House Passes Highway Bill – Biker Priorities Included

Thursday morning the full House of Representatives passed H.R. 3684 the Investing in a New Vision for the Environment and Surface Transportation in America Act or the INVEST in America Act. This bill is more commonly referred to as the highway bill. The bill is over 1,500 pages, spends $715 billion and includes five beneficial provisions for motorcyclists. The final vote on passage was 221 for and 201 against. Two Republicans voted in favor and no Democrats opposed. The Senate has begun work on their version of the highway bill and the two chambers will eventually need to work out the differences before an agreed upon bill is sent to the President for his signature. Traditionally, a highway bill has a five-year lifespan before Congress must fund and reauthorize programs again. Typically, highway bills occur in years ending in 0’s and 5’s. The last highway bill expired in 2020 but was given a one-year extension as Congress was unable to reach a compromise. Congress now faces a September 30th deadline to pass a new highway bill and reauthorize crucial transportation and safety related programs. Below is a brief recap of the five motorcyclist related items that the House of Representatives approved and included in this major piece of legislation: Profiling: The bill includes an update to current federal law on the issue of motorcycle only check points. The bill passed today includes language that prohibits state and local governments from using funds from the Department of Transportation to “profile and stop motorcycle operators or motorcycle passengers using as a factor the clothing or mode of transportation of such operators or passengers.” Traffic Stop Data Collection: An amendment to the bill by Congressman Tim Walberg (MI-R) and Congressman Michael Burgess (TX-R) added the term “mode of transportation” to a newly created

Highway Bill Unveiled for 2021

Last week, the U.S. House of Representatives Committee on Transportation and Infrastructure unveiled its 2021 highway bill, titled the Investing in a New Vision for the Environment and Surface Transportation (INVEST) in American Act. As you may remember, every five years Congress is required to reauthorize many of the highway related spending bills it passes. The current highway bill, known as the FAST Act, was given a one-year extension last year and is set to expire in September of 2021. The bill introduced Friday is a key component of the major infrastructure spending push the Biden Administration has made a top priority. For the last two years, the Motorcycle Riders Foundation and its members have diligently educated and lobbied lawmakers about the need to include motorcyclist specific priorities in a new highway bill. These grassroots efforts were given a boost with the inclusion of three major motorcyclist specific items in the bill. The Democrat lead bill includes the following provisions in its nearly 1,300 pages of text: Expanded prohibition on motorcycle only check points, including prohibiting using the clothing or apparel of riders or their passengers to profile or target bikers. Reestablishment of the Motorcyclist Advisory Council, which gives bikers a voice within the Federal Highway Administration. Included in the bill, a seat on the council is specifically designated for a “representative of a national motorcycle foundation.” Inclusion of motorcycles as a specific category that autonomous vehicle studies must account for during the testing of this new technology. Additionally, a motorcyclist rights organization is assigned a seat on an autonomous vehicle working group at the U.S. Department of Transportation. Oregon governor blocks motorcycle ‘lane splitting’ bill

However, despite bipartisan approval and hundreds of letters of written testimony — overwhelmingly in favor of the “lane splitting” legislation — Gov. Kate Brown this week vetoed the measure, citing public safety concerns. “I have several concerns with the bill as currently drafted, particularly related to public safety and noncompliance,” Brown said in a Wednesday letter to the state Senate president and House speaker, which was obtained by Oregon Public Broadcasting. Senate Bill 574 would have permitted motorcyclists to drive between lanes, on multilane highways, when traffic slowed to 10 mph (16 kph) or less — also known as “lane splitting” or “lane filtering.” In this situation, motorcyclists riding between cars could travel no more than 10 mph faster than the flow of traffic. States like California and Utah have enacted similar laws. While this idea concerned some drivers, motorcyclists argued lane splitting actually improves safety. “Perhaps one of the more dangerous situations for any on-highway motorcyclist is being caught in congested traffic, where stop-and-go vehicles, distracted and inattentive vehicle operators and environmental conditions pose an increased risk of physical contact with another vehicle or hazard,” Nicholas Haris, a representative for the American Motorcyclist Association, said in written testimony. “Even minor contact under such conditions can be disastrous for motorcyclists.” According to the Oregon Department of Transportation, in 2018, the most recent data available, there were 78 deadly motorcycle crashes in the state. “I have witnessed — during rolling traffic slowdowns on the Southern California freeway — motorcyclists cautiously, slowly and effectively moving through traffic and eliminating themselves from the traffic backup,” Kate Stoller, an Oregon motorcyclist, said in written testimony. Missouri motorcycle helmet law repeal has governor’s support, but it’s a small part of a larger bill

