Highway Patrol. Don Blancet, Executive Director of ABATE of California and Assistant Director of B.O.L.T. of California will testify, describing his greater than 60 helmet citations, all but three of them thrown out of court by the Judges specifically on the grounds that the citations were illegally issued in violation of the constitutional law of Bianco v. CHP.

The CHP officers who issued the citations will be interrogated, making plain that they do not understand and cannot conform to the constitutional requisites of the California and federal constitutional decisions which restrain the strict limits of legitimate application of the California helmet law. And what this evidence will amply demonstrate, is that the California helmet law isn’t being enforced in conformity with the California and federal constitutional decisions, and that, as a practical matter, it cannot be enforced constitutionally. The case is framed as an injunction and declaratory relief case to assure that it will reach the Court of Appeals. If the B.O.L.T members succeed in the trial court, we anticipate that the Court will declare that the helmet law unconstitutionally vague as applied and issue an injunction against its further enforcement; so the Attorney General will be forced to appeal. If the Court fails to enter a decision that voids the California helmet law then the Plaintiffs can then appeal and we would expect that the Court of Appeals will have no choice but to recognize that the defect in the law is its unconstitutional vagueness and that the law as reinterpreted cannot be applied constitutionally.

The litigation represents the culmination of the courageous and determined work of the Plaintiffs and other B.O.L.T. members like Richard Quigley and Steve Bianco who have fought the good fight on the streets and in the courts for the past 17 years.

The significance of the litigation extends beyond voiding the California helmet law because the due process deficiencies in the law will certainly undercut the NTSB’s efforts to impose the same law on every other state.

It will also provide the precedent for freedom fighters in every lid state to take into their state courts. Yes, this will be California appellate law. But in most states the constitutional arguments that will be upheld in this case will be “issues of first impression,” meaning issues not yet decided by the courts of the other states. When faced with an “issue of first impression” the Court’s always look to the decisions of the other states which have faced and decided the issue. And here on the issue of due process “vagueness,” this case will be the only relevant constitutional precedent in point.

As Don Blancet points out, this is indeed historic litigation. It is an honor for all involved in the case to be a part of it, and we reach out to all who would join us in this historic opportunity to take your place at the forefront of this fight. We can overturn the California helmet law. We can make plain that the law urged by NTSB is unconstitutionally vague and incapable of constitutional application. We can render NTSB’s recommendations to the states inert, undercutting the efforts of NTSB, the insurance and medical lobbies underway to obtain helmet laws in the free states.

We can shortcut by 17 years the constitutional court battles in every other lid state, and provide you the opportunity to void your helmet law decisively. Please accept this opportunity to join with ABATE of California and Delaware and Michigan and Northern Nevada as our partners in achieving freedom.

APC’S NEW ’08 HUSTLER– American Performance Cycles (APC) has added an additional bike to its 2008 model line-up.

The Hustler is a drop-seat cruiser FLH style Softail. The frame features 34 degrees rake in the neck and 3 degrees in the trees giving a total rake of 37 degrees. This is combined with a 3in stretch to create a 93in wheelbase.

Motive power for the Hustler comes from a 96ci black and chrome S&S engine fitted with an S&S Super E carb and Santee 50 CAL exhausts. This is backed by a Baker six-speed/RSD and billet closed primary. Wheels are forged one-piece billet by Forge-Tec or 80-spoke wheels. The rear 18in wheel carries a 240-section tire.

In addition the company has revealed plans to launch a lowered and stretched bagger model which will roll on either a 280 or 300 section rear tire. This as yet un-named bike will go on sale in the summer.

Hupy and Abraham, S.C. and Northeast Region A.B.A.T.E. of Illinois work together to fight biker discrimination– The much anticipated Ironhorse Roundup was scheduled for the first weekend of May, and as many as 30,000 people were expected. That is until the Mayor of Grayslake pulled the permit for the event, based on police intelligence reports. The controversy rages on; was this a safety issue or biker discrimination?

Attorney Pete Naylor, of Hupy and Abraham, S.C. represents the organizer of the event, Mark Khayat, and they are discussing legal options at this time. Meanwhile, Naylor attended and spoke at a special meeting on May 6th in Grayslake, attended by many area bikers including Hupy and Abraham,S.C. client Dave White and Wisconsin BOLT member, Mike Greenwald. AFFILIATE EVENT, BUS WINS TICET TO STURGIS AT ROD ‘N CUSTOM SHOW– INTERNAL – The 2nd annual Rod ‘n Custom Show, held at the HungExpo exhibition center in Budapest, Hungary, took place over the weekend of May 3-4 and is the latest in the series of events affiliated to the Official World Championship of Custom Bike Building.