Representative Jared Taylor of Republic in southwest Missouri says the governor promised he’d sign it, but Parson’s spokeswoman says while he has “indicated he is supportive of this issue, but like always, there will be a thorough bill review to see what else is in the bill.’ Democrat from St. Louis, Rep. Gina Mitten opposed this part of the bill on the House floor. None of my constituents probably care a bit about the myriad of other things in this bill, except for the helmet law,” she told colleagues. “I don’t know about the other folks in this room, but I got a ton of emails over the past few days saying, ‘Do not do this.’” Mitten says there is a financial cost to citizens for this proposed law. “You get a traffic ticket, you’re going to pay money to the Brain Injury Fund. ‘It’s about freedom’: Local lawmaker trying again on motorcycle helmet law repeal

Eric Burlison, R-Battlefield, almost had it last year. After pitching the idea as a win for individual freedom, he got it attached to a larger transportation bill that passed both houses. But Gov. Mike Parson couldn’t stomach another part of the bill and vetoed it. This year, Burlison thinks he’s got a decent shot to pass the idea as its own bill. Parson, a Republican, supported similar stand-alone bills as a legislator, so Burlison’s main focus is on getting it through the legislature again. “We’ll see how much time (Senate leaders) give it on the floor,” he said Friday, “but over time, we’ve made so many compromises on this, so I hope people will take that into consideration.” Those compromises, Burlison said, include a requirement for those going without helmets to have qualifying health insurance. The exemption from the state’s helmet rule would also only apply to riders ages 18 and up. Those provisions will likely never be enough for opposing lawmakers who say the plan will lead to more deadly accidents. They have a point. National Highway Transportation Safety Agency research indicates helmets saved more than 1,800 lives in 2016, and that if all motorcyclists would have worn helmets that year, 802 more people could have been saved. On its website, the Centers for Disease Control and Prevention make its position clear: “The single most effective way for states to save lives and save money is a universal helmet law.” They also point out that riders wouldn’t have to prove insurance coverage unless they were pulled over by law enforcement and worry the cost of accidents will ultimately take a toll on Medicaid. Legislature passes “autocycle” bill, creates new fee for three-wheelers

MADISON, Wis. (AP) – The state Assembly has signed off on a bill that would define autocycles in state law and establish registration fees for the vehicles. Autocycles are three-wheeled vehicles that can seat one or two people. The Republican-authored bill would define an autocycle as a vehicle with three wheels in contact with the ground, seating that doesn’t require straddling and a steering wheel. The bill would establish a $45 annual registration fee and allow anyone with a regular driver’s license to operate one. The Assembly approved the bill unanimously Tuesday. The Senate passed the measure in October. The measure goes next to Democratic Gov. Tony Evers, who can sign it into law or veto it. The governor’s spokeswoman, Melissa Baldauff, didn’t immediately respond to an email asking if Evers supports the bill.

Action Alert on $32 Fee Repeal

There has been an overwhelming displeasure with the process of the original bill. It was our understanding at the beginning last session, that the original bill would be to rescind the VLT for alternative fuel vehicle exceptions. In fact, part of the testimony was the fact that so many large trucks, who do the most damage on our highways, are converting to alternative fuels. Obviously, that’s not what happened. And it has been obvious by the public outcry, that the setting of the fees by the ADOT Director is not something the voting population is happy about. I could give you survey results of how motorcyclists in our state feel about this legislation, but I am sure you all are too familiar with the displeasure. I’ll just leave a few numbers for you – $133 additional dollars. That’s the additional fees one voter told me. He is a single man with 2 motorcycles, 2 cars and an off-road vehicle. The increase is more than he pays for both his motorcycles and one of his cars combined. From $35 to $99. Single mom. She has a beater car and a daily driver motorcycle to get back and forth to work. The motorcycle saves her a tremendous amount on fuel. The $64 increase is more than 2 months of her fuel costs on her bike. This is what one of our members just received and is the typical increase for a motorcyclist. I could go on and on with examples, but I am sure you get the picture of the negative financial impact this has had. The motorcycle community in Arizona is in favor of Senator Ugenti-Rita’s bill to repeal this absurd fee and we ask that you contact your State Representative and ask for a unanimous floor vote on SB1001.