The competition attracted 68 bikes entered by 31 builders from 14 countries. Winner of the ‘Absolut’ class was Roman Bus of custom shop Wildstyle in the Czech Republic who picked up a prize of 5000 Euros as a contribution to his expenses in attending the Official World Championship of Custom Bike Building in Sturgis over August 3-6.

Bus’s bike, “Event Horizon”, also won the Professional prize, and featured a 200 cui motor specially constructed by Duex Industries of Hamburg, Germany, a hand-made one-off frame with integrated oil tank and a hand-made rear fender containing the gas tank.

The event attracted over 16000 visitors and is being hailed as Eastern Europe’s biggest custom event.

The third annual Legend of the Motorcycle Concours d?Elegance, the world-class event exclusively for motorcycles, enjoyed its third year with enormous acclaim, a star-studded attendance and an incomparable roster of entries.

In attendance at the Saturday, May 3rd event were approximately 6,000 participants and attendees from five continents, admiring nearly 300 of some of the best motorcycles in the world and raising thousands of dollars for charity.

The featured marques were MV Agusta and Norton, with a historic and astounding gathering of the legendary Italian bike and one of the most significant assemblies of competition and pedigree Nortons in the world. From an 1894 Hildebrand & Wolfmueller Replica brought from Germany, to the only Merkel ?U? board track racer known to exist, to the Airstream chopper built and unveiled by Jesse James, every facet of motorcycle sport and culture was represented.

Giacomo Agostini, the greatest Grand Prix racer of all time, came from Italy with his family to receive the Lifetime Achievement Award, which was conferred by World Champion Phil Read who came over from England for the occasion.

The new chiefs currently working in the Kings Mountain headquarters include Chris Bernauer, General Manager and Nick Glaja, VP of Engineering.

General Manager Chris Bernauer is a lifetime motorcycle enthusiast and has been riding since he was 10 years old. ONSITE PSC– introduces a new twist on our proven Spill Containment line of products! RESPONDER Series has been improved to better contain the Decontamination procedures in the field. It’s the same, quick-deploying unit, and now, with an “continuous containment” feature, that doesn’t allow washdown fluids to leak in between Decon Stations.

The “Flap” is done in a bright Red Color, so Responders can see through the face shields (most cases, there are two) and distinguish where to step-over, and into the next stage. It also acts as the cover between units, and the “hook-loop” attachment secures ONSITE units from “sliding” that can occur when the Primary (Ground tarp) containment becomes wet, usually due to wash down solution getting past the containment unit. There is also adequate space, we call the “Thru-Slot” so water hoses can pass underneath, without compromising the space within the ONSITE unit, or having to drag hose around the perimeter

Deployment is extremely simple, and uses no hardware or tools. Using the Containment Cover, assembling the standard Three-Stage De con Station, can take ONE Responder Crew member less than Five (5) minutes to set up. Not Bragging. Just the facts

MR. KELLY PROMOTED AT S&S– S&S Cycle is pleased to announce the promotion of Howard Kelly to Communications Manager. Howard joined S in December of 2004, after spending eight years as the editor of HOT BIKE and STREET CHOPPER Magazines, two years on HOT ROD BIKES Magazine and just over one year at MOTORCYCLIST Magazine. He started out as the Customer Support Communications Specialist, his focus heavy on the creation of S Service Manuals. Through his time at S, Kelly has gravitated to handling media and advertising, in addition to overseeing web and video production. Drawing heavily on his publishing background, Kelly is well-suited to supply information to magazines that is to the point, and ready for their publications. ?When the opportunity to move to La Crosse and work for S&S came along I was very excited. I have used S parts on my bikes for as long as I have owned v-twins, and had visited the Viola facility countless times over the years. BRASS BALLS BOBBERS TAKES WELDING TO AN ART FORM—Sam Wills, Master Fabricator for Brass Balls Bobbers, hand builds the custom-production bobber motorcycles for Darwin Motorcycles. Each frame is built with 1-inch diameter by .156-inch wall D.O.M. tube with a 1026 medium carbon steel that is easy to weld and machine.

Sam comes from a top fuel racing background and uses the fabrication techniques to hand weld and hand fit frames that are the straightest and strongest frames available today.

Each frame is TIG welded. TIG stands for Tungsten Inert Gas welding and is also called Heliarc?.TIG is used by Sam because it is precise and provides a perfect finish that requires little to no finish work. It is an ideal process for Brass Balls Bobbers. Many enthusiasts have commented that the frame welds are pieces of art and really show the craftsman work of the entire motorcycle.
